I. CALL TO ORDER Carol Ellis, Community Standards Alternate Special Magistrate, called the Hearings to order at 9:05 a.m., and explained the magistrate's role and the hearing procedures. Pursuant to Florida Statute, all orders are appealable tot Circuit Court in Florida and not the City Commission. Also, that a fine will be imposed if the violation( ) are not corrected by the deadline. 11. SWEARING IN OF WITNESSES AND INTRODUCTION Ms. Loth administered an oath to all those intending to testify. Appearance and maintenance of exterior. Resurface, coat and stripe driveway and parking lot. Remove all outside storage, trash, and debris. Remove round post placed in the swaVe area right-of-way. Meeting Minutes Community Standards Special Magistrate Hearings Boynton Beach, Florida SEPTEMBER 19, 2018 Officer Scott presented the case, is was a citizen complaint, Initial inspection to May 24, 2018. This is a repeat violator. Courtesy notice issued. Thirty days were given to comply. Date notice posted on property and at City Hall September 7, 2018. There has been no contact with owner until this hearing, however, have spoken with tenants on numerous occasions about violations of cars, trash, debris, and outside storage. Tenants prevent owner from complying with violations. Prior case in January was closed. Date last inspected September 18, 2018, all violations still exist. City recommended 30 days from printed order for compliance, or$100 a day. Administrative costs $634.12. Current lien from five years previous on property for trash and debris. (See Case No. 18-1232.) Carline Saint Felix, owner, understands nature of violations, stating tenants break repairs as soon as they are made. Owner asks for time to evict tenants and take care of property, needs at least 60 days. Officer Scott does not object to 90 days if communications stay open to no that progress is being made. Fine Certification Hearing Case No. 18-1232 Carline Saint Felix Property Address: 2930 SE 2nd St Type of Property: Multi family, homesteaded Violation(s).- CO CH 10 SECT 10-56D CO CH 10 SECT 10-60B Remove shutters from windows to allow proper egress. Crawlspace opening on front of home must be covered and screened. Officer Scott presented the case. This case was brought before the Magistrate to certify that the address the property appraisers had is 2930 SW 2nd St., and to state for the record that both addresses, SE 2nd and SW 2nd, were cited. This is in order to proceed with the violation from July for the cars at SE 2nd Street, There is nothing to be done. (Related as 18-1231.) Carline Saint Felix, owner, stated that notice was received fort violations of unregistered and inoperable cars at 2930 SE 2nd Street. Officer Hart presented the case, which was a routine inspection. Initial inspection to February 15, 2018. Not a repeat violator. Initial notice issued February 16, 2018, by door er® Thirty days were given to comply. Date notice sent Certified Mail August 8, 2018, green card dated August 22, 2018. Certificate of Use inspection September 5, 2018, by Officer Weixier and failed. No smoke detectors in bedrooms, electrical panel was not labeled, most window screens were missing, soffit screens in disrepair, multiple items stored outside (mattress, TV, small refrigerator, etc.). Sod missing inswale, bare areas in front yard. Front door seal loose and non-effective. in in kitchen leaks. Vehicle in driveway for sale without a current tag. Blue Honda blocking sidewalk without a current tag. Unable to see water heater because of it stored in front and on top of it. Date last inspected September 18, 2018. City recommended 10 days from printed order for compliance, or$200 a day. Administrative costs $634.12. Isaac Antoine, a director of corporation, was verified to testify. Mr. Antoine stated some of the violations were unknown, especially the ones inside, because the tenant had never called for repairs. Once aware of violations when viewing property with is Weixler, began to make arrangements for repairs, also considering eviction proceedings. Has one ofthree other properties that is under permit for repairs. Requests more than 10 days for repairs outdoors. Decision as on testimony, Ms. Ellis ordered 1) 5 days from date of printed order at$250 a day for repair of smoke detectors,- and 2) 25 days from at of printed order at $250 a day, plus administrative costs of$634.12. Case No. 18-787 Alicia R Jean Francois Property Address: 150 NE 27th Ct Type of Property: Single Family, homesteaded Violation(s): CO CH 15 SECT 15-120D INCL Install sod in dead area of yard, including the swale area. Achieve clean-up. Repair driveway (permit may be required). Initial inspection at April 26, 2018. Not a repeat violator. Initial notice sent May 2, 2018. Thirty days were given to comply. Certified letter sent August 8, 2018, property posted on September 7, 2018. All violations still exist. it recommended 45 days from printed order for compliance, or$50 a day. Administrative costs $634.12. Alicia Jean Francois, owner, stated