I. CALL TO ORDER Hilary Zalman, Community Standards Special Magistrate, called the Hearings to order at 9:03 a.m. and explained the Magistrate's role and the procedures. Pursuant to Florida Statute, all orders are appealable to the Circuit Court in Florida and the City Commission. Also, that a fine will be imposed if the violation(s) are not corrected by the deadline. II. INTRODUCTION AND SWEARING IN OF WITNESSES Ms. Loth administered an oath to all those intending to testify. ROLL CALL IV. NEW BUSINESS Case Hearing Case No. 18-2426 Sem Po Ying Trust Po Ying Sem Property Address: 2601 NW 2nd St Type of Property: Single-family, homesteaded Violation(s): CO CH 15 SEC 15-120E INCL LDR CH 2 ART 4 SEC 2.8.2 Permit #143328 was existing, to enclose rear porch habitable space, until expired. AC Unit installed without a permit. Replace dryer vent cover. Officer Guim, presented the case, which was a citizen complaint. Initial inspection date October 16, 2018. Property owner was not a repeat violator. Thirty days given to bring the property into compliance. Certified mail sent July 9, 2019, green card dated July 31, 2019. The dryer cover has complied, but AC permit and garage enclosure violations still exist. AC is working, but without a permit. Property last inspected August 16, 2019. City Meeting Minutes Community Standards Special Magistrate Hearings Boynton Beach, Florida August 21, 2019 recommended property to be in compliance by October 5, 2019, or $50 a day assessed and administrative fee of$634.12. Po Ying Sem, owner, appeared and agreed that 45 days being offered should be enough time to come into compliance. Ms. Zalman explained the fee and costs involved. Decision Based on testimony, Ms. Zalman ordered compliance date of October 5, 2019, or $50 a day fines assessed and administrative fee of$634.12. Fine Certification Hearing Case No. 15-099 Henrietta D Copeland Property Address: 404 S Circle Dr Type of Property: Single-family, homesteaded Violation(s): 4-32 Leash Law Officer Roehrich, Animal Cruelty Investigator, presented the case, which is due to multiple citizen complaints. For purposes of this specific fine certification, initial inspection date July 25, 2019. Property owner is a repeat violator. Board Order issued February 19, 2015, in reference to leash law violations stipulating $250 fine per occurrence. Violations have been ongoing. Verbal notice given in 2018 as well as courtesy notices and civil citations. Number of days given to comply was immediate. Notice sent Certified Mail July 26, 2019, green card not returned. Date notice posted on property and at City Hall was August 12, 2019. Respondent's mother had four small dogs which ran loose continually in 2015. Ultimately, the mother moved and the property was quiet. In 2018, four new dogs appeared and complaints of small dogs running loose resumed. Warnings were issued in 2018, citation issued in 2018, complaints continued. Number of dogs reduced as one was hit by a car and another given away. Last contact was July 25, 2019, when photos were taken. Only one dog remains at this time. This is a health and safety hazard due to elderly population in retirement home nearby. City recommends fine of $250 for one occurrence on July 25, 2019. Henrietta Copeland, owner, stated precautions are now being made to contain the dogs in the backyard, and does not disagree with the complaints and concerns. Officer Roehrich agrees that the complaints only occur when Ms. Copeland is at work. Decision Based on testimony, Ms. Zalman certified the fine of$250.00. Page 2 Meeting Minutes Community Standards Special Magistrate Hearings Boynton Beach, Florida August 21, 2019 Case No. 18-790 Lanthia Mucale Property Address: 1714 Banyan Creek Ct Type of Property: Single family, homesteaded Violation(s): LDR CH 2 ART 4 SEC 2.8.2 Obtain a permit for structural repairs to front entrance, load bearing second floor, and around garage opening as stated in the Red Tag issued by Robert Cody. Officer Hart presented the case. Notice of violation date April 26, 2018. The Magistrate hearing was on January 16, 2019, Ms. Mucale did appear. Compliance date given was April 2, 2019, or$200 per day plus administrative fee. Property last inspected on August 20, 2019, violations still exist. Fine, including administrative