ACKNOWLEDGEMENT OF MEMBERS AND VISITORS After the Pledge of Allegiance to the Flag, Chairman Walshak introduced the Planning Director, Members of the Board, the d Planning Staff, and the Recording Secretary. He welcome Murray Howard, newly appointed Alternate Member, to the Board. Mr. Howard was sitting in the audience. APPROVAL OF MINUTES OF DECEMBER 13, 1988 Mr. Aguila called attention to the 5th line in the first paragraph on page 2 under "NEW BUSINESS, OTHER," of the minutes and said after "FEC Railroad tracks" the words "on the east, and 1-95 on the west" should be inserted. In the last paragraph on page 4, Mrs. Huekle said it should be Florida Statutes 163.360 instead of 160.360. Mrs. Huckle moved to approve the minutes as corrected. The motion was seconded by Mr. Richter and carried 7-0. MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA JANUARY 10, 1989 ANNOUNCEMENTS Joint Workshop with City Commission, January ~4, 1989 at 6:00 P. Mr. Annunziato reminded the Members of this meeting and asked them to pick up copies of three of the elements (Conservation Element, Coastal Zone, and Recreation/Open Space Element) they will be looking at that night. COMMUNICATIONS Chairman Walshak received a copy of a letter addressed to Murray Howard from Mayor Marchese, dated January 4, 1989, which said that on January 3, 1989, Mr. Howard was appointed by the City Commission as an Alternate Member of the Board. Chairman Walshak received correspondence and announced that he had material if any of the Members wished to become a Member of the American Planning Association at their own expense. OLD BUSINESS A. Kalra South Seacrest Boulevard at Golf Road, southeast corner Lot 1, less the road right-of-way of Sea- crest Boulevard, Plat of High Ridge, recorded in Plat Book 23 Page 225, Palm Beach County, Florida, Public Records Request for site plan approval to convert the existing single family residence into a 1,562 square foot medical office building Mr. Golden informed the Members that a site plan and parking lot variance had previously been submitted for this property under the name of Addison Square. Since that time, the property was sold to the Kalras. Mrs. Kalra is a doctor, and she plans to renovate the single family home into a medical office building. A new porch is proposed to be added to the existing home at the front entrance. Mr. Golden presented a colored elevation. Referring to the site plan, Mr. Golden said a 12 space parking lot is on the south side of the building. There are four more spaces than what is rquired by the Code. The MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA JANUARY 10, 1989 variance approval for Addison Square included two driveways (one on Golf Road and one on Seacrest Boulevard). Mr. Golden said the applicant was proposing to utilize the driveway on Seacrest Boulevard. Variances run with the land, so Mr. Golden said the applicant had the opportunity to utilize that location. The driveway onto Golf Road will not be utilized. The Technical Review Board (TRB) recommended approval, subject tc staff comments, as follows: Engineering Department 1. The type of pavement and base material should be shown, along with a section drawing of the finished pavement. 2. The drainage calculations do not check out. The proposed swale volume will have to be increased. Corrected drain- age calculations are required. Police Department 1. Secure or remove swimming pool. 2. Comply with the City's Construction Security Ordinance. Planning Department An additional 15 feet of right-of-way for Golf Road ks to be dedicated to Palm Beach County within 45 days of site plan approval in accordance with the Palm Beach County Thoroughfare Right-of-Way Protection Map. Forester/Horticulturist 30% of shrub species must be native. The species and quantities of trees to be removed, trans- planted or replanted with other trees should be ncted on the plan. Chairman Walshak noted there is already an existing ~rive- way, and he questioned whether Mr. Golden was suggesting that this driveway would remain in existence and they would have two curb cuts (one on 23rd and one on Seacrest). Mr. Golden showed a driveway on the site plan and said it is proposed to be taken out of service. They are proposing a driveway onto Seacrest to serve the parking lot, and that location is consistent with the previous variance approval for Addison Square. There was discussion about the drive- ways and the variance. Prior statements were repeated. MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA JANUARY 10, 1989 Mr. Golden informed Chairman Walshak that the applicant proposes to fill the swimming pool that is in back of the home, and a portion of the parking lot will be over the pool. Mr. Richter asked about the colors of the building, and Mr. Golden replied that the colors will be Concrete Buff and Sumac Red. Mr. Lehnertz