CALL TO ORDER Hilary Zalman, Community Standards Special Magistrate, called the Hearings to order at 9:00 a.m. and explained the magistrate's role and the hearing procedures. Pursuant to Florida Statute, all orders are appealable to the Circuit Court in Florida and not the City Commission. Also, that a fine will be imposed if the violation(s) are not corrected by the deadline. II. SWEARING IN OF WITNESSES AND INTRODUCTION Ms. Loth administered an oath to all those intending to testify. ROLL CALL IV. NEW BUSINESS Case Hearing Case No. 19-836 B&J Catering Inc. Property Address: 2201 S Federal Hwy Type of Property: Commercial Violation(s): NFPA 101 7.9.2.3 Provide service for emergency light. EFPA 1 13.3.2 In re: NFPA 25, repair deficiencies on fire sprinkler report. CO CH 9 SEC 9-22C Invoices of$100, $200, $300 Calvin Simmons, Fire Inspector, presented the case, which was a City Department referral. This is a health and safety hazard. City recommends 10 days for compliance, or $25 per day plus $100 administrative fee entered this date. Meeting Minutes Community Standards Special Magistrate Hearings Boynton Beach, Florida June 19, 2019 Decision As no one appeared, Zalman ordered compliance date of July 1, 2019, or$25 a day, plus administrative fees of$100.00. Case No. 19-1073 Cerberus SFR Holding Property Address: 3196 N Seacrest Blvd Type of Property: Single-family, non-homesteaded Violation(s): CO CH 4 SEC 4-32 Leash Law CO CH 4 SEC 4-36 County Registration CO CH 4 SEC 4-37 Rabies Vaccinations Officer Roehrich, presented the case, which was a citizen complaint. Initial inspection date August 28, 2018, when first complaint was received. This is not a repeat violator. Verbal warnings issued in 2018. Written notice was made May 28, 2019. Seven days were given to comply. Certified mail was sent June 3, 2019, signed green card dated June 7, 2019. The property was posted June 5, 2019. Chronological list of violations was given concerning multiple un-neutered/un-spayed pit bulls, resulting in seven citations with an argumentative resident. Twenty-six hours later, a communications dispatch was received regarding a deceased dog in the roadway in front of the residence; anonymous caller was eventually identified as Vincent Simms. At this time, the remaining three dogs had allegedly been removed and taken to a shelter; whereupon it was learned that the three dogs had been left to run loose in the parking lot afterhours (two were captured on the spot, the third not for four more days on Gun Club Road). On February 257 2019, a report was received of three pit bull puppies running in and out of traffic at the residence. The puppies were impounded. Claiming the dogs had been stolen from his backyard, Mr. Simmons redeemed the dogs from Animal Control, paying $940 in fees, intending to breed the dogs. Continued reports of aggressive dogs ensued over the next few months as the dogs got older. At this point four more citations were issued. Two weeks later, two uncontrollable females were surrendered to Animal Control. As of this date, Mr. Simms retains possession of the one male dog, but no record of vaccinations or license. Property manager was contacted in February and was told the situation would not be addressed unless it financially affected them. After another incident in May, additional contact was attempted with no response. This is a health and safety hazard. City recommended a Cease & Desist Order effective immediately with $1,000 per day per occurrence. Administrative costs $634.12. Ms. Zalman ascertained that one of the dogs could jump over the fence even though it was chained; it is possible the dog could also dig under the fence. Vincent Simms, significant other to the actual tenant, was not given permission to speak on behalf of the property owner; however, testimony on the record was allowed, the City Representative asked questions of Mr. Simms. It was learned that Mr. Simms had been at the property for 10 months and is the owner of the animals. The remaining male dog has been adopted by another family (his son-in-law); a transfer of ownership Page 2 Meeting Minutes Community Standards Special Magistrate Hearings Boynton Beach, Florida June 19, 2019 was requested as the micro-chip registration belongs to Mr. Simms. Mr. Simms claimed that the neighbors were throwing things at the dogs, which caused the dogs to act out. It was claimed that the neighbors attempted to break into the house after trying to get the dogs out of the way, and later killed the dog noted earlier. A police report was filed on these incidents. Mr. Simms