and Recording Secretary. He acknowledged the presence in the

the Ciuy Manager; Simon Ryder, Former Chairman of the

Deerfield Beach, FL 33441, regarding a modification suggested
to paragraphs 4f and 4g of the Comprehensive Plan in connec-
tion with a question Vice Chairman Blanchette had in regard
to deed restrictions. Attached to the letter was a petition
with 23 signatures, which requested that commercial proper-
ties be limited to one story. (A copy of said letter and
the attachments are attached to the original copy of these

Mr. Golden read the memorandum addressed to the Board, dated
March 14, 1989, from Mr. Annumziato. (See "Addendum A-i"
attached to the original copy of these minutes in the Office
of the City Clerk.) He stated that Sec. ll.2.D of the
Zoning Regulations contains a number of standards to which
conditional uses must conform, and he called attention to
items 2 and 9 of the memorandum. Otherwise, the project
conformed to the standards listed.
With reference to item 2, Mr. Golden drew attention to a
report from the Planning Department which discussed how the
parking situation would work and referenced the applicant's
parking study, which was attached to the agenda packets of
the Members. Mr. Golden then read item 9.
The TRB recommended approval of the conditional use, which
included the site plan and shared parking, subject to staff
comments attached to the original copy of these minutes as
Addenda A-1 through A-3 inclusive, and to the following:
Utilities Department
1. The new meter will require a separate tap off of the
water main.
2. Establish a permanent sampling point near the new meter.
3. Ihclude additional hydrants as needed to provide hydrant
coverage to within 200 feet of all points on all
buildings.
4. Provide fire flow calculations demonstrating 1500 gpm
fire flow with a 20 psi residual.
5. Provide details on the sanitary sewer.

Details on lighting plan prepared by Florida Power and
Light to be submitted for review prior to permitting.
Mr. Aguila did not see any mention about events, and he
questioned whether they may draw more people than the parking
spaces would accommodate. He also had not seen anything
about how many of the high school students drive. The park-
ing lot looked rather jammed in the picture he saw, and Mr.
Aguila did not know if that was an off day. He asked where
people park when there is an event.
Mr. Golden answered that the athletic events would occur on
weekday evenings and on weekends. When the events occur,
the school probably will not be in operation. There may be
one or two minor activities at the same time, which would
generate minimal parking. When it is used for major events,
it will be meeting Code requirements for parking.~. There will
be enough parking spaces for the gymnasium itself, plus
additional parking to meet that required by the zoning
regulations. Mr. Golden further explainedw and Mr. Aguila
made other comments.

introduced John Corbett, Dale Construction Corporation, and
Larry Kooi, Administrator, Lake Worth Christian School.
Mr. Dale thought Mr. Golden did a good job of answering Mr.
Aquila's question. The major events the school was asking
that their gymnasium be built for were events that would
take place during non-school hours. Therefore, there was no
need for additional parking beyond the Code requirements.
Mr. Aguila was concerned about what happens when there is
graduation or something like that. Mr. Dale recalled that
the question had come up in discussions with other people.
He thought the Parking Consultant had determined that there
are two major events during the year.
Mr. Kooi informed the Members that the School has a Fun Day,
and they usually have an auction in April. At that time,
there would have been a problem w~th the parking, but they
managed to contact a local church down the road and other
places for shuttle services. Mr. Kooi told Mr. Aguila that
there are 70 students in the upper two grades. 45 have cars.
The parking may take some of the pressure off during the
day.

Besides the parking on site, Mr. Dale called attention to
the open field. TheY obviously have a lot of overflow area,
if there is any need for it.
Mr. Collins asked where they have the graduation exercises.
Mr. Kooi replied that they are held at the elementary campus
in Lake Worth. At present, they do not have air conditioning
for the gymnasium.
Chairman Walshak asked if anyone wished to speak in opposi-
tion to or in favor of the application. There was no

Miss Heyden said the owners of the existing vacant building
are requesting approval to improve the existing non-conform-
ing parking lot and to add parking spaces to meet the gross
floor area that will be required for any future retail use
of the building. No changes to the outside of the building
were being requested.
Miss Heyden said two driveways currently exist to serve the
site. One is from Federal Highway, and one is on N. E. 8th
Avenue. The one on Federal Highway does not meet the 180
foot minimum distance from intersecting rights-of-way lines
required on arterial roads. The owners are requesting a
variance to continue to use the Federal Highway driveway.
The driveway serves four isolated parking spaces in front of
the building, which are needed to meet the requirement for
retail use.
The TRB recommended approval of the parking lot variance for
Federal Highway based on the following:
This driveway serves only four parking spaces.
There is an existing median within the North Federal High-
way right-of-way which would allow right turn movements
in and right turn movements out of this driveway.
After studying the possibility of relocating the four
parking spaces to the east side of the building, thereby
eliminating the need for the subject driveway, it was
concluded that even if the 20 foot alley adjacent to the
eastern property boundary were approved to be abandoned,
there would be insufficient room on the east side of the
building to provide the required 27 foot access aisle for
the relocated spaces.