read the memo from the Engineering Department and asked if there would be any problem in doing that. Mr. Golden answered that there should not be. Mr. Aguila referred to the comment from the Planning Depart- ment. If the applicant did that, he felt it would interfere with the location of the sign. Also, the landscape ~ould be within that. Mr. Golden responded that the applicant may have to shift that back. Mr. Aguila questioned whether the City allows the planting of trees on a utility easement. Mr. Golden replied that the Utilities Department enforces that. There is a list of permitted species, such as those with shallow root s~stems that will not interfere with the utilities. They can be planted in utility easements. After explaining, Mr. Aguila asked if the drawings would be used for permitting. He asked because there were a number of Code violations on them. Mr. Golden answered tha~ the plans would have to be supplemented at the time of per- mitting to show all of the interior renovations. The plans would have to be revised, subject to staff comments, and be resubmitted for sign off. Mr. Golden explained. Mr. Annunziato added that it may be the applicant's intent to use the plan sheets for permits, but the plans have ~ot received permit review. Mrs. Huckle thought this was an improvement over the prior site plan, and she was pleased that something new had been proposed for this site. There were further comments about the plan. No one was present to represent the applicant. Vice Chairman Blanchette moved to accept the request for site plan approval, subject to staff comments. Mrs. Huckle seconded the motion, and the motion carried 7-0. 2. Project Name: Kaufman Warehouse Building Agent: None - 5 - MINUTES PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA JANUARY 10, 1989 Owner: Samuel Kaufman Location: East side of S. W. 14th Place, south of $. W. 30th Avenue Legal Description: Description: Lot 8, Lawson Industrial Park Request for site plan approval to construct an 8,900 square foot warehouse/light industrial building on .5 acres Miss Heyden said the building will be used for warehouse storage and other light industrial uses. After explaining the parking, she said it will be on the north side of the building. There are windows, doors, and bay doors om the north side elevation only. The southern 1/2 of the lot will be subdivided off. It is not a part of this requestl but it is owned by Mr. Kaufman. Miss Heyden said it will be an off white stucco building with a dark blue band. She presented color chips to the Members. Blue canvas awnings will be above the windows and doors, and there will be a blue sign panel. The wes~ eleva- tion also faces the street and shows a blue sign panel and building address numbers. The east and south elevations are solid walls. The TRB recommended approval, subject to the following staff comments and Addenda A-1 through A-3 inclusive. Police Department 1. Needs stop bar. 2. Exterior pole lighting needs to be photo cell activated. 3. Comply with City's Construction Security Ordinance. Public Works Change dumpster location to adjacent to the building~ The dumpster pad should be 10xl0 and set back 25 feet from front of building. Total back set will be 35 feet from front of building to rear of dumpster pad. Forester/Horticulturist The applicant must meet with the City Forester to discuss landscaping in the cul-de-sac area of S. W. 14th Place. - 6 - MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA JANUARY 10, 1989 Fire Department Site shall conform to City subdivision requirements with reference to fire hydrant location. Mr. Lehnertz referred to the fifth comment in the memo from Bill Flushing, Assistant to the City Engineer, and asked why a letter was needed. When the subdivision was designed with on site retention, Mr. Annunziato said all of the sites served by the on site retention were calculated in the capa- city of the on site system. He thought Mr. Flushing was suggesting that the fact this occurred had to be documented. Mr. Annunziato explained that the water was not being retained on this property but was being retained on property of the subdivision. Mr. Aguila asked what would happen to the one foot between the building and the property line. He inquired whether it would be sodded. Samuel Kaufgman, 1401 N. W. 15th A~enue, Boca Raton, FL 33486, did not plan on doing anything. Chairman Walshak told Mr. Kaufman he would be called when the Board was finished with the City's presentation. Mr. Aguila asked if the hedge on the north side was in good shape. After discussion, Miss Heyden noted that Kevin Hallahan, Forester/Horticulturist did not address that, and she said she would have him look into it. Mr. Richter went to the site, and it appeared that there were four different properties on the cul-de-sac. TWo buildings have already been