claimed that the dogs are not violent unless provoked and that neighborhood children frequently play with them; that Officer Roehrich is "stretching the truth"; that he refuses to neuter/spay his dogs, but has no intent to breed them. All the dogs involved in the violations are no longer on the property; a new puppy is on the premises, but is kept indoors and walked on leash only, a $4,500 Parker Pit Bull, has all its shots, but is still too young for the rabies vaccinations. Officer Pierre attempted to confirm that the last dog in question was no longer on the property; however, because there is still no change of registrations, there is no way to confirm that. Officer Roehrich stated the last inspection was May 23, 2019, and cannot confirm Mr. Simms' claims. A discussion for handling the Cease & Desist Order ensued between Officers Pierre and Roehrich and Ms. Zalman. Ms. Zalman firmly instructed Mr. Simms on the parameters of keeping the dogs, either leased/chained, or legally contained within the property. Mr. Simms remained argumentative on several issues and has claimed that within 60 days he will no longer be in Boynton Beach. It was learned that State and local laws require rabies vaccinations at four months and the new dog is now five months old. Officer Pierre recommended the case be tabled; Officer Roehrich recommended the Cease & Desist Order. Ms. Zalman said tabling the case will not bring this matter to the Owner's attention and entered an order as follows. No administrative fees were entered. Decision Based on testimony, Ms. Zalman ordered a compliance date of June 29, 2019, or $500 a day. Case No. 18-2752 Diocles & Christina Trujillo Property Address: 1229 Piazza Antinori Type of Property: Townhouse, non-homesteaded Violation(s): CO CH 13 SEC 13-7 INCL CO CH 13 SEC 13-16 Apply for, pass inspection, and obtain a COU and occupancy. Officer Guim presented the case, which was a routine inspection. Initial inspection date November 9, 2018. Not a repeat violator. Initial notice was sent November 9, 2018. Thirty days were given to comply. Certified mail was sent April 30, 2019, signed green card dated May 6, 2019. Property was posted and at City Hall on June 4, 2019. Property does not currently have a BTR. COU was applied for but inspection failed for the AC unit. Owner has been contacted, but nothing has been obtained. City-recommended thirty days compliance, or $75 a day. Administrative costs $634.12. Page 3 Meeting Minutes Community Standards Special Magistrate Hearings Boynton Beach, Florida June 19, 2019 Diocles Trujillo, owner, stated the rental application was made in February, inspection was done, but the permit was difficult to obtain for an AC installed four years ago. Disagreement ensued regarding the administrative costs. Decision Based on testimony, Ms. Zalman Ms. Zalman ordered compliance date of July 1, 2019, or $75 a day, plus administrative fees of$634.12 entered this date. Case Hearing Case No. 19-21 Francis M Mulvey Est Property Address: 337 NE 14th Ave Type of Property- Violation(s)- Officer roperty:Violation(s):Officer Guim presented the case, and requested it be removed from the agenda 60 days. Permits are still needed for a carport, and help is sought for accomplishing the project. Decision Ms. Zalman ordered the case removed from the agenda. Fine Certification Hearing Case No. 18-2690 Methode LaFay LLC Property Address: 332 NE 15th Ct Type of Property: Multi-family Violation(s): CO CH 13 SEC 13-16 CO CH 13 SEC 13-7 INCL CO CH 15 SEC 15-120D.1 INCL CO CH 15 SEC 15-120B.2 INCL To obtain a rental license for the property. Apply for, pass inspection, and obtain COU and BTR. Install sod in the areas of yard where needed, including swale to achieve a green appearance. Officer Guim presented the case. Notice of violation was November 7, 2018. The Magistrate hearing was on March 20, 2019, and no one appeared. Compliance date given was May 2, 2019, or $25 per day plus admin fees of $634.12. COU and BTR violations still exist. There are 48 days of non-compliance, plus administrative fees of $634.12, for a total of$1,834.12. Lien Reduction Hearing Case No. 15-1172 Tina Rui Fan & Liang Bin Property Address: 114 NW 6t" St Type of Property: Single-family Violation(s): As noted in the Notice of Violations Officer Pierre presented the case. Notice of violation date May 7, 2015. The Magistrate hearing was on , 2015, and Bin Liang appeared. Compliance date given was October 31, 2015, or $100 per day plus admin fees. Date complied June 6, 2019. 