fee of $634.12, is $29,034.12. Representative appeared, did not have necessary documents to be allowed to speak. Officer Hart noted the owner has since vacated the property and the property is either being foreclosed or short-sale. Decision As no one appeared, Ms. Zalman certified the fine of$29,034.12, including administrative fee. Case No. 18-2725 Richard Waxman Property Address: 618 SW 1St St Type of Property: Multi-family, non-homesteaded Violation(s): CO CH 13 SEC 13-7 INCL CO CH 13 SEC 13-16 CO CH 15 SEC 15-120D INCL LDR CH 4 ART 3 SEC 11 CO CH 10 SEC 10-56B CO CH 10 SEC 10-56D Apply for, pass inspection for, and obtain a Certificate of Use and Occupancy. Obtain a Business Tax Receipt. Pressure clean walkway (removed, HOA's responsibility). Reseal parking area (removed, HOA's responsibility). Sod all bare areas (removed, HOA's responsibility). Replace missing window screens. Replace missing dryer vent cover, large hole in wall (complied). Officer Hart presented the case. Notice of violation date December 19, 2018. The Magistrate hearing was on June 19, 2019, no one appeared. There were two orders: July 1, 2019, for installing smoke detectors (has complied); July 8, 2019, for missing window screens (has not complied). Fines are $25 per day plus administrative fee. Page 3 Meeting Minutes Community Standards Special Magistrate Hearings Boynton Beach, Florida August 21, 2019 Property last inspected on July 12, 2019, violations have complied. Fine, including administrative fee of$634.12, is $734.12. Richard Waxman, owner, appeared, claiming he had spoken with Officer Hart, who explained what needed to be done. Respondent did it, called for an inspection on May 20, 2019, but did not hear back so assumed all was fine. Officer Hart returned call on June 18, but the next day was the hearing and he did not understand he was to attend the June 19 hearing. Officer Hart gave an accounting of his records. The two small windows in question were all that was missed, stating they are exhaust windows and not otherwise used. Ms. Zalman reduced the non-compliance by two days at $25 per day. Decision Based on the testimony, Ms. Zalman certified the fine of$684.12. Case No. 18-3096 Carla P Blue Property Address: 1291 SW 28th Ave Type of Property: Single family, homesteaded Violation(s): CO CH 10 SEC 10-52 Vehicle in violation is located at 1291 SW 28th Ave, contrary to City Code. Vehicle is inoperable. Current tag must be on vehicle at all times. Remove or register all inoperable vehicles on the property and in right of way. Officer Hart presented the case. Notice of violation date December 31, 2018. The Magistrate hearing was on June 19, 2019, no one appeared. Compliance date given was July 13, 2019, or$25 per day plus administrative fee or abate by towing. Unable to abate as vehicle was blocked in. Property last inspected on August 14, 2019, violations had complied after a call from resident. Fine, including administrative fee of $634.12, is $1,459.12. Carla Blue Mays, owner, appeared, stating the earlier notices sent to the property were not given to her by others on the property until the last one which was posted; was under the impression that as long as car was in the driveway it was okay. Husband has had a stroke, cars belong to her daughters who visit frequently. Ms. Mays says she cannot afford the fine. Ms. Zalman explained how lien reductions work once the fine is certified, however, since Ms. Mays did not sign a previous green card and extenuating circumstances, half of the fine was entered, or$729.56 including fee. The lien reduction can still be applied for. Decision Based on the testimony, Ms. Zalman certified the fine of$729.56. Page 4 Meeting Minutes Community Standards Special Magistrate Hearings Boynton Beach, Florida August 21, 2019 Case No. 19-379 Alma Fuidio Property Address: 25 Kensington Ln Type of Property: Single family, homesteaded Violation(s): LDR CH 2 ART 4 SEC 2.8.2 Obtain permit for addition being built on the rear of the home, being constructed without permits. Construction has been deemed unsafe by the Building Official. Officer Hart presented the case. Notice of violation date March 6, 2019. The Magistrate hearing was on May 15, 2019, no one appeared. Compliance date given was July 1, 2019, or $200 per day plus