CALL TO ORDER Hilary Zalman, Community Standards Special Magistrate, called the Hearings to order at 9:16 a.m., and explained the magistrate's role and the hearing procedures. Pursuant to Florida Statute, all orders are appealable to the Circuit Court in Florida and not the City Commission. Also, that a fine will be imposed if the violation(s) are not corrected by the deadline. I. SWEARING IN OF WITNESSES AND INTRODUCTION Ms. Loth administered an oath to all those intending to testify. ROLL CALL IV. NEW BUSINESS Lien Reduction Hearing Case No. 15-1055 Greenmount Management LLC Property Address: 3164 Ocean Pkwy Violation(s): For code sections as stated Officer Pierre presented the case. Notice of violation was April 30, 2015. Magistrate hearing was August 19, 2015, and no one had appeared. Compliance date given was August 29, 2015, or $100 per day. Date complied March 23, 2018. 1,069 days of non- compliance at $100 per day, for a total fine of$106,900, plus administrative fees. Owner of property has complied for lien reduction. Kara Stachell, attorney for current owner, stated the owner was not aware of the code violations on the property, which was a commercial property rented to a tenant. The address on the deed was that of the agent that assisted with the purchase of the property. Owner is in the process of selling the property and the lien came up in the title search. Meeting Minutes Community Standards Special Magistrate Hearings Boynton Beach, Florida AUGUST 15, 2018 City recommended 10% of the amount of the lien. Ms. Zalman opted for 15% because there no proof provided for the value of the property nor the amount paid to bring the property into compliance. Decision Based on testimony, Ms. Zalman reduced the fine to $16,035 plus $730.15 admin costs. Case Hearing Case No. 18-765 Nell Richardson Property Address: 140 SE 2nd Ave Type of Property: Single Family, non-homesteaded Violation(s): CO CH 15 ART 9 SECT 15-120B and 2B CO CH 15 SECT 15-120D INCL CO CH 10 SECT 10-56B CO CH 10 SECT 10-56D Remove all outside storage, trash, and debris. Remove round post placed in the swale area right-of-way. Sod and replace damaged driveway and redefine the driveway. Remove plywood from garage door. Officer Weixler presented the case, which was a citizen complaint. Initial inspection date March 21, 2018. Not a repeat violator. Courtesy notice sent April 6, 2018. Fifteen days were given to comply. Certified letter sent on July 24, 2018, green card dated July 26, 2018. Date last inspected August 14, 2018, plywood has been removed from garage door, trash and debris gone, post removed from swale area, but driveway apron still needs to be repaired. City recommended 30 days from printed order for compliance, or $25 a day. Administrative costs $634.12. it Richardson, owner, stated everything that can possibly be done is done; that Officer Weixler claims there is a swale, but if the gravel were removed, water would roll back onto the property from the street and into the garage. Feels there should be no fine for something that is the City's responsibility. There are numerous gravel driveways in the neighborhood, so owner does not understand what is meant by "redefine driveway." Officers Weixler and Pierre visited the property and explained to owner's brother that the issue is the apron area in the front, something needs to be done. Owner does not disagree, but wants to know why the apron, which is on City property, should be paid for by owner. Office Weixler stated that the swale area, though City property, must be maintained by owner. Decision Based on testimony, Ms. Zalman ordered 45 days from date of printed order at$25 a day. Permit for fence and roof repair required. Remove all outside storage, trash, and debris. Put address number on house. Officer Weixler presented the case, which was a citizen complaint. Initial inspection date May '10, 2018. Not a repeat violator. Written notice given May 10, 2018. Thirty days were given to comply. Certified letter sent July 11, 2018, green card signed July 17, 2018. Date last inspected August 14, 2018, fence has been removed, refrigerator removed, all other violations still remain. City recommended 15 days from printed order for compliance, or$50 a day. Administrative costs $634.12. Wendy Kelly, daughter of deceased owner, provided affidavit to appear on behalf of the estate. Ms. Kelly related family discord with brother who lives on property since father's death in 2016, and will not allow anyone on property to prepare it for