Town of Boynton as the selling PriCe of said pr0Perties~
A~WD~ERF~, the To~ of Boynton~is desirous of selliog
said properties, and ~gm. P. Somerville, a ~es~dent? citizen
and tax-payer of the Town of Boynton, Florida, is a Registered
Real Estate Broker and is willing to undertake the sale o~ said
proDerties,
NOW, THERE~0RE, in consideration of the covenants and~
agreements hereinafter set forth, it is mutually agreed between
the parties ~ereto as follows:m
Said Town of Boynton, through its duly elected ~ud quali-
Fied Commissioners, agrees to employ ~m. P. Somerville as its
sole agent a_~d gives him the exclusive right to sell, as such
agent, for a period of one year from the date hereof, and there-
after until terminated by thirty days w~itten notice from the
Town of Boynton, the properties shown by "Schedule A"..hereto ~
attached, at the price marked opposite each lot or lots, p~cel
or parcels, tra~ o~ tracts of land on said "Schedule A",
such other properties that the Town of Boymtonmay acquire and is
desiro~s
of selling during the
life of this agreement.
Authori-
ty is hereby givenby the Town of Boynton to ~. P. somerville,
at his discretion, to place "For Sale~ sign on said properties,
and to remove all other signs.
Said Town of Boynton ih~ther agrees that the purchase
price of said properties may be paid in the following manner, to-
wit :-
Seventy per cent (VO%) of the p~chase p~ice~ Of
said p~operties may be paid With valid outstand-
i~ and unpaid ObligatiOns of Said Town of BoYnton,
at the fdll face Value thereof, plus interest accrued
on said obligation, and
Thirty per cent (~0%) of the p~rchase price of said
properties shall be paid in cash.
Said Town of Boynton further agrees, that upon receipt
~y the Treasurer of the Town of Boynton, of the purchase price
of properties as herein set forth, to pay and discharge all
liens for State and County taxes that may be outstanding and
unpaid on the lands so purchased amd further agrees that the
Mayor and To-~n Clerk will execute a Special l?s~ranty Deed
for such lands for delivery to the purchaser thereof.
Said Town of Boynton further agrees to pay ~m. P.
Somerville, out of the first purchase money paid on each sale
or sales of said real estate, upon sale being effected~ direct-
ly or indirectly, for his services in securing such purchaser
or purchasers, a commission of Ten per cent (10%) upon the
amount of such sate or sales.
Said ~m. P. Somerville agrees that ~he will use al~ famtn-
and reasonable effort, time and attention to effect the
ss~e of said properties, pay for advertising said properties
for sale, and to ch~ge nothing for his services except in the
event of said as aforesaid.
IN TESTIMO_h~_ ~0_, the Town of Boynton has caused this
agreement to be subscribed in its corporate name by its Mayor~
attested by its Town Clerk, and its corporate ~aal to be here-
unto affixed by its Town Clerk, and the said ~. P. Somerville
has hereunto set his h~_ud and seal, all on the day and year
