I. CALL TO ORDER
Carol Ellis, Special Magistrate, called the Hearings to order at 9:00 a.m., and
explained her role and the hearing procedures. Pursuant to Florida Statute, all orders
are appealable to the Circuit Court in Florida and not the City Commission. She
explained a fine will be imposed if the violation(s)are not corrected by the deadline.

yard west of the driveway. Remove all outside storage.
Repair the damaged fascia board.
Officer Weixler presented the case,which was a citizen complaint. The initial inspection
date was September 8, 2016. It is not a repeat violator. Initial written notice was
September 28, 2016. Thirty days given to comply. Notice was sent by Certified Mail on
December 21, 2016. Green card was signed December 29, 2016. Date property last
inspected January 17, 2017. City recommended 30 days for compliance, or $150 a
day. Trash has been mostly removed, however, Officer Weixler discovered the shed
was older than 10 years so removed it from the violation list. Pictures were shown to
Ms. Ellis, revealing there is still outside storage and nothing has been done on the west
side of the driveway. There are no pictures of backyard where there is still a lot of loose
trash and debris. Repair to damaged fascia board is unknown.
Carol Moran,daughter of owner, lives on property with her mother. Ms. Moran stated
she does not understand what the outside storage is, there is a bucket under a window
air conditioner. Officer Weixler stated there are buckets and cans, and are in violation
of a City ordinance. Ms. Ellis recommended the owner work with the City to understand
what has to be removed.
Decision
Ms. Ellis ordered a 30-day extension date as stated on the Board Order,or$150 a day.

Officer Weixler presented the case, which was a City referral (Police Department
responded to an overdose). The initial inspection date was October 19, 2016. It is not
a repeat violator. Initial written notice was October 19, 2016. Ten days given to
comply. Notice was sent by Certified Mail on November 30, 2016. Green card was
signed December 5, 2016. Date property last inspected January 17, 2017, no license,
several things still undone, and another inspection not scheduled. City recommended
30 days for compliance, or $100 a day. Officer Weixler did not do the last inspection.
Ms. Ellis asked how many occupants are in the home; Officer Weixler replied six, which
is the limit. Regarding the overdose, the patient responded positively to Narcan and
was saved.
Phillip Catanzaro, authorized representative for tenant and owner, appeared. Ms.
Ellis asked why a subsequent inspection had not yet been scheduled. Mr. Catanzaro
cited communication with the landlord to get everything done. One thing is left to fix,
and then the inspection can be scheduled. Ms. Ellis asked if there had been any other
incidents at this home prior to the overdose, and Mr. Catanzaro replied there had not.
Outstanding issue is trimming the tree and palm trees. The location is a half-way
house, but has only been in use as such for six-eight months. Office Weixler stated that
application had not been made when the property was first used as such and rent has
been collected all that time. Mr. Catanzaro did not have any proof of representative for
owner on his person, but claimed to be Director of Operations for the corporation, but is
not listed as an officer. Ms. Ellis stated typically some sort of documentation is needed,
and required Mr. Catanzaro present to the Code Office by 5:00 p.m. some proof in
writing that he has some sort of connection to the establishment.
Decision
Ms. Ellis ordered a 5-day extension date as stated on the Board Order, or$200 a day.
Case No. 16-1614 Fitness International LLC

Violation(s): As stated in Notice of Violation
Assistant Fire Marshal Moore presented the case, respondent was not present. It is a
health and safety hazard. City recommended 30 days for compliance, or $200 a day.
Ms. Ellis noted there were fees in the narrative,and was told the fees have been paid.
Decision
Because a health and safety hazard exists, Ms. Ellis ordered a 10-day extension date
as stated on the Board Order,or$200 a day.

Officer Hart presented the case. Notice of violation was June 22, 2016. Code
compliance hearing date was September 21, 2016, and Karl Washington did appear.
The Code compliance date was October 6, 2016, or $300 a day plus administrative
fees. Property last inspected January 17, 2017, and violations still exist. The bees, the
trailer, and the windows have been corrected, but the outside storage,trash, and debris
remain. There are currently 104 days of non-compliance and fine continues to accrue
at $300 a day plus administrative fees in the amount of$730.15. Officer Hart showed
photos to Ms. Ellis.
Nina Clark,owner, stated she is currently moving into property which had been vacant.
She stated the pictures she presented had been taken a week prior. Ms. Ellis stated
that, based on the photographs, the property hasn't been 100% cleaned up, and the
respondent should coordinate with the Code officer to see if what is being done satisfies
the City.
Decision
Ms. Ellis ordered a 7-day extension date to finish the work,or the fine would be certified.

Property last inspected January 17, 2017, and violations still exist. There are currently
63 days of non-compliance and fine continues to accrue at $200 a day plus
administrative fees in the amount of$634.12. Officer Hart showed photos to Ms. Ellis.
Technically the property should be vacant as it is boarded up, but there are squatters.

