5 A RESOLUTION OF THE CITY OF BOYNTON BEACH,
6 FLORIDA, APPROVING AND AUTHORIZING THE CITY
7 MANAGER TO SIGN A FIRST AMENDMENT TO
8 AGREEMENT WITH JAMES D. STOKES FOR RED LIGHT
9 CAMERA SPECIAL MAGISTRATE SERVICES TO INCREASE
10 THE SPECIAL MAGISTRATE'S HOURLY RATE; AND
11 PROVIDING AN EFFECTIVE DATE.

14 WHEREAS, on August 6, 2013, the City Commission appointed James D. Stokes to
15 serve as the Special Magistrate for Local Red Light Camera hearings and approved the City
16 Manager to sign an Agreement for Special Magistrate services; and
17 WHEREAS,the Special Magistrate has requested that his hourly rate be increased from
18 $140 to $200 per hour; and
19 WHEREAS, the City Commission of the City of Boynton ,Beach upon
20 recommendation of staff,deems it to be in the best interest of the citizens of the City of Boynton
21 Beach to approve and authorize the City Manager to sign a First Amendment to Agreement
22 with James D. Stokes for Red Light Camera Special Magistrate to increase the Special
23 Magistrate's hourly rate.
24 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
25 THE CITY OF BOYNTON BEACH, FLORIDA,THAT:
26 Section 1. The foregoing "Whereas" clauses are hereby ratified and confirmed as
27 being true and correct and are hereby made a specific part of this Resolution upon adoption
28 hereof.
29 Section 2. The City Commission does hereby approve and authorize the City
30 Manager to sign a First Amendment to Agreement with James D. Stokes for Red Light Camera
31 Special Magistrate to increase the Special Magistrate's hourly rate. A copy of the First

32 Amendment is attached hereto as Exhibit"A".
33 Section 3. That this Resolution shall become effective immediately upon passage.

FIRST AMENDMENT TO AGREEMENT BETWEEN
THE CITY OF BOYNTON BEACH AND JAMES D. STOKES
This First Amendment shall take effect on signature by both parties.
THE CITY OF BOYNTON BEACH, FLORIDA, a municipal corporation,
hereinafter referred to as "CITY" and JAMES D. STOKES, hereinafter referred
to as "Special Magistrate"
WITNESSETH:
WHEREAS, On August 6, 2013, an Agreement between the City and Magistrate
was approved by the City Commission, pursuant to Resolution R13-075; and
WHEREAS, Special Magistrate has been compensated at the same hourly rate of
$140.00 per hour for the past six (6) years; and
WHEREAS, Special Magistrate has requested an increase in hourly compensation;
and
WHEREAS, the City has agreed to increase Special Magistrate's compensation.
Now, therefore, in consideration of the mutual terms and conditions, promises,
covenants and payments hereinafter set forth, City and Special Magistrate agree as
follows:
1. City agrees to pay Special Magistrate One Hundred Seventy-Five Dollars and
00/100 ($175.00) per hour or fractional part thereof for time spent by the SPECIAL
MAGISTRATE in preparation and research for special Magistrate hearings, for
attendance at such hearings, and if required, for drafting appropriate orders and
documents which result from such hearings.
2. All other terms and conditions of the Agreement not specifically amended shall
remain in full force and effect for the balance of the term of the agreement.