built. With reference to the Firs Department's memo, Mr. Richter wondered if the appli- cant would be required to bear the burden of the fire hydrant himself, or if it would be shared among those on the cul-de-sac. Mr. Annunzlato answered that it would depend on the location of the fire hydrant. The City Code provides that no part of any commercial or industrial buildinq shall be more than 200 feet from a fire hydrant. If this building is more than 200 feet from an existing fire hydrant, the owner must bear the responsibility of putting in a water main and fire hydrant. Mr. Richter observed that there was a little round spot in the middle of the cul-de-sac that was not landscaped. It appeared that the applicant was to meet with the City Forester to discuss landscaping in the cul-de-sac area, and he thought the City would be better off if that area was paved and made into a big turnaround area. Mr. Annunziato answered that the current Comprehensive Plan policies pro- vide that when properties develop adjacent to areas that 7 m MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA JANUARY 10, 1989 have to be landscaped along rights-of-way, there is an obli- gation on the part of the applicant to provide for that landscaping. There has always been somewhat of a commitment from the subdivider of the property to do that landscaping. Mr. Annunziato did not necessarily disagree with Mr. Richter about the pavement and said it may wind up being an alterna- tive. Mr. Richter thought it would be a simple solution to something that should be shared by four property owners. Mr. Kaufman was called forward. When he purchased t~e land, Chairman Walshak questioned whether Mr. Kaufman made an agreement with the people to whom he was selling to share the cost of putting in the fire hydrant. Mr. Kaufman replied that the cost of it would be on his shoulders. It seemed like everybody on that side of the street had to put a fire hydrant in front of his property. Chairman Walshak thought Mr. Richter's suggestion about paving the center of the cul-de-sac was good. Mr. Kaufman felt the whole street should pitch in and come to a conclusion about what should be done. ~r. Aguila again asked about the one foot between Mr~ Kaufman's building and the property line and asked if he intended to do nothing until the south is developed. Mr. Kaufman answered affirmatively and explained that the reason it is one foot off is because the footer will be two feet wide. Mr. Richter moved to accept the request for site plaT approval, subject to staff comments. Mr. Lehnertz seconded the motion, and the motion carried 7-0. 3. E-4 Canal See "Addendum B" attached to the ol'iginal copy of these minutes in the Offic~ of the City Clerk Request for use approval and site lan approval to construct a 3,924 square foot clubhouse on one (1) acre at the Q~antum Park of Commerce Planned Industria~ Development (PID) - 8 - MINUTES - PLAiqNING & ZONING BOARD BOYNTON BEACH, FLORIDA JANUARY 10, 1989 Mr. Golden made the presentation and said the futurelCity park within Quantum Park lies south of this site. This property was deeded to the FOP as part of the land swap between the City and Deutsgh Ireland. Mr. Golden eXPlained the land swap and then said the building is located in the approximate center of the site. Parking will be provided on the north and south sides of the building. A driveway is located near the west property boundary. There is ai25 foot greenbelt along Miner Road, iconsistent with the requirements of the PID requirements. Mr. Golden continued by saying the building will be %ight gray and CBS Construction. The TRB recommended approval, subject to the following staff comment and those sho~n in Addenda C-1 through C-3 inclusive. Forester/Horticulturist The applicant should provide additional landscaping viSually buffer the north property line and proposed building site. Vice Chairman Blanchette called attention to the rea~ backup in the parking lot, which was shown as 25 feet, and ~e asked if it should be 27 feet. Mr. Golden explained that St was not scaled from the actual line of pavement. The edge of pavement is actually 27 feet, but, for some reason, the line was drawn two feet away from the pavement. Mr. Golden assured Vice Chairman Blanchette that there was enough foot- age. There were comments relating to the minimum footage ~equired for the Fire Department and two way drives. Mr. Collins asked how long it will be before Miner Road will be completed. Mr. Annunziato answered that the road is~to be contraCted this year. Miner ROad, between Congress and High is to be under construction during the bgdget Ridge Road, year of 1989. It is currently under design. Vice Chairman Blanchette wondered what would happen Fo the old building. Mr. Annunziato replied that it will b? demolished when necessary. · George C. Davis, Architect, 1100 South Federal