Another case will come before the Magistrate next month for the property being
unsecured.
Michele Clancy, counsel for the owner, stated the property is being foreclosed on,
and there have been multiple issues trying to remove the squatters,who are armed and
chase away the contractor who tries to do the work. Ms. Ellis noted that at the
November hearing Mr. Silver had stated 15 days would be sufficient to resolve. Ms.
Clancy said they had been working on it, communicated with Officer Hart, and police
have had to escort the contractor there to remove the squatters. However, when the
police leave, the armed squatters return and scare away the contractor. Some work
has been done. Ms. Clancy said they are currently investigating possibility of an off-
duty police officer or someone to assist the contractor to remain at the property. Officer
Hart clarified that because no one could be found to do the work, he suggested Mr.
Silver contact the Code Office that has a list of recommended contractors who have
experience dealing with such individuals. Officer Hart stated that Mr. Silver had called
him about threats made against his maintenance person once the police left; and he
corroborated Ms. Clancy's statement about hiring an off-duty police officer and how to
go about it. Ms. Ellis stated that the owner is a corporation and should be able to afford
to hire the necessary personnel. Ms. Clancy requested more time to hire the off-duty
officer and bring the property into compliance. Officer Hart explained why the situation
had been broken into two cases, trash and debris on one case, security on another.
Removing squatters is a police matter, but there is no guarantee they won't come back.
Ms. Ellis advised the police be called to remove the squatters as many times as it takes.
Decision
Based on the testimony, Ms. Ellis certified the fine.
Case No. 11-692 Camelo Campos
Property Address: 330 NE 16Th Ave
Type of Property: Single-family

Officer Pierre presented the case. Notice of violation was March 24, 2011. Code
compliance hearing date was May 18, 2011, and no one appeared. The Code
compliance date for Cease & Desist Order was June 2, 2011, or $500 per occurrence,
with two occurrences for $1,442.06; second order was at $200 per day for a total of
$410,834.12. (Companion Case No. 13-1076.)
Phillipe Boucher, current owner, stated property was purchased July 19, 2016, as a
foreclosure at $51,000. The property was purchased for investment purposes, work
was done to comply as soon as possible, the property is currently vacant, and owner is
unsure whether it will be rented or sold. Owner presented a timeline showing the series
of events, along with pictures of the property. Market value is approximately $135,000,

and proof of $54,000 of repairs and labor thus far was also presented. Ms. Ellis
reviewed photos of current condition of home which appears to be very nicely done. Mr.
Boucher stated there was difficulty coordinating with the Building Department, but finally
accomplished it in six months.
Decision
Based on testimony, Ms. Ellis reduced the lien to $1,000 plus $730.15 administration
fees.
Case No. 13-1076 Camelo Campos

Officer Pierre presented the case. Notice of violation was May 20, 2013. Code
compliance hearing date was July 17, 2013, and no one appeared. The Code

stands for this case. Officer Pierre presented before and after pictures to Ms. Ellis.

Case No. 13-81 Chen Zhi Rui
Property Address: 117 SE 22nd Ave
Type of Property: Single-family
Violation(s): For Code Sections as stated
Officer Pierre presented the case. Notice of violation was January 17, 2013. Code
compliance hearing date was February 2, 2013, and no one appeared. The Code
compliance date March 3, 2013, or $1,000 per day. Compliance date was January 13,
2017. There are 1,412 days of non-compliance at $1,000 a day for a total fine of
$1,412,634.12. (Companion Case No. 14-1516.)
Chen Xueqiars, current owner, stated he is son of previous owner and took
possession a month ago upon father's death. Father spoke no English, and Mr. Chen
only learned of one of the violations after father died. The property is currently vacant,
and it depends upon the fine as to whether or not to sell the property. Mr. Chen

estimated value at $240,000, and mortgage is now up-to-date. Brian Anderson,
family friend, explained he had been advising Mr. Chen since father's death, that he is
now in compliance with all the repairs, and would like to keep the property. Mr. Chen is
asking for a reduction on the liens. Ms. Ellis asked City Staff for and was given before
and after photographs of the property. Respondent verified they do represent his
property, noting that property is in good shape. The roof was repaired, and Mr. Chen
said $23,000 was spent on repairs and gave Ms. Ellis the original receipts. Copies will
be made for the case file.
Decision
Based on testimony, Ms. Ellis reduced the lien to $1,000 plus $730.15 administration
fees.

Tom Coughlin, new owner, stated he took ownership of property November 29, 2016,
through the County foreclosure auction. Purchase price was $66,000, and the property
is currently up for sale at$120,000. Improvements and the utility liens total $7,500. All
the outside work as listed by Officer Cain include front yard sod, exterior paint, fixed
screen porch, pressure washed,trash removed, shed in back removed, fence fixed, etc.
Ms. Ellis requested copies of receipts and invoices, as well as photographs, be
presented to Code Office by next day for the case file.
Decision
Based on testimony, Ms. Ellis reduced the lien to $750 plus $730.15 administration
fees.

