I. CALL TO ORDER
Hilary Zalman, Community Standards Special Magistrate, called the Hearings to order
at 9:15 a.m., and explained the magistrate’s role and the hearing procedures. Pursuant
to Florida Statute, all orders are appealable to the Circuit Court in Florida and not the City
Commission. Also, that a fine will be imposed if the violation(s) are not corrected by the
deadline.

Officer Guim presented the case, which was a citizen complaint. Initial inspection date
March 13, 2018. This is a Red Tag issued by Building Department, and is not a repeat
violator. Initial notice issued July 24, 2018. Thirty days were given to comply. Certified
Mail sent September 28, 2018, green card signed October 22, 2018. There is one window
fixed in front, the remaining violations still exist. Last inspection was November 16, 2018.
City recommended 60 days from printed order for compliance, or $75 a day.
Administrative costs $634.12.
Jacqualine Smith, authorized agent for company, stated initially was not aware pulling
permits were required and has since been trying to locate contractor/subcontractor with
license to do so and has been taken advantage of. Now has a reputable contractor who
can get permit and thought the work could be completed within 60 days. However, Robert
Cody, Plans Examiner to Inspector, testified that typical timeframe would be six months,
or 180 days, at the outside. Discussion ensued amongst City staff. Plans have been
submitted and are still in plan check. The property is currently vacant.
Decision
Based on testimony, Ms. Zalman ordered 180 days from date of printed order or $75 a
day, plus admin fees of $634.12.
Case No. 18-1156 Arturo Dominguez & J Hernandez

Building permit required for fence back yard and side yard.
Officer Weixler presented the case, which was a citizen complaint. Initial inspection date
May 7, 2018. Not a repeat violator. Courtesy notice issued May 17, 2018. Thirty days
were given to comply. Certified Mail sent October 18, 2018, green card signed October
31, 2018. Date last inspected was November 20, 2018, and there has been no application
for the fence. City recommended 30 days from printed order for compliance, or $25 a day.
Administrative costs $634.12.
Arturo Dominguez, owner, testified via translator Officer Guim. The respondent
understands the violations on the property, but states a company was used to pull permit
for the fence. Respondent has had problems with neighbor claiming encroachment on
property, so decided to remove the fence. Now has contracted with company to put the

fence back up. Ms. Zalman noted there still has been no record of the permit being pulled.
Respondent agreed to the stipulations as explained.
Decision

Officer Guillaume presented the case, which was a citizen complaint. Initial inspection
date August 16, 2018. Not a repeat violator. Initial notice issued via courtesy notice.
Fifteen days were given to comply. Certified Mail sent October 5, 2018, green card signed
October 12, 2018. Last inspection was November 21, 2018. City recommended 30 days
from printed order for compliance, or $50 a day. Administrative costs $634.12.
Po Ying Sem, owner, received instructions from Ms. Zalman and Mr. Woods on the
process of acquiring a permit for the AC unit and the compliance stipulations. There was
a language barrier, however, respondent claimed to have not received the certified mail
and the signature on the green card was not hers. Mr. Woods explained the procedures
to the respondent and how to resolve the matter.
Decision
Based on testimony, Ms. Zalman ordered 30 days from date of printed order or $50 a day,
plus admin fees of $634.12.

Officer Hart presented the case, which was a citizen complaint. Initial inspection date
March 8, 2018. Not a repeat violator. Initial notice issued March 8, 2018, via verbal
notice. Thirty days were given to comply. Date notice sent by Certified Mail was October
5, 2018, green card was dated October 22, 2018. Property last inspected November 20,
2018. Fence has been repaired, but balcony is still in disrepair. This is a health and

safety hazard. City recommended 15 days from printed order for compliance, or $150 a
day. Administrative costs $634.12.
Mucale Lanthia, owner, stated she is currently unemployed, does not have money to fix
the house, and has requested assistance from the City. The house is currently occupied
by owner, but property will be put up for sale because of lack of funds to do repairs.
Officer Hart noted this has been an ongoing situation for eight months and there is another
case coming before the Magistrate next month where the entire front of the house is
virtually ripped off, exposing underside between first and second floor. Respondent
explained what has already transpired in an attempt to get City assistance, and has
received a quote for $2,500 to fix balcony. Officer Pierre will attempt to help. The property
is listed for sale, but there is no contract for purchase yet. The lien process was explained
to respondent by Ms. Zalman.
Decision
Based on testimony, Ms. Zalman ordered 15 days from date of printed order or $100 a
day, plus admin fees of $634.12.

