MINUTES OF THE PLANNING AND DEVELOPMENT BOARD MEETING HELD IN COMMISSION CHAMBERS, CITY HALL, BOYNTONBEACH, FLORIDA, ON TUESDAY, NOVEMBER 12, 1996, AT 7:00 P.M. PRESENT J. PLEDGE OF ALLEGIANCE Chairman Dub6 called the meeting to order at 7:05 p.m. The Pledge of Allegiance to the Flag was recited. 2. INTRODUCTION OF MAYOR, COMMISSIONERS AND BOARD MEMBERS Chairman Dubb introduced the members of the Board. He advised that Ms. Frazier will be sitting at the dais as a voting member later in the meeting since Mr. Eisner will be leaving because he is ill. In the absence of Mr. Hill, Mr. Reed sat at the dais as a voting member. 3. AGENDA APPROVAL No additions, deletions, or corrections were made to the agenda. Motion Vice Chairman Golden moved to approve the agenda as presented. Mr. Aguila seconded the motion, which carried 7-0. 4. APPROVAL OF MINUTES No additions, deletions, or corrections were made to the minutes of the last meeting. MINUTES PLANNING AND DEVELOPMENT BOARD BOYNTON BEACH, FLORIDA NOVEMBER 12, 1996 Motion Mr. Aguila moved to approve the minutes of the October 8, 1996 meeting. Vice Chairman Golden seconded the motion, which carried 7-0. 5. COMMUNICATIONS AND ANNOUNCEMENTS A. Report from the Planning and Zoning Department 1. Final Disposition of Last Meeting's Agenda Items Ms. Heyden reported the following: Boynton Festive Center Landscape Appeal - Approved by the City Commission subject to all staff comments. Boynton Commons PCD Site Plan Approval - The Planning and Development Board recommended that several comments be removed or reworded and a couple be added regarding additional landscaping and screening. Prior to the City Commission meeting, the Fire Department reexamined their comments and deleted the one regarding the access to the rear of the Sports of Authority. With regard to the turning radius behind Bed, Bath and Beyond and the other tenants in that area, there was a typographical error in their memo. It was supposed to say, "diameter", not "radius". Therefore, the p~ans were acceptable as drawn However, they still felt they needed rear access to that area. Therefore, the applicant agreed to locate the standpipes at the corner and screen them with shrubs. Burger King Site Plan Approval - The City Commission approved this subject to all staff comments and recommendations, in addition to the following: The design elements of the building will be the model for future outparcels in that shopping center. The City Commission wants the mansard extended all the way around the flat roof building. Therefore, we will expect that of Discount Auto Parts and the outparcel to the north of it, which was supposed to be Wal-Mart. Wal-Mart has backed out, so we do not know who that tenant will be. Boynton Common PCD Parking Lot Variance - Postponed. The variance may not be needed. We are working out some one-way issues on how to get access. MINUTES PLANNING AND DEVELOPMENT BOARD BOYNTON BEACH, FLORIDA NOVEMBER 12, 1996 Flowers Bakery Warehouse/Distribution Center Abandonment Commission approved this subject to staff comments. The City Riverwalk Shopping Plaza Abandonment - The City Commission approved this subject to staff comments. Jonathan's Grove Abandonment - The applicant tried to address the drainage ~ssue by certifying that the drainage could still be handled within a reduced easement width. However, he withdrew the application. 6. OLD BUSINESS A. Public Hearing Rezoning (Postponed from October 8, 1996) Project: Agent: Owner: Location: Description: East Ridge PUD W. Keith Grant John A. Grant, Jr., Inc. Gary De Graf De Graf, Inc. East side of the intersection of N.E. 4th Street and N.E. 20th Avenue Request for master plan approval for 33 single-family units in connection with a rezoning of 5.01 acres from R-3 to PUD (Planned Unit Development) with a Land Use Intensity of 7.00. W. Keith Grant with John A. Grant, Jr. Engineers and Land Surveyors, and Gary De Graf, the owner and developer of the property, were present. Mr. Aguila referred to Comment 21 and said the 2'6" is width of the buffer, not height of the buffer. He asked if Mr. Lewicki is suggesting that there be a buffer between the railroad and the development. Mr. Lewicki answered a~firmatively and said he is suggesting there be a 6' high buffer. Mr. Aguila pointed out that this is not what Comment 21 states. Comment 21 assumes that the 2'6" is a height: Mr. Lewicki suggested eliminating the word "increased" so that the comment reads, "It is recommended that.., the height of the 3 MINUTES PLANNING AND DEVELOPMENT BOARD BOYNTON BEACH, FLORIDA NOVEMBER 12, 1996 proposed 2'6" landscape buffer along the eastern property line be 6 feet." Mr. Aguila pointed out that you cannot buy landscape material at a nursery that is already 6 feet high. Mr. Grant had no objections to any of the staff comments. With regard to Comment 21, the applicant's intent is to plant a hedge that will mature to 6 feet in height and be maintained at that height. Chairman Dubb referred to Comment 16 and asked where the applicant is going to put the guest parking. He did not see any place to put it. Mr. Grant stated that he did not notice '~his comment. He said two parking spaces, one in the garage and one in the driveway, will be provided for each house. Chairman Dub~ asked if the roads are private and if the homeowners' association is responsible for maintaining them. Mr. Grant answered affirmatively. Motion Mr. Wische moved to approve the request for master plan approval for 33 single-family units in connection with a rezoning of 5.01 acres from R-3 to PUD (Planned Unit Developmentl with a Land Use Intensity of 7.00 for East Ridge. Mr. Aguila seconded the motion and clarified that with regard to Comment 21, it is understood that the information shown on the plan for landscaping is that they are going to provide a 2 1/2 foot landscape buffer with hedges of 36" inches at planting time, and the hedge wiJl be maintained at 6 feet when it reaches that height. Mr. Wische agreed to include this in the motion. Chairman Dubb asked how the applicant is going to put in guest parking when there is no place to put it. Mr. Aguila pointed out that Comment 21 does not even indicate how many guest parking spaces staff wants. The motion carried 7-0. (Mr. Eisner previously left the meeting.) The Board left Comment 21 for staff tO work out. No one in the audience wished to speak on this item. 7. NEW BUSINESS A. Nortech Warehouses, Inc. 1314 Neptune Drive Request to construcl a 125 foot high monopole communication tower and conversion of approximately 360 square feet of an existing warehouse to an equipment room Mr. Lewicki circulated several photographs of the site. Chairman Dub~ read a note from William F. Koch, Jr., agent for the owC~er of the adjacent property (Pelican Estates) to the west of the subject property, in opposition to granting the conditional use for the 125 foot tower until he has had the opportunity to evaluate its construction and effect on Pelican Estates. Jill darkesy represented BellSouth Mobility. She introduced Kevin Ratterree from Kilday and Associates. Chairman Dubb asked if this request has been discussed with the neighbors. Ms. Jarkesy said it has not. Discussion ensued regarding whether or not Mr. Koch was notified of this request in a timely fashion. Ms. Jarkesy stated that when this application was submitted two months ago, the applicant provided a courtesy property owners' notification which was prepared for mailing and submitted to the Planning and Zoning Department. She said it is up to staff to send out those courtesy notices. However, all that is legally required is a publication in the newspaper, and that was done. She has not heard from this property owner; however, he was on the list of property owners to be notified. Ms. Heyden pointed out that.Mr. Koch is the property manager. She suspected that the reason he just received notification of this request today is because he is the agent for the owner. The notification goes to the owner and it probably took some time to get to him. Chairman Dub6 pointed out that Mr, Koch can appear before the City Commission to object to this request. Ms. Jarkesy requested a copy of Mr. Koch's note. She will talk to him tomorrow morning to address his concerns before the City Commission meeting. Ms. Jarkesy sa~d BellSouth Mobility has had a lease with this property owner for nearly a year. In March, 1996, Mr. Ratterree's office met with staff to submit and prepare the application for zoning. At that time, itwas referred to the City Manager's Office and placed on an