Chairman Wische also introduced Bulent Kastarlak, Director of Developmc Rumpf, Acting Planning and Zoning Director and the Recording Secretary. Wische introduced the Board Members to the audience. 3. APPROVAL OF AGENDA Mr. Dub6 moved to approve the Agenda. Motion seconded by Mr. Myott carried 7-0. 4. APPROVALOF MINUTES Mr. Dub6 moved to approve the minutes of the May 12, 1998 meeting. seconded by Mr. Myott. MINUTES PLANNING AND DEVELOPMENT BOARD BOYNTON BEACH, FLORIDA MAY 26, 1~ COMMUNICATIONS AND ANNOUNCEMENTR, (Mike Rump Planning and Zoning Director) Mr. Rumpf informed the Board that all items that were approved 12,1998 Meeting were approved by the Commission with the excepl Bradshaw Variances that were tabled at the previous meeting. Also, Mr. Rumpf stated that the Riverwalk Plaza Variance item was for thirty days at the Commission meeting. Mr. Reed also inquired as to the status of the updating of the sign and landscal Mr. Rumpf stated he did not have any more information at this time. HopefL will be more information at the next meeting. Mr. Reed also noted that when Mr. Aguila was on the Board, he proposed type of recognition be adopted by the City for property that exhibit~ characteristics, to be announced on a quarterly or yeany basis. Chairman Wische stated that this Zoning Code Variance was before the weeks ago and has been reviewed thoroughly and the material again reviewed for tonight's hearing. Mr. Rurqpf replied staff had nothing to add. ~ Mr. Schmidt did state that the staff recommendations have changed since thCL last time the matter appeared before this Board. One of the reasons for the staff cha~ ge is that Ms. Bradshaw and Mr. Schmidt met with Mr. Rumpf in order to provide th6 City staff with additional documentation that the City did not have to support the pos[ on of the petitioner set forth in both matters on the agenda this evening. Based )on that presentation to staff, the recommendation has changed substantially. Chairman Wische requested that Mr. Rumpf update the Board on these char es. Mr. Rumpf stated these changes were made as a result of re-evaluating so, ne of the circumstances. In addition, some of the information received added to the d,.~finition of "vested status" with respect to its recognition by the County, the Taxing Aul ~ority, the age of the units and dealing with "historic" property. Aerial photos were ptilized to determine when the individual units were constructed as there is no zoning map or evidence to determine when the units were actually constructed. Chairman Wische made the following comments: Chairman Wische stated that the variance requests an overall reduction of 15Q)0 square feet and stated he arrived at this figure by doing some mathematics. Chairman Wische referred to Page 12 of the Petition that was a letter from the Official of the City, Don Jaeger informing the owner that the property does n With the Code. Chairman Wische also stated that a letter from William Building Official dated April 21. 1994 informed the owner that the property brought up to cede. Also, an additional letter from Christopher Cutro, then Pla Zoning Director for the City dated September 22, 1992 informed the owner thc does not comply. Chairman Wische requested clarification from Mr. Schmidt. Mrs. Bradshaw was informed at that time that the property would have to be brought up to code and hired an architect to accomplish this. A site plan was prepared and submitted to the City and was tentatively approved with a few changes The City apProved the site plan, but Mrs. Bradshaw did no~ have the financial means to complete the project. As a result the project was changed so that it could be accomplished in tw( The City approved phase 1 and Mrs. Bradshaw upgraded the property sub The City placed a great deal of requirements for the approva and created s burden on Mrs. Bradshaw. However, Mrs. Bradshaw did comply. One requirements was that parking for both phase I and phase 2 be put in at the phase 1. Also, the City required that she put in a special drainage system, whi include parking for phase 1 and phase 2, and Mrs. Bradsh aw complied. Mrs. Bradshaw for 2 ~ years has been cooperatinglwth the City and has complied with everything the City has requested The only remaining issue is the one befOre the Board this ~vening and one small minor building issue which is that one of the units being used as an apartment building has a ceiling heigh of 6'11" and the building code requires that the minim um ceiling height be 7'. This is a ~ne-inch differential that has to be dealt with later on. Chairman Wische thanked Attorney Schmidt for his presentation and further st, ted that he has been to the site and it is a fine add ition to the neighborhood. Chairman Wische opened the meeting to the public. Lloyd Powell, 112 North Federal Highway, Boynton Beach took the podi[ m. Mr. Powell restated his prewous concerns regarding an apartment house bein¢ on the property. Mr. Rosenstock asked the petitioner if he was aware of any code enforcen-hnt liens against his property filed by Palm Beach County. Mr. Myott suggested the word "settle" with the County, Inasmuch as there is a that the fine could be reduced through negotiation. Mr. Rosenstock stated he was not against a reduction of the fine, but wante that the fine would be paid. Mr. Rosenstock further stated that in the future the City requests annexation of property, a title search be done to determine if any liens on the property. Mr. Barrera stated that he has tried to comply with the procedures requir~ County, and prior to any fines being imposed upon the property a County suggested that he annex his property to the City of Boynton. Mr, Rumpf further stated that PUD have landscaping b~ ffers and if the City did compromise at this point, Mr. Rumpf stated buffers should be az ded as a condition. There are three other locations that are ~n close proximity, since they are wi' fin 2400 feet of each other, one of these sites would be precluded.
