MINUTES OF REGULAR MEETING OF PLANNING AND ZONING BOARD HELD IN COMMISSION CHAMBERS, CITY HALL, BOYNTON BEACH, FLORIDA, TUESDAY, AUGUST 8, 1989 AT 7:30 P.M. MINUTES Approval of the Minutes was postponed until a more full complement of board members is present. COMMUNICATIONS AND ANNOUNCEMENTS Chairman Walshak made sure all board members in attendance had received a copy of correspondence from the City Manager's office with information from the Florida Dept. of Agriculture and Consumer Services. AGENDA APPROVAL Chairman Walshak wished to add to the Agenda discussion on Chapter 19 as well as discussion of the Technical Review Board. Under 7.B.6. he wished to add Space Saver Self Storage, Site Plan Review. Mrs. Zibelli moved to approve the Agenda as amended. Mr. Collins seconded the motion, which carried 5-0. OLD BUSINESS A. Description: Request for the abandonment of a ten (10) foot wide utility easement on Lot 18, Block 2 of the Cranbrook Lake Estates Planned Unit Development Jim Golden explained that Mr. and Mrs. Kerry Kessel are requesting abandonment of the 10' wide utility easement which runs parallel to their rear property line. They wish to construct an in-ground swimming pool in their back yard. Acting City Engineer George Hunt recommended approval of the request as submitted, owing to the existing cable and 2 MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA AUGUST 8, 1989 telephone lines bein9 located outside the easement around the lake maintenance area. Please see "Exhibits B & C" attached to the original copy of these Minutes in the office of the City Clerk. Mr. Golden remarked that the utilities affected have no problem with the abandonment. Florida Power & Light, Southern Bell Telephone, Comcast Cable and Florida Public Utilities had indicated they could approve the request. It was noted that the property owner owns property all the way to the lake and if something were to happen, the property owner would be liable. Mr. Robert Bickford, agent for the owner, was available to answer questions. As no one wished to speak in favor of or in opposition to the proposed request, THE PUBLIC HEARING WAS CLOSED. Mr. Collins moved to approve the request for abandonment as submitted and as recommended by the Engineering Dept. Mr. Howard seconded the motion which carried 5-0. PARKING LOT VARIANCE 2. Request for a variance to Section 5-142(h)(7) "Driveways" of Article X, Parking Lots Tambri Heyden remarked that on June 20, 1989 the Commission had approved the site plan contingent upon approval of the parking lot variance for the number of driveways proposed. The parking lot regulations allow two driveways for frontage and the fire station is proposing three. The TRB recommended approval of the parking lot variance for three reasons, as enumerated in Carmen Annunziato,s August 2, 1989 memorandum to the Planning and Zoning Board. As no one wished to speak in favor of or in opposition to the proposed request, THE PUBLIC HEARING WAS CLOSED. MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA AUGUST 8, 1989 Mr. Howard moved to accept the request for a variance. Mr. Zimmerman seconded the motion, which carried 5-0. B. SITE PLANS NEW SITE PLANS Project Name: Agent: Owner: Location: Legal Description: Description: Brighton Gardens ACLF Curtis L. Shenkman, Esq. Congress Center, Ltd. West side of S. Congress Ave., north of Woolbright Rd. See "Exhibit F" attached to the original copy of these Minutes in the office of the City Clerk. Request for site plan approval to construct a 150 bed adult congre- gate living facility on 3.81 acres Tambri Heyden explained this facility will share the existing entrance from Congress Ave. which currently serves the Congress Center. Congress Center owns the vacant parcel and Marriott Corp. has a contract to purchase% it. An 8' CBS wall was built by Congress Center along the west property line to buffer any f~ture commercial development. The proposed building will have orange/brown concrete roof tile, white trim and off-white stucco textured walls. A colored elevation of a sign was available for viewing, that had colors compatible to the!building° The sign had a pink and teal sign border and letters. The TRB had recommended approval of this request subject to the following staff comments. Building Department i. Ail plans submitted for public record by a design pro- fessional, registered in the State of Florida, must be signed and sealed. 2. Show Occupancy Classification. 3. Building may be mixed occupancy and must conform to SBCCI 403. 4. Exterior wall must meet 703.1 and Table 600 SBCCI. Engineering Department 1. Provide a light pole imbedment detail and Engineer's 120 M.P.H, certification. 2. Lighting needs to be controlled by photo electric device. 