AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA,
k~ENDtNG'SEC~ION 17~4t OF cHAPTER lY OF THE coDIFIeD
ORDINANCES OF SAID CITY TO PROVIDE BROADER PROVISIONS
REGARDING LITTERING; PROVIDING FOR THE AUTHORITY TO
CODIFY, SAVINGS CLAUSE, P~PEALING PROVISIONS AND FOR
OTHER PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON,
BEACHr FLORIDA:
Section 1: That Section 17-41 of Chapter 17 of the Codified
Ordinances of the City of Boynton Beach, Florida, is hereby
amended to read as follows:
"Section 17~41. Litter.
(a) Litter in public places. No person shall throw
or deposit litter in--or upon any street, sidewalk or
other public place within the city except in public
receptacles, in authorized private receptacles for collec-
tion, or in the official city sanitary landfill areas.
(b) Sweeping litter into gutters prohibited. No
person sha~l sweep int~ or deposit in any gutter', street,
or other publ~ic place within the city the accumulation
of litter from any building or lot or from any public or
private sidewalk or driveway.
(c) Litter thrown by persons in vehicles. No person,
while a driver or passenger in a vehicle, shall throw or
d~lt.~ltter upon any street or other public place
within ~ne city, or upon private property.
(d) Litter in lakes and fountains. No person shall
throw or d~'itt~r in any fountain, pond, lake, bay
or any other body of Water in a park or elsewhere within
the city.
(e) Litter on oDcupied private property. No person
shall throw or dep0si~ litter on any occupied private
property within the city, whether owned by such person
or.not, except that t~e owner or person in control of
private property may deposit such household trash or
litter in designated 9reas of said private property
for collection as provided elsewhere in this code.
(f) Litter on vacant lots. No person shall throw
or deposit litter on ~y ~n or vacant private property
within the city whether owned by such person or not.

"(h) Person__. For the purpose of this section 'person'
is any person~ firm~ partnership, association, corporation,
company or orgainization of any kind.
(i) Litter. For the purpose of this section, 'litter'
shall mean garbage, trash and all rubbish and %,~stes such
as paper~ wrappings, cigarettes, cigars, cardboard, tin
cans~ containerst wood~ glass, and other materials of any
kind."
Section~: Authority to Codify: Specific authority
hereby granted to codify and incorporate this Ordinance in the
City's existing Code.
Section 3: Separabilitv: Each of the provisions of this
Ordinance are separable~ including word, clause~ phrase or
sentence, and if any portion thereof shall be declared invalid~
the remaining portion shall not be affected but shall remain in
full force and effect.
Section 4: R_epealinq Provisions: Ail Ordinances or parts
of Ordinances in conflict herewith are hereby repealed.
~ection 5: An. Effective Date: This Ordinance shall
become effectzve in the manner and at the time provided by law.
