A Regul~r Meeting of the Board of Town Co~wuissioners of time Town of Boynton, Florida, was held at the Town Hall on Tuesday evening, Dece~oer 6, 1932 at V:30 o'clock P.M. Present: Ho D. Stevens, Mayor Frank Nutting, Vice-Nayor J. P. Bowen, Town Clerk. The above constituting the entire Board of Town Commission~ ers of the Town of Boynton, Florida. The Minutes of the Regular Mesting held November were read and approved upon motion made by Co~missioner Bowen, seconded by Commissioner Nuttir~ and duly carried. Resolution to pay claims was adopted. BE IT RESOLVED by the Board of Town loners of the Tow~ of Boynton, Florida, that the Treasurer be~ and he hereby is authorized and instructed to cancel Town of Boynton Refunding, Waterworks and Street Bond No. 18 Issue of October l, 1923 and paste same in bond book~ Commissioner BOwen made a motion that ~ne Town redeem Coupon No. ~ of Bonds numbers 37 to 43 Inclusive and numbers 48 to 53 IncSusive, Refunding Series ~B~ Issue amountir~ to Three Hundred and Ninety ($390.00) for same out of the interest and Sinking Fund. This motion was seconded by Co~issioner Nutting and duly carrie~ The following letter was read: Honorable To~ of Boynton, Florida, Gentlemen:- I am pleased to advise you that Waterworks and Street has been redeemed Town of Oct !, 1928~ Dollars, paying ~yse!f and others interested in the welfare of Boynton, a sufficient sum of money to complete paying the cost inthe suit Tow~ of Boynton vs ~Aaite Construction Company in the Circuit Court of Ap~a!s in New 0rle~ns has been secflred and placed with your attorneys to be used for that purl through the efforts of Coz~niss- West Palm Beach, '~ ' November 19, 1932. i ~:ve been advised that you passed a resolution inst,.ct!rig your atto~neys to dismiss this case p-~rely for the reason t?mt you oo:3~d not see your way clear to finance the cost of the suit° ::ow~ in view oF the fact, that these costs h~ve been raised by parties interested in the outcome of the suit, I believe it is your duty ~,s Com~.issioners of the Tenon to rescind the action taken and instruct your Attorney's to continue the case so long as the To'~ is not called on for any further costs. Co~nnlssioner Bowen made a motion that the Tov~ rescind its action of :ay ll, 15~ and allow the Attorneys to proceed with the case, so long as the Town is not called on to pay any f-~ther costs. There being no second the motion was lost. After a lengthy discussion, Co~missioner Nutting made a mot ion that the Co:fission investigate as to the a~¢isability of consenting to the continuation of the Appeal in tbs case of To-:~ of Boynton vs :?:?~ite Construction Company~ This motion was seconded by Co~nissioner Stevens and 'duly .~arrmedo Comm~ss:o_~er Bowen opposed.
