AUTHORIZING AND DIRECTING THE F~YOR AND
CITY CLERK TO EXECUTE AMENDMENT NO. 2 OF
THE AGREEMENT FOR CONSTRUCTION

iNC.; A COPY OF SAID AMENDMENT BEING
ATTACHED HERETO AS EXHIBIT "A"; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, on July 7, 1992 the City Commission of the City of
~oynton Beach selected Stanley Consultants, Inc., to perform the
Engineering Services for the Utility Data Acquisition and Control
~ystem; and
WHEREAS, upon recommendation of staff, the City Commission
f the City of Boynton Beach deems it to be in the best interests
)f the citizens and residents of the City of Boynton Beach,
Florida~ to execute Amendment No. 2 to the contract with Stanley
Dnsultants, Inc., which amendment increases the existing
Dntract for construction management services of the West Water
lant and raw water pipeline from $1,033,330 to an amount not to
~xceed $1,306,330.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE
~ITY OF BOYNTON BEACH, FLORIDA THAT:
Section 1. The Mayor and City Clerk are hereby
~uthorized and directed to execute Amendment No. 2 to the
agreement between the City of Boynton Beach, Florida and Stanley
lonsultants, Inc., said Amendment being attached hereto as
Khibit "A".

Explore flexibility of West Water Treatment Plant
Contract I for modifications advantageous for future
integration with DACS. Such modifications miF~ht include
elimination of the Moore Products 352 controllers and
substitution of network based SCADA products for the
Intellution FIX ACE station currently specified.
Conduct a one week on-site study with the CITY and
representative DACS manufacturers to establish
requirements, review alternatives, assemble vendor
literature, hold selected vendor presentations and
develop recommendations including very rough cost and
schedule estimates. The series of meetings for this
study will be held in Boynton Beach.
Prepare a letter report of the results of the study
including budgetary engineering for the design and
construction phases of the DACS.
2.22 During the DACS coordination phase and for the period
provided, the OONSULTANT shall, usin~ its best efforts,
provide the followin~basic services for the additional work.
2.22.1 Prepare revised Instrument and Control Plan Sheets (or
Sketches) and SPecification revisions for changes to
construction Contract Documents for the ongoing
construction of the West Water Treatment Plant and for

This amendment amends the Consultant Agreement for Construction

hereinafter referred to as 'the CONSULTANT" in consideration of the
mutual benefits, terms, and conditions hereinafter specified.
*The general terms and conditions of the agreement remain
unchanged.
*In EXHIBIT A of the agreement the PROJECT SCOPE shall be
revised to include Items 1.5 through 1.8 and the BASIC
SERVICES DURING CONSTRUCTION PHASE shall be revised to include
Items 2.21 through 2.21.4, Items 2.22 through 2.22.2, Items
2.23 through 2.23.4 and Items 2.24 through 2.24.6.
*The Construction Managers Compensation shall be revised as
per Exhibit B which shall replace Exhibit B of Amendment $1
*In EXHIBIT C of the agreement the CITY'S RESPONSIBILITIES
shall be revised to include Items 2.10 through 2.12
The written agreement, Dated March 5, 1991, is hereby amended to
include the Additional Servzces as stated in this Amendment $ 2
together with the attachments.

1.5 The additional work for Phase I of the Data Acquisition and
Control System (DACS) includes a team to: review of available
existing DACS reports and studies, identify DACS requirements,
develop DACS alternatives, prepare costs and schedule
estimates, make specific recommendations for integrating the
West Water Treatment Plant Controls in the DACS and provide
recommendations for the strategic DACS direction.
The DACS study phase is to include integration with the
specified West Plant control system, data communication to the
East Plant, integration of the East Plant controls, and
integration with the lift station pump control system.
1.6 The additional work for Phase II of the Data Acquisition and
Control System (DACS) includes preparing revisions to plans,
Instructions to Contraotor and Change Orders for the ongoing
West Water Treatment Plant Construction Contracts to integrate
the West Water Treatment Plant Controls into the DACS.
This DACS coordination phase will also include providing
information for recommended changes in the ongoing
modifications of the East Water Treatment Plann Control to
integrate them into the DACS.

The additional work for Phase III of the Data Acquisition and
Control System (DACS) includes preparing of Plans and
Specifications for the construction/installation of the DACS.
This DACS design phase will include integration of the West
Water Treatment Plant control system, integration of the East
Water Treatment Plan% controls, integration of lift station
pump controls and data communication from all points to a
centrally located system.
The additional work for Phase IV of the Data Acquisition and
Control System (DACS) includes Construction Management
Services during the construction/installation of the DACS.
During the DACS study phase and for the period provided, the
CONSULTANT shall, using its best efforts, provide the
following basic services for the additional work.
1 Review existing DACS reports and preliminary requirement
statements provided by the CITY.

The CITY will compensate the CM in accordance with the
terms and conditions of this AGPEEMENT as follows:
For the Basic Services provided by the CM as set out in
Exhibit A, the CM shall be paid as Total Basic
Compensation, an amount not to exceed $1,306,330.00.
This amount includes a Lump Sum of $1,088,330.

shall be earned as services are rendered and as related