With respect to the site plan, Miss Heyden said landscaping,
buffer walls, and a proper traffic control would be
installed. The TRB recommended approval, subject to staff
comments attached to the original copy of these minutes as
Addenda B-i through B-3 inclusive, and to the following:

the alley. Miss Heyden answered, "Not at this time." After
discussion about separating the property, she apologized for
not mentioning that a six foot high CBS buffer wall is
required along the property line and called attention to
comment ~2 in Mr. Annunziato's memo of March 8, 1989
(Addendum B-3).

33060, came forward and answered affirmatively when Mr.
Richter asked if she was familiar with the staff comments.

Motion on Parking Lot Variance
Mr. Lehnertz moved to approve the request for a variance to
Section 5-142 (h) (3) "Driveways" of the Parking Lot
Regulations, subject to staff comments. The motion was
seconded by Mr. Aguila. Motion carried 7-0.
Chairman Walshak reminded the Members that the P&Z Board is
as far as a parking lot variance goes, providing they have
a unanimous decision. It used to be a majority decision,
but the City Commission changed it so that it now requires a
unanimous decision.
Motion on Site Plan
Mr. Aguila asked whether they were doing anything to the
elevations of the building as well as the site plan. Frank
Brusco, also of the Pompano Beach address, answered "No."
Chairman Walshak advised that the request for site plan
approval was for the parking lot only.
Mr. Richter moved to approve the request for site plan
approval to allow for reconstruction of the exzsting parking
lot to enhance leasing opportunities for the existing
building, subject to staff comments. Mr. Collins seconded
the motion, and the motion carried 7-0.

Miss Heyden informed the Members that Citrus Avenue is
between Executive Circle and Citrus Glen Drive and the
request for abandonment is for the purpose of installing a
security gate system and a manned guardhouse.
The Engineering Department recommended approval, subject
to the comments in the Memo dated March 6, 1989 from William
Flushing~ Deputy City Engineer. (See Addendum D attached
to
Comments from other departments were as follows:
Utilities Department
1. The water meter for the guardhouse should be relocated to
the utility easement located along Executive Circle.
2. Indicate the location of the fence relative to the utility
easement between Lot 64 and the City's lift station.
3. The fence on the City's property must be maintained by
the developer or the subsequent association. Please pro-
vide this assurance in writing, to be recorded with the
deed for the association's commonly held area.
Planning Department
There is no need for this street to exist as a public right-
of-way north of the collector road (Citrus Glen Drive). The
abandonment of this right-of-way would also be required prior
to the installation of a private security system, as proposed
by the developer.
Discussion re Site Plan Modification
With respect to the site plan modification request, Miss
Heyden said the applicant was requesting approval to install
a private security system to include a 24 hour manned
guardhouse with gate at the northeast corner of Citrus Glen
Drive and Citrus Avenue and five unmanned breakaway gates.
The locations were pointed to on the overlay.

Miss Heyden stated that the unmanned gates have been located
so that they will be visible from the guardhouse and can be
opened by the residents via a card or opened for guests,
service or emergency vehicles by checking in at the guard-
house or waiting at on~ of the gate locations until the
guard can activate the gate. Citrus Glen is divided into
two separate homeowners associations with no master associa-
tion to regulate and maintain these amenities. For this
reason and because of problems with service and emergency
vehicles' access, only the manned guardhouse with the gate
and other gate were recommended for approval by the TRB.
Miss Heyden explained that was because both of those gates
would be controlled by one homeowners association located
within Executive Estates. She further explained and repeated
prior statements.
Miss Heyden clarifisd that th~ security system had been
designed so that when the man at the guardhouse sees a car
at one of the gate locations, he can activate the gate.
Also, they were talking about two homeowners associations in
two different plats. The guardhouse is located in one plat,
and two different associations were Involved. Mr.
Annunziato pointed out that there is no master association
to offse~ the cost of the guardhouse. Mr. Zimmerman noted
that Citrus Glen Drive separated the two subdivisions. Mr.
Annunziato responded that there was one developer and two
separate developments.
Miss Heyden continued that the other part of the request was
for a fence around the City lift station at the northwest
corner and also a fence along the perimeter for buffering
from the adjacent property. A colored elevation of the
guardhouse was supplied, which indicated tan walls, dark tan
doors, and a terra cotta tile roof.
The TRB recomended approval, subject to the following staff
comments:
Building Department
1. The overall heights of site fences are limited to six
feet.
2. The homeowners documents should provide for perpetual
maintenance of the site fences by the Homeowners
Association.

Discussion
Mr. Lehnertz asked if the street that was being abandoned
would become a private street as opposed to being a public
street. Mr. Annunziato answered that the guardhouse could
not be constructed in a public right-of-way, and he indicated
where the guardhouse would go. Miss Heyden explained the
way the gates would function to Mr. Collins.
Mr. Aguila asked if there would be some kind of a buzzer from
the gates to the guardhouse, in case the man in the guard-
house is not watching the gates. Miss Heyden answered that
it had not been discussed. If the man in the guardhouse
cannot see the gate, Mr. Annunziato replied that a buzzer
system may not be the answer, because they would not know
who they would be letting in.
Delfin Menendez, Senior Architect, MSM Design Group,
630 South Dixie Highway, West Palm Beach, FL 3340'1-5835,
was coming for the abandonment of Citrus Avenue, north of
Citrus Glen Drive, for the purpose of building a guardhouse
to provide a security system to the development. For
buffering reasons, they also have a request to put a fence
around the City owned lift station site at the corner of
Miner Road and Lawrence Road, just on the east side of the
property along the lots that abut the east boundary.
Some concern was brought up at the TRB meeting about the
inconvenience that would be created for access to the Citrus
Trail development that is south of the Citrus Glen Drive
area. Mr. Menendez said the developer's desire would have
been just to abandon the main collector road and establish
the guardhouse at the entries but, apparently, it is against
the policy of the City to abandon collector roads of that
kind. He explained and added that it appears that this type
of security system is established more and more every day.

