AN ORDINANCE OF THE CITYOF BOYNTON BEACH, FLORIDA,
DECLARING THE INTENTION OF SA-ID CITY TO EXTEND ITS
MUNICIPAL TERRITOriaL LIMITS BY THE ANNEXATION OF A
CERTAIN UNtNCORPO1L~TED TRACT OF LAND CONTAINING LESS
THAN TEN REGISTERED VOTERS, LYING CONTIGUOUSTHERETO
AND WITHIN PALM BEACH COUNTY, FLORIDA, TO WIT: A
PARCEL OF LAND IN SECTION 5, TOWNSHIP 46 SOUTH,
~G-E 43 EAST, MORE pARTICULARLY DESCRIBED HEREINAFTER;
DEFINING THE BOUNDARIES OF SAID CITY TO INCLUDE SAID
LA~ND;.REPEALINGALL oRDINANCES OR PARTS OF ORDINANCES
IN CONFLICT HEPd~WITH; pROVIDiNG FOR SAVINGS CLAUSE,
P~E~EALING PROVISIONS AND FOR OTHER PURPOSES.
W~EP~EAS, the owner of the property more particularly
described hereinafter has heretofore petitioned the City Council
of the City of Boynton Beach, Florida, requesting the annexation
of certain property lying adjacent and contiguous to the terri-
torial limits of said municipality and within the same County
to the municipal territorial limits of said City; and
WHEREAS, said tract of land contains less than ten
registered voters; and
WHEREAS, the City Council of the City of Boynton Beach,
Florida, deems the annexation of said land to be beneficial to
and in the best interests of the said City and the owner of said
land that said land be annexed and included within the municipal
territorial limits of said City;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF BOYNTON BEACH, FLORIDA:
Section 1: That the City
Beach, Florida, hereby declares its
of land more particularly described
which is hereby made a part hereof,
Council of the City of Boynton
intention to annex the parcel
in the attached "Exhibit A"
to the municipal territorial
limits of the City of Boynton Beach, Florida, at the expiration
of thirty days from the passage of this Ordinance.
Section 2! That the City Clerk shall proceed with publi-
cation of notice of adoption of this Ordinance in accordance
with the Charter of the City in such cases made and provided.
Section 3: Repealing Provisions~ All ordinances or parts
of ordinances in conflict herewith are hereby repealed.
Section 4: Separability: Should any section or provision
of this ordinance or any portion hereof, be declared by a Court
of competent jurisdiction to be invalid, such decision shall not
affect the validity of the remainder hereof as a whole or any
part hereof, other than the part declared to be invalid.