agenda. Subsequent to that. the City Commission decided to work on a new 5 MINUTES PLANNING AND DEVELOPMENT BOARD BOYNTON BEACH, FLORIDA NOVEMBER 12, 1996 ordinance. In a spirit of cooperation, the applicant agreed to withdraw this item from the agenda and looked at the City map to discuss possibly locating this to City-owned property. There is a public ownership site to the north of this site. It is outside our search area and did not work in terms of our radio frequency requirements. That is County-owned property and even if it were to fait within our search area and has the proper zoning, it is not a City site. BellSouth Mobility has an antenna on a City park and expects to work with the City in the future on City-owned sites. Th is particular site was the only property that would work. She submitted an engineer's certification which indicates the searc~ area was and why this location was necessary. It is at the very northern limits of the search area. Mr. Ratterree po nted out that the property to the west of the subject property is a vacanl parcel of land. Ms. Jarkesy agreed to all the conditions of approval. No one in the audience wished to address this item. Motion Vice Chairman moved to recommend approval of the conditional use to construct a 125 foot high monopole communication tower and conversion of approximately 360 square feet of an existing warehouse to an equipment room, subject to staff comments. Mr. Aguita seconded the motion. Mr. Rosenstock said the issue of an antenna has come before the City Commission and this Board for manY years. He felt it is bad enough that we have some located in our area. He stated that the City Commission has repeatedly requested that antennas be placed on the same towers that are presently available, if possible. He felt it is detrimental to the Cityls appearance and wondered how many more towers we are going to allow and where they are going to be. He cautioned the citY Commission to set a strict policy and not perm:it towers ~lly-nilly throughout the City in the future. Ms, Jarkesy stated that this is an industrial area and is surrounded on all sides by the M-1 zoning District. Mr. Rosenstock asked how far away you can see the antenna, He expressed concerned about the people who can see a 150 foot antenna sticking up in the air and the lightiflashing at night, Ms. Jarkesy agreed to construct this monopole to accommodate another user. She pointed out thatlthe City s current ordinance is very restrictive. 6 MINUTES PLANNING AND DEVELOPMENT BOARD BOYNTON BEACH, FLORIDA NOVEMBER 12, 1996 Mr. Rosenstock asked if there is anything in the Code that states that when the technology changes, these people have to take their towers down. Ms. Jarkesy agreed to execute a removal agreement that if the applicant ever ceases to utilize the antenna, it will be removed. She pointed out that this is a County requirement. The motion carried 6-1. Mr. Rosenstock cast the dissenting vote. 2. Project: Agent: Owner: Location: Bescription: lTV Tower Agustin A. Hernandez The School District of Palm Beach County Palm Beach County School Board 505 South Congress Avenue Request for conditional use approval to co-locate private telecommunication equipment/antenna on an existing School Board telecommunication tower. Mr. Lewicki circulated several photographs. Chairman Dub6 stated that the piece of property south of Congress Middle School, commonly known as lTV, is one of the biggest eyesores in the City. In addition, the County and the School Board had promised to remove the satellite dish, which has not been used in years. He said the County Road Department moved to Boynton Beach from Boca Raton and dumped fill, barricades, and jiffy johns there. He felt the School Board thumbs its nose at the City and does not care about Boynton Beach. He pointed out that we are the only City on this coast in the County that does not have a high school. Mr. Hernandez, Planning Specialist for the School Board of Palm Beach County, is aware that the City has requested the School Board to remove the satellite dish, to do some landscape buffering of the lTV site, and to remove the maintenance equipment and the stockpiling of fill materials. Mr. Hernandez said he is working on relocating the Maintenance Division and their equipment and materials to a new site on Ranch House Road just south of Southern Boulevard. It should be ready for occupancy shortly after the first of the year. He referred to a letter dated September 26, 1996 from Larry Zabik, Assistant Superintendent, and said Mr. Zabik has gone on record to commit to the removal of the dish, that Division of the Maintenance Department, and the materials by April, 1997. Our telecommunications partners do not want to be partners on a site that is aesthetically displeasing. We are preparing to move expeditiously on the removal of the dish. Our Landscape Division has started to plant Palm trees there. The proposal before the Board tonight includes a hedge in both north and south directions and around the proposed new enclosure. The neage will be allowed to grow up 6 feet high and will be maintained at that MINUTES PLANNING AND DEVELOPMENT BOARD BOYNTON BEACH. FLORIDA NOVEMBER 12. 1996 height. The dish will be removed before we appear with another request for any type of antennae in the City. Mr. Rosenstock asked for a commitment in writing regarding the removal of the equipment and the plantings. Mr. Hernandez said there is a group that has to stay in this end of town to take care of the schools in the Central and South Counties. We are going to relocate the group responsible for the schools in the north area to our new site on Southern Boulevard. He said his words are on the reoord, in addition to Mr. Zabik's letter. Chairman Dubb pointed out that the letter only mentions the dish and estimates removal will be accomplished by April 1, 1997. He said he would notapprove this request without removal of the dish and fence. In addition, he wanted landscaping. Mr. Hemandez was willing to remove the fence at the same time that the dish is removed. Mr. Wische stated that the equipment and debris have been there for years even tough the City has constantly requested its removal. He asked how we can believe the School Board now. Mr. Hernandez stated that we have acquired asite that has the proper zoning to accommodate industrial materials and ,estimated t~at it will be ready for occupancy the first part of the year One of the new Superintendent s ~op priorities is to be good neighbors with our citizens. Mr. Hernandez said he will do his best to keep his word to have the dish and fence removed after the first of the year and relocate that Maintenance Division to the qew headquarters. Mr. Rosenstock asked when he needs the antenna installed. Mr. Hernandez said it needs to be installed immediately. Mr. Rosenstock stated that the Palm Trees that were planted do nothing to stop the view of all the horrendous equipment in the rear. He recommended that the Board not grant this request until all the conditioris are met. Mr. Hernandez had all intentions of fulfilling the conditions and asked for time to get a salvage crew ou~ there and remove the dish. He knows the citizens of Boynton Beach have been h;urt; however, he pointed out that by delaying the partnership with this telecarrier, thestudents will be hurt. The revenues generated from this will go to that lTV to enhance reception and delivery to the school centers. Mr. Hemandez requested approval to move forward with attaching the antenna to the tower, and promised to fulfill all staff's conditions. He advised that the last time they were ready to remove the dish, they could not find the scrap value to keep their books straight. Tonight he has the assistance of a telecarrier firm with expertise in this area, and they have assured him that they will find an expertise who knows the salvage value so that he can MINUTES PLANNING AND DEVELOPMENT BOARD BOYNTON BEACH, FLORIDA NOVEMBER 12, 1996 hand it over to his audit and budgeting departments, declare the dish salvage, and have it hauled out of there. He advised that it is not being saved for future hookup because the technology is antiquated. Steve Hoffman from the law firm of Mastriana and Christiansen represented Sprint Spectrum. He said the landscaping comments will be taken care of immediately, and he offered to:move the satellite d sh to another site. He advised that the antenna is needed immediately and he cannot.