sale. The matter goes to court on September 11 to resolve the issues. Property is not a rental. Decision Based on testimony, Ms. Zalman ordered 45 days from date of printed order or$35 a day, plus admin fees of$634.12. Case No. 18-1252 Lee S Berinstein Property Address: 117 SE 4th Ave Type of Property: Single Family, homesteaded Violation(s): CO CH 13 SECT 13-7 INCL CO CH 13 SECT 13-16 CO CH 15 SECT 15-120D INCL Certificate of Use and Business Tax Receipt required for group home as well as home rental. Mow and trim all overgrowth on property. Officer Weixler presented the case, which was a citizen complaint. Initial inspection date May30, 2018. Not a repeat violator. Written notice given May 30, 2018. Fifteen days were given to comply. Property posted on August 3, 2018. Date last inspected August 14, 2018, overgrowth has been complied. City recommended 15 days from printed order for compliance, or $150 a day. Administrative costs $634.12. Officer Weixier noted this same violation occurred a year ago, it complied, then the house became vacant, telling the officer that the house was going to be sold. However, three or four months later, the house was rented to another group home. Patrick Ronan, representative for owner, provided affidavit to appear on behalf of the owner, stating the property is being rented again as owner attempted to sell it but could not. Mr. Ronan requested 20 days to finish complying with remaining violations. Decision Based on testimony, Ms. Zalman ordered 20 days from date of printed order at $150 a day, plus admin fees of$634.12. Case No. 18-1570 Pik Two Investments LLC Property Address: 124 SW 12th Ave Type of Property- Single Family, non-homesteaded Violation(s): LDR CH 2 ART 4 SECT 2.8.2 CO CH 10 SECT 10-52 CO CH 13 SECT 13-7 INCL CO CH 13 SECT 13-16 CO CH 15 SECT 15-120D INCL CO CH 10 SECT 10-56C Certificate of Use and Business Tax Receipt required. Inoperable vehicles in backyard and driveway. Outside storage, trash, and debris. Correct all fire hazard and life safety issues within 5 days. Officer Weixler presented the case, which was a citizen complaint. Initial inspection date July 20, 2018. Not a repeat violator. Address at City Hall not corrected for property service. Property was posted on July 31, 2018, as a family in back of house had a two- year old girl in crib. Because of illegal conversion, there is no means of egress. Refrigerator in back unit runs from an extension cord. Single family home converted to tri-plex, no permits were pulled for conversion. Pool barrier fence broken, in open position. Date last inspected August 14, 2018, fence violation still exists. Severe life safety hazard. City recommended 10 days from printed order for compliance, or $500 a day. Administrative costs $634.12. Ernest Hilaire, manager for owner, provided power of attorney to make decisions on behalf of the owner. Ms. Zalman ascertained that all three units are rentals, stating no one should be living there due to all the health and safety issues. Mr. Hilaire stated two of the tenants are not paying rent because of leak in the roof. Mr. Woods stated that the baseline of the violation is that there are three illegal, units when there should be one. Officer Weixler presented a letter from Building Inspector Robert Cody, stating on July 20 an unsafe posting/stop work was posted for the living conditions. Decision Based on testimony, Ms. Zalman ordered 1) 48 hours effective immediately to fix smoke alarms, fence/access by pool to be rectified, open wiring by AC unit and open electric conduit on porch need to be covered and secured, or $500 per day; 2) remaining violations have 25 days from date of printed order or $500 a day, plus admin fees of $634.12. Recommends owner consult with counsel to remove tenants within that time to make all necessary repairs. Case No. 18-558 MIA Real Rentals 11 LLC Property Address: 2430 NW 2nd St Type of Property: Single-family, non-homesteaded Violation(s): CO CH 13 SECT 13-7 INCL CO CH 13 SECT 13-16 CO CH 15 SECT 15-120D INCL Apply for, pass inspection, and obtain Business Tax Receipt and Certificate of Use and Occupancy. Sod property and remove outside storage. Officer Guim presented the case, which was a routine inspection. Initial inspection date March 6, 2018. Not a repeat violator. Written order given March 6, 2018. Thirty days were given to comply. Certified mail sent July 5, 2018, green card dated July 16, 2018. Date last inspected August 14, 2018; outside storage and BTR/COU violations still exist. No