4 MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA AUGUST 8, 1989 3. Provide parking lot traffic control devices, to include stop signs, directional arrows, painted stop bars, etc. that conform with the Manual of Uniform Traffic Control Devices and Article X, Parking Lot Regulations. 4. Handicap ramp details required. 5. Dumpster pad and enclosure detail is required. 6. Design of the parking lot and facilities shall be done by an Engineer registered in the State of Florida and the plans submitted shall be sealed. Article X, Section 5-142(f) Drainage. Utilities Department 1. Many of the fitting descriptions include the word "lead". Please clarify the meaning of this or delete it. 2. It appears the water main can cross over, rather than under, the storm drainage in the northwest corner of the site. This would be preferred from a maintenance standpoint. Police Department 1. Provide lighting details (5-142A). 2. Fence along canal (Public Safety). 3. Traffic Control Devices at exits and within parking (City Ordinance ~5-142C). lot. Public Works Department "Check Ordinance for dumpster enclosures. Also call Public Works to verify angle of approach to dumpster pad." The median of Congress Ave. in front of the site must be irrigated and landscaped. The plans must be reviewed by the Parks Division which will assume maintenance after the plants are installed. 2. 50% of the tree species/quantities must be native. 3. Shrubs/hedge plants along road R.O.W.'s must be 36" in height where parking stalls are located. 4. The road R.O.W.'s must receive sod and irrigation. Chairman Watshak requested that the Board not receive late staff comments just prior to the meeting. He referred to memoranda received from the Police Dept. Chairman Walshak was tired of the pattern and hoped it would change. 5 MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA AUGUST 8, 1989 Attorney Curtis Shenkman was present at the meeting as well as Mr. Larry Reid, Director of Development, Marriott Corp. Mr. Shenkman stated there were five staff comments they would like to discuss. 1o Relative to John Guidry, Director of Utilities' comments dated August 2, 1989, in condition 2. Mr. Guidry requested the water main cross over the storm sewer. Mr. Guidry did not have the benefit of the depth drawings. The applicant's engineers reviewed the plans and cannot honor that request. There is a 30" cover requirement of soil over the top of the pipes. If the water main were to cross over, as requested, it would only leave 19" of cover which would not meet the Code requirement. No representatives from the Utilities Dept. were present at the meeting. 2. Mr. Shenkman referred to Carmen Annunziato's August 3, 1989 memorandum, condition 5., which reads: "The following information is needed on the freestanding sign: sign colors, materials, letter size and style. Additionally, only the project name is allowed to be adver- tised on the freestanding sign. Chapter 21, Section 21-3, Freestanding Sign." Mr. Shenkman remarked Mr. Annunziato had used the phrase "project name". In the Sign Ordinance, in the definition of freestanding sign, the terminology is "project, title, or one main use." They are basically requesting a modification of that condition so the language tracks the language which exists in the Sign Ordinance. Mr. Shenkman stated the sign does in fact meet the Ordinance. Mr. Golden remarked interpretation of the Sign Ordinance would ultimately be made by the Building Official. Mr. Jaeger addressed the Board and indicated strict reading of the Sign Code would prohibit the amount of information that is on the proposed sign. The Code is in the process of being revised. Mr. Jaeger believed the freestanding sign language will be liberalized in the new Sign Ordinance. Mr. Jaeger recom- mended concurrence with the Planning Dept.'s comments and said this issue could be readdressed at the time the appli- cation for a sign permit would be required. At that time there is a good possibility that the Sign Code would have been modified. Mr. Shenkman was agreeable. 3. Relative to Kevin Hallahan's August 2, 1989 memorandum, they would like to request the deletion of condition 1. which requires the median on Congress Ave. in front of the site to be irrigated and landscaped. Applicant intends for the median to be concrete. Mr. Golden explained the 6 MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA AUGUST 8, 1989 Forester was not sure if there was to be green area in the median. Since it will be concrete there would obviously be no need for greenery or irrigation. 