Hilary Zalman, Community Standards Special Magistrate, called the Hearings to order
at 9:06 a.m., and explained the magistrate's role and the hearing procedures. Pursuant
to Florida Statute, all orders are appealable to the Circuit Court in Florida and not the City
Commission. Also, that a fine will be imposed if the violation(s) are not corrected by the
deadline.

Officer Weixler presented the case, which was a routine inspection. Initial inspection
date March 19, 2018. Courtesy notice sent March 26, 2018. Fifteen days were given to
comply. Property posted on July 6, 2018. Date last inspected July 17, 2018, trash and
debris gone, but blue tarp on roof remains. City recommended 30 days from printed order
for compliance, or$25 a day. Administrative costs $634.12.

Nerlie Escarment, owner, stated the roof had leaking problems for several months. The
public adjuster has made her wait for repairs, does not know how much longer. City is
not opposed to 60 days. Ms. Escarment is to tell public adjuster that City says the roof
has priority.
Decision
Based on testimony, Ms. Zal ordered 60 days from date of printed order at$25 a day.

Officer Weixler presented the case, which was a routine inspection. Initial inspection
date April 4, 2018. Not a repeat violator. Courtesy notice sent April 9, 2018. Fifteen days
were given to comply. Property posted on July 6, 2018. Date last inspected July 17,
2018, vehicles still remain. City recommended 15 days from printed order for compliance,
or$50 a day. Administrative costs $634.12. City requests order to remove vehicles if no
compliance within 15 days.
Beverly Mercer, owner, admitted neglecting having the cars removed, and will do so.
Decision
Based on testimony, Ms. Zalman ordered 15 days from date of printed order, after which
time the City will remove the vehicles and a fine of$50 a day.

however, still no permit for AC. Property appraiser shows owner is living there, she is
not, tenants evicted, and is now vacant, so COU/BTR can be removed. City
recommended 30 days from printed order for compliance, or $75 a day. Administrative
costs $634.12.
Sera Cimmino, owner, stated she will be moving into the premises, has contacted AC
company that installed the system seven years ago under previous owner, who claims it
was not their problem that the permit was not pulled initially. A new contractor is ready
to come do the work. Because all other work is done and owner will occupy, an additional
20 days was granted.
Decision
Based on testimony, Ms. Zalman ordered 50 days from date of printed order at$50 a day.

Remove or register all inoperable vehicles.
Officer Scott presented the case, which was a routine inspection. Initial inspection date
May 24, 2018. This is a repeat violator. Written order given May 24, 2018. Thirty days
were given to comply. Notice posted on property and at City Hall on July 5, 2018. Officer
Scoff has had no conversations with the owner at this property, has spoken with tenants
on numerous occasions about removing or registering the vehicles. Language barrier
may have existed, but best efforts were made. Date last inspected July 13, 2018. No
health and safety hazard. City recommended 10 days from printed order for compliance,
or $100 a day. Administrative costs $634.12. City requests order to remove vehicles if
no compliance within 10 days.
Jean Leon, husband of owner, could not provide affidavit permitting him to speak on
behalf of owner.
Decision
Based on testimony, Ms. Zalman ordered 10 days from date of printed order to register
vehicles, after which time the City will remove the vehicles and a fine of$50 a day.

Fine Certification Hearings
Case No. 17-823 Vernon Thompson Jr Trust

Officer Hart presented the case. Notice of violation date July 28, 2017. The Magistrate
hearing was on April 18, 2018, and Ricki Scott appeared. Compliance date given was
May 26, 2018, or$150 per day plus admin fees. Property last inspected on July 17, 2018,
some violations still exist, unregistered vehicles removed, fence issue resolved. 54 days
of non-compliance with fines of $150 per day, plus administrative fees of $634.12, for a
total of$8,734.12. Current code compliance issue is the parking lot needs to be resealed,
there is some dead vegetation, and the business is quite overgrown as well.
Ricki Scoff, property manager and owner's son, showed receipts for $787 for sod.
Requested a meeting with Officer Hart on June 16, asked at that time what else needed
to be done. Was told it was trees, the fence, etc., so took care of that. Nothing was said
about the swales. Spoke with Officer Hart on July 12 and was told the swales need to be
done; has a receipt for an additional $467 for seeds; pictures show what owners consider
a trash pile and had no idea that was to be included. Will go get another pallet or two of
sod. The debris is a daily process considering the area and due to wind, pedestrians,
loiterers. Officer Hart disputed some of the testimony as to what was actually discussed,
and it was made clear there is no such thing as a trash pile allowed in the City. Ms.
Zalman recommended talking with City on how best to reduce trash.
Decision,
Based on testimony, Ms. Zalman certified a portion of the fine to $5,000 plus
administrative fees of$634.12, and $150 a day until resolved.