health and safety hazard. City recommended 30 days from printed order for compliance, or$50 a day. Administrative costs $634.12. Cory Carano, counsel for owner, stated property is being rented, and is hearing for the first time that the outside storage has not been addressed. Mr. Carano gave an overview of Fourth Amendment violations for the requirement of an interior inspection in order to receive a business license, stating that usually these cases do not go forward, but for some reason this one did; had contacted City Attorney but did not hear back yet. Mr. Woods stated that the City's position is not that an inspection is being asked for the license, but for the Certificate of Use, which has not been obtained. Mr. Carano asked that the matter not be decided until City Counsel has a chance to reply. Decision Based on testimony, Ms. Zalman ordered 30 days from date of printed order at$50 a day, plus admin fees of$634.12. Page 5 Meeting Minutes Community Standards Special Magistrate Hearings Boynton Beach, Florida AUGUST 15, 2018 Case No. 18-1149 Cerus SFR Holdings III LP Property Address: 405 Gateway Blvd Type of Property: Single-family, non-homesteaded Violation(s): CO CH 15 SECT 15-120D INCL CO CH 10 SECT 10-58D LDR CH 2 ART 4 SECT 2.8.2 Secure building permits for interior remodeling of kitchen and bathroom, room conversion in back of property. Get permits for AC installed and for hot water tank. Do plumbing, clean out extension done without permit. Get permits for electrical outlet box in carport. Put new sod in areas of grass and resurface floor in carport area. Officer Guim presented the case, which was a citizen complaint. Initial inspection date May 7, 2018. Not a repeat violator. Written order given May 7, 2018. Thirty days were given to comply. Certified mail sent July 10, 2018, green card dated July 17, 2018. Date last inspected August 14, 2018; remodels have been done, but at this time the property is vacant, some building permits still need to be obtained. City recommended 90 days from printed order for compliance, or $75 a day. Administrative costs $634.12. James Strouss, attorney for it company, stated the violations arose as former owner was an absentee owner. Cerberus just took title recently and is in the process of working with a General Contractor, some permits have been applied for, others must be presented for architectural review. This is a buy and hold situation, and 90 days should be sufficient to comply. Decision Based on testimony, Ms. Zalman ordered 90 days from date of printed order at$75 a day, plus admin fees of$634.12. Case No. 17-2089 Marta R Pejouhy (deceased) Property Address: 152 SE 28th Ave Type of Property: Single-family, non-homesteaded Violation(s): CO CH 10 SECT 10-2 CO CH 10 SECT 10-26 CO CH 15 SECT 15-120D INCL Mow yard, de-weed yard, trim trees and hedges. Remove all trash and debris from front yard. Repair front window. Sod or fertilize all bare areas. Remove roll-out dumpster from driveway. Initial inspection date October 19, 2017. Not a repeat violator. Courtesy notice given. Thirty days were given to comply. Property posted August 3, 2018. Marta Pejouhy died more than a year ago, Officer Scott has been working with Walter Pejouhy, who does not reside there; a friend of the mother has been living there rent-free. There have been numerous extensions due to family issues and other concerns. Property last inspected August 14, 2018, items still outstanding are the sod and driveway, dumpster was scheduled to be removed August 15, 2018. City recommended 60 days from printed order for compliance, or $25 a day. Administrative costs $634.12. Walter Pejouhy, son of deceased owner, did not have proof of power of attorney, and could not testify in this matter. Decision Based on testimony, Ms. Zalman ordered 1) 5 days from date of printed order for proof of dumpster removal or $25 a day; and 2) remaining issues 60 days from date of printed order for compliance or$25 a day, plus admin fees of$634.12. Case No. 18-452 Clifford & Michel Janvier Property Address: 260 N Palm Drive Type of Property: Single-family, non-homesteaded Violation(s): CO CH 13 SECT 13-7 INCL CO CH 13 SECT 13-16 CO CH 15 SECT 15-120D INCL LDR CH 2 ART 4 SECT 2.8.2 Obtain a Business Tax Receipt and Certificate of Use and Occupancy. Obtain building permits for a fence installed without a permit. Repair driveway. Officer Guim presented the case, which was a routine inspection. Initial inspection date February 26, 2018. Not a repeat violator. Initial