4. Mr. Reid addressed the fourth condition. A request had been made by the City to irrigate the 3' of grass between the sidewalk and curb running north and south along Congress Ave. Applicant would like to over sprinkle it from the interior side of the sidewalk, rather than run pipes underneath the sidewalk. The Board agreed this was something the Forester could look at prior to the Commission meeting to determine feasibility. Applicant agreed. 5. Mr. Reid discussed item 2. of the Police Dept.'s remarks, relative to providing a fence along the canal for safety reasons. Mr. Reid believes the canal has visual amen- ities. It has to be landscaped to Code. They do not believe it has a particular safety value as the fence would have to be back 30'. They feel it will infringe on the visual impact. Also, from a safety standpoint it would still allow someone to walk around the side and back behind where they would be less likely to be seen by staff. The applicant would prefer landscaping as a buffer there rather than a wall or fence. Mr. Golden stated this is not really a Code requirement, but is a safety oriented recommendation. At ACLFs sometimes there are patients with Alzheimer's Disease that tend to wander. Safety is an important concern. Chairman Walshak thouqht consideration should be given to attaching this to the Code in the future. Since the Code does not require the fence, the Chairman felt it would be left up to the appli- cant's discretion whether or not to put it there. Discussion took place relative to the height of the building and Mr. Annunziato's third comment in his August 3, 1989 memorandum. Mr. Reid explained it was a misnomer on the drawing. It will be under 25' in height. It will have a flat tile roof as opposed to barrel tile to ensure they are under 25' There will be no mechanicals on top of the building. Chairman Walshak remarked that the applicant needed to discuss these points with staff prior to the Commission meeting. The P&Z Board would hold off from attaching these few staff comments from it's recommendation. Motion Mr. Collins moved to approve the request for site plan approval, subject to staff comments as previously discussed. Mr. Howard seconded the motion, which carried 5-0. 7 MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA AUGUST 8, 1989 e Project Name: Agent: Owner: Location: Legal Description: Description: Boulevard Manor Care Vasant P. Bhide Bhide & Hall Architects, P.A. Vari-Care, Inc. West side of South Seacrest Blvd., south of S.E. 26th Ave. See "Exhibit H" attached to the original copy of these Minutes in the Office of the City Clerk. Request for approval of an amended site plan to allow for the expan- sion of the existing facility from 110 beds to 180 beds. Tambri Heyden explained all existing parking area will be removed to accommodate the expansion with the exception of the parking area along the ~orth parking line, which will be used only for service vehicles, loading and emergency access. Currently this non-conforming parking area of the building is only wide enough for one way flow into the site which has resulted in some problems. The access isle will be widened for two way flow and the connection to S.W. 22nd Ave. will be removed. New parking areas will be constructed in front into the rear of thle new expansion. Adjacent land uses and the color scheme we,re explained. The TRB recom- mends approval of the requesit, subject to staff comments. Building Department 1. Building must meet Table 600 SBCCI. 2. Elevators must be provided. Engineering Department "Landscaped island in center of circle must be protected by raised continuous concrete Curb. Please indicate on plans." The parking area must be visually screened with a 36" height hedge along the road R.O.W.'s. 2. The parking lot at the SW corner of the property must be screened with hedge plants. 3. Vines should be planted on the decorative wall. 4. The road R.O.W. 's must be sodded and receive irrigation. Mr. Vasant Bhide, Architect, explained they agreed to all staff comments, but one. He referred to the the Building Department's comment 2. which referred to an elevator being provided. Mr. Bhide noted the building will be one story. Motion Mr. Howard moved to approve the request for approval, sub- ject to staff comments. Mr. Collins seconded the motion, which carried 5-0. Project Name: The Grove Shopping Center Agent: Goldenholz-Fischer, Architects & Planners, P.A. Owner: Grove Partners, Ltd. Location: South Federal Hwy. at Old Dixie Hwy., west side Legal Description: Description: See "Exhibit K" attached to the original copy of these Minutes in the office of the City Clerk. Request for site plan and shared parking approval to construct a 158,773 sq. ft. shopping center (including a supermarket, drug store, 6-plex theatre, and 3 leased out parcels on 15.98 acres). Tambri Heyden explained this site plan was approved several years back and was later amended several times. Underground utilities and infrastructure