Mr. Menendez showed where the guardhouse was proposed to be
to manually control access. He pointed to an access that
would be for residents only, and he said it would automati-
cally open for the residents the same way garage doors can
be opened from cars. All of the gates will open automati-
cally going out. In case of emergencies, the developer and
subsequent homeowners' associations will be held liable for
damages for any damages to vehicles or to the system from
any emergency vehicle.
Mr. Menendez acknowledged the comments with respect to any
type of inconvenience this system may create, although he
felt it would be under the supervision of the guard at this
point. Me asked for approval of the security system at the
north site (Executive Estates), and they will come at a
later time with a modifica%ion to try and create a similar
situation at a point he designated on the overlay. Mr.
Menendez commented that probably, they would have larger lots
where they could work out a system in order that the two
developments would be separated and have their own security.
Mr. Aguila understood Mr. Menendez to say he would like the
Board to only react to the northern half. Mr. Menendez
answered that the applicant would prefer that the Board
approve both, but they would acknowledge the comments.
Instead of putting everything on hold, he asked the Board to
approve the north side and maybe they can work out a solution.
Chairman Walshak asked if Mr. Menendez was referring to the
north side and the two gates further up. Mr. Menendez
answered affirmatively. Chairman Walshak determined that
the applicant was going along with the findings of the TRB.
Mr. Menendez confirmed that was right. He stated that he
read the comments from the TRB and had no problems with any
other TRB comments.
Mr. Annunziato inquired whether they were talking about only
the gate morth of the collector, only the gate house north
of the collector, and nothing south of the collector. Mr.
Menendez confirmed he was talking only of the north. Chair-
man Walshak noticed that the TRB agreed that those two gates
would be all right, and he asked if Mr. Menendez was saying
he did not want to put the south gates in now. Mr.
Menendez referred to what they had submitted, and he said
the Inconvenience would be just minimum, but he acknowledged
that the comments were very valid comments. After further
comments by Chairman Walshak, Miss Heyden indicated on the
overlay what the TRB recommended approval of.

Mr. Golden told the Members the applicant was requesting an
elevation change to accommodate the restaurant and its
facade. The TRB recommended approval, subject to the

1. The elevations indicate that the applicant proposes a
door and step along the south vehicular access. The door
and step must not hinder vehicular movement or compromise

been working closely with the City Staff.
Attorney Koehler called attention to the red awning requested
by Vision Works of Eckerd Drug Corporation that the City
Commission had addressed in December. He apprised the Members
that Herman's Plaza is a national sporting goods company's
name, and it will be the chief name appearing on the project.
They were before ~he Board with elevatiom changes to add
windows and doors for Applebee,s Restaurant.
Mr. Aguila wished to see what had previously been approved
and what was not approved. Mr. Weiner showed renderings and
said they were requesting the location of Applebee's
Restaurant, and he indicated the three bays they would be
taking. He requested a change from an accent feature of
white tile to the same stucco treatment which is on the
primary walls. The applicant was also requesting a minor
canvas canopy, which he thought protruded about eight or 12
inches from the face of the building. Mr. Weiner indicated
the locations of the canopy and the sign location. Attorney
Koehler showed swatches of the canopy materials.
Mr. Lehnertz referred to the second comment in the memo from
Don Jaeger, Building Department, and asked if the applicant
was in favor of that. Attorney Koehler answered that they
worked with Mr. Jaeger. On Friday, they made their first
attempt to submit a sign program to him. It was rejected
for reasons that they corrected on Monday (yesterday), was
accepted by Mr. Jaeger, and will be before the CAB and City
Commission in the cycle they were in now. Attorney Koehler
felt they had done what the City wanted in that area.

Mr. Aguila referred to the second comment in the memo from
Kevin Hallahan, Forester/Horticulturist, and he asked how
that problem would be resolved in that the sprinkler lines
are laying on top of the gravel. ~en he was there yester-
day, a lot of sand run-off was on the sidewalk. Mr. Aguila
explained that it is underwashing the sand. Mr. Davis was
unaware of the problem and suggested that perhaps the
irrigation system was not installed properly. Mr. Aguila
further explained the problem. Mr. Davis thought the appli-
cant should stipulate that it should be buried.
Chairman Walshak pointed out that Mr. Davis was in agreement
with the staff comments. He read the comment. There was