willingness to comply, but needs more time to accomplish plan to replace the entire asphalt driveway with concrete. Knows that permit will be needed, per quotes from contractors for driveway repairs, one stating a time frame of three-four weeks due to need for permit, surveying, removal of asphalt, dumping. Officer Pierre stated all that is needed for the violation is to patch the hole in the apron of the driveway and sod the bare patch int yard; whatever future project is planned after that is up tot owner. No permit is needed to patch the hole. Decision as on testimony, Ms. Ellis ordered 45 days from date of printed order or $50 a day, plus admin fees of$634.12. Case No. 18-41 Paula Chapek Property Address: 1 Cedar Circle Type of Proingle Family, non-homesteaded Violation(s): CO CH 13 SECT 13-7 INCL CO CH 13 SECT 13-16 CO CH 10 SECT 10-56D Obtain Business Tax city Certificate of Use and Occupancy for rental property. Repair or replace broken fence on side of property along Meadows Blvd. Repair screen on back porch. Officer Guim presented the case, which was a citizen complaint. Initial inspection to January 19, 2018. Not a repeat violator. Initial notice given January 3, 2018. Thirty days were given to comply. Certified Mail sent July 31, 2018. Property posted and at City Hall on September 7, 2018. BTR and COU applications received, but no inspection has been scheduled. Dilapidated fence removed from side of property; however, now pool is exposed. unto 4 feet pool safety fence is around it as well as pool screen closure, because it is a corner property,wooden fence should be replaced. Property last inspected September 14, 2018. City recommended 45 days from printed order for compliance, or $75 a day, Administrative costs $634.12. Officer Guim noted that house may possibly be vacant, but is currently for rent. Paula Chapek, owner, stated the property is currently vacant, family had lived here and it has never been rented. Realtor thought it would be a good idea to rent it to recoup some money to repair and improve property. HOA does not have requirement for a fence; Page 4 Meeting Minutes Community Standards Special Magistrate Hearings Boynton Beach, Florida SEPTEMBER 19, 2018 stated that Building Department also told her the fence was not required, Mr. Woods said the fence is not required because aft enclosure around the poo 'l- however, a permit was needed to completely remove the dilapidated fence,just the postcannot be left. Ms. Chapek related that a permit was attempted on May 3rd for replacing the fence, but was denied because at the time City could not find her as owner of property. Officer Pierre explained the difference between permits for homesteaded or non-homestead criteria. Mr. Woods explained that a contractor would have to be hired to get permit for demolition to make sure it was an correctly, Friend Richard Pelletier testified that the plans are to rebuild the fence; a contractor is still needed to pull the permit and put up the fence. A good deal of misunderstanding between Officer Guim and Owner was noted. Decision Based on testimony, Ms. Ellis ordered 45 days from date of printed order at $75 a day, plus admin fees of$634.12. Case ® 18-1156 Arturo Dominguez & J Hernandez Property Address: 209 SW gth Ave Type of Property: Single Family, non-homesteaded Violation(s): LDR CH 2 ART IV Sect 2(A)2 Officer Weixler presented the case. Case had originally been slated for removal because of insufficient notice, is Weixler was not prepared tot action. Arturo Domingue, owner, was present. Ms. Ellis spoke to owner in Spanish. For the record, the owner of the property stated his name, Ms. Ellis advised him that the case would not be heard today, and continued to next month. Correct mailing address was verified, and was instructed that notice would be sent by Certified Mail. Fine Certification Hearings Case ® 17-1157 Polonio LLC Property Address: 227 SW 2nd Ave Type of Property: Duplex, non-homesteaded Violation(s): CO CH 13 SECT 1 ®7 INCL CO CH 13 SECT 13-16 Officer Weixler presented the case, stating the Case has come into compliance and would like to certify the administrative fees of$634.12. Daniel Zejerman, owner, as why the sum was being charged, and Ms. Ellis explained the administrative fees which cover inspections and time spent on the case, Mr. Zejerman objected to the fees, stating they had incurred costs oftheir own in coming into compliance due to mistakes made by the City, given wrong advice and accruing Page 5 Meeting Minutes Community Standards Special Magistrate Hearings Boynton Beach, Florida SEPTEMBER 19, 2018 unnecessary expenses, etc. Officer Weixler gave an accounting of the City's expenses and cited the Florida Statute 162 allowing charge of said administrative fees. Decision Based on testimony, Ms. Ellis certified the payment of administrative fees of$634.12, Case No. 17-2304 South Florida Property Property Address: 200 Knuth Rd, Unit 244 Type of Property, Commercial Violation(s): LDR CH 2 ART 4 SECT 2.8.2 Unit divided into two spaces