administrative fee. Property last inspected on August 20, 2019, violations still exist. Fine, including administrative fee of $634.12, is $10,834.12, and continues to accrue daily. Alma Fuidio, owner, appeared, stating the permit has been applied for, one person approves the permit, then next week someone else declines approval. Would like to keep the room and make corrections, but cannot work with architect when they do not know what is or isn't being approved. Ms. Zalman advised the architect should be in communication with the City to avoid misunderstandings. Owner asked for two weeks extension. Officer Hart believes the problem lies with the structure not meeting the required setbacks for the building; because there is electrical in the structure, a permit may be needed to take the structure down. Once the building is in compliance, Respondent can apply for a lien reduction hearing, and Ms. Zalman explained the process and to work closely with the City. Decision Based on the testimony, Ms. Zalman certified the fine of$10,834.12, and will continue to accrue at $200 a day. Lien Reduction Hearing Case No. 09-3116 Barbara J Rudd Property Address: 306 NE 11th Ave Type of Property: Single-family Violation(s): As noted in the Notice of Violations Officer Pierre presented the case. Notice of violation date September 25, 2009. The Magistrate hearing was on November 18, 2009, no one appeared. Compliance date given was November 28, 2009, or $100 per day plus administrative fee. Date complied March 3, 2010. The property has 94 days of non-compliance with fines of$100 per day in fines and administrative fee of$730.15, for a total of$10,130.15. Habitat for Humanity is the current owner of the property. Page 5 Meeting Minutes Community Standards Special Magistrate Hearings Boynton Beach, Florida August 21, 2019 Holly Carson, Director of Homeowner Services, Habitat for Humanity, appeared stating the land was acquired in August 2018 from City of Boynton Beach. The construction team completely cleared the lot before building the two new villas for two Boynton Beach families and dedicated in April 2019. Ms. Carson asked that the lien be drastically reduced, and explained to Ms. Zalman how the Habitat for Humanity projects work to provide affordable housing. Habitat for Humanity has a strong partnership with Boynton Beach and the CRA. Ms. Zalman was presented photos of the property. Decision Based on the testimony, Ms. Zalman removed the entire lien and costs were waived. Case No. 10-41 Wachovia Mortgage Corporation Property Address: 212 SE 1St Ave Type of Property: Single-family, homesteaded Violation(s): As noted in the Notice of Violations Officer Pierre presented the case. Notice of violation date January 8, 2010. The Magistrate hearing was on April 21, 2010, and no one appeared. Compliance date given was May 6, 2010, or$100 per day plus administrative fee. Date complied April 15, 2012. The property has 709 days of non-compliance with fines of $100 per day, plus administrative fee of$730.15, for a total of$71,630.15. Owner of property has complied for lien reduction. Brandon Parker, new owner, stated the property was purchased and financed as an owner-occupied property from Wachovia. Upon speaking with Diane Springer, previous head of City Code Compliance, Mr. Parker was under the impression that the $70,000 lien could be reduced. Receipts for costs for renovation were presented to Ms. Zalman. The home was purchased for $76,000 and approximately $100,000 was put into the property; current assessment is $230,000. Owner's goal is to refinance the property due to high interest on home renovation loan. Decision Based on the testimony, Ms. Zalman reduced the lien to $2,502.65, including the administrative fee. Case No. 11-2277 Tang Services Inc. Property Address: 2412 Tuscany Way Type of Property- Violation(s)- As noted in the Notice of Violations Officer Pierre presented the case. Notice of violation date August 22, 2011. The Magistrate hearing was on May 16, 2012, and no one appeared. Date complied July 25, 2019. The property has 2,615 days of non-compliance with fines of $100 per day fine assessed and administrative cost of $730.15, for a total of $262,230.15. Owner of property has complied for lien reduction. David Schmidt, attorney representing property