written notice sent February 28, 2018. Thirty days were given to comply. Notice of hearing sent May 19, 2018. Property posted August 3, 2018. Date notice posted on property and at City Hall was July 17, 2018. BTR/COU was applied for, but property failed inspection for electrical issues. There are tenants. City recommended 45 days from printed order for compliance, or $150 a day. Administrative costs $634.12. Clifford Janvier, owner, asked for 90 days to correct the violations and gave plans for repair, stating the contractor often fails to show up. Mr. Janvier lives in Port St. Lucie. Owner planned to remove the fence same day after hearing. Permitting procedures were explained to owner. Officer Guim will speak with owner to clarify next steps. Case No. 18-1164 72 & Sunny LLC Property Address: 121 W Ocean Ave Type of Property: Single-family, non-homesteaded Violation(s): CO CH 15 SECT 15-120D.1 LDR CH 2 ART 4 SECT 2.8.2 Obtain permits as stated in the notice of Red Tag. Building not to be occupied. Permits abandoned. Permits abandoned over six months, remove work or new permits required. Building Board of Adjustments and Appeals shall go to Board for reinstatement of permits and unsafe structure of building system. Mow, trim, and de-weed all overgrowth on the property and remove all materials stored outside, as well as trash and debris. Officer Hart presented the case, which was a City Department referral. Initial inspection date May 8, 2018. Not a repeat violator. Initial written notice issued May 23, 2018. Thirty days were given to comply. Certified notice by mail sent July 5, 2018, green card signed July 8, 2018. All violations still exist. Date property last inspected August 14, 2018. City recommended 30 days from printed order for compliance, or$150 a day. Administrative costs $634.12. Dayan Abraham, owner, stated there is a tenant on the property, that there are annual inspections from City and are in compliance with all the licensing requirements. Property was purchased several years ago and was renovated. Over time, wanted to add more bedrooms to the unit to enhance it. Respondent took out a loan to have the build-out done, but what should have taken six months has become several years. Owner claims contractors have embezzled and stolen. Permits were reinstated several times. Two hurricanes in as many years have set the project back, insurance carriers have delayed and are now being sued. Lenders have also stolen money from escrow and it is being handled by Palm each County Court. Currently has a contract to hired contractor and finish the project. (Related Case 18-506.) Page 8 Meeting Minutes Community Standards Special Magistrate Hearings Boynton Beach, Florida AUGUST 15, 2018 Fine Certification Hearings Case No. 18-506 72 & Sunny LLC Property Address: 121 W Ocean Ave Type of Property: Single family, non-homesteaded Violation(s): CO CH 10 SECT 10-56D CO CH 10 SECT 10-60B Remove shutters from windows to allow proper egress. Crawispace opening on front of home must be covered and screened. Officer Hart presented the case. Notice of violation date March 30, 2018. The Magistrate hearing was on June 20, 2018, and no one appeared. Compliance date given was July 17, 2018, or $50 per day plus admin fees. Property last inspected on August 14, 2018, the violations still exist. 30 days of non-compliance with fines of $50 per day, plus administrative fees of$634.12, for a total of$15,634.12. The screen is still ripped, there are tenants with an infant. There are feral cats in the neighborhood. (Related Case 18- 1164.) Dayan Abraham, owner, stated when he had last spoken with Officer Hart, he was in compliance and was not aware this fine was continuing. Decision Based on testimony, Ms. Zalman certified the fine to $1,500 plus administrative fees of $634.12, and $50 a day until resolved. Case Hearing Case No. 18-1237 Joseph J Scrivo Property Address: 1046 Old Boynton Rd Type of Property: Single-family, non-homesteaded Violation(s): CO CH 14 SECT 14-3 Remove the oversized taco truck from the property. This type of 'truck is prohibited from parking in a residential neighborhood. Officer Hart presented the case, which was a citizen complaint. Initial inspection date May 29, 2018. This is a repeat violator. Initial written notice issued June 4, 2018. Ten days were given to comply. Certified notice by mail sent June 28, 2018, green card signed July 17, 2018. The vehicle has been removed, but this is the third offense for this vehicle in 2018. City recommended $100 