without a building permit. Officer Weixier presented the case. Notice of violation date November 7, 2017. The Magistrate hearing was on February 21, 2018, and again on June 20, 2018. Compliance date given was April 21, 2018, or$100 per day plus admin fees. Property last inspected on September 18, 2018, violation still xists® 152 days of non-compliance with fines of $100 per day, plus administrative fees of $634,12, for a total of $15,834.12. History of the violation was given to Ms. Ellis as to discovery of illegal conversion and attempt to remedy. Original hearing was extended due to car accident and respondent unable to appear. [Officer's and Respondent's testimony is inaudible or unintelligible at 1:14 through 1:24.] Respondent appeared, requesting the case be tabled to be heard by Magistrate Zalman because of her unique knowledge of this case. Overview of case was given for Ms. Ellis. City recommended a 90 day extension, It was noted that the administrative fees of $634.12 would be due whether or not the case complies within time. Decision Based on testimony, Ms. Ellis granted 90-day extension for fine certification. Case No. 17-2433 Duane S & Faith D Cyr Property Address: 134 SE9th Ave Type of Property-, Single Family, non-homesteaded Violation(s)- CO CH 15 SECT 15-120D INCL CO CH 13 Section 13-7 INCIL CO CH 13 Section 1 ® Officer Weixler presented the case, stating the Case has come into compliance and would like to certify the administrative fees of$634.12. Duane Cyr, Jr., son of owner, stated there should be authorization from previous hearing allowing him to speak. Case ® 18-561 Wells Fargo Bank NA Property Address: 218 SW 6th St Type of Property: Single Family, non-homesteaded Violation(s)- CO CH 15 SECT 15-120D INCL CO CH 13 SECT 13-7 INCL CO CH 13 SECT 13-16 Certificate of Use and Business Tax Receipt. Remove trash and debris. Officer Weixler presented the case. Notice of violation date March 22, 2018. The Magistrate hearing was on July 7, 2018. Compliance at given was July 14, 2018, or $100 per day plus in fees. Property last inspected on September, 18, 2018. 68 days of non-compliance with fines of $100 per day, plus administrative fees of $634.12, for a total of $7,434.12. Possible life safety issues due to posts that may collapse if children play on them. Caution tape ordered by Magistrate was not put on the posts. Matthew O'Kell, attorney for Wells Fargo, stated this was a foreclosed property. Wells Fargo is in process of retaining a contractor, unable to find one who could handle the work within time allowed by previous order. Everything was brought into compliance except forte posts, which requires a different contractor. Property is under contract for sale, should be closing within next few weeks. Mr. O'Kell will instruct that the caution to be put up as requested, asking that the fine be reduced to administrative fees, if possible, Mr. Woods noted the caution tape was a relatively simple order, and still has not been one, in addition to fixing the problem. Mr. O'Kell does not see the caution tape on the violation list; however, Ms. Loth had the order to she seven days to install tape. Ms. Ellis does not understand why a large corporation cannot comply- however, a lien reduction may be applied for when property is in full compliance. The orders as previously issued were explained to r® O'Kell. Decision Based on testimony, Ms. Ellis certified the fine. Case No. 18-708 Schneldine & Eric St Aude Property Address: 215 SW 1st St Type of Property: Single family, homesteaded Violation(s)- CO CH 15 SECT 15-120D INCL LDR CH 2 ART 4 SECT 2.8.2 CO CH 10 SECT 10-56D Page 7 Meeting Minutes Community Standards Special Magistrate Hearings Boynton Beach, Florida SEPTEMBER 19, 2018 Permits required for fence. Remove outside storage, trash, and debris. Mow and trim all overgrown property areas and put sod where needed. Put address numbers on house, Officer Weixler presented the case. Notice of violation at April 119 2018. The Magistrate hearing was on June 20, 2018, no one appeared. Compliance date given was August 7, 2018, or $75 per day plus in fees. Property last inspected on September 18, 2018, most violations still exist. 92 days of non-compliance with fines of$75 per day, plus administrative fees of$634.12, for a total of$7,534.12. Eric St Aude, owner, testified with a translator, stating he went tote wrong address for the last hearing date (GPS directed to City of Pompano), but did not attempt to follow up afterwards. Ms. Ellis ascertained that the respondent understands the nature of the violations, that no other properties are owned, and respondent lives at the property. Respondent has not yet applied for permit for the fence, but there are numbers on the house now. Officer Weixler said there was a permit, but it expired with no inspections. ort record, Respondent was given is Pierre's card to contact the it to correct the violations. Repair pool enclosure. Mow all overgrown property areas, trim over- grown vegetation. Repair or remove dilapidated wood fence on side yard. Officer Guim presented the case. Notice of violation to February 20, 2018. The Magistrate hearing was on June 20, 2018, no one appeared. Compliance date given was August 7, 2018, or$100 per day plus admin fees. Property last inspected on September 18, 2018, some violations still is , problems with pool maintenance and enclosure. 