Highway, came forward. Mrs. Huckle referred:to comment %3 from Biil Flushing, Engineering Department, (Addendum C-l), and asked under what circumstances the City could expect the County to provide a sidewalk. Mr. Annunziato answered that th, - 9 - MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA JANUARY 10, 1989 County's cross section for the road most assuredly will provide for a bike path on one side. He thought it would depend on who gets there first. If the applicant requests a certificate of occupancy (C.O.) before the road is in place, the City's Code will require that he construct a sidewalk. After the road is under construction or before it is completed, the County would build the sidewalk. Under Appendix A, Chapter 7, Uses Permitted in a PID~ Chairman Walshak asked what this would be classified as. Mr. Annunziato thought they would just call it an FOP private clubhouse. It is not a public facility. There was discussion about the location. Vice Chairman Blanchette asked if there would be a shooting range, and Mr. Annunziato answered, "No." In Appendix A, Section 7, paragraph (e) under PID, C~airman Wals~ak noted they talked about professional buildings and office buildings. Be commented that it was up to the Board to establish consistency with the PID. Mr. Annunzlato responded that it has long been recognized that they could never anticipate all of the different uses that could locate in a PID. There were further comments. Mrs. Huckle moved that the Board make a finding that the FOP clubhouse is consistent with the PID zoning. Mr. Richter seconded the motion, and the motion carried 7-0. Menendez and Enrico Rossi Quantum Associates East side of Alpha Drive cul-de-sac, south of South Park Boulevard Lots 46-B and 46-C at Alpha Drive, Quantum Park at Boynton Beach, P.I.D., Plat No. 10, recorded in Plat Book 60, pages 34, 35 and 36, Public Records of Palm Beach County, Florida Request for site plan approval to construct a 14,842 square foot solvent distribution center on Lots 46B and 46C (3.19 acres) at the Quantum Park of Commerce Planned Industrial Development 10 - MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA JANUARY 10, 1989 On August 9, 1988, Mr. Golden said the P&Z Board approved this type of use for those lots categorized as industrial on the master plan of Quantum Park. The applicant submitted a letter to the City at that time, which described in detail the nature of the business, including the products and characteristic of the corporation's facility. A copy of the letter was included in the ageuda packets the Members had and was also included in the materials that went to the Environmental Review Committee. The project passed environ- mental review. Looking at the site plan, Mr. Golden said the main building is proposed to be located in the center of Lot 46-B. Lot 46-C is the canal right-of-way. Quantum owns the center of the South Water Management District (SFWMD) canal, which is an easement. The building is a one story structure with a mezzanige and a total height of 26½ feet. There is a steel dock for load- ing and unloading, a warehouse area, and administrative offices. In addition to the main building, a tank farm building is located adjacent to the dry retention area on the north/central portion of the site. Mr. Golden explained how the tank farm is connected to the main portion of the building. Mr. Golden informed the Members that the storage tanks in the tank farm contain used oil and mineral spirits, ~hich are picked up by tanker trucks and returned to the r~cycling centers, which are located elsewhere, for reprocessing. They are shipped to the corporation's facilities for redistribution. The size of the tank farm is 2,435 square feet. Mr. Golden added that is the area within the ~alls. Access to the site is provided by Alpha Drive, and parking is provided on the east and west sides of the building and on the east and west sides of the tank farm building~ The building is proposed to be constructed of concrete block with steel overhead doors and a galvanized roof. Glass windows and doors are set in aluminum frames. The b~ilding is a light brownish color, and there is a blue ceramic tile band around the building. The TRB recommended approval, subject to staff comments attached to the original copy of these minutes in the Office of the City Clerk as Addenda D-1 through D-3 and to the following comments: 11 MINUTES - PLANNING & ZONING BOYNTON BEACH, FLORIDA BOARD JANUARY 10, 1989 Engineering Department The storm drainage inlets should not contain water so as to create a mosquito nuisance. A 12 inch mesh covered opening should be provided in the bottom. Three cubic feet of 3/4 inch wash rock should be placed below the opening. Police Department Comply with the City's Construction Security Ordinance. Forester/Horticulturist A vegetative buffer shall be preserved