were constructed and the project was abandoned. The approvals were no longer good because 9 MINUTES - PLANNING & ZONING BOARD BOTfNTON BEACH, FLORIDA AUGUST 8, 1989 permits were not secured within the time frame set by Code. The applicant is interested in reviving this project. The new site plan is different from the original, due to chanHes ~n the parking lot regulation. Specifically, landscaped islands and other pervious areas had to be designed around the existing catch basins. Ms. Heyden noted two entrances will serve the center; the main entrance from Old Dixie Hwy., and a right turn-in, right turn-out restricted left turn entrance from Federal Hwy. The traffic study indicated the following off-site improvements: 1) A left turn lane into the project's main entrance from Old Dixie. 2) An exclusive left turn lane from Old Dixie to Fed. Hwy. 3) A new right turn lane from Federal Hwy. to Old Dixie. 4) Reconstruction of the median at Old Dixie and Federal Hwy. 5) A new northbound left turn lane from Federal Hwy. into the project's north entrance. A shared parking study was submitted to allow shared parking at the peak hours. Elaboration took place regarding adja- cent land uses and color scheme. The TRB recommended appro- val, subject to staff comments. Building Department 1. The theatre is a threshold building and must conform to FS-553. 2. Show occupancies and construction types. Engineering Department 1. D.O.T. permit is required for work done in Right-of-Ways of Federal Hwy. and Old Dixie Hwy. 2. Islands adjacent to main aisles in parking lot shall have stop signs and stop bars (pavement markings). 3. Parking lot aisle immediately in front of Retail "C" appears to be inadequately lit. Engineering Dept. suggests an additional light be provided in landscaped island which abuts this aisle. Mr. Donald Fischer, Architect and Mr. Lee Summers, Agent for the owner were both present at the meeting. Mr. Fischer stated they are in agreement with all staff comments, including those from the Police Dept. It was noted the proj- ect is not in the CBD. He explained the history of the Addison Square project which had been planned previously. The original developer did not proceed with the project due to a pending litigation con- cernlng the building height. The property was sold to Mr. Kalra who would now like to raze the single family home on the site and construct a one story medical office building for his wife's medical practice. Mr. Golden referred to the two driveways and indicated the location is consistent with a previous variance approval. The building will be located near the intersection and parking will be provided on the south side. Exterior design/colors were explained. The TRB recommended approval, subject to the following staff comments: Building Department 1. Show type of construction. 2. Show handicap parking detail to code. 3. Handicap ramp must meet code for slope. 4. Building must meet Table 400 and 600 of SBCCI. Request for site plan approval to construct 135 multi-family rental units on 11.95 acres at the Quail Lake P.U.D. Mr. Golden explained this is the third in a series of site plans at this location. The first was called Savannah Place and the second was called Sutton Place. Applicant intends to construct 135 units as provided for in the approved Master Plan for Quail Lake. Driveways will be provided onto S.W. 19th Ave. on the north side and there is a right turn- in right turn-out only driveway onto Congress which has been separated by the Fire Dept. Sub Station by about 220 ft. There is s private recreation area which includes a pool and a clubhouse. Mr. Golden described the Spanish motif of the buildings' architecture and tbs colors. The TRB recommends approval, subject to the following staff comments. Building Department 1. Fully dimension site plan. 2. Plans for permit need to be sealed by an architect or engineer. 3. Show the type of construction and conformity to Table 600. 4. Show handicap access throughout. 5. Show a typical parking detail. Brenda Arnold of Kilday & Associates stated applicant agrees with staff comments but they do have a question regarding the replat, which Dan Shalloway of Shalloway Engineering would address. Reference was made to Carmen annunziato's August 2, 1989 memorandum~ item 6: "This site must be platted (Section 11 of Appendix B, Planned Unit Developments)." Mr. Shalloway stated they could accept this but they feel it is unnecessary and adds a great deal of time to a process. 