Officer Hart presented the case, which was a routine inspection. Initial inspection date
August 31, 2018. Not a repeat violator. Initial notice was given September 18, 2018, via
written notice. Ten days were given to comply. Date notice was posted on property and
at City Hall was November 7, 2018. Property last inspected November 20, 2018. There
are still lawn mowers, garbage cans on sidewalk. It is cleaner, but not completely.
Pictures were provided. City recommended 10 days from printed order for compliance,
or $50 a day. Administrative costs $634.12.
Daniel Jerome, owner, states he has already done the clean-up, but will move what is
left as of yesterday. Mr. Woods and Officer Hart explained what the violation is and what
still needs to be done. All items must be removed from the sidewalk within 10 days.
Decision
Based on testimony, Ms. Zalman ordered 10 days from date of printed order or $50 a day,

property. Remove all materials stored outside as well as
trash and debris.
Officer Hart presented the case, which was a routine inspection. Initial inspection date
October 5, 2018. This is a repeat violator; see previous Case No. 14-969. Initial notice
was given October 5, 2018, via written notice. Ten days were given to comply. Date
notice sent Certified Mail was October 5, 2018, green card dated October 22, 2018.
Property last inspected November 20, 2018. This is health and safety hazard; vehicles
have been registered, though unsure about the ones backed up against fence. One
vehicle has been removed, but it is unknown if the remaining ones are operable as they
have been there for years. Because it is a health and safety hazard and a repeat violator,
the City does not recommend any day for compliance, but a fine of $300 a day plus
administrative costs of $634.12 until it is cleaned up.
Daniel Jerome, owner, claims all cars have been registered and are insured.
Respondent continues to claim the trash and debris has been cleared despite pictures
from last inspection to the contrary. Officer Hart explained exactly what needs to be
corrected so there is no confusion going forward.
Decision
Based on testimony, Ms. Zalman ordered 10 days from date of printed order or $150 a
day, plus admin fees of $634.12.

Officer Weixler presented the case. Notice of violation date March 15, 2018. The
Magistrate hearing was on June 20, 2018, and no one appeared. Compliance date given
was August 4, 2018, or $75 per day plus admin fees. Property last inspected on
November 21, 2018, violations still exist. 78 days of non-compliance with fines of $75 per
day, plus administrative fees of $634.12, for a total of $6,484.12. Pictures were not
entered into the system, City recommended the case be postponed.
Decision
Based on testimony, Ms. Zalman tabled the case to December.

Officer Weixler presented the case. Notice of violation date March 29, 2018. The
Magistrate hearing was on July 18, 2018, and no one appeared. Compliance date given
was August 20, 2018, or $25 per day plus admin fees. Property last inspected on
November 20, 2018, violation still existed in morning but had complied by afternoon,
hence two sets of pictures. 94 days of non-compliance with fines of $25 per day, plus
administrative fees of $634.12, for a total of $2,984.12.
Aglaise Marescot, owner, testified via translator Officer Pierre after the last name
discrepancy (maiden name now used) was cleared up. Respondent explained that she
is a single mother, no husband, unemployed, and cannot afford the amount of the lien.
The length of time it took to comply was explained as shipping items to Haiti, and now all
is done, property is clean. Ms. Zalman noted this is not a lien reduction and asked the
City to advise respondent on that process, which Officer Pierre explained.
Decision
Based on testimony, Ms. Zalman certified the lien at $1,000 plus $634.12 admin fees.

Office Guillaume presented the case. Mr. Woods explained the reasoning for removing
the case an additional 180 days in order to comply. The only thing that still exists is the
original administrative costs of $634.12; there is no per day fine for 180 days.

property, trim overgrown vegetation. Repair the fence.
Officer Guim presented the case. Notice of violation date March 13, 2018. The
Magistrate hearing was on June 20, 2018, and respondent appeared. Compliance date
given was August 7, 2018, or $100 per day plus admin fees. Only violation remaining
was the pool. Property last inspected on September 7, 2018, and is in full compliance.
104 days of non-compliance with fines of $100 per day, plus administrative fees of
$634.12, for a total of $11,034.12.
Richard Shores, son-in-law of owner, stated Mrs. Stimely is 79 years old and home-
bound with heart disease (heart valve replaced five years ago). family has been cleaning
up property since hurricane even though owner does not use backyard at all. Ms. Zalman
explained fine certification and the process of a lien reduction. A small fine reduction was
granted at this time.
Decision
Based on testimony, Ms. Zalman certified the fine for $9,034.12.

