Via the City Clerk's Office, Mr. Golden asked that the word "vacancy" be added
between the words "office" and "rates" in the second paragraph on page 5.
Motion
Vice Chairman Dub~ moved to approve the minutes of the January 10,
as amended. Mr. Weigle seconded the motion, which carried 4-0.
5, CONNUNICATIONS AND ANNOUNCENENTS
1995 meeting,
Ms. Heyden announced that the next regular Board meeting is on February 14,
1995. In addition, the City Commission is having a Code Review Workshop on
February 16, 1995, and the Board was invited to attend.
With regard to rewriting the platting laws, Mr. Hukill advised that we are accu-
mulating the land development regulations, which is going to be workshopped on
February 16, 1995. The members of this Board will be sent the proposals for
that, and he encouraged them to attend that meeting.

Mr. Hukill stated that we have had quite a lot of activity with respect to plats
in the last 60 to 90 days, and there are several more coming forward. Scanning
the records to see what had been going on in Boynton, he discovered that there
were no plats in 1991. In 1992, there were a total of three, which generated
only 84 lots. There were two in 1993 that generated 98 lots, and there were two
in 1994 that generated 208 lots {Quail Run Villas and Jonathan Groves, both of
which are under construction).
Mr. Hukill advised that this evening we are dealing with approximately 450 plus
single family homes and 250 plus apartment units on four plats. Another 600
units have entered the process and will be coming back to the Board. Therefore,
it would appear that in another year or so, there is going to be an awful lot of
building activity. This totals around t,300 units (half apartments and half
single family homes). Mr. Hukill told the Board this to put them on notice that
activity is beginning to increase in the City. He stated that plats do not
always end up being develooed communities, but if these do, there will be a lot
of activity coming forward.
Mr. Hukill advised that the Board has previously seen all of the plats on
tonight's agenda. They have been before the Board as master plans, site plans,
etc.
He reminded the Board that a couple of months ago, we were trying to shorten the
platting process for the applicants and a variety of ways to do this were con-
sidered. These plats before the Board this evening, come as preliminary plats,
according to the Code. However, in reality, they are close to being final
plats. These people essentially have completed plats. In most cases, land has
been dedicated or land dedication fees have been paid, bonds have been posted,
and fees for the required developments have been paid. Therefore, they are
pretty much ready to go straight to the City Commission for approval.

Citrus Park is a plat that came to this Board some time ago. It is a develop-
ment north of the school on La~rence Road, on the east side. It contains
approximately 115 single family homes. They are ready to go. However, they are
short one thing before going to the Commission. One of these developers is
short County Health Department approval. One of them is short abandonment of an
easement that there is some drainage running across, and the Citrus Park PUD is
short property owners' association approved documents. Those requirements have
to be met before proceeding.
Chairman Lehnertz noticed that the City Engineer recommended accepting the
develloper's fee in liieu of land dedication. He asked if this is for park
facilities that normally would be required. Mr. Hukill advised that it was.
Chairmen Lehnertz aske~ why {his recommendation was made. He felt we need parks
in this residenti~al area.
Mr. Hukil] explained that the developer has the option to dedicate land or pay a
fee. The Recreation ?d Parks Department makes a judgement call as to whether
they have met their li.s~ of criteria for getting a reduced fee in lieu of land
dedication. In ~his Particular case, they either did not have sufficient land
to dedicate for a park, or they opted not to.
Mr. Hukill believed that several years ago, before any of the Citrus develop-
m~n~s were there~ a park was included~ He did not know happened to that. He
sta~ed that in their ~Qans, the Nautica development has included a park across
the street.
Ms. Heyden stated that when Citrus Park originally came through for rezoning,
the original master plan included a dedicated park site. About 1½ to 2 years
later, they came back with a substantial deviation to their master plan and they
rezoned the property, had a new master plan approved, and deleted the public
park site. At that time, the City Commission decided it was acceptable to
accept a fee in lieu of the land.
Ms. Heyden advised that the City is broken down into neighbhorhood planning
areas. An inventory has been taken regarding the public park sites in each of
those areas. This inventory included the size, what is in those parks, and
potential park sites to acquire in that neighborhood planning area to satisfy
any deficiency in recreation. There are a couple of sites that we will be
acquiring that serve this particular planning area. One of them is on the
Nautica plans.
Chairman Lehnertz recalled that Citrus Glen

Mr. Hukill stated thatlin 1989 or 1990, when the school property was being
purchased, the intention was to combine the Citrus area park with the school

site. However, the development did not move quickly enough to make that come
out when the school was going on line. Therefore, the Sch~el Board purchased
additional land east so that the school site goes farther east than what was
originally intended.