14 MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA AUGUST 8, 1989 He stated the parcel is platted already. The reason staff wants them to do a replat is because they will need to add some water and sewer utility easements within the parcel. Mr. Shalloway said this could be accomplished through a separate instrument that describes these easements. If the City feels the plat is absolutely necessary, applicant would like it clear that they can apply for and obtain building permits prior to the final plat being filed. They wouldn't expect C.O.s to be issued. Mr. Golden explained the platting is a requirement of the P.U.D. Regulations. There is an existing boundary plat that would have to be replatted. This is not something that can be deleted as it is an Ordinance requirement. Concerning permitting, Mr. Golden believed the applicant could apply for and initiate his interior reviews with the Building Dept. before the final plat is approved. Final plat approval would be required before a permit could be issued for utilities. Mr. Shalloway noted this is a rental property and would have one ownership. They are not planning on splitting it up. This could be handled by separate instrument, in his opi- nion, and elaboration took place. Mr. Golden was not aware of any instances in the City where you had a replat of a boundary plat for a rental project in a P.U.D. that was handled by instrument. Chairman Walshak felt they were getting into a very tech- nical question. When this gets to the Commission, he was sure the Commission would probably seek the City Attorney's opinion on this. Don Jaeger commented that the Code would allow them to accept applications for permits, however, they could not release a permit prior to the final platting. Motion Mr. Collins moved to approve the request for site plan approval of the project, subject to staff comments, except No. 6 of Carmen Annunziato's memorandum dated August 2, 1989, which the Board recommends the Commission get a legal opinion on. Because of staff com- ments the Planning Dept. suggested there were technical dif- ficulties which the applicant should work on and then bring the project back through in 30 days to the next TRB meeting. 15 MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA AUGUST 8, 1989 Mr. Golden stated that recommendation was made by the TRB not the Planning Dept., and was consistent with City policy. Chairman Walshak asked if that policy was covered in Chapter 19 anywhere? Mr. Golden felt in part, it is. He referred to broad comments that indicate the plan must be complete before it is forwarded to the Planning and Zoning Board. Reference was also made to two projects on the Agenda which had been rejected previously by the TRB because they needed revision. They were revised and resubmitted and were heard by the Board at this meeting. Chairman Walshak made reference to the Code and remarked that the TRB's responsibility is to forward the application along with their recommendation, either approval or denial, to the P&Z Board. As far as the TRB setting policy, if they want to do that, Chairman Walshak said they had better suggest an appropriate Code change. Mr. Golden stated the TRB does not set policy. There has been a directive for a number of years through the City Manager's office. The question was raised as to whether the directive had ever been put in writing. Further discussion took place. Mr. Golden indicated the technical problems were raised pri- marily by the Building Dept. and the Fire Dept. Other departments had comments of their own. Chairman Walshak referred to Med Kopczynski's August 1, 1989 memorandum which lists 11 comments. He saw nothing in these comments basi- cally any different than in comments for numerous other proj- ects at the meeting. Discussion took place regarding item 4 on the memorandum: "Building must conform to Table 600 and 703.1." Don Jaeger remarked that Med KoPczynski had concurred with his determination that there would be nothing in his com- ments which would prohibit this plan from moving forward. Mr. Golden stated he understood these sections of the Code referred to separations between buildings and remarked that the separation might have to be increased. He understood the applicant may have been required to apply for an appeal from the Building Board of Adjustment to help solve the problem. Mr. Jaeger indicated this was correct and recom- mended the project be approved subject to these staff com- ments. He stated in the past they had approved projects subject to these identical comments and they have gone before the Building Board of Adjustment for variances on this very same issue. In the past th~ Board of Adjustment has granted them the appeal to the Standard Building Code on this subject. He saw nothing prohibiting this project from being approved subject to them going before the Board. 16 MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA AUGUST 8, 1989 Chairman Walshak felt it should be brought to the Commission's attention that directives and policies should be straightened out. Some direction should be given to the Technical Review Board as far as these applications are con- cerned, so that every applicant coming through gets the same treatment. Ann Toney, Assistant to the City Manager, commented that Interim City Manager, George Hunt, had received the memoran- dum from Jim Golden regarding this project. His recommen- dation on behalf of staff and as supervisor of all members of the TP~ was that this be passed, subject to all staff comments. Further discussion took place. Mr. Golden remarked the TRB has not received any directive to discontinue this proce- dure. Chairman Walshak felt it would be up to the Commission to provide directives. Discussion took place on who supervises the TRB on site plans. Mr. Golden felt the Planning Director does. Chairman Walshak disagreed and referred to page 1091 of the sub- division Article V, and stated the City Engineer would chair the TRB. In the absence of a City Engineer who would chair the TRB on site plans? Chairman Walshak felt that was something the Commission might want to act on. Mr. Golden commented these Codes go back many years. There was a time when there was no Planning Director and the City Engineer did essentially approve site plans, even though there wasn't really a site plan procedure. There may be some discrepancies. Ann Toney suggested this be taken back to staff so that a recommendation could be mads to the Commission that perhaps an amendment take place to address tbs concerns brought up tonight. Mr. Murray Zweig representing the owner and Mr. John Provost-Heron, with Michael Scavuzzo & Assoc., Architects, were present at the meeting. Mr. Provost-Heron believed that a representative of their firm had attended the TRB meeting. They are in agreement with 95% of the staff com- ments. Mr. Zweig commented they are addressing a working type drawing at this point. Some of the items brought up were in reference to interior curbing which the applicant felt would hinder the drainage of rain water on the asphalt. Additionally there were recommendations to install trees in the concrete buffered islands, outside of the overhead doors. He felt they do meet the Code landscape requirements and feel this would cause an additional maintenance problem if the trees are added. Chairman Walshak remarksd 17 MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA AUGUST 8, 1989 landscaping issues would be addressed by the Community Appearance Board. A brief recess was called at 9:15 P.M. so that colored ele- vations could be retrieved from the Planning Dept. for viewing. The Planning Dept. was unaware this project was going to be added to tonight's Agenda. The Planning and Zoning Board meeting resumed at 9:35 P.M. The colored elevations were examined and discussion took place. The 700 to 800 units will have garage door type open- ings. Public restrooms will be located inside and outside. The units are to be used strictly for storage. Tenants are not allowed to set up workshops. The entire property will be fenced with security fencing. There will be 24-hr. moni- tored access, hooked into the Police Central Station. Discussion took place relative to access for Police and Fire personnel and an automatic gate. Mr. Provost-Heron stated they were in agreezent with staff comments except one or two. One of the comments dealt with an elevator which is not required. Mr. ~asger interjected he spoke to Mr. Kopczynski and they were withdrawing that requirement. Chairman Walshak remarked the roadway in front of the site is in bad shape. Floodin~ takes place. Chairman Walshak asked if the applicant wou~d be willing to cooperate in some manner with the City in addressing this problem? This is something the Chairman fel~ the applicant should keep in mind prior to addressing the Commission. Conditioned upon the approval of the P&Z Board, Mr. Jaeger remarked this project could be scheduled for the next C.A.B. meeting. A "Hold Harmless Agreement" was submitted by Mr. Provost-Heron which would hold the City harmless relative to any damage to the gates at the site if the Police or Fire Depts. had to gain access. Annunziato Planning Director City Fire Station August 2, 1989 $3 - Parkinq Lot Variance Section 5-145(~)(4) of the Code of Ordinances requires that when a variance to Section 5, Article X, Parking Lots is requested, the Technical Review Board must forward to the Planning and Zoning Board a recommendation, and that the recommendation forwarded is to be made part of the public hearing proceedings. To that end, this memorandum is forwarded, consistent with 5-145(c)(4). The City of Boynton Beach has requested a variance, to Section 5-142(h)(7) Driveways which states that no more than two driveways shall be permitted from any property. Even