Lou Moshakos, 797 Camino Lake Circle, Boca Raton, FL 33432,
was in agreement with the staff comments, with the exception
of the menu board. He said there was a little discrepancy.
They have a menu board they have been using, and the menu
inside is the same menu they have in the drive through menu.
The drive through menu is located directly behind the build-
ing, and it takes a 4x7 menu board to accommodate the menu
they have. If the applicant cannot meet the Sign Code
requirements, Mr. Annunziato advised Mr. Moshakos that he
should avail himself of the variance process.
Mr. Moshakos informed Chairman Walshak that they have a Mr.
Submarine in Deerfield Beach, Oakland Park, on Commercial
Boulevard, and there are six or seven in the Keys. This one
is the furtherest north, but there will be one in Riviera
Beach. They basically have Greek dishes. They will have
Greek salads and gyros.
Mr. Aguila asked if they could have a drive through window
because there is an existing drive through. Mr. Annunziato
answered affirmatively.
Mr. Aguila did not see any indication about the dumpsters
being enclosed and he wanted to see gate enclosures on the
dumpsters, although he understood the Sanitation Department
does not like them because they must get out of the trucks.
He recommended that dumpster gates be provided on all
projects. Mr. Annunziato informed Chairman Walshak that
there in no Code that requires or does not require them. It

might become incumbent upon the applicant to see that he has
the gates open because the dumpsters are picked up on a
regular schedule. Chairman Walshak thought this should be

Miss Toney advised that the policy now is that if they have
gates, they are to be open at a certain time. If the gates
are closed, the garbage is not picked up. There was further
discussion. Chairman Walshak did not think the Board could
do anything about the gate enclosures now because they had
to abide by the Codes. Mr. Annun~ziat0 thought the Board
could impose any reasonable restriction on the approval of
a site plan if it was related to health, safety, welfare and
harmony. After further comments about whether it could be
put in the motion as a recommendation, Chairman Walshak felt
it would be up to the motion maker. Mr. Moshakos agreed
with Mr. Aguila's suggestion and said they will have gates.
Mr. Aguila moved to approve the amended site plan to allow
for elevation changes and parking lot improvements, subject
to staff comments and the discussion of providing dumpster
gates on the proposed dumpster location as well as a wall
with a stucco finish. Mr. Collins seconded the motion, and

George Davis, Architect, 1100 South Federal Highway, came
forward. Mr. Howard asked about the size of the Hibiscus
hedge. Mr. Davis referred to there being no staff comments,
but said the~e should be one from Mr. Jaeger. He felt Manor
Care should replace all of the hedges and trees that were
destroyed along the east property line of Congress Avenue in
the widening of the street. Mr. Davis said that should be
part of the motion tonight. He agreed with Mr. Howard that
the hedges along the northeast corner had been severely
trimmed. Mr. Davis believed the hedges would come back, but
he suggested ~hat the Board could stipulate that if they do
not come back, they may be replaced.
Chairman Walshak thought the Board would be usurping Code
Enforcement. There was discussion about Code Enforcement
and Chairman Walshak alluded to numerous places where trees
and shrubs in new construction projects are dying. He said
it was up to the Board as to what they wanted to do about
the hedges in this project.
Mr. Richter moved to approve the request with the contingency
that they replace all of the landscaping that was destroyed
by the widening of Congress Avenue. Mr. Aguila seconded the
motion. There was discussion about the motion and whether
it should say they should br~ing the landscaping to Code and

company will occupy the existing building. The Novatech
facility went through a conditional use approval around 1984.
Mr. Golden said the existing parking lot, to a large degree,
meets Code because of the prior conditional use approval.
The applicant will have to upgrade certain aspects of the
site, and Mr. Golden explained. Some changes were proposed
for the exterior of the building, and they were shown on the
colored elevations.
Originally, the elevations submitted proposed to make use of
.some panels that had been left over by Novatech. Mr. Golden
read a letter from James A. Johnson, Architect, which
addressed the fact that the elevations had been revised
since the original submittal to change the exterior
material. The letter stated that the cost to use the
Novatech system proved to be too prohibitive, so the
drawings were revised to show the changes. The changes were
explained in the letter.

Delray Beach, FL 33483, informed the Members that Thomas C.
Usher, owner of the project and Usher Insurance Company was
also present. Mr. Johnson was familiar with the staff
comments and agreed with all of them.
Thomas C. Usher, 25 S. E. Second Avenue, Suite 1140, Miami,
FL 33131, stated that he is a Canadian pharmaceutical manu-
facturer in Toronto, where they have a factory that makes
pharmaceuticals based on sugar, including one which just
cleared the Canadian equivalent of FDA for the treatment of
AIDS. He believed the drug would also be cleared in the
United States. One of the activities of the factory here
will be to manufacture this drug. It starts from sugar by a
fermentation action developed by Mr. Usher in England.
Mr. Usher explained how they make the drug. Me referred to
making various things from dextron and said the original
invention was a substitute for blood for blood transfusions
that is now used all over the world. Mr. Usher stated that
they have derivatized the same dextron used for blood substi-
tution into various products for the treatment of anemia,
cholesterol and now AIDS. The drug has not yet gone into
chemical trials. They are going into clinical tests in
Canada and the United States. Mr. Usher did important
pioneer work in the pharmaceutical field. They will use
large quantities of alcohol and sugar in the process but
otherwise it is a non-toxic process.
In Canada, Mr. Usher said it is called an emergency drug.
The AIDS situation in Canada is desperate, and pressure was
put on the Canadian FDA to allow it. It has been on the
market in Japan for the treatment of cholesterol, so it is
known to be safe. The AIDS community has been buying it,
and Mr. Usher said they have been shipping it to Japan.
They have not been allowed to sell it in Canada, but homo-
sexuals are entering Japan to bring it back. There has been
publicity in medical papers about this. Mr. Usher believed
the emergency regulations do not require clinical trial if
you can satisfy the regulative body that it is safe.
Mr. Johnson explained to Mr. Aguila that the building is an
open, structural shed that has a roof only and no walls.
Ail they are doing is enclosing the existing walls. They