owners, stated the owners were unaware of the lien until the time of attempted sale. Tang Services is a New York company, the notice of violation was mailed and returned, and when posted, the tenant did not give the notice to the owners. When served to the registered agent, said agent claims no recollection of having received it. The needed inspections never were scheduled ("fell through the cracks"). The property was purchased by one of the corporation members in 2005 for $215,000; the current contract to sell is $167,000, with appraisal of $129,000. Owner has paid all BTRs up to date (2017), property is currently vacant. City recommended reduction of 10%-5%, as property was being rented without obtaining BTR until two years ago. Decision Based on the testimony, Ms. Zalman reduced the lien to $15,112.65, including the administrative fee. Case Hearing Case No. 19-539 Deivin R Guzman Property Address: 101 Azalea Cir Type of Property: Single-family, non-homesteaded Violation(s): LDR CH 2 ART 4 SEC 2.8.2 CO CH 13 SEC 13-7 INCL CO CH 13 SEC 13-16 COU/BTR required for home rental. Building permit required for interior renovation and a new roof. Officer Weixler, presented the case, which was a citizen complaint. Initial inspection date March 26, 2019. Written notice give March 26, 2019. Thirty days given to bring the property into compliance. Property posted August 8, 2019, for service. New roof, interior renovation, new post put up, but all without permits. Red tag is on the screen, and filed stop-work order was submitted by an inspector from Building Department. City- recommended property to be in compliance by September 21, 2019, or $50 a day assessed, plus administrative fee of$634.12. Deivin Guzman, owner, stated he bought the house to live in five-six months previously; trying to fix and paint it inside and out, but was not aware permits were needed for the work he has been doing. Ms. Zalman instructed the respondent to go to Building Department regarding the Red Tag/Stop Work Order, who will then give instructions on Page 7 Meeting Minutes Community Standards Special Magistrate Hearings Boynton Beach, Florida August 21, 2019 what needs to be done to come into compliance. For example, permits are needed for the new roof, the marble post, interior renovations including drywall and electrical. Mr. Guzman stated he did not replace the roof, but painted it. Officer Pierre recommended the case be tabled for further evidence. Decision Based on testimony, Ms. Zalman ordered the case be tabled for 30 days. [Ms. Zalman called for a five-minute recess.] Fine Certification Hearing Case No. 18-3036 Rivera Indarte LLC Property Address: 609 SW 1St Ct Type of Property: Single family, non-homesteaded Violation(s): CO CH 13 SEC 13-16 CO CH 13 SEC 13-7 INCL Apply for, pass inspection for, and obtain a Certificate of Use and Occupancy. Obtain a Business Tax Receipt. Officer Hart presented the case. Notice of violation date January 23, 2019. The Magistrate hearing was on June 19, 2019, and no one appeared. Compliance date given was July 10, 2019, or $25 per day plus administrative fee. Property last inspected on August 20, 2019, violations still exist. Fine, including administrative fee of $634.12, is $1,684.12. Alejandro Sixto, counsel for owner, stated permits have been pulled for this property and the companion case (see Case No. 18-3037), and requested a 30 days extension to finish the work. Ms. Zalman said this is the fine certification phase and discussed with Officer Hart what all is needed. Officer Hart said an electrician as well as a plumber is needed for the water heater permit, and that the permits applied for in June have yet to be approved. Ms. Zalman ascertained that the owner is in the process of complying and instructed on the lien reduction process. After some discussion, Ms. Zalman decided to table the case. Decision Based on the testimony, Ms. Zalman tabled the case for 30 days. Case No. 18-3037 Rivera Indarte LLC Property Address: 611 SW 1St Ct Type of Property: Single family, non-homesteaded Violation(s): CO CH 13 SEC 13-16 Page 8 Meeting Minutes Community Standards Special Magistrate Hearings Boynton Beach, Florida August 21, 2019 CO CH 13 SEC 13-7 INCL Apply for, pass inspection for, and obtain a Certificate of Use and Occupancy.