Officer Guim presented the case. Notice of violation date June 6, 2018. The Magistrate
hearing was on August 15, 2018, and no one appeared. Compliance date given was
September 23, 2018, or $50 per day plus admin fees. Property last inspected on
November 15, 2018, and is in full compliance. 52 days of non-compliance with fines of
$50 per day, plus administrative fees of $634.12, for a total of $3,234.12.

Paolo Fontana, owner, stated had a job offer in New York and decided to rent out home
(had lived there since 2003). Aware that a tax application was needed, but it was an
oversight that didn’t follow through. Tenant is extremely old, daughter is caregiver, but
the postings sent to home weren’t delivered until the last one. Respondent took care of
matters immediately, and is hoping for some leniency as any reportable event such as a
lien could affect his state license. A 25% fine reduction was granted at this time.
Decision
Based on testimony, Ms. Zalman certified the fine for $2,584.12.
Lien Reduction Hearing
Case No. 06-2887 Kenneth & Alice J Snow

Violation(s): For code sections as stated.
Officer Pierre presented the case. Notice of violation date November 9, 2006. Magistrate
hearing was January 17, 2007, and no one had appeared. Compliance date given was
January 27, 2003, or $150 per day. Date complied June 5, 2013. 2,320 days of non-
compliance at $150 per day, for a total fine of $348,000, plus administrative fees. Owner
of property has complied for lien reduction. (Related Case No. 12-1740.)
Helen Forbes, sister of owner and personal representative of estate, stated Mr.
Snow died March 31, 2018. Was aware of one lien on property before respondent died.
Father of respondent taught epileptic son the auto mechanic trade, but passed away in
2000, leaving the business and house to his son, who proved not to be a very good
businessman. The work was done on the property several years ago, and Ms. Forbes
was under the impression that everything having to do with the lien had been resolved
until the time for putting the property up for sale. Estimated appraisal of the property is
$1.3 million. There were issues with an evicted tenant who had caused problems with
the property, at a cost of $12,000, plus $11,000 for painting and $4,000 for sod on swale,
and other costs to almost $30,000. The liens have nothing to do with current tenant.
Proceeds of sale of property will go Mr. Snow’s daughter. Glen Forbes gave additional
testimony on the history of the original violations. Lengthy discussion on several methods
of lien reduction ensued, City ultimately recommended 90% reduction, in order to facilitate
sale of property and with knowledge the property was under compliance prior to the
owner’s death.

Officer Pierre presented the case. Notice of violation date September 10, 2012.
Magistrate hearing was December 19, 2012, and no one had appeared. Compliance date
given was January 3, 2013, or $150 per day. Date complied May 13, 2013. 129 days of
non-compliance at $150 per day, for a total fine of $19,250, plus administrative fees.
Owner of property has complied for lien reduction. (Related Case 06-2887.)
Helen Forbes, sister of owner and personal representative of estate, appeared, with
testimony as given for Case No. 06-2887. This violation was for a concrete pad poured
without a permit. City recommended 90% reduction, in order to facilitate sale of property
and with knowledge the property was under compliance prior to the owner’s death.
Decision
Based on testimony, Ms. Zalman reduced the lien to $1,935 + $634.12 = $2,569.12.

not to be occupied. Permits abandoned over six months,
remove work or new permits required. Building Board of
Adjustments and Appeals shall go to Board for
reinstatement of permits and unsafe structure of building
system. Mow, trim, and de-weed overgrowth. Remove all
materials stored outside, as well as trash and debris.
Officer Hart presented the case. Notice of Violation date May 23, 2018. Magistrate
hearing was on August 15, 2018, respondent did not appear. Compliance date October
9, 2018. Fine proposed by Magistrate was $150 a day, plus administrative fees. Back
half of building, addition never completed, front half is currently occupied. Property last
inspected November 20, 2018, and violations still exist (mowing is being done). Number
of days of non-compliance 43 days at $150 a day, plus administrative fees of $634.12,
for a total of $7,084.12.
Decision
As no one appeared, Ms. Ellis certified the fine of $7,084.12.
