PLEDGE OF ALLEGIANCE Chairman Wische called the meeting to order at 7:03 p.m. and led the Allegiance to the Flag. 2. INTRODUCTION OF MAYOR, COMMISSIONERS AND BOARD MEM Chairman Wische acknowledged the presence of Bulent Kastarlak, De Director; Tambri Heyden, Planning and Zoning Director; and Mike Rum Planner. Mr. Wische announced that Mike Rumpf would be assuming thc Temporary Director of the Planning and Zoning Department beginning May 'ledge of IERS elopment ,f, Senior dut es of 122 1998, due to the faCt that Ms. Tambri Heyden will be leaving her position with the Cil ~/. Chairman Wische introduced the Board Members and the Recording Secreta~: Chairman Wische expressed his appreciation for the water furnished to Members this evening by the City staff. 3. APPROVAL OF MINUTES Mr. Reed moved that the minutes of the April 28, 1998 meeting be approved. Mr. Dub6 seconded the motion and carried 7-0. 5. COMMUNICATIONS AND ANNOUNCEMENTS A. PLANNING AND ZONING REPORT (Tambri Heyden, Planning and Zoning Director) Ms. Heyden stated that late this afternoon her office received a re,quest for a two-week postponement until May 26, 1998 of the public hea~ings for Barbara Bradshaw Zoning Code Variance for the two items on onight's agenda. (Item 7A.1 and 7A.2) Motion Mr. Dub6 moved that the public hearing on the Zoning Code Variance from t ~e City of Boyntc~ Beach Land Development Regulations, Chapter 2 - Zoning, Secti¢ 5.G.2.a (rear and side yard setback) and Request for Variances from Chapter 2 - Zoning, Section 5 G.2.a (dwelling size) in the matter of 658 Manor Drive (Barbara radshaw) be tabled until the May 26, 1998 Meeting. Motion seconded by Mr. P, eed a~d carried 7-0. A. Ms. Heyden stated that at the last Planning and Development Board meeting there were two items on the Agenda relating to Be] Restaurant, one was for abandonment of a special purpose and the other was the gate elevations to be referred back review. Ms. Heyden stated that at the last City Commission mE items were approved. Ms. Heyden also stated that there were two items that had bee the last City Commission meeting that were before this Board 14, 1998 meeting. NEW BUSINESS; PUBLIC HEARING Zoninq Code Variance (South Buffer Wall) Project: Agent: Location: Description: Riverwalk Plaza Lee Starkey 1606 S. Federal Highway Request for variance from the City of Boynton Beach Land Dev. Iopment Regulations, Chapter 2 - Zoning Section 4L-Buffer Walls, to allow a 6 ! Dot high chain linked fence along the south property line in lieu of the required 6 lot high concrete block buffer wall to se 3arate the Riverwalk Plaza from the abutting residential district. Lee Starkey, representing the owners of Riverwalk Plaza, was present to t( Starkey stated that Mike Carey, one of the partners of Riverwalk Plaza present to answer any questions. Chairman Wische inquired if staff had any additional comments they w( present at this time. Chairman Wische inquired if there were any other Board comments. Ms. Hey(]en stated that her office has receved other calls from residents who were opposed to the fence and those persons were encouraged to be present th~s evening. Mr Dubb s~tated that unless Mr. Koch ~s present to substanbate Mr. Starkeys co~nments, this Board cou d not go against Mr. Koch's prior letter requesting ,this Board deny the valiance. Mr. Dub6 inquired if the matter would be referred to thC, Consent Agenda on next Week' s Commission meeting and was told this is the proceioure. Mr. Dub6 stated that Mr. Koch could attend the Commission meeting and ihform the Commission that he has changed his mind and then the Commission can nlJle on the variance. Mr. Starkey stated that Mr. Koch informed him he would appear at the Commission meeting next week and if those two conditions were not a part of the approva he would oppose the variance. Discussion ensued regarding Mr. Koch's conversatior with Mr. Starkey, but this Board can only abide by the facts presented to it. 5 MEETING MINUTES PLANNING AND DEVELOPMENT BOARD BOYNTON BEACH, FLORIDA MAY 12,[1998 Chairman Wische reiterated that if this Board issued a denial this evening should appear before the Commission meeting and the matter could be pulk Consent Agenda for discussion. Ir. Koch off the Attorney Pawelczyk informed Chairman Wische that this Board could conside all facts presented as testimony even if it is not in writing in making a decision. Aisc. Attorney Pawelczyk stated that if the item goes on the Consent Agenda, someone woul have to ask one of the Commissioners to pull the item offthe Consent Agenda for com lents. Mr. Reed stated that he has items A through F, which allow this Board variance request and comments should be restricted to those items. Chairman Wische asked if there were any other Board comments and there b opened the public hearing portion of the meeting and asked for anyone in the who wished to testify, may do so now. Dominic Laria, 5500 North Ocean Blvd., Crown Colony Condominiums. stated that there are five buildings on the premises and Mr. Laria lives in the House. Mr. Laria stated his building is perpendicular to the new Winn-Dixie facility anc the .lights and noise are ever present. Further Mr. Laria objects to the chain link fence and has sent his objections in writing toMs. Heyden. Mr. Laria further stated that putti lg a chain link fence would reduce some of the light intensity, some of the no~se and sc me of the litter. Mr. Laria further stated that there are elderly and infirmed who can not sleep because of the noise and bright lights and object to any actions that would in, rease the noise and the insults that the condominium owners are subjected to from this 1 ~cility. Mr. Laria stated they nave requested that the light intensity is reduced from :he Winn- Dixie