Digby Bridges, Architect, Marsh & Associates, P.A.,
124 N. E. 5th Avenue, Delray Beach, FL 33483, said with
respect to the comment about hazardous waste, his client had
been cleared of that. The applicant does not expect to use
any hazardous material. It is basically testing concrete
compression strengths, soils, different materials, etc.,
geological things, and water testing. There are no hazardous
wastes.
Mr. Bridges noted all of the comments and wanted to clear
one of the comments made by Don Jaeger, Building Department.
(See Addendum H-1 attached to the original copy of these
minutes.) Mr. Bridges said the sign was shown on the survey
but not on their site plan as a free standing sign. It is
an existing, free standing sign which has gone through all
of the City's approvals. The signs on the building will be
reduced in size from those existing because they cannot fit
on the new band. They will go through the CAB, and they are
on the CAB drawings. Mr. Bridges stated that they will also
get rid of the Australian Pine on the entrance drive.
Chairman Walshak drew attention to the 9th comment in Mr.
Jaeger's memo. After further comments, Mr. Annunziato
advised that if the sign is not conforming, they will have
three years to comply. Mr. Bridges stated that he had met
with Mr. Jaeger, and they are sorting out the landscape
plans. All of the corrected plans will be back in tomorrow,
including drainage. Mr. Bridges was in agreement with all

Miss Heyden informed Chairman Walshak that the site plan on
the overlay was approved by the City Commission in October
of 1988. The area was sold, resulting in a relocation of
the retention area on adjacent property within a dedicated
easement. Another change was a shifting of the driveway
onto Congress south and moving Building A (the front build-
ing) north. This change was indicated on the drawings
submitted for site plan modification. The driveway is with-
in 25 feet of an existing driveway on the property to the
north, which raised concerns by the Public Works, Police,
and Engineering Departments.
Miss Heyden continued by saying the applicant has worked
closely with the City Staff and yesterday, they reviewed
revised plans where ehanqes can be made. On the revised
plan, the applicant reduced the front building square foot-
age by 800 square feet, and two surplus parking spaces were
deleted to increase interior landscaping. Miss Heyden added
that the easement will not be used strictly for retention.
She informed the Members that the current elevations were
identical to the colors and materials that were submitted at
the original site plan approval.
The TRB recommended approval, subject to staff comments
attached to the original copy of these minutes as Addenda
I-1 through I-2 inclusive, and to the following comments:

property to at least 10' in width. This lane may consist of
a compacted rock base with sod overlay, to meet the City's

1. The applicant must submit a permit from the Palm Beach
County Engineering Department to install the landscape
materials in the Congress Avenue median.
The applicant should submit calculations for interior
parking lot landscaping showing a minimum of 20 s.f.

Chairman Walshak recalled when this first came through in
August or September of last year, a question was brought up
about a residence. He commented that all over the country,
this is being done (a residence on site to secure the
grounds). Chairman Walshak recollected that the Board had
said they would address this when they got to the Compre-
hensive Plan, but he did not remember addressing it at any
of the workshops they had during the past two months. Mr.
Richter agreed that it is a normal thing in industry.
Mr. Aguila wanted to see the handicap spaces located on the
other side, closer to the building, so handicapped people
do not have to go across the driveway to get to the ramp.
Miss Heyden thought there was a comment by Don Jaeger, Build-
ing Department, about handicap accessibility. Reference was
made to the 8th comment from the Building Department
(Addendum I-2).
Mr. Richter asked about the first comment from the City
FOrester. Mr. Golden explained that Congress Avenue is a
County road.
Randall Adrian, Agent, 6929 Town Harbor Boulevard, Boca
Raton, showed a rendering of what the Board approved in
September. In working with the City staff, they made a
mere image of the building. They cut it off 800 square feet
because when they flip-flopped the building, the side was
not exactly square, and it gave them a little dimensional
problem where they could not keep the landscaping around the
parking lot on their property. 800 square feet was chopped
off the building to do that. It has been their policy and
their intent not to ask Boynton Beach for any variances.
Mr. Adrian believed everything they have is totally in
accordance with all of the City Ordinances.
Mr. Adrian informed Vice Chairman Blanchette that he just
finished this type of building in Pompano Beach. Vice
Chairman Blanchette asked how many people actually go into