~fford to wait to install it u~til the equipment is moved. Mr. Rosenstock asked when Mr. Hernandez started negotiating with Sprint to install the antenna. Mr. Hemandez said approximately four months ago. Mr. Rosenstock asked why landscaping has not been put in there and why the fence and dish have not been removed within the last four months. Chairman Dub6 suggested removing the dish before this matter goes to the City Commission on Tuesday. Mr. Aguila wanted the words "It is recommendation that" removed from Comment 3. He felt it should be a requirement, not a recommendation, n addition, he wanted the words "a slatted, 6 foot high chain link fence" deleted from Comment 7 because that type of fence does not look nice and the slats end up getting pulled out. He suggested that the applicant present the City Commission with a full detailed plan showing exactly what the applicant intends to do. He felt the applicant needs to look at the entire site that the School Board controls, not just the part around the satellite dish. He felt the landscape that was added to the south side of the drive should be continued the entire length of the east property line to shield all of the parking and the maintenance equipment. Motion Mr. Aguila moved to approve the request for conditional use approval to co-locate private telecommunication equipment/antenna on an existing School Board telecommunication tower at lTV, 505 South Congress Avenue, the lTV tower location owned by the School Board of Palm Beach County, subject to all staff comments with the following conditions: The wording, "It is recommended that" in Comment 3 be removed; The wording, "a slatted, 6 foot high chain link fence or" be removed from Comment 7; and The applicant provide a detailed, entire site cleanup and landscape plan to the City Commission. 9 MINUTES PLANNING AND DEVELOPMENT BOARD BOYNTON BEACH, FLORIDA NOVEMBER 12. 1996 Vice Chairman Golden seconded the motion, which carried 4-3. Messrs. Rosenstock and Wische, ano Ms. Frazier cast the dissenting votes. B. Site Plans New Site Plan Project: Agent: Owner: Location: Description: Carmax at Quantum Park PID James G. Willard Quantum Associates, Inc. Lots 77, 78, 79 and 80 - Quantum Park, High Ridge Road Request for site plan approval to construct a 53,072 square foot auto sales facility on 13.678 acres in Quantum Corporate Park. Jim Willard, Attorney for Quantum Associates, introduced Paul McClellan and David Seaman representing Circuit City, and Rocky Biby and David Risinger of Kimley-Horn & Associates. Mr. Willard asked for permission to discuss Item 7.B.2 before Item 7.B.1 because it affects all of Quantum Park and the Carmax site plan, and when the Carmax site plan comments are discussed, several of them will not be relevant. Motion Mr. Rosenstock moved to switch 7.B.2 to take precedent over 7.B.1. Mr. Wische seconded the motion, which carried 6-0. Ms. Frazier was away from the dais. Major Site Plan Modification .¸ Project: Agent: Owner: Location: Description: Quantum Park (peripheral greenbelt and modified PID sign program) Roscoe Biby Kimley-Horn & Associates, Inc. Quantum Associates, Inc. Northwest and southwest corners of the intersection of 1-95 and Gateway Boulevard. Request for approval to establish landscaping specifications for the PID peripheral greenbelt and modify the approved sign program to include two (2) multiple I0 MINUTES PLANNING AND DEVELOPMENT BOARD BOYNTON BEACH, FLORIDA NOVEMBER 12, 1996 business wall signs located at the northwest and southwest corners of the intersection of Gateway Boulevard and High Ridge Road/Park Ridge Boulevaro and one (1) multiple business freestanding s~gn located on the east side of Lot 91. Several drawings of Quantum Park, the location of the peripheral greenbelt, the lots owned and controlled by Quantum Associates, the lots that have been sold, the 25 foot and 40 foot landscape buffer plan, and the primary s~gns that were requested as an amendment to the Quantum Park sign plan were displayed. One was the project identification and anchor tenant identification sign proposed at the corner of Gateway and 1-95 on Lot 91. This is a curved monument type sign. A wall sign is proposed at the southwest corner of Gateway and High Ridge. Mr. Willard said there are a number of Carmax site signage on the Carmax site that are being considered as part of an amendment to the overall Quantum Park sign plan. Mr. Willard confirmed for Chairman Dub6 that the wording on the toll signs at 1-95 is identical. Mr. Willard advised that two monument signs, one on the northwest corner and one on the southwest corner as you enter the Park on Gateway, were previously proposed. However, the one on the northwest corner is being eliminated because it is not necessary, and the size of the other one will be reduced from 9 1/2 feet to 6 feet, as recommended by staff. In addition, there was a proposal by Carmax for a pylon s~gn on the Carmax project. In consideration of the request for the Carmax identification on the major 1-95/Gateway s~gn, the applicant would withdraw the request for the pylon sign on the Carmax site. Comments 2, 3, 4, and 5 Mr. Wiliard had no objection to Comment 1. He said Comments 2, 3, 4, and 5 are repeated numerous times and reference objections to the height, size, and character of the signs as advertising off-premises. He contended that Quantum Park is a Planned Industri¢l District, and the Planning and Development Board and the City Commission have the flexibility to grant changes to the master sign p~an. Comment 2 states that the proposed 75' pylon sign is 55 feet taller than the 20 feet permitted by the Land Development Regulations. Mr. Willard said the reason for the height of the s(gn is twofold, One, it is proposed to be on the southeast corner of Lot 91, which is abeut 25 feet below the crown of the ramp at 1-95 and Gateway; There are also many 11 MINUTES PLANNING AND DEVELOPMENT BOARD BOYNTON BEACH, FLORIDA NOVEMBER 12, 1996 trees there. The reason for the height of the proposed s~gn is to get the signs above the trees, and the reason for the size of the letters is to provide readability at 1,000 feet so that cars traveling on 1-95, especially southbound traffic, can see the sign and identify the etters. In addition to the identification of Quantum Park, there will be up to three major users within the Park. With respect to the issue of off-premises advertising, it is suggested that the word "premises" be defined as the entire Park. Mr. Willard said this is clearly a master plan, a Planned Industrial District, and he did not see any reason for limiting the interpretation of premises to Lot 91. He believed that identifying users within the Park is not off,premises For this reason, if the Board approve the signs, Comments 2, 3, 4, and 5 would have to be rejected. Comment 6 Mr. Willard would like to insert the words "if any" in Comment 6 so that it reads, "The appropriate agency ... buffer plans to make sure the vegetation meets the criteria of each agency, if any, if the vegetation is planted within their easements and/or right-of-way." He said staff is concerned that the landscaping to be constructed in the peripheral greenbelt area meets the requirements of the South Florida Water Management District, the Lake Worth Drainage District, and power companies to the extent they have such criteria. He did nol mind advising these agencies what he intends to plant, and if they have requirements, he will meet them. Comment 7 Mr; Willard would like to change the "Quantum Park Association" to "Quantum Community Development District,' (the CDD). He advised that maintenance obligations of all common areas in the Park, including the road system, the stormwater drainage system, and the landscaping, is all handled by the CDD. Comment 9 This comment mirrors comments 2, 3, 4, and 5. t2 MINUTES PLANNING AND DEVELOPMENT BOARD BOYNTON BEACH, FLORIDA NOVEMBER 12, 1996 Comment 10 Mr. Willard asked that this comment be deleted because QuanTum Associates does not own Lot 90A. That lot was sold to Tri-Rail and he did not have the ability to put the sign there. Comment 14 Mr. Willard requested that the last sentence of this comment be deleted. He proposed that the sign face of the freestanding sign be illuminated with internal lights focused on the sign face. He did not believe it is appropriate to illuminate it with external lights. Comment 17 and 18 Mr. Willard said these comments are the same. They ask for foundation landscaping around the base of the freestanding s~gn. He did not believe that ~s necessary or appropriate at this time. No one is going to see it. It is heavily wooded. At the time that lot develops and is site planned, it is likely that the grade of the lot would be raised and it would oe appropriate to landscape the base (~f the sign at that time if any of the existing vegetation is removed. He asked that these comments be deleted. Comment 19 Mr. Willard requested that "Quantum Park Property Owners Association, Inc." be changed to "Quantum Park Community Development District". Comment 20 Mr. WiIIard said this refers to the wall sign that is proposed for the corner of Gateway and High Ridge. The one on the northwest corner will be eliminated, and the height of the other one will be reduced to 6 feet. He asked that this comment be modified. Mr. Aguila noticed that the plan indicates that the monument sign has an overall height of 9' 5". He pointed out that the overall height is to the top of the arch, which is more like 12'. Mr. Risinger said if we are reducing the dimension from 9'5" to 6', then the center arch would be another 1 '6" tall. The height of the sign was 11'. t3 MINUTES PLANNING AND DEVELOPMENT BOARD BOYNTON BEACH, FLORIDA NOVEMBER 12, 1996 Comment 22 Mr. Willard asked that this comment be deleted. This comment asks that the color currently approved for the background of the individual lot monument signs be added to the wall structure trim. Mr. Willard does not believe it is necessary to do that. Comment 25 Mr. Willard would like to change the "Quantum Park Property Owners Association, Inc." to "Quantum community Development District". Comment 27 Mr. Willard would like to delete the second sentence in this comment. He proposed that the lights be internally illuminated, not back-lit or ground lit. Comments 35 and 37 The first sentence in Comment 35 states to submil a survey of each perimeter lot shown on sheet B1. Mr. Willard advised that every ot is platted and he did not want to do individual surveys. Mr. Haag said this survey shows where the easements are on the lot. Florid a Power and Light will not have any regulations or requirements. All they will have is some recommended planting materials for their easements. The applicant has not shown on the plan where the perimeter greenbelt will be. Because the scale is large, you cannot tell where the greenbelt starts and where it ends. He believes it starts at the lot line and works its way n towards the project 25 or 40 feet. Mr. WiIlard said that is correct. Mr. Haag stated that on the survey or on the platted lots, you are going to encompass some of the South Florida Water Management District right-of-way and some Florida Power and Light and Southern Bell easements, which are going to make it very difficult to plant the material shown. He was not necessarily looking for a survey, but a plat would show where all the easements are. He believes that the applicant will not be able to plant that 25 or 40 foot buffer when you fall under the restrictions of South Florida Water Management and FIodda Power and Light. Mr. Willard was not worried about Florida Power and Light or Southern Bell. Comments 35, 36, and 38 are somewhat related ane pertain to the manner in which the greenbelt is constructed and maintained. He did not object to Comment 38 because it states, "It is 14 MINUTES PLANNING AND DEVELOPMENT BOARD BOYNTON BEACH, FLORIDA NOVEMBER 12, 1996 recommended that the approved perimeter greenbelt landscaping be installed on a perimeter lot by lot basis." As each perimeter lot comes ~n for approval, we would have a site plan identifying the perimeter 25 or 40 foot and any easements that are located on it. If the approved plan was prohibited by the South Florida Water Management District, then an alternative would have to be evaluated at that time, which would include pushing it further into the lot. There are some perimeter lots that are on canals and there may be South Florida Water Management District easements that encreach into part of that area. But whether it is on the slope or bank of the canal or on the surface makes a difference as to whether they are going to object to what is planted there. As those lots come in for approval, we would like that te be considered at that time. The same goes for the 1-95 lots. Mr. Willard did not think it ~va.s necessarY to identify every eaSement of every agency today and.get permission in advance, when some of then~, with the excePtion of the S~uth Flodda water Management District, do not have the authority to dictate what s p anted there Mr Willard didnot want to do the survey or identify all the easements today. Mr. Haag disagreed wholeheartedly. He referred to the lots adjacent to Dos Lagos and saidthere is a Lake Worth Drainage District equalizing canal E-4. He was in possession of a~cdpy of the plat Showing a dedication for right-of-Way that is 87 feet w de That 87 feet is on .the appliCant's lot. That means the first 87 feet has been dedicated in an ordinance or iB the official record boors to Lake Worth Drainage District. Mr. Haag believes the applicant is not going to have any ability to do anything within that area. Mr. Willard said the "A" lots are basically the canal because they did not have any right-of- way af that time. It was platted and dedicated on the plat for drainage purposes. Not all of the 87 feet is in the canal. He agreed that when these lots come in for development we are going to have to go to the top of the canal and we may encroach into the easement and ,have another 25 feet coming into the lot. He will do that when the site plan comes in. Mr. ~/illard did not object to Comment 36 provided it is clarified to state, "at the time of individual lot construction". He pointed out that the last sentence in Comment 36 states that if the proper buffer is not obtained with the buffer plan that the outside agencies and utility users approve, the new submittal may require shifting the greenbelt out of the easement. He requested that Comments 35 and 37 be deleted. MINUTES PLANNING AND DEVELOPMENT BOARD BOYNTON BEACH, FLORIDA NOVEMBER 12, 1996 Comment 39 Mr. Willard advised that we have shown the tree spacing of the Date Palms that are to be located on 1-95 at 60 foot spacing. We believe that because of the size of Date Palms as well as the existing vegetation and other plantings that are in the peripheral plan for the 25 foot cross section, the 60 foot spacing ~s appropriate. Mr. Rosenstock pointed out that the applicant would only need four additional Date Palms because of the 50 foot spacing. Chairman Dub6 recognized the presence of Dale Sugerman, Director of Human Resources/Assistant City Manager, in the audience. Aisc, at this time, Mayor Gerald "Jerry" Taylor arrived. Mr. Aguila pointed out that this area is along 1-95. At 65 miles an hour, 60 feet spacing ~s probably appropriate on 1-95. Comments 40 and 41 Mr. Willard requested that the last three sentences in Comments 40 and 41 be deleted. and that "40 foot on center" be changed to "60 foot on center". Mr. Haag advised that these are andscape requirements. Mr. Willard said when we talked about interior property lines as part of the perimeter greenbelt plan, we are not trying to dea~ with interior lot lines. If that is already in the landscape code. when a site plan comes ~n, we will have to comply with whatever the code says at the time. Aisc, we did not want to do a site plan for each perimeter lot until such time as it is proposed for development. Mr. Aguila suggested deleting everything from the end of the comments starling with "The design of the 25 foot peripheral greenbelt is acceptable, .. He said it deals with perpendicular lines to the greenbelt that are no1 part of this issue. These requirements can be addressed at the time of individual site plan approval for the individual lots. Mr. Haag said this comment attempts to say that the peripheral greenbelt landscaping can also be used for the vehicle use area screening. Mr. Aguila stated that that becomes a site planning issue. Ms. Heyden advised that we are trying to establish consistency. From now on, we will allow those kinds of landscaping requirements to be applied to the greenbelt and landscaping. Mr. Willard objected to these comments to the extent that they require current site plans for each perimeter lot. If these comments are only intended to imply that at the time of the perimeter lots development, a site plan would show it, then he had no objection. 