A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
AUTHORIZING AND DIRECTING THE M~YOR AND
CITY CLERK TO EXECUTE A RECYCLING AND
EDUCATION GRANT AGREEMENT BETWSEN THE
CiTY OF BOYNTON BEACH AND THE SOLID WASTE
AUTHORITY OF PALM BEACH COUNTY; A COPY OF
SAID AGREEMENT BEING ATTACHED HERETO AS
EXHIBIT 'IA"; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS~ The Solid Waste Authority, acting by and through
the State of Florida Department of Environmental Regulation,
hereby offers assistance to the local government Df the City
of Boynton Beach for all allowable costs incurred up to and
not exceeding $45,085o00; and
WHEREAS~ the City Commission of the City of Boynton
Beach, Florida deems it to be in the best interest of the
citizens and residents of the City to execute a Recycling and
Education Grant Agreement with The Solid Waste Authority of
Palm Beach County, said Agreement being attached hereto as
Exhibit "A".
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH~ FLORIDA THAT:
Section 1. The City Commission of the City of Boynton
Beach hereby authorizes and directs the Mayor and City Clerk
to execute an agreement between the City of Boynton Beach and
The Solid Waste Authority of Palm Beach County, a copy of
which Agreement is attached hereto as Exhibit "A".
Section 2. This Resolution shall take

PART II - GRANT CONDITIONS
The method of payment for the period October 1, 1992 through August 31. 1993,
will be on a reimbursement basis only.
The grantee shall submit payment requests on a quarterly basis. An original of
the paymem request, with summaries and appropriate contracts attached, shall be
due on the 10th day of the month following the reporting period.
Grant funds may be obligated for allowable expenditures unti/August 31, 1993.
The grantee may expend grant funds and liquidate obligations until August 31,
1993.
Expenditures shall be limited to allowable items as listed in Section 1%716.430
of the Solid Waste Grants Program Rule:
Solid waste recycling grants shall be used to provide funding for
recycling program capital costs, which include equipment
purchases, solid waste scales,, facility construction and other such
costs approved by the State of Florida Department of
Environmental Regulation.
Grant funds may also be used for temporary operating subsidies,
provided that the applicant shall demonstrate that such a use is
necessary for the success of the recycling program, and shall show
how the subsidy will benefit the program. The applicant shall also
demonstrate that the subsidy is temporary by providing reasonable
assurance that the program will be able to operate without a
subsidy from this grant program by October I, t993.
"In order to demonstrate that operating subsidies are temporary,
the applicant shall also demonstrate that at least 50% of the
operating costs of its recycling program are being funded from a
source other than this grant program. Therefore, no more than
50% of the total operating costs of its recycling program may be
funded from this grant program. The applicant shall submit an
expenditure report along with any reimbursement request showing
the total amount spent on the recycling program. Total
reimbursement for operating costs shall never exceed 50% of the
total program cost reported in the expenditure report for each
reimbursement request," according to the State of Florida
Department of Environmental Regulafion's Grant Conditions.

Recycling grant funds shall be used for projects to assist local
governments in recycling paper, glass, plastic, construction and
demolition debris, white goods, and metals and in composting and
recycling the organic material component of municipal solid waste.
e. Solid waste education grant funds shall be used to promote

recycling, volume reduction, proper ~sposal of solid wastes, and
market development for recyclable materials. Up to 30 percent of
grant funds may be used for plarming studies to assess the
feasibility and success of the recycling and education programs.
All existing public and private recycling infrastructure shall be
fully used to the extent possible when planning and implementing
the local government recycling program. Funds shall not be used
for duplicating existing private and public recycling programs
unless the applicant demonstrates that such existing programs
cannot be integrated into the planned recycling program.
Each recipient of grant funds shall maintain accurate records of all expenditures
of grant funds and shall assure that these records are available at all reasonable
times for inspection, review or audit by State of Florida Department of
Environmental Regulation personnel and other personnel authorized by the
Department. Records shall be kept for a period of at least 3 years following the
end of the grant period. The grantee agrees that it will expeditiously initiate and
complete the program work for which assistance has been awarded under this
agreement in accordance with all applicable provisions of Florida Statutes and the
Florida Administrative Code.
The State of Florida Department of Environmental Regulation has the right to
terminate a grant award and demand refund of grant funds for non-compliance
with the terms of the award of the Solid Waste Grants Program Rule 17-716.
Such action may also result in the Department declaring the local government
ineligible for further participation in the program until the government complies
with the terms of the grant award.
Allowable costs incurred on or after the budget period start date, October 1,
1992, may be charged to this agreement~ Any requests for reimbursement of
travel expenses must be submitted in accordance with Section L12.061, Florida
Statutes.
Grant funds shall be included in the grantee's Annual Audit performed under the
Single Audit Act (A128). Any subgrants made by the grantee shall also include
a provision for the subgranted funds to be included in the subgrantee's Annual
Single Audit.
Grantee shall obtain all necessary constrnction-related permits before initiating
construction.
The State of Florida's performance and obligation to pay under this grant
agreement is contingent upon receipt of funds presently anticipated from the
Florida Department of Revenue.
