AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA,
AMENDING CHAPTER 5 OF THE CODIFIED ORDINANCES OF SAID
CITY BY ADDING SECTION 5-4 TO REQUIRE A $t00,00 CLEAN-UP
BOND PRIOR TO THE ISSUAi',iCE OF A BUILDING PERMIT; PRO-
VIDING FOR AUTHORI~ TO CODIFY, SAVINGS CLAUSE,
REPEALING PROVISIONS, AN EFFECTIVE DATE AND FOR OTHER
PURPOSES.
WHEREAS, the City Council of the City of Boynton Reach, Florida, deems it
necessary and advisable for the general welfare of the inhabitants and citizens
of said City to require the posting of a bond to insure that property within
the City is properly cleaned up upon completion of work performed under
building permits issued by said City;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
BOYNTON BEACTI, FLORIDA:
Section I: That Chapter 5 of the Codified Ordinaaces of the City of
Boynton Beach, Florida, is hereby amended by adding Section 5-4 which shall
read as follows:
~Sec. 5-4. Clean-up bond.
Prior to the time that a permit is issued by the City for the
making of additions, alterations or repairs to real properly/ or
existing structures within the City or prior to the time that a
building permit is issued for the construction of a building in
the City, the person desiring to obtain the permit for such work
shall be require~to post a one hundred dollar ($100.00) cash bond
to insure that ali construction debris shall be kept 'n a con-
tainer approved by the city building official or the deputy building
official and removed from the job site no less frequently that
every seven days and to further insure that the properly/ will be
properly cleaned up prior to the issuance of a certificate of
occupancy. In the event the construction debris is not removed
fro~ the job site no less frequently than every seven days as
aforesaid or is not cleaned up to the satisfaction of the city
building official or a deputy building official at the time of
final inspection by the city building official or a aeputy build-
ing official, then in either event the bond shall be applied by
the City towards the expense of removing said construction debris
and the remaining balance of the bond, if any, sha. II be refunded
to the person posf:ing same after the issuance of the certificate
of Dccupanc¥.~
Section 2: ~.utherity to Codify: Specific authority is hereby granted to
codify ant incorporate this Ordinance in the City's existing Oode.
Section 3: Separability: Each of the provisions of this Ordinance are
separable, including word, clause, phrase or sentence, and i¢ any portion
thereof shall be declared invalid, the remaining aortion shall not be affected
but shall remain in full force and effect.
Section ~: R_~epealing Provision~: All Ordinances or parts of Ordinances
n conflict herewith are hereby re~ealed.
Section 5:
