Call to Order by Local Hearing Officer James D. Stokes The Honorable James Stokes, Special Magistrate, gave a brief overview of the program at 9:08 a.m. He presented himself and explained he was appointed to hear the cases all over the state. He will see the evidence for the first time this morning. All monitors are tied together and all will see the sane thing at the same time. He will watch a video and receive a packet of registration information and calibration of the camera. The request for hearing, initial notice and documents for the case. City presents first. She called paramedics, but they took too long, so she put her in the car and drove. She presented paperwork in support of her testimony which Mr. Stokes viewed. Mr. Stokes commented individuals are in distress, or injured. His standard speech is if she was t-boned it would not have helped the situation Decision Mr. Stokes dismissed the case. Jesse Tapia Notice No. 1851900228466 Officer Jones, Boynton Beach Police Department, commented on September 8, 2019, at 8:47 p.m., a vehicle registered to the violator was travelling southbound on N. Congress Avenue at Gateway Boulevard in lane two. After a review of the electronic evidence, a Notice of Violation was issued on September 23, 2019. The red-light time was 2.1 seconds. After a review of the electronic evidence, the Notice of Violation was issued on November 22, 2019. The red-light time was .7 seconds. He had an evidence pack and video and still images to present. Ms. Flores and Mr. Stokes viewed the evidence. Ms. Flores heard sirens, and did not know what direction it was coming from, so her reaction was to go through the light. Mr. Stokes reviewed the complete video a second time. Mr. Stokes explained he sees how the vehicle reacts and if they moved to the right, but she continued in the intersection straight away. It did not seem like she was moving out of the way. Decision Mr. Stokes upheld the violation and assessed a fine of$243. Alice Hill Notice No. 1851900242129 2 Hearing Minutes Red Light Camera Hearings Boynton Beach, FL January 8, 2020 Officer Surajbally stated on September 24, 2019, at 7:47 a.m., a vehicle registered to the violator was travelling eastbound on Woolbright Road at SW 8t"Street in lane four. After a review of the electronic evidence, a Notice of Violation was issued on October 16, 2019. The red-light time was .8 seconds. He had an evidence pack and video and still images to present. Ms. Hill and Mr. Stokes viewed the evidence. Ms. Hill saw the vehicle approaching and slowed down, but she felt like she was already past the light, she paused and the car had passed her. Decision Mr. Stokes upheld the violation and assessed a fine of$243. She asked how to appeal. Mr. Stokes explained she had to appeal within 30 days and it has a strict deadline. Nathan Stephen Conrad Notice No. 1851900244190 Officer Petriello, Traffic Infraction Enforcement Officer, indicated on September 26, 2019, at 3:50 p.m., a vehicle registered to the violator was travelling eastbound on Woolbright Road at SW 8t" Street in lane three. After a review of the electronic evidence, Officer Petriello issued a Notice of Violation on October 16, 2019. He had an evidence pack and video and still images to present. Messrs. Conrad and Mr. Stokes viewed the evidence. Mr. Conrad commented his vehicle was over the straight line. His initial citation said you can request a hearing if what you feel is best for everyone. The car to his left was texting and driving the whole time. At that moment, if he stayed in the right lane, and he had to switch over to the next lane to stay away from the driver, it would point him towards south and he was going to 95 north, so he had to come around. He hoped the camera would show further back. With this person texting, when they realized the light was red, if he would have jammed on his brakes, he would have stopped in the middle. The camera is no longer there. Mr. Stokes was unsure beating him to the intersection was the best choice. The cameras do record speed. The speed limit is 40 mph and camera said the vehicle was traveling 55 mph. He should have slowed to get behind the vehicle, but Mr. Conrad was well behind the limit line when the light turned red Decision Mr. Stokes upheld the violation and assessed a fine of$243. After a review of the electronic evidence, the Notice of Violation was issued on October 10, 2019. The red-light time was 1.5 seconds. He had an evidence pack and video and still images to present. Messrs. Enoicy and Stokes viewed the evidence. Mr. Enoicy noted he was in the middle lane behind a Jeep, which stopped abruptly. He was slowing down, but he felt he would not be able to slow down in time. He did not want to run into the back of the jeep and there was a truck next to him. He initial reaction was to speed around the white truck to avoid the jeep. He did not want to endanger anyone. Mr. Stokes appreciated the position Mr. Enoicy was in, but commented he put himself in the position. He had a hard time excusing it. Mr. Stokes commented he did not have a lot of wiggle room. Decision Mr. Stokes upheld the violation and assessed a fine of$208.