and/or planted, so as to provide a screen with not less than 75% opacity and not less than 30 feet in height within five years of the date of approval of the particular plat or site plan. Mr. Golden advised that the memo from the Fire Department was deleted. There was an issue concerning a fire h~drant that should be there and is not there, but that issue will be taken up with Quantum. In addition, there was an issue concerning the buffer along the Boynton Canal. Mr. Golden said the PID zoning regula- tions require a 40 foot buffer and there has been soSe debate between Quantum and the City about where the buffer should go. Since Quantum owns to the middle of the Canal, they are contending that the buffer should be within the actual canal easement. The City took the opposite position that the buffer should be 40 feet on the property. A compromise was reached with 20 feet in the easement as a sodded area and 20 feet within the property as an actual landscape buffer. In the midst of this conversation; Mr. Golden said there was an oversight concerning a buffer wall that was required to be constructed. The applicant is working on revising his Community Appearance Board drawings to include a buffer wall. Mr. Golden guessed the comment about the buffer wall should be added as %7 on the m~ the Planning Department (Addendum D-3). (This comme] added to the staff comments as ~7 in the memorandum January 4, 1989 that went from the Planning Departme] the City Commission for their meeting of January 17, Chairman Walshak asked what the Environmental Review said about the 40 feet from the water. He further commented. Mr. Annunziato interjected that the easement runs to the center of the canal but the canal only occupies 40 feet of the easement. There is still the canal bank that occupies another 50 or 60 feet before you get to Safety Kleen s property line. The building is set back approximately 80 feet from the property linc, so there is a substantial distance between the building and the actual water. After discussion, Mr. Annunziato stated that Quantum s position was that because there was at least 40 feet of land on the canal side of the property line in an easement, that all of the required 40 feet of landscaped buffer should be on that property. Mr. Annunziato argued that someday, some- time, the SFWMD will come through, maintain the canal, bull- doze that easement, and there will be no more buffer. He said probably all of the buffer should be on the applicant's property. They looked at the definition of a landscape buffer, and it was not conclusive. Grass could be part of a landscape buffer. Mr. Annunziato recommended to the Board that the opaque portion of the landscape buffer be on private property, not easement, given the potential that at some point and time the SFWMD could bulldoze everything on the canal side of the property. The opaque buffer would be un- touched because it would be on private property. Mr. Annunziato thought that was ~a pretty good compromise~ Chairman Walshak questioned whether the gray area was within the Code itself. Mr. Annunziato answered that the g~ay area was the fact that the SFWMD did not mandate that the canal right-of-way be given to them in a number of feet. They took an easement. Mr. Annunzlato apprised the Members that all of the landscaping, the trees, the landsoaped buffer and wall will be on private property, not easement property. Mr. Golden informed Mr. Collins that when they built the master system at Quantum, they forgot to install fire hydrants. This will be taken up with Quantum, as it is Quantum's responsibility. Vice Chairman Blanchette recalled that Mr. that the building was CBS. He asked if it shaded area on the bottom and steel above. Golden mentioned was CBS on the Delfin Menendez, Architect, M.S.M. He said the building is constructed of veneer cinder block. It is the typical metal structure building. It has a darker color on the bottom and a lighter color on the upper portion. A band of blue tiles will be on the top of the building. The plans comply with all of the require- ments with respect to parking and landscaping. Mr. Menendez said they are working on the landscape buffer and havinq a lot of discussions. They had several conversa- tions with the City staff on how to deal with the buffer. With respect to other comments from the TRB, Mr. Menendez said his office and Mr. Rossi's offices are taking care of all of the comments. Enrico Rossi, Rossi & Malvasi, Engineers, Inc., 1675 Palm Beach Lakes Boulevard, Suite 407, West Palm Beach, FL 33401, said they are the Engineers for the applicant and for Q~antum. Referring to the staff comments, Mr. Rossi stated that the engineering layout for Quantum Park provided for no hydrants along the streets as you normally would find for a subdivision. The obvious reason was that they were talking about large