Property Address: 1530 Rialto Drive
Type of Property: Single-family home

Officer Pierre presented the case. Notice of violation was January 16, 2015. Code
compliance hearing date was May 20, 2015, and no one appeared. The Code
compliance date was May 30, 2015, or $500 a day. Compliance date was August 12,

Linda Vega, representing Invitation Homes, stated property was purchased a couple
of years ago, and related the chronology of repairs and failed inspections before finally
passing. The property is currently rented.

Victor Galluzzo, Jr., part owner and property manager, stated he has owned the
property two-three years; it was managed by a different management company, but he

has taken over management himself for the past year and a half. Mr. Galluzzo had
asked for six months'extension for sod because of$157,000 invested in remodeling the
units. He had tried to get someone to come out to inspect the sod, but no one ever
came. He did not know he had to come back to a hearing. Sod has been completed
since March 24, 2016, and the owner presented the receipt. The lien was not
discovered until owner applied for refinancing.
Decision
Based on testimony, Ms. Ellis reduced the lien to$730.15 administrative fees.

Diana Fleurmand [phonetic], mother of owner, stated she appeared because owner
was in class at college. The family lives at the property. Owner was unaware of the
violations at the time they took over property from tenants,they have gotten permits and
installed new AC and water heater, and have done a lot of work to improve property
since living there. Ms. Ellis asked for photographs of the property to be submitted by
noon the next day for the case file.
Decision
Based on testimony, Ms. Ellis reduced the lien to$730.15 administrative fees.

Julie Hynds, representive,stated the primary reason for the delay for compliance was
the need to repair or replace the driveway. The permit was applied for March 14, 2016,
approved April 19, 2016, and time was needed to complete the inspections. Other
items involved in complying included sod, and costs were almost$9,000. The property
has been kept in good condition, and they asked for a lien reduction. Ms. Hynds
presented invoices. Before and after photos were already in the case file.
Decision
Based on testimony, Ms. Ellis reduced the lien to$730.15 administrative fees.
Case No. 16-192 Kendrick Soares

Officer Pierre presented the case. Notice of violation was January 26, 2016. Code
compliance hearing date was April 20, 2016, and Omar Petite and Pat Soares
appeared. The Code compliance date was May 20, 2016, or $150 a day. Compliance
date was August 12, 2016. There are 236 days of non-compliance at $150 a day for a
total fine of$36,034.12.
Omar Petite, contractor, and Patrick Soares, brother of owner, stated when the fine
was originally certified, it was because the permit had not yet been pulled for the AC
change out. AC permit was pulled on May 19, 2016, and approved by the City. Ms.
Ellis explained that the inspection was still needed for the business tax receipt in order
to come 100% into compliance. Property was bought as a foreclosure for $140,000;
family members are living on the property; $20,000-$25,000 has been spent on
remodeling with work done family's construction company. There were before and after
pictures in the case file. Ms. Ellis viewed some receipts and instructed owners to
provide the rest of the receipts to Officer Weixler before noon the next day for the case
file.
Decision
Based on testimony, Ms. Ellis reduced the lien to$730.15 administrative fees.

Obtain a building permit for the shed. Remove trash and

Officer Weixler presented the case. Notice of violation was June 8, 2016. Code
compliance hearing date was August 24, 2016, and son of owner appeared. The Code
compliance date was October 8, 2016, or $100 a day. Violation still exists. Date last
inspected was January 13,2017. There are 102 days of non-compliance at$100 a day
plus administrative fees for a total fine of $634.12. Trimming and mowing has been
done. Trash and debris is picked up and some attempt has been made with the sod.
Shed is still in back, but permit has been applied for, Permit #16-2663. On June 28,
2016, the owners were called with comments on their plans to make corrections and
resubmit, but comments were never picked up. Officer Weixler presented pictures to
Ms. Ellis.
Calvin Thompson,son of owner, presented a letter giving him authority to testify. Ms.
Ellis read the letter into the record: "On behalf of Oscar and Lucille Colwell, we would
like Calvin L. Thompson, our son, to represent for us because we are of the age of 88
and 91. Our other son Calvin Mason, Sr., had a massive stroke on the ladder building
the shed, so the structure holds sentimental value, and on the mercy of the Court,
please help us save the structure. We have been at 2300 NW 2nd St., Boynton Beach,
Florida, since 1987, which is 30 years. That has to mean something. /s/ Oscar and
Lucille" Mr. Thompson gave a history of the incident mentioned in the letter and stated
he is the only able-bodied family member left who can take care of matters.
Decision
Based on testimony, Ms. Ellis tabled the case to February 15, 2017, to give time to
remove shed or get the permit.

"The City is requesting that the fines be certified in the following
cases. All the violators have been provided Notice of today's
hearing, with Proof of Notice filed in the record with the Board
Clerk. At this time, no one is present in Chambers for any of the
cases 1 am requesting for certification at this time. All of the cases
have been re-inspected prior to today's hearing and each case
remains in non-compliance.
The following cases are requested for certification at this time in the
amount established by the Board in the Orders of Violation for each
case, with the amount as set forth on the docket".-