where a property abuts more than one public or private right-of-way, in no instance shall the number of driveways exceed two on each street~ In this instance, the City is requesting 3 driveways onto Miner Road. The site plan for the fire station was approved by the City Commisszon on June 20, 1989, contingent upon approval of the subject parking lot variance. For an explanation of the Code requirement, the nature.of the variance requested, and the variance justification, please refer to the attached Notice of Public Hearing, application andsite plan diagram. On Tuesday, August 1, 1989, the Technical Review Board (TRB) met to review the plans and documents submitted, and to formulate a recommendation regarding the variance requested. After review and discussion, the TRB recommended approval of the variance as submitted for the following reasons: The city facility proposed will not only be used as a fire station, but also as a Police Department pistol range and an "annex" for basic city services such as water bill pa!auents and city library book returns. To accommodate the public at this facility, a window served by a one-way, circular, drop-off area is to be provided. It was felt that it was necessary to keep the public entrance and parking area separate from the entrance and parking area to be used by emergency vehicles for safety and emergency access reasons. e Although the site has frontage on two public rights-of-way, Miner Road and Congress Avenue, and by code a driveway that meets the 180 foot distance requirement could have been proposed onto Congress Avenue, the Fire Department did not want an emergency egress driveway onto Congress Avenue. Driveways onto Miner Road were preferred as the safest, most convenient egress for emergency vehicles because an emergency traffic signal could be installed at the intersection of Miner Road and Congress Avenue and activated to regulate the traffic on Congress Avenue when needed. Eliminating one of the driveways would result in the need to provide circulation around the south side of the fire station building. Such a vehicular area would encroach into the 40 foot landscape buffer along the south property line. (This buffer was established in the covenants and restrictions in the warranty deed to buffer the adjacent Melear PUD when the parcel was dedicated by Melear to the City as a condition of planned unit development zoning approval.) Annunziato Planning Director RE: High Ridge Country Club - Site Plan Modification With respect to the above, please be advised of the following: On July 11, 1988, the Zoning Board of Adjustment approved a variance which provided for relief from the parking space requirements for a proposed 18,084 square foot addition to the High Ridge Country Club. According to the records on file in the City Clerk's Office, the total square footage of the existing building and the proposed addition was to be 40,936 square feet. This would require that 410 parking spaces be provided at the ratio of one parking space per 100 square feet of gross floor area. Through res~riping of the parking lot and the addition of some new parking spaces, the applicant was proposing to provide 280 spaces. The variance requested and approved on that da%e was for 130 cars, as outlined in the attached correspondence. On September 21, 1988, the City Commission approved the site plan modification for the proposed expansion. Comparison of the site plan application on file in the Planning Department with the records in the City Clerk's Office for the parking variance show that the square footage approved on the site plan application (19,970 square feet) exceeded the square footage proposed on the variance application (18,084 square feet) by 1,886 square feet. Therefore, a shortage of 19 parking spaces will exist when the Current expansion is completed (the actual deficit will be 12 due to the provision of 7 additional spaces beyond the 280 spaces proposed on the variance application). The proposed locker room addition would require the provision of 52 additional parking spaces. The applicant is requesting site plan approval subject to the future approval of an additional variance from the Zoning Board of Adjustment. Concerning the current 12 space deficit, these spaces should either be included in the future variance request or should be constructed on the premises. Double detector check valves are, therefore, unnecessary and should be deleted. 2. Add isolation valves as required, 3. Provide fire flow test data and calculations. 4. Indicate a cleanout to be installed at the property line. Water services with either end under paving shall be of type "K" copper. Also, adhere to the City's standard detail for service connections. 6. Indicate all utility easements. 7.