these types of places. Mr. Adrian replied that 30 cars a
day come. He stated that his daughter is a paraplegic, and
she would not have any problem with anything there. Mr.
Aguila clarified that he would like to see them be able to
get out of their cars and go right up the ramp that is pro-
vided. He pointed out that the applicant has the room for
the same handicapped spaces on the other side. Mr. Aguila
felt it would be a safer condition. Mr. Adrian had no objec-
tion to that.
Mr. Adrian was familiar with all of the staff comments but
said some are not applicable any more. He alluded to a
comment that said they needed to get a variance because
there were some bushes in the easement. Mr. Adrian said
they had changed that, so the comment was no longer appli-
cable.
In response to a question by Chairman Walshak, Mr. Adrian
confirmed that he had a residence on his original plan, and
he stated that he would prefer to have a residence there,
but he did not want to ask the City for a variance.
Chairman Walshak questioned why Mr. Adrian would not want to
ask for a variance and he advised that the variance laws are
to help people. Mr. Adrian did not want delays for
variances. After further comments were made by him and
Chairman Walshak, Mr. Adrian informed the Members that he
made a presentation on a similar project in Mangonia Park,
and they insisted on a Resident Manager. Although he
thought it would be added security for the tenants and would
assist the Police and Fire Departments, Mr. Adrian had not
submitted an application for a varIance. He emphasized that
he needed to get the project built, and he elaborated.
Mr. Annunziato advised the Members that no residences are
permitted in the M-1 category. The only way they could be
permitted would be if the City Commission could construe
that it would be an accessory use to this kind of facility
and be so customary and incidental that the Zoning Ordinance
would not have construed it not to be permitted. This City
has never concluded that. Mr. Annunziato suggested that now
may be the time to address it. Chairman Walshak recalled
that he had wanted that on the agenda for the Comprehensive
Plan but, apparently, it had fallen through the cracks. He
wanted the Board to address it at the next workshop.
Mr. Richter moved, seconded by Mr. Lehnertz, to approve the
request, subject to staff comments.

Mr. Annunziato asked whether the motion should include that
the handicapped parking spaces should be closer to the
office. Chairman Walshak answered that was part of the
staff comments that Mr. Adrian had agreed to.
A vote was taken on the motion, and the motion carried 7-0.
Chairman Walshak commended the TRB for doing a good job.
OTHER
CONSISTENCY REVIEW - Proposed amendment to Section
ll.H.13, c (4) of Appendix A, Zoning, parking requirement
for day care centers
Mr. Golden stated that the staff has had a lot of feedback
from developers of day care centers that the City's parking
requirements are overly stringent, particularly when you
look at other cities, countiss, and jurisdictions. W-hen
the request came through for a day care center at Quantum,
the zssue was raised at that time too.
Mr. Golden said that recently, the City reviewed a site plan
that was for a water service agreement for a day care center
in Palm Beach' County that will be annexed in the near future.
The day care center agreed to go through the City's site
plan approval, and the same issue came up. The day care
center agreed to meet City Codes as much as possible where
it did not conflict with the County's Codes. The one area
where they had a real problem was the number of parking
spaces. Mr. Annunziato advised the developer to obtain
information about other jurisdictions and their requirements,
do an analysis of existing facilities, and submit it to the
TRB so they could evaluate it. The TRB did that.
Mr. Golden continued by saying many have felt all along that
the requirements are excessiue. After evaluating that, the
TRB felt it should be changed from one per 200, which is the
retail requirement, to one per 300, which is in line for
the Professional/Office requirement. Also, the issue came
up about drop off areas in front of the building, so that
was addressed too.
Vice Chairman Blanchette thought the parking for a lot of
occupancies should be looked at, and he agreed with the TRB.
Mr. Golden said the parking at some of the mini warehouses
may be less intense than general warehousing. Vice Chairman
Blanchette felt that some pa~king for self storage is a

waste of money, and the money reflects back to the cost of
the user.
Chairman Walshak referred to Safekeeping (the project above)
where he gets 30 trips a day, and the City is requiring that
he have 140 parking spaces. That seemed really excessive.
He asked if a study could be done. Mr. Annunziato answered,
"Sure." Chairman Walshak thought the consistencies were
nice and expressed that he would like to see more of this
kind of thing done. With regard to self storage, Mr.
Annunziato said they would look at parking and a residence
and see if there is a lot of documentation. They will bring
back facts and comments. Mr. Annunziato felt Mr. Adrian of
Safekeeping could be very helpful, as he knows what he is
doing.
Mr. Golden added that this requirement would put
line with Delray Beach and will be a little more
than the County's. There were further comments.

Funding Element
Chairman Walshak asked if the Board would get a funding
element prior to the public hearing next week (Wednesday,
March 22nd). Mr. Annunziato did not know that they would
get it prior to the public hearing but said they will
certainly get it prior to the adoption of the plan.
Chairman Walshak knew the Planning Department was under a
great amount of pressure, and he thought they were doing a
tremendous job.
When a particular Code is not working as was intended and
needs to be modified, Mr. Aguila asked ii something is done
as they go along or if they wait until the whole Plan is
done. Mr. Annunziato replied that there is documentation
for almost everything. He added that standards change too.
Large portions of the Zoning Code have already been amended,
such as the commercial aspects, environmental, and the non-
conforming uses. Mr. Annunziato said probably 70% of the
Zoning Code have received major amendments in the last four

years. The City did not anticipate going back into the
Code.
Over the past three or four months, Chairman Walshak felt
the Board had brought up numerous consistency changes that
some of them would like to see. He felt it was a good idea.
Mr. Annunziato informed Mr. Aguila that if the City
Commission deems it necessary and it is consistent with the
Board's and staff's recommendation, the Commission will go
into the Code amendment procedure.