lots which are two acres or greater. Each developer, as he comes in, has to place the hydrants off of the main street and bring the water into the project,and locate the hydrants where they can best locate them in relationship to the building and get access for fire protec- tion. They do show them on~ the plans for five, whic~ meet with the Code. Mr. Rossi d~d not know ~at the question was as to why Quantum had not p~ovided the fire hydrants when each applicant and each owner, as he develops his individual lot, provides his own hydrant by bringing it off the existing main. Mr. Rossi was hearing the second question for the first time (the wall requirement within the buffer). In all of the hearings they had on the park itself, he had never heard the wall mentioned as a necessity. Mr. Rossi recognized that the Code calls for a wall being provided by the commer- cial development when you have residential and commercial or industrial. Because this is a PIDr he felt that at some point, Quantum may take exception to that. A PID has certain contractual obligations at the offset which deal with master plans, etc. He was sure Quantum would hear about it. Mr. Rossi stated that the distance across a waterway between a residential and industrial develpment had to sometimes be a factor as to whether or not a wall is needed. The Code 14 - MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA JANUARY 10, 1989 did not address that distance, and he felt there was sti question about its applicability because of the PID natur of this project. Mr. Rossi emphasized that the need for this was not brought out in any of the previous comments This was the first time he heard about it. In response to a question by Mr. Richter, Mr. Rossi repl it was a Code issue. Mr. Annunziato interjected that it a Code requirement, and he added that the City would not doubt the fact that there is large right-of-way, buildinG setback, and no paved buffer is required. However, he pointed out that this Board could not waive the wall. On the Board of Adjustment could waive it. If it made sense not to have the wall, those arguments should be made befc the Board of Adjustment. That was an option that the applicant had. vas Ly Other than that, Mr. Rossi said the comments addressed to the civil engineering aspects were reviewed, and he accepted them. Chairman Walshak asked if the roof on the building was galvanized. He heard Mr. Menendez say it was veneer over metal sheet. Mr. Menendez replied that it was basically a prefab structure. Around the outside, it is like a masonry building. Chairman Walshak determined that it was n~t veneer_ but actually block, and the roof is galvanized. Daniel Dowling, Project Engineer, Safety Kleen Corporation, 777 Big Timber Road, Elgin, Illinois 60123 came forward and gave the history of the company, which was founded in 1968. He said the company operates 175 facilities of this type. Seven are in the State of Florida in Jacksonville, Tampa, Tallahassee, Port Charlotte, Orlando, Delray ~each~ and Miami. After this facility is built, the Delray Beac~ facility will be shut down and relocated to this new facility. The reason behind the relocation of the D~lray Beach facility is because they are in a multi-tenant build- ing, and the State requires a minimum 50 foot setback for storing waste materials. They have 50 feet, but it is a very limited area. Another problem they have in Delray ~ Beach is the underground storage tanks they have, which ale within Jo many feet of Delray Beach's well field. The State of Florida will not permit that facility, and they have given them a stay at that facility until a new facility i~ found and permitted. Mr. Dowling informed the Members that the company operate~ four businesses. Their primary business is their parts 15 MINUTES PLANNING & ZONING BOYNTON BEACH, FLORIDA BOARD JANUARY 10, 1989 washing business. That is a sink atop a drum, which they lease out to their customers. Anywhere from one to four weeks, they service that machine. They go in, pick up the dirty drum of solvent, put that on their truck, put a lid on it, and it is sealed. They give the customer a fresh drum of solvent, and clean the machine up. Chairman Walshak asked what the solvent is. Mr. Dowling replied that it is 99.9% mineral spirits and .1% dye. They also supply their customers with allied products, which are soaps for spoil filters. They also supply immersion cleaners (carburetor cleaners) to gas stations. Tha~ is also in drums. Inside the drums are approximately SlX or seven gallons of immersion cleaner. Mr. Dowling continued by saying their second line of business is paint refinishing. They service the auto body industry with buffing pads, abrasive pads, body fillers and rubbing compound. They also have a machine related to their parts washing machine, where they supply the auto body industry with five