Mr. Hukill stated that the Vinings is a development north of Home Depot. It is
part of the original Woolbright PUD. It contains approximately 252 apartment
units. It is approximately one-half of the to~al apartment development that
Trammell Crow is proposing for that area. There has been considerable
discussion about a road north of Home Depot that would run east and west. It
has sometimes been referred to as Morton's Way~ This property is directly north
of that. This applicant is filing two separate plats, one of which is before
the Board, which will be developed separately from the other one. The applicant
will utilize the master drainage plan from the previous PUD. The applicant has
gone through the process relatively quickly. The only significant holdup they
have is the abandonment of an easement. The storm water from south of the prop-
erty where Home Depot is, currently runs over land. It goes through a pipe part
way, comes out of the pipe, goes over land, and ultimately lands in the lake.
There is an easement on the pr~i~erty where theapptica~t wishes to build. In
the past week, they have put un~:er conlstruction closure on that underground
drainage system. As soon as that water is pullin~ through that drainage system,
that easement will be released. It will then be able t~ be abandoned and the
plat will go forward. Bettina Scherer of Trammell Crow was present. She esti-
mated that this will occur in about three weeks, MP. HUkill advised that this
will, therefore, probably be on the February21, 1995 Cqty Commission agenda.

Vice Chairman Dube stated that the Board has seen this several times in the past
year. He noticed that staff is recommending approval subject to outstanding
staff comments. He pointed out that the staff comments are not attached to the
backup material as they normally are. Mr. Hukill advised that most of the com-
ments have been ironed out. He believes there are only two or three comments
left.
Ms. Scherer stated that the site plan and master plan have been approved. The
only remaining comments to address on the plat are the drainage and homeowners'
association documents.

Mr. Weigle moved to approve the request construction plans and preliminary plat
for construction of infrastructure, landscaping, and private recreation to serve
252 rental apartments in connection with a previously approved planned unit
development for the Vinings at Boynton Beach - Phase 1, located on the east side
of S. W. 8th Street, approximately 1,400 feet north of Woolbright Road, subject
to all Staff comments. Vice Chairman Dube seconded the motion, which carried

Mr. Hukill stated that Nautica is the Boynton Nurseries project. Like the
Vinings, the applicant has split it into two pieces. Howevers, there are two
differences. This one is divided into lots, and both plats are being submitted
simultaneously.
Mr. Hukill reminded the Board that this is the development with the smaller
lots. In many cases, the side lot lines are "Z" shaped. It has its own
recreation facilities. It has a collector road that enters at Citrus Glen. It
lines uP with Citrus Glen on one side, goes through the development, and winds
around to the south. That would be a City street. The rest of the streets in
there are privately owned. There is an access for emergency vehicles to the
west out of Plat II.
JOhn Dl~lond of 8531 Sun Up Trail in BOynton Beach represented the neighbors to
the West of this property. Initially, they had some concerns about density and

the fact that there was riot a heOge or a screen of some sort. They discussed
with the developer. The developer agreed to put up a hedge with a chain link
fence to try to preserve the integrity of their area. Mr. Diamond submitted a
copy of a Petition signed by residents of White Feather Trail. This Petition
states that the builder will erect a chain link fence and plant a Ficus
Benjamina hed9e along the property line. (This Petition is attached to the
minutes of this meeting.)
Chairman Lehnertz advised Mr. Diamond ~hat this will be taken into consideration
When the site plan comes belh3re the Board.
In response to Mr. Hukill, Mr. Diamond advised that nothing has been signed yet.
The neighbors and the developer are still discussing how far the plants are
going to be planted on center. However, they are close to an agreement.
Mr. Weigle asked if we could get something for the record from the applicant,
stating that he agrees to negotiate with these homeowners as far as a chain link
fence and hedge.
Rick Costello with GL Homes stated that he does not yet have anything in writing
or of record. This issue just came to his attention last week. He confirmed
that they are close to an agreement, He stated that this is a voluntary coali-
tion of homeowners. They endeavored to get the Petition signed at the appli-
cant's request so that when it comes before this Board for the site plan, the
Board would know that the applicant had negotiated with all of the neighbors as
a group. The applicant has agree~ to install a five foot high chain link fence
anda berm. The City Forester has signed off on Ficus as the plant material.
What remains is finalization of the documentation.
In response to Chairman Lehnertz, Mr. Costello estimated that the site plan will
come before the Board in March or April.
Chairman Lehnertz stated that he would appreciate it if some type of a native
plant Or xeriscape type of hedge is useO instead of a Ficus hedge. Mr, Costello
advised that Ficus was proposed as the solution because it is very dense and the
homeowners were con=ern~ ~bout security and privacy.
In response to Vice Chairman Dube, Mr. Costello stateo that this would be the
entirety of the western boundary. It would be the two western sections that run
south and north, as well as the section that borders to the north.
In response to Mrs. Frazier, Mr. Costello stated that these houses will probably
cost between $100,000 and $140,000.

Chairman Lehnertz stated that he has received some negative feedback from the
City Commission and he does not appreciate it because feels that this Board is
doing an exceptional job.
Chairman Lehnertz stated that there was an article in the Palm Beach Post within
the last week that stated that as part of their Comprehensive Plan, Palm Beach
County would like to limit or restrict growth out west and encourage growth in
the eastern part of the County, Chairman Lehnertz stated that all the
infrastructure is in the eastern part of the County, it is easier to support
people, and it costs less.
He stated that the City is allowing three plats, with close to 1,000 living
units, in the western part of the County. These three plats are all zero lot
line and Z type homes with high density compared to what there should be. He

felt the City has gone about this entirely wrong and they have been dOing that
