Deducting the amount of $185.3V expenditures from
amount paid by the To~m of $&5V.OB leaves a credit of $2V1,61 on
attorney, s fees. The Cou~t allowed a fee of $1,&39.1V
leaves a balance owing me by the Town of $1~ 16V.52 In
~ddition to ~he abcve~ the T~n owes $100.00 to the ~ster,
C. Y. By~d, which fee was allowed by the Cot~t. However, i ~ve
a check from~helby ~oz~l ~-u the s~m of $88.84~ ~ pa~ent of
t~es on p~o~ty dis~ssed from ~e foreclosure suit, which
leaves the To~ ow~, when this item is adjusted,
the s~ of

A further discussion was !~d regarding the construction
of a storm shelter, including water works and electric light
system. Nr. Newm~an T. ~iller, Attorney, ~no was present sug-
gestedthat application For loan From the Federal Public Works
Administration be divided into two or t~ee projects so that
in the event tb~t one or more projects are rejected there
will be a possibility that one or more will be approved.
Notion was made by Com~uissioner Stevens that the
Towm~ Commission take the necessary steps for proc'mring
above mentioned lo,us. This motion was seconded by Com-
mlssi~ner Bowen and unanimously carried.

It is my opinion that you would not be warrs_uted in
making this payment for fut~c_~e services until after s~ elec-
tion has been held on tbs question of the refunding of the
present i~lebtedness of the Town of Boyhton has been deter-
mined by a vote of t~he people of said Town. It is my under~
steading in the reading of this telegram t~at $800.00 $,ought
is in p~ment for a partial as well as a f~tture final
proving opinion, Certainly you would not be warranted in
expending this or any othe~ sum of money for such purpose
until you have first had t~his question of refunding deter-
mined by the citizens of yo~¢ ~nicipality who are qualified
to pass upon such questions~
Therefore, t render it asmy opinion that you should
not pay t.~s or Shy other susa of money until after an elec-
tion has been held,
