Mr. Rumpf informed the Board that all items that were approved

Also, Mr. Rumpf stated that the Riverwalk Plaza Variance item was
for thirty days at the Commission meeting.

Chairman Wische inquired if staff had anything further to present. Mr. Rurqpf replied
staff had nothing to add. ~
Mr. Schmidt did state that the staff recommendations have changed since thCL last time
the matter appeared before this Board. One of the reasons for the staff cha~ ge is that
Ms. Bradshaw and Mr. Schmidt met with Mr. Rumpf in order to provide th6 City staff
with additional documentation that the City did not have to support the pos[ on of the
petitioner set forth in both matters on the agenda this evening. Based )on that
presentation to staff, the recommendation has changed substantially.
Chairman Wische requested that Mr. Rumpf update the Board on these char es. Mr.
Rumpf stated these changes were made as a result of re-evaluating so, ne of the
circumstances. In addition, some of the information received added to the d,.~finition of
"vested status" with respect to its recognition by the County, the Taxing Aul ~ority, the
age of the units and dealing with "historic" property. Aerial photos were ptilized to
determine when the individual units were constructed as there is no zoning map or
evidence to determine when the units were actually constructed. Originally me. re weight
was being given as to when certain changes were made to the property subs~equent to
the original construction. |
Mr. Friedland stated that he looked at the property and felt that the design fit~ with the
neighborhood and requested that he be allowed to make a motion.

Chairman Wische made the following comments:
Chairman Wische stated that the variance requests an overall reduction of 15Q)0 square
feet and stated he arrived at this figure by doing some mathematics.
Chairman Wische referred to Page 12 of the Petition that was a letter from the
Official of the City, Don Jaeger informing the owner that the property does n

he has been to the site and it is a fine add ition to the neighborhood.

stop running. Mr. Rosenstock asked Mr. Barrera if he would pledge to pay the
violations if this Board approves the annexation. Mr. Barrera stated he wou d agree to

Mr. Myott suggested the word "settle" with the County, Inasmuch as there is a

Mr. Rosenstock stated he was not against a reduction of the fine, but wante
that the fine would be paid. Mr. Rosenstock further stated that in the future
the City requests annexation of property, a title search be done to determine if
any liens on the property.
Mr. Barrera stated that he has tried to comply with the procedures requir~
County, and prior to any fines being imposed upon the property a County
suggested that he annex his property to the City of Boynton. While Mr. Ba~

Although itappears on the agenda as a new master plan, it is in effect replacing an old
expired master plan. Mr. Kilday had the following comments to make regarding the

approved the project. Mr, Rumpf further stated that PUD have landscaping b~ ffers and
if the City did compromise at this point, Mr. Rumpf stated buffers should be az ded as a
condition.
Mr. Rosenstock inquired if the Planning Department can specifically sl ite what
landscaping they require. Mr. Rumpf said this can be worked out with the Petil oner.

Mr. Kilday stated he will begin with the Conditions of Approval and would ike tO address
Condition #9 with regard to parking spaces. There are two types of parking involved.
One is parking lot parking in 0ute~ areas, which provided for the full 27' and the other
parking is garage parking. For garage parking, 27' or more has been provi~led. Mr.
Kilday stated he has two single loaded garages wh ch did not back up to another garage
and are on the side of the unit. The back up distance is 22' and Mr Ki day ~enuP_~t~d

Mr. Kilday agreed to this wording. This issue pertains to the south garages m bu'ld'ngs
16 and 19. Mr. Kilday pointed out the area on the map to the Board and staff.
Mr. Rumpf stated this change is agreeable to staff.
The next condition Mr. Kilday addressed was condition #28 and requested that the
words "If an approved turn around area is not provided" be deleted and make the "t"
capital "T".

