was held at the Town Hall, Boynton, Florida, at 7:30
o'clock P.Y.,., Tuesday
evening, February 16, 1932.

The above constituting a majority of the Board

February 2, 1932 were read and approved, upon motion
of Comnzi~sioner Bowen, seconded by Commissioner Nutting
and duly carried.

Upon motion made by Commissioner Bowen and

OF BOYNTON:
l, T~hat the propose~ Letter Agreement of the Town
of Boynton with Florida Power & Light Company, which is
hereinafver set forth in f~.l in Section 2 hereof, be
the same is hereby approved as to form and substance.
That the ~ayor and the Town Clerk of md on
behalf of the Town of Boynton, be and they are hereby
authorized and directed to execute and enter into with
Florida Power & Ligh2 Company the said Letter ~reement
approved in Section 1 hereof, and hereinafter set forth
in form, words and figures as follows:

Gentlemen:
At your request, and in order to assist you in
working out some of your present financial probiems~ We
hereby agree that as of February l, 193~, we will tem-
porarily discontinue the operation of twenty-six (28)
100 candlepower overhead bracket type street lights and
four ~4) 100 candlepower w~l~nite Way~' street lights, here-
tofore operated under the Street Lightim~ ~reement now
in effect between us and dated the 2nd day of March 1926.
It is understood that while the said twenty-six (26)
overhead bracket t~De street lights and the said four
(4) ~'~hite Way" streev lights remain so discontinued,
we will hot bill you for the operation thereof.
~.t any time or from time to time, at your request,
we will restore to seryice any or all of the above
described street lights and after such restoration to
service, we will bill you for the operation thereof
and you will pay therefor in accordance with the said
Street' Lighting Agreement dated the- 2nd day of March 1926.
it is understood and agreed that while any or all
of the' lights discontinued hereunder or discontinued
under the Supplementary Agreement now i.u effect between
us and dated the ~6~h d~uy of August 1929, remain so dis-
contLnued, you will no~ require us, sad we will not be
obligated, to install any additional street lights under
the said Street Lighting Agreement dated the 2nd day of
Marc~h 1925. it is further understood ~cd agreed that
should you fail to perform any of your obligations under
the-said Street Light'Lug Agreement, the said Supplemen-
tary Agreement or hereunder, we, at our option, may cease
to supply electric energy ~nd service to you and such dis-
continuance of service shall not be deemed to be a ~reach
~y us of the said Street Lighting Agreement or the said
Supplementary Agreement.
Except as provided in this letter, the said Btreet
Lighting Agreement and the said Supplementary Agreement
shall remain in full force mud effect between us.
If you agree to the foregoing, kindly so indicate
by having your proper officers execute this letter
~ud the abtaohed copies in the spa~es provided for that
F~rpose and under your corporate seal.

Frank L. Anderson, Treasurer~and Tax Collector
presented Surety Bond ~8~SV2~-D in amount of $8000.00
of The ~merican Surety Company of New York in favor
of the To~m of Boynton, Florida.
Attorney J. H. Adams examined the Bond which
he appr~¢ed,
Thereupon Commissioner Bowen made a motion that
the Bond be accepted and approved by the Board of
Town Commissioners. This motion was seconded by
Co~muissioner Nutting and duly carried.
Commissioner Bowen made a motion that the follow-
ing Resolution be adopted and passed.
l~hereas Lot 10, Block 6, Section 28, Boynton Heights,
is and has been a yacht .lot, smd
~,~qaereas~ this Lot was assessed for the years 1929
and 1930 showing improvement wb~ich is an erroenous
assessment.
Therefore, Be It Resolved by the Board of Town
Co~mr~issioners of the Town of Boynton, Florida, that
the Treasurer, ~d Tax Collector be ordered and in--
structed and he. is hereby ordered and instructed to
charge off the errorneous Tax assessed for improvement
against Lot 10, Block 6, Boynton Heights for the years
1929 and 19~0.
' This motion was seconded by Commissioner Nutting
mud du~y carried.
The Treasurer, Frank L. Anderson, stated that
there had been a misunderstanding in ag~arding the
Seaboard 0il Compsmy the conzract for furnishim~
the Tow~ with gas and oil for the Sar~itary Truck and
that the Seaboard 0il Company had not intended to
extend credit to the Town for an indefinite period but
expected to receive payment each month.
The Treasurer also stated that the Seaboard 0il
Company b~ad directed ~r. J. E. Wooten to stop furnishing
gas and oil to the Town on credit.
Commissioner Bowen made a motion that Y~ ~. Ho James
be given the contract to furnish the S~nitary Truck and

Fire Entwine with gas, oil and~ep~irs for a period of
t~ee months, to be paid when funds are available.
This motion was seconde~ by Con,missioner Nutting
and ~ duly carried.
Mr. ~. A. Weaver requested tne Commission to
adjust the back taxes on his property known as L~ s
15, 18, 16, 17~ Block A, Pence Subdivision #l and
Lot 10, Block B, Pence Subdivision #l, ~ud Lots

Upon motion of Commissioner Bowen seconded by
Commissioner-Nutting and~u~y~°~ carried, ~h~ Treasurer
was instructed to cancel ........ the said Tax Sale

~8!a~d, adjust tb~ back taxes on the basis of the
19~9 tax, waiving all interest ~ud pe_ualties, providing
all taxes ~dus to date, including the year 19Gl, were
paid within thirtydays.
Commissioner Bowen madeira motion that the Certificate
of Indebtedness to the Florida Power & Light Company, be
dated to become due on or before December 31, 1932.
This motion was seconded by Contmissioner Nutting
and duly carried.
Com~i~2ioner Nutting asked Treas~a~er, ~ax Collector,
Water Supt., Frank L. A~uderson, vfny he had not painted the
~Parking~' spaces on the streets as he
~Stop~ signs and
had ordered.

replied that up to the present time
that he had been unable to find the time to do this
work as there had been other things more important
to be done.
Commissioner Nutting made a motion that tb~ matter
of the suit by the Bondholders against the To~n be
turned over to the Term £4ttorney J. H. Adams and that
he use his judgment as to filing an answer.
This motion was seconded by Commissioner Bowen
and duly carried~
Attorney Adams stated that there would be another
hearing at Fort Pierce,Th~&r~day Feb. 18, on the Palm
Beach Company suit.