Conditional Use Application
Summary: Timothy p. Dale agent for the Lake Wo~ ~-~ -'
School Society, Inc., is requesting Conditional Use approval to
construct a 17,500 square foot gymnasium at the exist~g school,
site. The existing school, which occupies a 10.08 acre parcel,
is located on the east side of High Ridge Road, south of Hypotuxo
Road. The school is zoned R-iAA, Single-Family Residential.
Secondary schools are permitted subject to Conditional Use
approval in the R-iAAA zoning district.

Residential, in Palm Beach County. Abutting the s~ject parcel
to the easu is the right-of-way ~or the Seaboard A~ine Railroad
and Interstate 95. Abutting the subject parcel to tl~_ south are
vacant single-family platted lots within the Cedar P~d~e Estates
Planned Unit Development (PUD), with the exception~ the lot
adjacent to High Ridge Road which is zoned RS in Ps~ Beach
County and is currently owned by the Lake Worth Christian School.
Abutting the subject parcel to the west is the right~-~_lr_~-way for
H~gh Ridge Road. Further to the west across High Ri~_~ Road, are
szngle-family homes on large platted lots zoned RS in Pa!m Beach
County.
Proposed Use (see attached copy of site plan ~ The applicant is
proposing to construct a 17,500 square foot gymnasium to serve
the existing high school. The existing parking lot is proposed
to be renovated to meet the requirements of Article X, Parking
Lots. A new parking lot addition is also proposed on the north
side of the g!rmnasium. Include~with this application is a-
request for approval of a shared parking allocation (see attached
~opy of the parking study).
Standards for Evaluating Conditional Uses: Section tl.2.D of the
Zoning Regulations contains the following standards to which
conditional uses are required to conform. Following each of
these standards is the Planning Department's evaluation of the
application as to whether it would comply with the particular
standard:

The Planning and~Zoning Board and City Commission shall consider
only such conditional uses as are authorized under the terms of
these zoning regulations, and, in connectiontherewith, may grant
conditional uses absolutely or conditioned upon the faithful
adherence to and of fulfillment of such restrictions ~d
conditions including; but not limited to, the dedication of
property for streets, alleys, and recreation space, and
sidewalks, as shall be necessary for the protectionof the
surrounding area and the citizen's general welfare, or deny
conditional uses when not in harmony with the intent and purpose
of this section. In evaluating an application for co~ditionai
use, the Board and Commission shall consider theeffect of the
proposed use on the general health, safety, and welfare of the
community, and make written findings certifying that satisfactory
provision has been made concerning the followingsta~d~rds~ wh~re
applicable:
Ingress and egress to the subject property and pr-_~osed
structures thereon, with particular reference to~tomobile
and pedestrian safety and convenience, traffic flow and
control, and access in case of fire or catastrophe.
Proposed access to the property would occur by waF of the two
existing driveways onto High Ridge Road. These two driveways
provide sufficient access to the site. As required by the
Parking Lot Regulations, the applicant has submit-t~d a
traffic control plan which provides for placement of traffic
signs and pavement striping. A stabitize~, fire /m~e has been
provided around the perimeter of the proposed g!rmn~sium to
allow for emergency vehicle access in case of fire or
catastrophe. '
Off-street parking and loading ar~as where required, with
particular attention to the items in subsection D.! above,
and the economic, glare, noise and odor effects t~e
conditional use would have on adjacent nearby pro_~_rties, and
the city as a whole.
The applicant has submitted a shared parking study which
indicates that sufficient parking has been provided to meet
the n~ds of the school when in operation and the gYr~nasium
~uring major athletic events (see attached report on shared
parking). It is not anticipated that the proposed-use would
create a nuisance for the ex~sting residences located to the
north and across High Ridge Road to the west, as the.proposed
glannasiumwil! be located in the south/central portion of the
site, at least 200 feet from the nearest residence.
Refuse and service areas, with particular reference to the
items in subsection D.1 and D.2 above.
A dumpster is proposed to be located at the east end of the
new parking lot addition, north of the proposed gymnasium.
The Acting Public Works Director has indicated that this

would be a suitable location for the dumpster.
Utilities with reference to locations, availability~
compatibility.