Officer Hart presented the case. Notice of violation date July 28, 2017. The Magistrate
hearing was on April 18, 2018, and Ricki Scott appeared. Compliance date given was
May 26, 2018, or$100 per day plus admin fees. Property last inspected on July 17, 2018,
only violation remaining is sod on the back side of yard. 54 days of non-compliance with
fines of$100 per day, plus administrative fees of $634.12, for a total of$6,034.12.
Ricki Scott, property manager and owner's son, appeared, stating he was unaware
that trash piles were not permitted or he would have done all the sodding at one time.
Ms. Zalman feels owners are attempting to comply and the area remaining is small, and
will reduce the fine.
Decision
Based on testimony, Ms. Zalman ordered the fine certified at $3,000 plus admin fee of
$634.12, and $100 per day until resolved.

and Occupancy. Obtain Business Tax Receipt. Large
ficus tree leaning west could cause hazard, remove tree.
Officer Hart presented the case. Notice of violation date January 24, 2018. The
Magistrate hearing was on March 21, 2018, and a company representative appeared.
Compliance date given was June 4, 2018, or$200 per day plus admin fees. Property last
inspected on July 17, 2018, violations still exist; however, tree has been removed. 45
days of non-compliance with fines of $200 per day, plus administrative fees of $634.12,
for a total of $9,634.12. COU application has been made, BTR has been obtained.
Inspection is all that remains.
Ryan Finlayson, representative, appeared and presented affidavit to speak, stated the
tree was difficult to remove as power lines ran through it and FPL had to de-energize the
line to be removed, which took some time, but was prior to first hearing. Inspection has
not been done due to lack of cooperation from tenant, but is now being scheduled for the
next week. Will do a notice of entry and be present himself if necessary.
Decision
Based on testimony, Ms. Zalman ordered the fine certified at $6,000 plus admin fee of
$634.12, and $200 per day until resolved.

Officer Hart presented the case. Notice of violation date December 6, 2017. The
Magistrate hearing was on April 18, 2018, and no one appeared. Compliance date given
was May 26, 2018, or$200 per day plus admin fees. Property last inspected on July 17,
2018, and has complied. 53 days of non-compliance with fines of $200 per day, plus
administrative fees of $634.12, for a total of $11,434.12. There was an issue with
notification, property appraiser lists address correctly, but without unit number, so notices
were not received. Property was posted at the door on NE 2nd Street, which is vacant, so
that was not received either. Once became aware, has worked with Officer Hart
throughout entire process, so leniency is requested.
Duckens Aristilde, owner, stated property was purchased sight unseen, unaware area
was as rough as it is and that someone had already gone in and gutted the place,
including plumbing, was a complete mess with needles everywhere. He began the work
unaware permits were needed when Officer Hart cited him for work he was doing. Since
then, he has complied with all permits, has a contractor and engineer for plans. Owner
has spent $7,000 to date curing the violations. Contact information has been corrected.
Decision
Based on testimony, Ms. Zalman ordered no fine, only certified admin fee of$634.12.
Lien Reduction Hearing
Case No. 13-2093 Shira Funding Group LLC
Property Address: 3000 Ocean Pkwy
Violation(s): For code sections as stated
Officer Pierre presented the case. Notice of violation was September 23, 2013.
Magistrate hearing was November 20, 2013, and no one had appeared. Compliance date
given was November 30, 2013, or $200 per day. Date complied December 10, 2015.
739 days of non-compliance at $200 per day, for a total fine of $147,800, plus
administrative fees. Owner of property has complied for lien reduction.
Ilan Abenhalm, current owner, stated the property was purchased in 2013 and started
working on the violations that came with the property but was unaware of liens. Hired a
property manager who stole from him and other illegal activities. The estimated current