16 MINUTES PLANNING AND DEVELOPMENT BOARD BOYNTON BEACH, FLORIDA NOVEMBER 12, 1996 Comment 45 Mr. Willard said this comment deals with the proposed pylon sign on the Carmax site, which will be deleted in the event the 1-95/Gateway sign ~s approved. Mr. Haag asked about the wall sign. Mr. Willard said the sign on the northwest corner will be deleted and the one on the southwestwill be reduced in height. Mr. Haag stated that [he condition for the pylon sign on the :Carmax site is linked back tO the 75 foot tall sign. Mr. Willard agreed that there is sufficient Oarmax identification so they do not need an on-site pylon sign if their name is going to be on the 1-95/Gateway sign. If the 1-95/Gateway sign is disapproved, we wish to have a 30 foot on-site pylon sign. Ms. Heyden asked if Mr. Willard is proposing any freestanding signs along 1-95 or on any of the other lots.. Mr. Willard said he is not proposing that. The only lots we currently have a development plan for is Carmax. We would eliminate their sign and attempt to eliminate pylon signs upand down 1-95~ However, there may be a user that needs one. Comment 46 Mr. Willard asked that the first sentence in this comment be deleted. If the 1-95 sign is approved, then the first sentence stays. If it is not approved, we would like the pylon sign. Comment 47 Mr. Willard would like this comment deleted. Ms. Heyden advised that the Quantum Corporate Park sign is no longer illuminated and asked if Quantum Park plans to relight it. Mr. Willard did not know, but will find out. Comment 48 Mr. Willard said this comment relates to the on-site Carmax pylon sign in the Florida Power and Light easement. This sign may be eliminated if the other sign is approved. If it is not eliminated, it Will either be relocated or a release from Florida Power and Light will be obtained. Comment 49 Mr: Haag pointed out that a sentence was omitted from this comment. After the third sentence, the following sentence should be inserted: It is recommended that the proposed 17 MINUTES PLANNING AND DEVELOPMENT BOARD BOYNTON BEACH, FLORIDA NOVEMBER 12, 1996 monument sign be amended to comply with the current project identification sign regulations. Mr. Willard said this particular comment focuses on a Carmax monument sign on High Ridge. Carmax is proposing to use its standard corporate color scheme (the yellow, white, and blue sign face). This comment appears to be inconsistent with Comment 46, which States that the light grey color of the proPosed pylon sign structure and the blue background of the sign face with yellow and white text are consistent with the Carmax corporate colors and comply with the color limitation specified in the Community Design Plan. Mr. Haag said we are trying to create uniformity within the PUD's internal road system so that all of the signage is the same. Mr. Willard understood the purpose of this comment; however, he requested the Carmax corporate colors. Comment 51 Mr. Willard asked if this comment is directed to a specific s~gn other than the Carmax monument sign on High Ridge. Mr. Haag advised that it is also directed to the directional s~gn further north. Mr. Willard confirmed that anything that can be seen from High Ridge P, oad is to be changed to the green Quantum standard colors. Mr. McClellan did not agree with this comment. He said there is a comprehensive sign plan for the overall site with consistent colors throughout the site. Mr. Aguila did not generally have a problem with the greenbelt plan and proposal. rvlr. Haag advised that with regard to the greenbelt, the applicant wishes to omit comments 35 and 37, and modify Comment 39 to state "60" foot instead of "50" foot. Motion Mr. Aguila moved to approve the greenbelt as submitted, subject to staff comments, with the following conditions: Eliminate Comments 35, 37, and 39. and delete the portion in Comments 40 and 41 that does not directly deal with the greenbelt. Vice Chairman Golden felt there are some valid points in Comments 35 and 37, and he had a problem eliminating them. With regard to Comment 37, Mr. Aguila pointed out that the applicant is only going to be able to dc what they are allowed to do by the various agencies. Ms. Heyden advised that South Florida Water Management District is very vocal 18 MINUTES PLANNING AND DEVELOPMENT BOARD BOYNTON BEACH, FLORIDA NOVEMBER 12, 1996 and allows basically only grass. She wanted it understood that that part in the greenbelt does not just go away. It gets shifted. Mr. Willard pointed out that this is addressed in Comment 36. Mr. Rosenstock seconded the motion. With regard to Comment 35. it was agreed that the platted document would be suitable, instead of doing a separate survey. The motion carried 7-0. Mr. Haag addressed Development Department Comments 2 through 5. He said these are code regulations and staff cannot change them. He said Mr. Willard feels "premise" should be considered all of Quantum Park rather than each site. One of staff's recommendations was to reduce the 75' tall sign and use the overpass as ground zero so that the sign height would start at the elevation of the overpass. It is approximately 35 feet from 1-95 to the top of the guardrail. Mr. Rosenstock asked how high the sign would be above the roadway. Mr. Haag said it would be 20:feet, which is the maximum the code allows. He believes the power poles on Lot 91 are 75 feet tall a. nd that the sign would be the same height. Staff wants nothing on this sign but"QuantumiCorporate Park". Staff does not want tenants identified on it. Staff wants it to be a project identification sign similar to the one that runs parallel to 1-95. Mr. Willard asked if the City would agree to the trimming of the pine trees if the sign was reduced to 60 feet. He said the only reason for the height of 75 feet was so that the panels would be legible from the Interstate. Ms. Heyden pointed out that this lot is going to be cleared when it is developed, so those trees will not be there. Therefore, the sign could be lower. Mr. Haag summarized. The sign should be 75 feet tall and should only say "Quantum Corporate Park". In addition, the area is way above what is allowed by the Code. You can only vary 25 percent of the area. The top of the sign would be a maximum of 20 feet above the top of the interchange at that area. The measurement should be from the guardrail up. Mr. Willard said the sign is based on the letters for legibility from 1-95, which is a uniq Je circumstance in the City. The off premises is a very logical interpretation based on the definition of premises in the LDR and the fact that you have a Planned Industrial District. 19 MINUTES PLANNING AND DEVELOPMENT BOARD BOYNTON BEACH, FLORIDA NOVEMBER 12, 1996 Mr. Willard confirmed for Mr. Aguila that there will be no more than three users identified on the sign. Vice Chairman Golden asked if other types of signs have been considered. He associated this sign with a truck stop or gas station. He stated that Quantum is a special project. It ~s not a commercial strip or light industrial center along 1-95. It is an upscale project. He felt something a little more uniquewould be appropriate there. Mr. Haag believes the width is due to Florida Power and Light lines being very close to [-95. Mr. Willard said the applicant has no need to build that sign if it is limited to "Quantu Mr. Haag addressed the wall signs. He said the applicant omitted the s~gn on the northwest corner and is willing to reduce the size to 6 feet. The center projection would be 18" above that. Staff has a problem with the off-premise sign because it contains users that are not on that specific lot, and the area is above code requiremerrts. The sign for Carmax alone is 77 square feet, and only 64 square feet is allowed for freestanding signs. Mr. Willard said beca, use of the reduction in the height of that panel, it will go below the 64 square feet. Mr. Haag said it will meet the Code requirements of 64 square feet per sign. However, the applicant still wants two additional s~gns. Mr. Willard said this is a curved sign and will be located atthe corner of Gateway and High Ridge. The Carmax logo would have the left end panel with an arrow because they are located south on High Ridge. It would serve as a directory sign for cars exiting the IntersTate at Gateway. We would have a space for two other users to give them prominent identification at the main entrance of Quantum Park. Mr. Haag stated that if the three signs are approved there, the lettering, style, and color will be consistent, and they would be more sophisticated than the signage for Carmax. With respect to the two on-site monument signs on High Ridge and the sign in question, Mr. Willard said the monument structure itself (the materials around the perimeter and the wall) would mesh with tt~e existing Quantum color scheme and materials, and the panels would be the corporate panels and cotors for the particular users. A significant portion of the signs would tie into the existing Quantum signs. He did not intend to replace all the existing signs. With regard to some of the signs, it seemed to Vice Chairman Golden that we are moving in the direction of a shopping center instead of a corporate park. Mr. Aguila felt we are going in the wrong direction if Mr. Willard is talking about a green, metal sign with the Carmax insert instead of a stucco and cast stone curved wall monument sign. Mr. Haag's concern was making the signage consis:ent for all three of the panels. 20 MINUTES PLANNING AND DEVELOPMENT BOARD BOYNTON BEACH, FLORIDA NOVEMBER 12, 1996 Mr. Aguila asked if the applicant would agree to equally reduce the width of the sign. Mr. Risinger advised that the length of the wall will be reduced. Mr. Aguila asked what the individual signage is being constructed of and if it is going to be lit. Mr. Risinger said the design notes on the drawings indicate that three panels would be accommodaled when the wall is built. If the other two panels are not used for some period of time, the wall will be completed with drivit panels or stucco veneer and will be internally illuminated. With regard to the big pylon sign, staff made-some comments about foundation landscaping. Mr. Haag did not see how the applicant is going to put up that sign without disrupting lhe vegetatidn around it. Mr. Aguila suggested making them aware that they should take proper care not to destroy that vegetation until they are. ready to develop that site and make some remedial repair if they do. He pointed out that foundation planting on an undeveloped site is going to die. Chairman Dub6 asked for, a consensus with regard to the lighting of all signs. Mr. Aguila said it makes Sense to in[erior light the signs. It is one less thing for people to vandalize and you do not have to deal with the pro!ection of light beams. Ms. Heyden agreed to this. Mr. Haag said there are no problems with the Carmax signage except for whether the 75 foot sign ~s going to be there or not. He believes the applicant agreed to comply with staff's comment and change the monument sign to green, but still wanted the cabinet internally illuminated. Mr. McClellan had a problem with the green on the monument sign at the south end because the green color clashes with his logo. He proposed to do a h!gh quality sign and use the materials of the wall sign and a neutral background. Chairman Dubb stated that this defeats the ;purpose of having all the signs the same. Mr. McClellan asked if a new sign could be created in the park for major users. Vice Chairman Golden asked if there ~s any way to tie into those s~gns some of the pinegreen color. Mr. Willard advised that it could be put on the other signs. Mr. Haag asked if the applicant is going to omit the pylon sign on the Carmax site with the green with the 20 feet above the crown of the road. Mr. Willard answered affirmatively. Motion Mr. Wische moved to approve the pylon sign, 60 feet, with the trees trimmed so they can see it, with only three reader boards on the Quantum Corporate sign Mr. Rosenstock seconded the motion. Comment 42 Mr. Willard said staff is concerned that the PID use approval.required that the vehicle storage area be Iimited to 15 percent of the site. It has to do with a zoning code provision in the RID section that says outside storage is limited to 15 percent of the site. It was Mr: Willard's recollection that as discussed with the Board in July, this is a staging area that 22 MINUTE S PLANNING AND DEVELOPMENT BOARD BOYNTON BEACH, FLORIDA NOVEMBER 12, 1996 nvolves inventory of the vehicles on the site; a service/staging area that clearly exceeds 15 percent of the site. Mr. Wische recalls agreeing that it was a staging area, not a storage area. Ms. Heyden explained that it was approvec meeting the code. Mr, Willard rec uested that this be deleted. Comment 43 Mr. Willard said this concern is more specifically addressed in Comment 61 and asked that it be deleted. Mr. Lewicki said there was a statement on the site plan regarding the screening. He would like tosee a detailed drawing of it as proposed by the engineer and which meets the standard that this Board and the City Commission approved. Mr. Aguila wanted a chain link fence with an epoxy coating and a hedge that will be allowed to grow to a height of 5 or 6 feet. Mr. Willard said it will be opaque. He will provide more detail. Mr. McClellan said he had no desire for the publicto see into that area. Comments 44 and 45 Mr. Willard requested that the word "shall" be changed to "may". Because of the sandy soil, he anticipated that there will nol be many trees that will be able to be relocated. Chairman Dub~ pointed out that it states, "The trees which can be relocated...". Therefore, if they cannot be relocated, the applicant does not have to move them Comment 46 Mr. Willard said this comment has been met. He has submitted the letter, and there is no micro-site proposed on this site. Comment 47 Mr. Willard requested that this comment be deleted. It refers to the greenbelt plan that has been discussed earlier in the meeting. Comment 48 Mr. Willard believes that there has already been a reference n this report to the acceptance of 187 parking spaces as adequate. Vice Chairman Golden advised him to just change the calculation. 23 MINUTES PLANNING AND DEVELOPMENT BOARD BOYNTON BEACH, FLORIDA NOVEMBER 12, 1996 Comment 50 Mr. Willard said this co mment relates to screening the equipment on top of the building. The Interstate is east and he did not think anyone can see it from there. To the west, there is a tremendous amount of existing landscaping in the berm along High Ridge. and there ~vill be more landscar)ing in the parking lot itself. Mr. McClellan said you are going to have a tough time seeing the building as it is. Mr. Aguila said we are trying to avoid seeing a compressor sitting on the roof that is 5 feet up m the air right at the edge of the parapet. If the equipment is center and the parapet is high enough, there will be no problem. Comment 51 Mr. Wiltard requested that the back of the service area and dumpster enclosure not be required to be landscaped. Mr. Biby explained that it would serve no purpose. The landscaping would be virtually out in the middle of pavement, and he was trying not to have maintenance in that area. Mr. Lewicki had a probtem with this request because it would be in violation of the Code. Chairman Dub~ said it makes sense with what they want to do. Comment 54 Mr. Willard requested that this comment be deleted. It deals with the spacing of the perimeter trees which was addressed in the peripheral greenbelt plan. Ms. Heyden pointed out that this comment states, "This requirement is not met at several locations." Mr. Haag advised that this is against the right-of-way of High Ridge Road. Mr. McClellan agreed to add more trees ttnere if that is an issue, Mr. Lewicki explained that it has been agreed that the spacing of the trees along 1-95 would be 60 feet. However, they have to be spaced 40 feet on all other locations facing all other rights-of-way. Mr. Willard agreed to this comment. Comment 55 Mr. Willard requested that this comment be deleted. It deals with hedges along the right- of-way. 24 MINUTES PLANNING AND DEVELOPMENT BOARD BOYNTON BEACH. FLORIDA NOVEMBER 12, 1996 Comment 57 Mr. Willard said there is an easement in favor of the Community Development District to get to the big Quantum Corporate Park sign on 1-95. It is in the declaration of easements covenants restrictions for Quantum Park. Mr. Lewicki pointed out that it did not show up on the survey or the site plan. Mr. Willard will note :it on the site plan that there is an access easement to the ODD for maintenance of the Quantum Corporate Park sign on Comment 58 Mr. Aguila asked who is going to maintain the greenbelt. Mr. Willard said the CDD would take responsibility. It is going to be primarily imposed on individual ot owners, and the CDD will have an easement and right to go onto the property and maintain it if the lot owners do not. This right will be given to the CDD in the existin¢ declaration of easements, covenants and restrictions. Comment 60 Mr. Willard said this item was already discussed and can be deleted. Comment 67 Mr. Willard said this deals with the concern that the Fire Department and Public Works have for egress from the property for fire trucks and big trash trucks. It was agreed that their concerns about turning radius and access could be satisfied if a third driveway were designed for exiting movements of fire and trash trucks. We have designed that into a revised site plan which we would amend. The definition defines access and access ways. If it is not a principal ingress and egress to the site, then it is not an access. Therefore, we think an exit only driveway for public service type trucks ~s not an access and does not require a variance. Mr. Willard requested that this comment be deleted. Ms. Heyden said she has discussed this with the City Attorney and the Director of Development, and a variance is needed. She said a variance allows adjacent property owners to be notified, and we cannot waive their right to be notified, Mr. Willard said we are the adjacent property owner. Ms. Heyden disagreed. 