store and their response was that four additional lights were installed o that side of the building. The lights are now intolerable. Mr. Laria stated he felt that ~ Jinn-Dixie did not exhibit any sensitivity to the neighbors or the community. Mr. Lark said that some trees have been installed on the property line and it is appreciated, but i has in no way alleviated these problems. There are homeless people and vagrar ts on the property and other deplorable offenses take place 24 hours a day due to thee increase in lighting on the property. Mr Laria stated a wall would help ~educe the~e existing problems and would n fact like to see the height of the wall increased. Mr. L~ria stated they are good citizens of Boynton Beach and their way of life has been impaozed by th s development and fha nked the Board for the opportunity to speak. MEETING MINUTES PLANNING AND DEVELOPMENT BOARD BOYNTON BEACH, FLORIDA MAY 12,11998 Mr. Bu ent Kastar ak the Director of Development asked to address the Meml~ers. Mr. Kastarlak informed the Board that the Winn-Dixie issue was brought to his Department's attention by Ms. Heyden, the Cry Manager and our neighbors in Ocean .R~ge. Mr. Kastadak stated a visit was made to the Winn-Dixie site wi;~h the City's Building Division Manager and although the lights were not on at that time, we were able to c~etermine what ~(he cond tions cou d be at nght. His department is preparing a report tO~ the City Manager regarding the circumstances of their findings and how the I ghtin~l can be reduced; As soon as the report is presented to the City Manager, E will be made available to the public. Mr. Starkey asked to respond to Mr. Laria's comments regarding the wall. M Starkey stated the wall is along the south property line between the shopping cente and the FIND property. Mr. Starkey further stated that the wall would not be visil ~e to the residents of Crown Colony and would have no affect on them. Chairman Wis( ~e stated [hat the meeting should focus on the wall and not be sidetracked. Mr. Rosenstock inquired why the Applicant did not wish to construct a wall. M . Starkey stated they did not want to construct the wall as there is only 2 ¼ feet betweer the edge of the paving and the property line and t ~s very dCf[cult to get a 6 block all with a foundation in that space. Aisc, there ~s an elevation differential between the shopping center property and the FIND property. Mr. Rosenstock inquired as to the difference in elevation. Mr. Starkey sta ~d it was between one foot and 18." Mr. Rosenstock inquired if the Applicant's engineer was familiar with the City Code that requires a wall. Mr. Starkey replied affirmal vely. Mr. Starkey let they were ,b, eing held to a building code that was 30 years old. b r. Starkey staten it would take 24' wide of footing to construct the block wall that wou d )nly allow six inches on either side and is not much room. Mr. Rosenstock inquire, why the applicant needed this space. Mr. Starkey stated they might have to/put more construction in the property. If the surface were flat, there would be nc~ problem. However, when one edge of the footing is a foot to 18 inches above th(~ adjacent ground, there may be a tilting problem. Mr. Starkey stated the wall ~vould be approximately 150' long. Mr. Myott inquired if the applicant could have applied for the variance at an e~ -lier date? Aisc Mr. Myott stated the applicant, if he had applied eadier, could have ~resented engineenng plans that showed the difficulty in installing this type of wall. Mr. Michael Carey wished to respond to Mr. Myott's question and was s, 3rn in by Assistant City Attorney Pawelczyk. Mr. Carey stated he lived at 218 Westmir ~ter Road, West Palm Beact~ and is one of the partners in Riverwalk Plaza. 7 MEETING MINUTES PLANNING AND DEVELOPMENT BOARD BOYNTON BEACH, FLORIDA MAY 12, 1998 With regard to the timing, Mr. Carey stated they could have applied earlier. Thiere have been a number of requests they have tried to accommodate with the heights, Which has affected their decision making. Mr. Carey said that the property drops off thre~ feet into the Mangrove swamp. Mr. Carey was not disputing the reasoning b( 3ind the construct on of the concrete wall, but stated this area ~n question is a spoils ~ rea. Mr. Carey also stated that when the neighbors approached him about screening 'he Winn- Dixie store, 25 and 30-foot trees were planted, costing at least $30,000. Mr. Carey said that the wall would not go down to the water. It would be abou short of the water. The wall would begin about 50' beyond the building westerly. Mr. Carey stated that the fence they would construct would intended purpose of holding back debris and the likelihood of any ~ construction on that .property would be nil. Mr. Carey further stated that if there a likelihood that this property were likely to become residential, he would not the request to construct this fence. Mr. Myott inquired if there was going to be any work performed under the s~ open. Before asking for a vote on the motion presented in this matter, Chairma asked Mr. Kastarlak, Director of Development for the City of Boynton Beach t views on the motion. Mr. Kastarlak stated his Department would be undertak study to update the Industrial Classification System, which had been used in ti some years. This is a Classification System used by the Federal Go' previously known as the Standard Industrial Classification (SIC). Mr. Kastar that the new System has been ~mproved and expanded and when the C institutes this Classification, a presentation to this Board will be made. Attorney Pawelczyk stated Mr. Rosenstock was correct and if the Board appr~oves the use before it this evening and if the Code did change, it would become a non- conforming use.