value of the house is $99,000, over $35,000 has been put into the property.
Improvements include driveway with permits, windows, AC, sprinkler system, sod on
whole property. Had to eject squatters, so rented property which turned into an even
bigger mistake that ended in eviction, lots of mistakes were made. Officer Pierre said the
property now looks very nice. City recommends reduction to $10,000, however, Owner
lost business in hurricane and has nothing to pay even a reduced fine at this time. The
property is now up for sale. Mr. Wood offered that the City can give time to pay the lien.
Options for sale were given for owner to discuss with own counsel.
Decision
Based on testimony, Ms. Zalman reduced the fine to $9,500 plus admin costs.
Case No. 16-258 Armenian Cultural Assn America
Property Address: 850 W Boynton Beach Blvd
Violation(s): For code sections as stated
Officer Pierre presented the case. Notice of violation was February 2, 2016. Magistrate
heciring was April 20, 2016, and a representative appeared. Compliance date given was
May 20, 2016, or $100 per day. Date complied June 6, 2018. 746 days of non-
compliance at $100 per day, for a total fine of$74,600, plus administrative fees. Current
owner of property has complied for lien reduction. History is that a vacant lot was cleared
without a permit.
Nancy Guffey, Esq., and John Kochkerian of ACAA, gave a background of the hearing
in 2016, and the purpose for purchasing the land 20 years ago was to build an Armenian
Church and Cultural Center. Plans were never realized. Volunteers helped to keep the
land maintained and took some liberties without permits to a few trees. All that was
needed was a minor landscape modification application since nothing was going to be
built there. Thousands of dollars were spent, trees were planted along the Boulevard,
and did all that they were required to do by Mr. Breese. To pay this fine would require
taking up a collection from the Association members, but plans are to sell the property so
the AC AA can keep going. City considers as this is a non-profit, $5,000 is acceptable.
Decision
Based on testimony, Ms. Zalman reduced the fine to$4,800, plus admin costs of$730,15.
Case No. 14-1834 JP Morgan Chase Bank

Officer Pierre presented the case. Notice of violation was August 6, 2014. Magistrate
hearing was September 17, 2014, and no one had appeared. Compliance date given

was September 24, 2014, or $100 per day. Date complied September 26, 2017. 1,097
days of non-compliance at $100 per day, for a total fine of$109,700, plus administrative
fees. Owner of property has complied for lien reduction.
Paul Minoff, Esq, attorney for owner, stated this was a case where a lot was actually
done over a long period of time, and has records of all the repairs and adjustments were
done every year ($70,000 has been spent), which were give to Ms. Zalman. Every time
it was thought compliance had been reached, there was another issue. A contract is
pending for$75,000. There is a tremendous net loss; acting in good faith despite length
of time involved. City recommends reduction to $10,000.
Decision
Based on testimony, Ms. Zalman reduced the fine to $9,925 plus admin costs of$730.15.

Officer Weixler presented the case, which was a routine inspection. Initial inspection was
February 9, 2018. Not a repeat violator. Courtesy notice was issued February 12, 2018.
Fifteen days given to comply. Certified Mail sent June 1, 2018, green card signed June
7, 2018. Property last inspected on July 17, 2018. Trash and debris, mow and trim have
complied; however, white rocks were put on swale which is not acceptable by the City.
The City recommended 30 days from the printed order for compliance, or a fine of $25
per day plus $634.12 admin fees.
Clinton Bower, President/CEO, stated was not aware that rocks were not allowed in the
swale. Has attempted to reach tenant several times, only spoke with him once, explained
the car is parked illegally on east side swale, preventing upkeep when cars are present.
Put the rocks down so at least when people park there it would not kill the grass. This is
a home for disabled people, there are no sidewalks to access the streets. Officer Weixler
did go to property and had one of the cars removed, but cannot remove the one with a
valid tag. At an impasse because City cannot tow, the resident will not cooperate.
Suggests a meeting with Planning & Zoning to see if there are other alternatives.

Based on testimony, Ms. Zalman ordered 30-day compliance as stated on the Board
Order, or$25 a day, plus administrative fees.

March 29, 2018. Not a repeat violator. Courtesy notice was issued March 30, 2018.
Fifteen days given to comply. Property was posted on May 31, 2018. Property last
inspected on July 17, 2018. The City recommended 15 days from the printed order for
compliance, or a fine of$25 per day plus $634.12 admin fees.
Aglairescot, owner, testified with Officer Luney Guillaume translating. Ms. Zalman
stated the recommended time for compliance and the proposed fine, asking if the Owner
can remove the debris and storage items. Officer Weixler noted a health and safety
hazard because one of the stored items is a refrigerator. Ms. Zalman instructed the
refrigerator be secured so no one can get into it while preparations are being made to
remove it.

handling the case, and reported the completion progress. I also explained to him
the insurance coverage holding up the replacement of the vandalized storefront
window. The window was finally replaced a few months later by Roth Glass and