25 MINUTES PLANNING AND DEVELOPMENT BOARD BOYNTON BEACH, FLORIDA NOVEMBER 12, 1996 Comment 68 Mr. Willard said this comment deals with overhead doors. He displayed elevations of the Carmax building and said the west elevation, which faces High Ridge, has overhead doors. He requested an administrative variance because there is no other place to put the doors. Mr, Aguila asked hew high the doors are. Mr. McClellan believes they are about 10 feet. Mr. Aguila asked about the landscape material on the street. Mr. McClellan said there are trees and a continuous hedge on the street. He offered to put in more treesto help screen it. Mr. Aguila asked how high the '~rees will be at planting time on High Ridge. Mr. Willard said they will be 8 to 10 feet. In addition, there are existing trees in the median. Mr. Willard advised that instead of the split face block originally proposed on the outside of the building, ©ircuit City wants to use a cast in place tilt-up construction panel that will mucn better withstand the wind loads. Mr. MCClellan said for economic purposes, it would boa concrete oanel that!will be finished with a textured paint or stucco so it would look like a masonry wall. Ms. Heyden was not prepared to respond to this request since this was the first time it was mentioned. Mr. Aguila would like wheel stops at every parking space in the customer and employee parking area only. Motion Mr. Aguila moved to approve the request for site plan approval to construct a 53,072 square foot auto sales facility on 13.678 acres in Quantum Corporate Park, Lots 77, 78, 79, and 80, for Carmax at Quantum Park, subject to all staff comments with the following modifications: Delete Comments 42, 43, and 47. 55, 60, and 68. Comment 51 - remove the wording in the last sentence that states "along the back". Recommend to the City Commission approval of the third driveway to solve the Fire and Public Works access ~ssue. The monument sign on the southwest corner of the site be redesigned to match the previously approved monument sign for High Ridge on Lot 65B with regard to architectural style, feature, colors, materials, and textures. 26 MINUTES PLANNING AND DEVELOPMENT BOARD BOYNTON BEACH, FLORIDA NOVEMBER 12, 1996 The pylon s~gn on the southeast corner of the site be deleted if the 60 foot or so sign on 1-95 is approved by the City Commission. Provide concrete wheel stops in the three rows of the employee parking area. Mr. Rosenstock seconded the motion. Vice Chairman Golden stated that he voted against the use approval and is going to vote against the site plan to be consistent. With regard to the on-site monument sign that is going to be redesigned, Mr. Willard advised that Comment 49 is concerned with the sign area. He proposed to leave the sign area the same size. Mr. Aguila had no objection as long as the size of the sign does not exceed the Code requirement. The motion carried 6-1. Vice Chairman Golden cast the dissenting vote. Cottrell The Tradewinds Group North side of the intersection of Wootbright Road and S.W. 8th Street Request for approval to modify the approved sign program to include freestanding and wall signage for outparcels and main building tenant(s). Ms. Cottrell and Michael Morton, the property owner, were present. Ms. Cottrell said her firm had done some work for RaceTrac regarding the application for site plan approval extension. RaceTrac was approved a number of years ago and just got moving on this site a year and a half ago. They had received their site plan approval, submitted for permits, and only after submitting for permits for their signs were they made aware that the signs had never been approved as part of their site plan application package. They have not been issued permits for signs for the RaceTrac facility. One small, freestanding sign exists, but it is temporary and it will not be in place once the permit signs are approved. In addition, there are no wall signs on the building. All of the signage at RaceTrac is temporary. They were given a temporary permit for the freestanding sign so that they could display their prices. When the application for the sign package was put together, the Building Department commented that in order to receive approval for the s~gns, the applicant would have to 2? In the meantime, the developer nas secured contracts with several other tenants at that site. This application is a modification to the master signage program for the PCD and includes those new tenants in the overall package. This is an attempt to present a sign program that indicates the existing approvals, what is proposed for RaceTrac, and what is proposed for future tenants Who have been contracted to:develop on these sites. The sign program that has been submitted for RaceTrac is consistent with the development that already exists with respect to colors and architectural appearance. In addition, there is a request to approve the signs for Discount Auto and Burger Kir~g. The application includes Wal-Mart s~gns; however, that contract has not been executed. Therefore, the Wal-Mart signs will be eliminated. In addition to the request for the master sign program modification, the applicant made a request for awaiver of the Community Design Plan requirement that limits the number of colors that can be at the site. Staff has indicated that the applicant is inconsistent with Community Design Plan guidelines regarding the style of the signs and the style of the lettering, ltwas Ms. Cottrell's Understanding thal it was agreed at the TRC meeting that the, applieant:~vould not be requiredto submit applications for waivers for those two items. She felt the applicant is consistent with the requirements for a consistent lettering style which exempts nationally registered copy. She advised that alt the signs are nationally regis~eredicopy~ and the~cabinet style that has been selected was approved with the Home D~0t. H~m~ Depot ha~s two cabinet styles--the cabinet and the channel letters. All of the sigr~s: indicate channel letters. She felt the applicant is consiStent with what has already been approved. For this reason, only one waiver ree Jest was submitted. Mr. Roser~stock stated that Mr. Morton presents something different every time he appears before the Board. He would like to see an overall concept of what these signs are going to look like. Ms. Cottrei! said this application :attempts to do just that. Part of this project is su,bject tO separate settlement agreements r~f litigation. She said the overall concept of this d,~veloPment has changed frown what was originally presented. Mr. Rosenstock asked Mr, Morton if he would be willingto put into writing that there will be no overall signage along Woolbright Road to cover all the tenantsto the north. Mr. Morton said this project is not an ordinary shopping center like the one on Hypoluxo Road and Congress Avenue. This is a shopping center of box type users and small ou~parcets. RaceTracis a national user. /t has its own identity and owns it own parcel and, therefore, is looking for its sign identification. Cracker Barrell ~s a national chain and has its own identity. Burger King is.a~ chain.and has adjusted their building design to meet the criteria of some of the commerits that were presented earlier. It is a very nicely designed building 28 MINUTES PLANNING AND DEVELOPMENT BOARD BOYNTON BEACH, FLORIDA NOVEMBER 12, 1996 and very acceptable, t is different that RaceTrac and Cracker Barretl. Home Depot has been there since 1990. t is a big box. It is the same type of Home Depot that is built in over a thousand locations throughout the country. If Wal-Mart would have come here, it would have been a typical Wal-Mart slore. Al of these parcels are not part of a cohesive shopping center as was originally, generically planned. The 1986 master plan did not