gallon drums of lacquer thinner that clean the drums and nozzles in body shops. Mr. Dowling explained how this is done. Mr. Dowling said a new line of business the company is getting into is waste oil. They pick up waste oil from gas stations and garages. With regard to the design of the facility, Mr. Dowlir informed the Members that it is a 100000 square foot building. The block is 8 inches thick. The buildin¢ broken up into three basic areas. The building is totally sprinklered for that type of use. Everywhere collection spills any inside the building, Mr. Dowling said they have tubs. They do not drain. Two are 15,000 gallon mineral spirit tanks. One will house the clean mineral spirits, and one will house the dirty mineral spirits. The other two are waste mineral tanks designed for 20,000 gallons. The tanks will also be covered. Mr. Dowling stated that there will be a pipe bridge. There will be no underground tanks at the site. It is against their policy to have tanks underground. Mr. Dowling told the Members that they believe in inspecting all of their facilities daily, and he explained how they do their inspections. Mr. Dowling emphasized that they are a regulated business. This facility was submitted to DER, and DER notified them in December, 1988 that they completed their review of the application. Safety Klean now has to notify both publicly and in writing that they are seeking a hazardous waste permit for this facility. That is presently being done, and Mr. Dowling said if there are no major criticisms by anybody, they anticipate receiving a construction permit sometime in late February or sometime in March. Before you can construct or operate any facility of ~his type, Mr. Dowling said you must have a construction permit. After the facility is built and constructed, there are strict guidelines for inspections. During the construction of the project, they need to have written reports submitted to DER by a Special Engineer in the State of Florida attest- ing that the building has been built to the design. At the end of the project, all piping, tanks, and vessels must be tested and certified, and reports sent to DER before fluid is allowed to be put into the tanks or before the facility can be used. Mr. Dowling said the way they will use the facility i trucks will come at the end of a day's service, back the warehouse, which has a dock. The whole body of will be inside the warehouse. The drums that have mineral spirits are handled in that manner. They are never emptied or handled. The waste oil will be handled by 3,000 gallon tankers that will go out to the customers, suck the oil out of the customers' tanks, bring it back to the facility, and pump it into the above ground tank. Mr. Richter asked about vents or exhaust gases. Mr. Dowling replied that the tanks have to be vented, according to the Environmental Protection Agency (EPA), and he explained how it was designed. Mr. Richter asked if any fumes or exhaust gases could get into the air. Mr. Dowling answered, "No." He added that there will be no odors or smells emanating from the facility. Vice Chairman Blanchette asked how the material will be removed. Mr. Collins questioned how long the material would stay there. Mr. Dowling said in a facility this size, which is a larger facility, a tanker will probably arrive 9nce a week from their recycling center. The recycling center is in South Carolina. The tanker will deliver 7,000 gallons of fresh mineral spirits and remove 7,000 gallons of di~ty mineral spirits. The ~anks are also equipped with high iewel alarms, which is a requirement of the DER. In the event a tank reaches 95% of full volume, an alarm will warn both the driver and the facility manag~er that there is a danger before it reaches full tank capacity. Even if it would reach full tank capacity, the ta~ks are surrounded by dike walls like an abo~e ground swimming pool. That swimming pool will hold approximately a volume of two tanks, if they were to empty simultaneously. As there is a roof over the top of the tanks, no water will enter it, so there will always be full volume capacity for any type of spillage. __W~,en the tanks are full with material that nobody wa~ts, Vice Chairman Blanchette asked where it would go. Mr. Dowling replied that they have 12 refineries throughout the United States. They do not generate any hazardous waste. They provide a service for their customers when they pick up their materials. At this facility, all they are doigg is transferring it. They take it to a refinery, which would be like the one he mentioned in South Carolina. It will be recycled into mineral spirits. Mr. Dowling said they recover about 70% of all of the mineral spirits they put out there. 30% is lost to evaporation. Some comes back as water and some as sediment. Mr. Aguila moved to approve the request, subject to staff comments.
