O74-08ORDI.N.ANCE NO. 74-8 AN EMERGENCY ORDINANCE OF T~E CITY OF BOYNTON BEACH, FLORIDA, AMENDING SECTION 64 OF ARTICLE IV OF MUNICIPAL CI~ARTER .OF SAID CITY, AS AUTHORIZED UNDER CHAPTER 166 OF THE FLORIDA S~AT~TES EI~TITLED "MUNICIPAL HOME RULE POWER ACT", DECREASING FROM $90,000.00 TO $1~000100 AS THE AMO%~T IN EXCESS OF WHICH ALL PLrRCHASES OR SALES SHALL BE ADVERTISED FOR BIDS AS PROVIDED FOR ~IN SAID SECTION; PROVIDING FOR ~UTaO~ITY~ TO CO0t~z, SAVINGS~ CL~USE~ R~LING PRO- ISIONS, AN EFFECTIV~ ~DATE~AND FOR O~R PURPoSEs. WHEREAS, the City Council of the City of Boynton Beach, Florida, desms it necessary and essential for the efficient daily operation of the municipal government to decrease from $90,000.00 to $1~000.00 the amount in excess of which all put- chases or sales shall be advertised for bids as provided for under Section 64 of Article IV of the municipal Charter of said City. NOW, T~EREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH~ FLORIDA: Section 1: That Section 64 of Article IV of the municipal Charter of the City of Boynton Beach~ Florida~ is hereby amended to read as follows: "Section .64. Purchaslnq aqent, selection, duties; ~ompetitive biddinq. The City Council shall appoint an officer or employee of the City, other than a member of the City Council, as purchasing agent for the City who shall be responsible for the purchase, storage and distribution of ell supplies, ma terials, equipment and other articles used by an office, department or agency of the municipal government. All pur- chases or sales of City property shall be subject to the approval of the City Council, and shall conform to such regulations as the City Council may from time to time pre- scribe. All purchases or sales involving amounts in excess of $1,000.00 shall be made only after the publishing of an advertisement for bids thereon in a newspaper of general circulation in the City at least one time, not less than eight (8) days prior to the date set for the reception of such bids~ together with such other notice as the Council may direct. The City Council shall have the power to reject any end all bids submitted and received, and to waive any informalities in connection with such bidding. With regard to the sale of any real estate owned by the City,~ regardless of the estin~ted value thereof, no such sale shall be conducted or ~onsummated until such time as sub- ject propor~ 5~s been appraised by a disinterested quali- fied appraiser to be designated by the City Council for hereby City's "the purpose of establishing a fair market value thereon. ~After such appz~isal shall have t~en completed and a fair m~rket value placed on subject property, the sale of same shall be advertised in accordance with the above procedure and competitive bids thereon received with the established fair r~arket v~Iue being the minimum bid acceptable by the City..Th~ test.of such appraisal and the administratl.ve costs xncurrgd.~n.con~e~t!on wi,Ch the.competitive ,bidding procedure shaI1 be borne by ~he individual iRitiatiug the P 0Posed sale bY deposmt~ng the estima'ted costs with the City Clerk at the time of the ini~tial pUrchase request." Section 3: Separability: Each of the provisions of this Ordinance are separable, including word, clause, phrase or sentence, and if any portion thereof shall be declared invalid, the remainlng portion shall not be affected but shall remain in full force and effect. ~ection 4: ~epea!in~ P~r~¥isions~.- All ordinances or parts of ordinances in conflict herewith are hereby repealed.