17320 days of non-compliance with fines of $100 per day, plus administrative fees of $730.15, for a total of$132,730.15. Owner of property has complied for lien reduction. Liang Bin & Tina Rui Fan, owners, stated they were the owners in 2015. Violation notices in 2015 went to tenant, violations were corrected, but were not aware of lien until title search when they attempted to sell, a buyer is currently on contract. No tenants have been present since 2015. Sale price is $180,000. Original violation was tenant's fault, though tenant did inform the owners when there was a notice doorhanger and compliance was made within days in 2015. However, Officer Pierre said the owners complied early on, but failed notify for inspection and stop the lien. City recommends $500 plus admin fees. Decision Based on the testimony, Ms. Zalman reduced the fine to $500, plus $730.15 administrative fees. Case No. 15-2640 Claude & Kaylee Joseph Property Address: 746 NW 1St Ave Type of Property: Single-family, homesteaded Violation(s): As noted in the Notice of Violations Officer Pierre presented the case. Notice of violation date November 24, 2015. The Magistrate hearing was on February 18, 2016, and no one appeared. Compliance date given was February 27, 2016, or $100 per day plus admin fees. Date complied January 187 2017. 325 days of non-compliance with fines of $100 per day, plus administrative fees of $730.15, for a total of $33,230.15. Owner of property has complied for lien reduction. Page 5 Meeting Minutes Community Standards Special Magistrate Hearings Boynton Beach, Florida June 19, 2019 Claude Joseph, owner, stated at first he was renting the home without a permit, not knowing at the time that one was needed. An estimate of the expenditures to come into compliance was given (inaudible). Mr. and Mrs. Joseph have lived at the house last three years. City recommended 5% reduction. Decision Based on the testimony, Ms. Zalman reduced the fine to $1,450, plus $730.15 admin costs. Case No. 16-772 Gary & Celia Fisher Property Address: 29 Winchmore Ln Type of Property: Single-family, non-homesteaded Violation(s): As noted in the Notice of Violations Officer Pierre presented the case. Notice of violation date April 15, 2016. The Magistrate hearing was on June 15, 2016, and no one appeared. Compliance date given was June 30, 2016, or $100 per day plus admin fees. Date complied May 28, 2019. 1,061 days of non-compliance with fines of$100 per day, plus administrative fees of$730.15, for a total of$106,830.15. Owner of property has complied for lien reduction. John O'Neill, attorney for owner, submitted authorization to speak on their behalf. This is a rental property, the owners are out of state using a local property manager. Tenant has been there for 10 years; however, forms received in 2016 were not forwarded to owners at the time. Payments were made to Boynton Beach as soon as learning about the violations for penalties, permits and fines on June 1 ($163.55); another payment was made in August, possibly for the fees. Efforts were made to be in compliance, working with property manager. Three issues came up with inspection for rental license, two were taken care of and the third for a water heater apparently "fell through the cracks." Therefore, the permit that would have stopped the daily assessment of lien was not obtained. Total invoices of $2,904.25 were submitted, including certain fees paid to the City. The water heater was upgraded, permit pulled, and new water heater was reviewed and approved. Owner has otherwise been in compliance since August of 2016. Ms. Zalman noted the property manager was at fault for not following through for compliance. City recommended 10%-5% reduction. Decision Based on the testimony, Ms. Zalman reduced the fine to $6,100, plus $730.15 admin costs. Notice of violation date May 29, 2018. The Magistrate hearing was on September 19, 2018, and no one appeared. Compliance date given was October 1, 2018, or $100 per day plus admin fees. Date complied April 15, 2019. 131 days of non-compliance with fines of $100 per day, plus administrative fees of $730.15, for a total of$13,830.15. Owner of property has complied for lien reduction. Sabine Joseph, owner, stated she was in Haiti when the notice came for the September hearing. Respondent spent $13,000 on the roof and approximately $9,000 on the landscaping, screen, and wiring. City recommended a 10% to 5% reduction. Decision Based on the testimony, Ms. Zalman reduced the fine to $600, plus $730.15 administrative costs. Decision As no one appeared, Ms. Zalman certified the fine of $5,384.12, and continue the daily fine.
