R,' ~00-~ A RESOLUTION OF THE CITY COMMTSS:[ON OF THE CITY OF BOYNTON BEACH, FLORTDA, ESTABLTSHTNG A FEE OF $200.00 PER HOUR FOR EACH HOUR OF DELAY FROM THE SCHEDULED ARR/VAL Ti[ME OF THE FUNERAL, TF DELAY TS GREATER THAN ONE HOUR; AND PROVTDTNG AN EFFECTIVE DATE. WHEREAS, the City Code of Ordinances Commission shall from time to time, by Resolution, cemetery lots, fix the price to be charged therefor, and the terms and conditions of such sales, and shall fix the schedule of fees to be charged for permits, burials, openings and closings, and other services; and WHEREAS, there have been several occasions when funeral arrival times were delayed through no fault of the City, which resulted in the City making overtime payments to City staff; and WHEREAS, to offset the expenditure of overtime payments due to a delay which is not caused by the City, the City Commission of the City of Boynton Beach, Florida deems it to be in the best interests of the citizens and residents of the City to pass through the cost, by establishing a fee of $200.00 per hour for each hour or part thereof of delay from the scheduled arrival time of the funeral, if delay is greater than one hour. NOW, THEREFORE, BE I'T RESOLVED BY THE CI'TY COMMISSION OF THE CITY. OF BOYNTON BEACH, FLOR/DA THAT: Section 1. Each Whereas clause set forth above is hereby ratified as being true and correct and incorporated herein by this reference; provides that the City provide for the sale of Section 2. The City Commission of the City of Boynton Beach, Florida, hereby establishes a fee in the amount of $200.00 per hour for each hour or part thereof of delay from the scheduled arrival time of the funeral, if delay is greater than one hour. C ITY~~I C A ~'Vic(~ Mayor Mayor Pro Tem Commissioner ATTEST: " CEMETERY SCHEDULE POLICY NOVEMBER 14, 2000 (REVISED*) PURPOSE: To provide the best possible service to families and funeral homes by avoiding simultaneous arrivals, traffic congestion and conflicts of equipment usage during funerals at Boynton Beach Memorial Park. 1. Check with City Clerk's office (742-6063) to determine available time on the day of the funeral. Please allow one hour between funerals. 2. Funeral Directors should use their past experience with churches and families to estimate an actual arrival time, which will not interfere with other funerals at the cemetery. Discuss arrival time schedule with the family and church, so they understand the purpose of schedules. An excessive early arrival time can be a hindrance as well as arrivals more than one hour late. 3. If Funeral Directors realize that the church service will be over earlier or later than expected, he/she should call the cemetery crew leader to determine alternate arrival times at the following: 742-6229 (Maintenance Office) 885-5401 (Beeper) 236-0046 (Cell Phone) 4. If necessary, request the family to slightly delay their arrival at the cemetery, so that no other funerals are affected. This allows cemetery workers to move equipment if needed. An alternative would be for cemetery workers to direct the funeral group to a quiet area of the park until the scheduled services are complete. 5. Provided every effort has been taken to contact us, no late fee would be assessed. The Parks Director will send a Notice of Intent to Assess a Late Fee to the funeral home director*. If it ever becomes necessary to assess the late fee, the funeral home may request an appeals to the charge. The funeral home may appeal to the Parks Director for a review of the circumstances involved to determine if the penalty should apply or appear before the Cemetery Board of Governors if dissatisfied with the Parks Director's decision. A response will be required within 48 hours ofthe next working day with a memo to the Secretary of the Cemetery Board. ATTACHMENT TO RESOLUTION NO.