42 days of non-compliance with fines of$100 per day, plus administrative fees of $634.12, for a total of $4,834,12. Pool is empty but has some black waters from recent rains; though in back of property, it is a corner lot so screen enclosure is an issue. Desires Shores, daughter owner, presented authorization to speak on behalf of owner stating mother is elderly and disabled and unable to do any of the work. Mr. and Mrs. Shores are the only ones to dot work, but of or extensive hours in addition to Mrs. Stimely's caregiver. Waiting on estimate for pool maintenance and repairs, difficulty finding someone in this season. Have used some sunshade fabric to go around lower portion of pool enclosure inthe interim. Officer Guim suggested applying for program for disabled persons to maintain their property. Ms. Shores has been investigating other grants to help with this. City recommends an extension for grants to process. Decision Based on testimony, Ms. Ellis ordered a 60-day continuance. Magistrate hearing was August 19, 2009, and no one had appeared. Owner of property has complied for lien reduction. Michael Weiner, Attorney, and John Rodgers, son of owner, appeared. Mr. Rodgers read a prepared statement (copy in file) aft history oft case as the family's investment, the damage done to the property during a storm, and subsequent negotiations with POA on maintenance payments towards settlement. Legal counsel was brought into the picture in 2010. Meadows on the Green went into bankruptcy in 2010, went into receivership who decided the six units had been abandoned even though property taxes were paid in full. Settlement agreement drafted in 2011, but dispute continued, eventually going to trial in 2017. The case was lost, and an accounting of costs was given, It was not until 2018 that the fine for not obtaining a license to rent the units was discovered. Mr. Rodgers had been and the opinion that the issue had been dropped in 2009, and was not aware of accruing a daily fine in this matter. r® Weiner stated he is r® Rodgers attorney for this code enforcement hearing and was not his counsel fort previous matters just testified to. An accounting of the status of the State Court proceedings was given, including awarding to Meadows on the Green which Mr. Rodgers has to pay ($148,000), is is why a private loan is in sought, and once paid Mr. Rodgers can resume custody of the units. Notice of violation was January 11, 2016, Magistrate hearing was March 16, 2016, and Michael Kattoura appeared. Compliance date given was March 31, 2016, or$100 per day. Owner was trying to rent the house when an inspection was done, and was never told about a replaced water heater. Not until the house was to be sold was the lien discovered. Steps were taken, permits and repairs, to be in compliance. Value of the home is $300,000. $100,000 equity line on the property. gecislon as on testimony, Ms. Ellis reduced the fine to $5,000, plus admin costs of$730-15, Case No. 17-423 Gabrielle D Dick Property Address: 2321 NE 4th Court Violation(s): For code sections as stated Officer Pierre presented the case. Notice of violation was March 16, 2017. Magistrate hearing was July 19, 2017, and no one appeared. Compliance date given was August 31, 2017, or $50 per day. Date complied August 14, 2018. 347 days of non-compliance at $50 per day, for a total fine of $17,250, plus administrative fees. Current owner of property has complied for lien reduction. Anthony Ellis, fiance of owner, authorization of agent form had been submitted, and proceeded to give history behind the lien is involved the tenant at the time, and a compounding of violations when compliance was attempted. There was confusion inthe owner receiving notifications on this and several other properties as tenant was not giving notices toowner. When the violations were discovered, compliance was made so that properties can be sold. Decision Based on testimony, Ms. Ellis reduced the fine to $1,000, is admin costs of$730.15. Case No. ® Stephen Colucci &Angela Perry Property Address: 1240 SW 28t'Ave Violation(s)- For code sections as stated Officer Pierre presented the case. Notice of violation was October 8, 2015. Magistrate hearing was March 16, 2016, and Stephen Colucci appeared. Compliance date given was May 15, 2016, or $50 per day. Date complied February 27, 2017. 287 days of non- compliance at 50 per day, for a total fine of $14,350, plus administrative fees, Current owner of property has complied for lien reduction. Mrs. Colucci and Ms. Ellis discussed the history of the court trial leading to the resolution. Pecision Based on testimony, Ms. Ellis reduced the fine to $1,000, plus admin costs of$730.15.