get implemented and approved until 1990. It was a generic plan and at that time, if all those buildings were interJ:onnecteC there would be a cohesive sign program. However, th s is a series of outparceis~ Remaining on this parcel is an outparcel to the north o4 D ~sceunt Auto. Mr. M~rton hopes t~ present a plan for this parcel in the.next two weeks. The only thing left in the shopping,center would be the 14 1/2 acres that Wa -Mart was supposed to occupy. Chairman Dubb referred to the monument and pylon signs on page 4 and said those are basically all the signs, with the exception of the unknown tenant who is probably go~ng to want a sign. Mr. Morton said the only signs that are not on the plan would be a sign that would be on the wall of the third outparcel and the signs that will be on the wall of the 14 1/2 acre site that Wal-Mart was supposed to occupy. Chairman Dub~ asked if there is going to be one big sign With all the tenants on it. Mr. Morton said there will not be a massive sign for every tenant in this project. Mr. Aguila asked if Mr. Mor~on is going to submit a typical design of the shape, stature, and design elements of all the different pylon signs so that there is at least some continuity in the deSign. Mr. Morton stated that the cont nu ty does not exists because it is a series of outpa~cels. On the west side of 8th Street there are two outparcels (RaceTrac and Cracker BarrelJ). RaceTrac is proposing to put in a sign on the fascia of the enc osure The r package is a little different and stands off to the side. RaceTrac and Cracker Barreil are on one side of the street and are apart from this center. Even though a common property owner~ deyeloped all qf this:property, 8th Street bifurcated this property and separated RaceTrac.and Cracker Barrell tO one side. Mr. Morton said Burger King has asked for a pylon sign. Discount Auto is putt ng up a monumeni sign, not a~pylon sign. He felt we should try to keep the continuity with regard to the size of these signs. He f:elt the third parcel in that outparcel should also maintain contini~ity iwith regard itc the si~ze of the signs. Tonight, he was trying to establish the necessity f~or more than tWo Co ors, n add t on to the b ack and white, so that the tenants can have their corporate, ogos RaceTrac is using colors that are going to be used on the other Side of the street as well. Therefore there will be some commonality. The only extra color t!at RaceTraC w~r~is is grey in their signl which matches their building. The red and yellow!colors willr be used on'he other side of,the street. Discount Auto has red and yellow. Mr. Morton promised to keep the color continuity when the third parcel is done. Vice Chairman Golden thought Discount Auto's typical colors are were grey and yellow. Mr. Morton said they typically have a yellow background with red letters and a grey building. The grey building Will be the same color as RaceT~a_c. Ms. Cottrell said the red, yellow and grey colors do not have the exact manufacturer s specifications, but they are very close, Mr. Rosenstock stated that Mr. Morton has not presented some kind of diagram and complete description of ail the signs he is requesting the Board to approve this evening. Mr. Morton said the ink is still wet on the Burger King approval and they are still trying to finalize getting all their ducks, in a row to get their permits pulled. The plans for Biscount Auto were submitted to the Planning Department this morning. He would be happy if the Board made a decision on RaceTrac and Burger King, and he will return with Discount Auto. Mr. Aguita accepted the fact that all the tenants are going to want their corporate signs. However, he asked that there be some continuity with the design of the cabinets that house the different corporate images. Mr. Morton agreed with Mr. Aguita. He said the Discount Auto monument sign should be of the same cabinet size that wilt be approved for Burger King. Ms. Cottrelt said staff requested that the yellow on RaceTrac be changed to an orange yellow color: She felt the orange is not going to be compatible with the red that is in the rest of the signs. Item 7. B,4 Mr. Morton agreed to delete the color green, as requested in Comment 1. However, he requested that Comment 2 be deleted and that RaceTrac be allowed to keep the grey in their sign. Ms: Cottrell said the only grey is in the cabinet for the monument sign. The reason grey was selected was because it matches the building. Staff is recommending that it be changed to white; She felt the white would stand out more. Mr. Morton added that the Discount Auto building is going to be grey to match the RaceTrac building. Ms. Cottrell requested that Comment 3 be deleted. She advised that the dark blue selected for RaceTrac was to match Wal-Mart. The only dark blue being proposed is around the channel letters. Royal blue was originally approved for the overall sign concept for the shopping center. It exists above the Home Depot sign on the pylon, and may be replaced in the future. Mr. Morton stated that if he changes the pylon s~gn in the future, he witl use dark blue instead of royal blue. Mr. Morton was agreeable to having the locations of the signs approved for Discount Auto, but tabling the size and colors of Discount Auto and the third outparcel. Ms. Heyden advisedthat this Board does not havethe ability to do that. In addition, she opposed doing this. She said the COlor yellowis going to be key to Discount Auto and it is better for them to know it now while the site plan is in process. Motion Chairman Dubb passed the gavel to Vice Chairman Golden and moved to approve the Community Design Plan appeal for Shoppes of Woolbright revised sign program, subject to staff comments with the following modification: Delete Comments 2 and 4, and change Comment 3 to dark blue, leaving the royal blue that is on the Home Depot sign. The royal blue on the Home Depot sign is to be changed to dark blue if it is ever repainted. Mr. Aguila seconded the motion, which carried 6-1. Mr. Rosenstock cast the dissenting vote. Item 7.B.3 Mr. Morton agreed to Comment 2, except with regard to the sign that has no tenant. He said Comment 3 should be eliminated. When the master plan was originally approved, there were two pylons signs on Woolbright Road on the plan. With regard to Comment 4, he said the Burger King site plan has various sign components that are shown on the plan. Ms. Heyden advised that Comments 3 and 4 can be eliminated because staff has made a similar comment that is more specific. Mr. Morton requested that Comment 13 be deleted because there are no other stores. Therefore, this comment is not applicable at this time. Ms. Cottrell advised that Comment 17 relates to the Community Design Plan and a single sign;style. Originally, two (channel and cabinet) were approved. Ms. Heyden stated that the original approval allowed them to use either on one building. Chairman Dub6 said the applicant would have to do that in the future if he wants to use something other than the channel letters. Chairman Dub6 said Burger King does not have to change its letters. Therefore, Comment 18 can be deleted. Ms. Heyden stated that it was not clear to staff whether Burger King's letter style was actually a trademark. Mr. Morton will provide verification of that. With regard to Comment 19, Mr. Morton stated that two signs have been approved as part of the orig~nat plan. Ms.. Heyden said she has documentation show ng that only one was approved. She advised that staff has not been able to predict when the master plan will be approved. The master plan is being held up byDQT andother reviewing agencies. Ms. Heyden revised this comment to read that this can be postponed to, plat approval for Parcel 2. Mr. Haag added that it is hinging on the median cut leading into Burger King. With regard to Comment 22, Mr. Morion agreed to move the Burger King sign from Woolbright Road to 8th Street. Therefore, there will only be two pylon s~gns on Woolbright Road. Motion Vice Chairman Golden moved to recommend approval of the major site plan modification for the Shoppes of Wooibright request for approval to modify the approved sign program to include freestanding and wall signage for outparcels and main building tenants, subjec! to staff comments with the following exceptions: Delete Comments 3, 4, 13, and 15, and reword Comment 20 to postpone to platting of Discount Auto. Mr. Morton said he does not have any control over what staff does with his plan. Ms. Heyden advised that staff just received the median plans 30 days ago.