Lastly, Item 31 as it relates to the two south buildings, delete the buildings in their
entirety as this issue was addressed in the Master Plan.
Mr. Rumpf requested that the same language regarding landscaping that was a
condition ofthe Master Plan apply to this apProval as well (condition #6 in Item ~.1.4).

walking into an office building with elevators in the interior, which can be multi storage
facilities. These types of facilities are typically utilized by office type user~ for files
storage and the like and by residential users for small household items. Thc space is

To accomplish this goal, the first step is to have a cross reference bhin the

come up with detailed zoning code regulations, which is the text amendmen These

Mr. Kilday stated that Item 7.A. 5. is the actual text amendment and Item 7.,~ is the
actual office/commercial language for the Comprehensive Plan. Under he Text
Amendment there is a second site that Mr. Anderson is proposing to build a Iraditional
storage facility, which is the site located by 1-95. north of Boynton Beach E ~ulevard
which use to be the grainery building which is under the bridge next to Foster )il. With
regard to that location, Mr. Anderson would like to build a mixed-use buildin( that has
some tradition al bay uses, as well as limited access uses.
Mr. Kilday stated that with regard to the C-1, there was a concern that you wa~ to avoid
an over-proliferation of these types of uses and there is a mimmum s~ paration
requirement which is 2500 feet, which equates to one-half mile separation )etween
uses.
Mr. Kilday presented enlarged drawings of the type of building being proposed
approved in Palm Beach County, between North Palm Beach and Pair
Gardens, and was approved by all three entities. Mr. Kilday explained how the

to make a conditional use application, and would have to submit a comple'

The only change Mr. Kilday would suggest to staff's comments in item 3 that the
maximum height of 30 feet be changed to allow for a five foot periphery :o extend
beyond the 30 feet to hide any air conditioning equipment.
Mr. Rosenstock addressed his concerns to the City Attorney and asked when lhere is a
request to revise the Code of the City, how much study has staff and the Cit Attorney
given to the request. Attorney Pawelczyk stated he has not had an opportur ty to look
at the request as he was furnished the package today.
Mr. Ru mpf stated that he wrote the changes with other staff members.
Mr. Myott felt there was a lot of technical information contained in the i'ext Plan
Amendment and does the cry want to encourage more storage facilities ~ the City
limits. Secondly, do we want storage facilities to replace potential office dev~ Iopments
and the like. Mr. Myott also stated that the Board should be presented with st ~tistics as
to how many of these facilities currently exist and what is the potential for futu~ ~ storage
facilities to be built. Mr. Myott stated he did feel there was enough backgrou~ d to vote
favorably on this issue.
Mr. Rosenstock inquired if the Petitioner could wait until more information is made
available to the Board. Also, Mr. Rosenstock requested that the City Attorn6y review
the matter. Attorney Pawelczyk stated he would only review the ordinance w :h regard
to egality and the legal form of the ordinance and not necessarily review th content
unless it is conflicting with the law.
Mr. Rosenstock stated he would like to know just how many units and square 9et exist
in storage facilities and what types of storage facilities currently exist withir the City
boundaries.
Mr. Rumpf also stated he had concerns in reviewing these types of changes and how
this would this relate to future Jand use. Mr. Rumpf pointed out on the nap that
currently there are four locations in excess of one acre classified for office ~nd use.
There are three other locations that are ~n close proximity, since they are wi' fin 2400
feet of each other, one of these sites would be precluded. Mr. Rumpf stated here are
approximately six storage mini-warehouses in the City and these facilities are ot within
2500 feet from the other facilities.
Mr. Kilday stated that currently there are no limited access facilities in the City.

Ali utilities easements shall be shown on the rectified landscaping
drawings so that we may determine which trees may interfere with
utilities. In general, palm trees will be the only tree species allowed
within utilities easements. Canopy trees may be planted outside of the
easement so that roots and branches will not impact those utilities within
the easemant in the foreseeable furore. LDR Sec. 7.5-18.1 gives public
utilities the authority m remove any trees that interfere with utility
services, either in utility easements or public rights-of-way.
Dept. of HRS permits will be required for the water and sewer systems
serving this project. (sec. 26.12).
Comprehensive Plan policy 3C.3.4 requires the conservation of potable
water. City water may, therefore, not be used for irrigation where other
sources are readily available.
Sec. 26-34(E) of the City Code requires that a capacity reservation fee be
paid for this project either upon my request for signature on the Health
Dept. application forms or within 30 days of site plan approval,
whichever occurs first. This fee will be determined based upon final
meter s~ze, or expected demand.
Water and sewer lines to be owned and operated by the City shall be
included within utilities easements. Please show all proposed
easements on the engineering drawings, using a minimum width of
12 feet. The easements shall be dedicated via separate instrument to the
City as stated in Sec. 26-33(a) of the Code.
Approval from Palm Beach County Environmental Resources
