AN ORDINANCE OF THE CITY OF BOYNTON BEACH,FLORIDA,
iN AMENDING ORDINANCE 02-013 TO REZONE A PARCEL OF
G LAND DESCRIBED HEREIN AND COMMONLY REFERRED TO AS
1 MADISON ON THE AVENUE FROM C-2 NEIGHBORHOOD
f COMMERCIAL TO IPUD INFILL PLANNED UNIT
M DEVELOPMENT; PROVIDING FOR CONFLICTS,
• SEVERABILITY,AND AN EFFECTIVE DATE.

111 WHEREAS,the City Commission of the City of Boynton Beach, Florida has adopted
1 c Ordinance No. 02-013, in which a Revised Zoning Map was adopted for said City; and
11 WHEREAS, the City has made application to rezone land, said land being more
11 particularly described hereinafter, from C-2 Neighborhood Commercial to IPUD Infill Planned
1! Unit Development; and
11 WHEREAS, the City Commission conducted public hearings as required by law and
1 i heard testimony and received evidence which the Commission finds supports a rezoning for the
1: property hereinafter described; and
11 WHEREAS, the City Commission deems it in the best interests of the inhabitants of
2 I said City to amend the aforesaid Revised Zoning Map as hereinafter set forth.
2 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
2+ THE CITY OF BOYNTON BEACH,FLORIDA,THAT:
21 Section 1. The foregoing Whereas clauses are true and correct and incorporated
21 herein by this reference.
2! Section 2. The land herein described be and the same is hereby rezoned from C-2
2: Neighborhood Commercial to IPUD INFILL PLANNED UNIT DEVELOPMENT. A location
2 map is attached hereto as Exhibit "A" and made a part of this Ordinance by reference. Legal
2: Description:
2' LOTS 11, 12, AND 13, ROBINSON ADDITION,ACCORDING TO
31 THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 23, PAGE
3 144, OF THE PUBLIC RECORDS OF PALM BEACH COUNTY,

3 3 Section 3. That the aforesaid Revised Zoning Map of the City shall be amended
3 a accordingly.
4 Section 4. All ordinances or parts of ordinances in conflict herewith are hereby repealed.
4 Section 5. Should any section or provision of this Ordinance or any portion thereof be
4 _ declared by a court of competent jurisdiction to be invalid, such decision shall not affect the
4 3 remainder of this Ordinance.
4 Section 6. This ordinance shall become effective immediately upon passage.
