A Regular Meeting of the-Board of Tow~ Cor~missioners
of the Town of Boynton, Florida, was held at the Town
Hall on Tuesday evening, October l, 1935 at V:30 o~clock P.M.
Present: H. D. Stevens, Mayor
Wm. Menzel, Vice-Mayor
The above constituting a majority of the Board of
Town Commissioners of the Town of Eo~ton, Florida,
The minutes of the Regular Meeting of September 17,
1935 were read and approved.
Upon motion made by Commissioner Stevens, seconded
by Commissioner Msnzel and duly carried the following
bills were approved for pa~yment:

A discussion was held concerning the 1935 Tax ~ssess-
merit Rol! and the amv_sab~lmty of adopting a budget ~t-~h~s
~.~i~e!~f~?oh~ F~s~year beginning November 1, 1935; The
To~m Treasurer suggested to the Commission that the adoption
of a budget should be delayed ~til the outcome of the
Harvey S. Wa~wick Man~amus suit, now pending, is ascertained;
Inasmuch as'~a levy requirement by the Court would necessitate
the a_~nd.~e_~ o~ any Budget adoeeed ~t this
the Con,mission voluntarily included in such Budget~ a le~
as demanded in the Warwick suit.
Mr. ?~u. P. Somervil!e~ Resident Agent for the
ConstFaction Co., and other creditors, stated that if an
ez~horbitant millage were to be levied for the exclusive
benefit of a minority creditor, that the ir~terests which
he represents would seek a millage in like proportion
for their holdings. He fmrther stated that neither he,
nor the interests which he represents, favor such action,
unless they are being greatly discriminated against.
After a further discussion, a motion was made, seconded,
~d duly carried, adthb~Zing the Town Treasurer to defer
the preparatio~ of the Budget until further am~lssm by
the Conmuission, and should t~s ~ud~et not be prepared
in season To send ou~ bills To ~ne Taxpayers, on~ Tax
Collector shall notify the Taxpayers of the To~ by post-
card~ of such delay.
~r. Newn~n T. Miller, Town Attorney, stated that he
had been requested by Mr. S. C. Kearle~,a~s attorney of
West Palm ~= ~
=~acn, to call to the Commissioners' attention
the War Department's hearing to be held on October loth
to hear complaints against the proposed construction of
a seawall ~ud groynss at the ~cCormack property on Ocean
Beach.
It was ascertained that someone had, without authority,
made a c mp=~ to the War Department in behalf of the
Term of Bo~ton; the Conn~.~issioners immediately expressing
~' ~v~ ~ ~ oroo0sed construction.