per occurrence from this date forward for parking of an oversized vehicle. Administrative costs $634.12. Page 9 Meeting Minutes Community Standards Special Magistrate Hearings Boynton Beach, Florida AUGUST 15, 2018 Diana Jacome, tenant, owns the vehicle in question. However, since the case is with the owner of the property, Ms. Zalman made the decision based on Officer Hart's testimony. Decision Based on testimony, Ms. Zalman ordered $100 per future occurrence, plus admin fees to date of $634.12. Fine Certification Hearing Case No. 18-17 Maluco LLC Property Address: 2623 S Seacrest Blvd, Unit 118 Type of Property- Commercial Violation(s): LDR CH 2 ART 4 SECT 2.8.2 Obtain permits for interior wall construction. No permits to modify existing room into two rooms in Suite 118, as noted in the Notice of Red Tag attached by Robert Cody. Officer Hart presented the case. Notice of violation date March 30, 2018. The Magistrate hearing was on June 20, 2018, and no one appeared. Compliance date given was July 21, 2018, or $50 per day plus admin fees. Property last inspected on August 14, 2018, violation still exists. 26 days of non-compliance with fines of $50 per day, plus administrative fees of$634.12, for a total of$1,934.12. As of August 14, 2018, the actual permit was canceled, not sure by whom. David Goldstein, attorney for it 118, appeared, stating the present general contractor employed to take down the wall is on a job out of town and was unable to attend. The tenant will no longer be using this suite, but will remove the wall to be in compliance. Mr. Goldstein was retained the day prior to the hearing. Officer Hart recommends a permit be obtained for demolition, if needed, in case there is power in the wall. Discussion followed as to how to certify the fine should the wall not be removed by the next calendar date. Decision Based on testimony, Ms. Zalman tabled the case to September 19, 2018. Lien Reduction Hearing Case No. 05-1502 Prudent Financial Corp Property Address: 121 NE 13th Ave Violation(s): For code sections as stated Page 10 Meeting Minutes Community Standards Special Magistrate Hearings Boynton Beach, Florida AUGUST 15, 2018 Officer Pierre presented the case. Notice of violation was July 6, 2005. Magistrate hearing was August 17, 2005, and no one had appeared. Compliance date given was August 27, 2005, or $50 per day. Date complied December 5, 2005. 99 days of non- compliance at $60 per day, for a total fine of$4,950, plus administrative fees. Owner of property has complied for lien reduction. George Niarchos, agent for owner, presented affidavit to testify on behalf of respondent. This is an empty lot and has been a problem. A company hired for $200 a month in 2005 to keep the lot clear of trash and stopped doing the work they were being paid to do. The new company hired was when the property came into compliance, and has been maintained ever since (total paid out$31,000). The lot is for sale and a possible buyer wants to build a home there. It was through the title search that the owner became aware of the lien. Decision Based on testimony, Ms. Zalman reduced the fine to admin costs of$730.15. Case No. 16-1258 George Damian! Property Address: 418 NW 11 th Ave Violation(s): For code sections as stated Officer Pierre presented the case. Notice of violation was August 4, 2016. Magistrate hearing was September 21, 2016, and a representative appeared. Compliance date given was November 1, 2016, or$100 per day. Date complied April 27, 2018. 572 days of non-compliance at $100 per day, for a total fine of $57,200, plus administrative fees. Current owner of property has complied for lien reduction. George Damiani, owner, and Steve SamiIjan, attorney for owner, gave history of a purchase in foreclosure in September 2015, and address on deed title company used was the address of the real estate agent handling the sale. Mr. Damiani was not aware of the violation notice, but when discovered immediately contacted City and brought property into compliance. Amount spent improving property was $29,000 in addition to purchase price of $45,000 for an abandoned duplex. Property is currently rented out. Officer Hart stated an inspection was done on September 23, 2016, and it failed at that time, so owner was aware of the violations. It lapsed until passing inspection on April 27, 2018. Property is much improved. Copies of receipts for renovations will be provided. Decision Based on testimony, Ms. Zalman reduced the fine to $5,720, plus admin costs of$730.15.