The existing utility systems and the proposed extensions are
adequate to serve the proposed use. However, s~ additional
fire hydrant protection will be required, as noted in the
comments from the Utilities Director.
Screening, buffering, and landscaping with refer~e to typ. e,
dimensions and character. '
Some additional landscaping is required for the renovated
parking lot and the new parking lot addition. ~n~ proposed
landscaping meets the requirements of the landscape~ codeJ-
6. Signs and proposed exterior lighting, with reference to
glare, traffic safety, economic effect, and compatibility and
harmony with adjacent and nearby properties~
There are no additional signs proposed. Wi~ respect to
lighting, the applicant has hired the Florida Power and Light
Company to prepare a site lighting plan that meets the
minimum requirements of the Parking Lot Regula~. The
details of this plan will be reviewed by staff, prior to
permitting. It is not anticipated that the prop~_~ed lighting
plan will create a nuisance to surrounding land
~ 7. Required setbacks and other open spaces.
The proposed setbacks for the new 9Aaunasiumexce~d the
requirements of the R-1AA zonin~ district reguiat~s.
8. General compatibility with adjacent properties ~ other . properties in the zoning district.
The proposed gymnasium is consistent with ~he curr~nt use of
the property and it is not anticipated that there will be any
adverse impacts to adjacent properties. The closesu existing
residence is located over 200 feet to the north of the
proposed gymnasium and the vacant single-family lots which
were platted as part of the Cedar Ridge Estates Planned Unit
Development lie over 70 feet..:to.~the south.
9. Height of buildings and structures, with ~eference to
compatibility and harmony with adjacen~ and nearly
properties, and the City as a whole.
The proposed building height is thirty and one-half feet. On
February 21, 1989 the City Commission approved a height
exception to allow for an additional six feet above the
twenty five feet permitted under the R-1AA zoning district
regulations. It is nou anticipated that the proposed
building height would create a conflict with surrounding land
uses.
10. Economic effects on adjacent properties and the City as a
whole. ~
It is not anticipated that the proposed gymnasium addition
would have an adverse impact on property values in ~e
vicinity or would, impair the developability of these
properties.
Comprehensive Plan Policies

Conditional Use application.

above-referenced request for an amendedsite plan.
To follow-up the note on the plans that "the Homeowners Association shall
be liable' for damages to city emergency vehicles on duty", a hold harmless
agreement shall be drawn up and reviewed by the City Attorney.
Provide details for guardhouse parking.
Show the proposed fence locations on the master development plans
consistent with the previously appmoved fences.
Since previously approved fences are to be maintained by the Homeowners
Association, the association documents shall include maintenance of the
proposed fences on lots 100-110. If document revisions are necessary,
they shall be reviewed by the City Attorney.
Clearly indicate on sheet L-3A where the chain link fence and the shadow
box fence are to be located in relation to each other around the city
lift snation. A written agreement should be submitted for review by the
City Attorney regarding which party will maintain the fences and land-
scaping around the lift station.
Due to the visual distance of the security ganes at Temple Avenue, Orange
Drive and Citrus Trail from the guardhouse on Citrus Avenue, the proposed
system would require all guests, service vehicles with deliveries or on
call and city emergency vehicles to check in at the guardhouse in the
middle of the development resulting in decreased response time and confusion.
In addition, there is not a master association for the Executive Estates
and Citrus Trail plats. Each is controlled by a separate association.
This may present a problem since the guardhouse manned with a 24 hour guard
is situated in the Executive Estates plat.

Please be advised of the Planning Department's comments with-~nespecz to the
above-referenced request for an amended site plan.

Revise data on sheet A-la and page 4 of site p~an appi~n regarding
parking. The total gross floor area including that used f~r ~rehouse
storage and accessory office ~pace requires 1 parkiug~paee for every
800 ~quare feet. Therefore, based upon 112,519 gross floor area,
parking spaces are required; 143 parking spaces have ~ ~_vided.
(The ratio of 1/800 applies to all bays that arel~m~er than 500
square fee~. The bays that are larger than 500 square ~ rmqn/re not
less than 2 parking spaces).
3. Delete the word "apartment" from "bUilding ~ first f~mor-~=r?- " on sheet
A-4. If it is the desire to pursue allowing a reside~. ~=~-essorv to
the principal storage use, (currently prohibitedintb~M--l=~ietri~t)

Language must be provided in the drainage easement agreement
to allow for these elements to be placed in the easement and
for perpetual maintenance of these elements.

3. The landscaping plans conflict with the engineering plans
at the northeast property corner.
4. Curbing must be provided around landscape areas adjacent to
parking stalls.
5. Rooftop air conditioning units must be baffled.
6. The zoning ordinance ~rohibits residences in M-1

will insure a timely permitting process.

Provide documentation prior to final sign-off verifying that the
additional 7 feet of right-of-way for Congress Avenue has been
dedicated.
Sheets 3 of 6, E 1 and 1 of 2 do not show the paved access no the manhole.
If a C.A,B. landscape variance is applied for and non approved for
required landscaping provided off-site, parking along the southern
property line will have to shift. To do this, total building square
footage may have to be reduced if more thanthet~wo surplus parking spaces
are deleted. ~ The City Forester's comment regarding a shortage of
required interior landscaping within the parking areas which should
be summarized in tableform on the landscape plan may also.result in
a reduction of square footage. Any changes in building footprint or
parking layout must be shown on the following drawings: 2 of 6, 3 of 6,
A-ial E 1, 1 of 2 and 2 of 2. The elevations on sheets A-6 and A-7
may change. Also the following floor plan drawings may be affected:
unit schedule on A-la, A-2, A-3, A-4, A-5, E-2, E-3, E-4, M-2 and M-3.
