WHEREAS, pursuant to the provisions of Chapter 166 of the
Florida Stat~tes~ entitled "Municipal Home Rule Powers Act", the
City Council of the City of Boynton Beachi Floridai deems it
necessary and advisable :foz the efficien~ daily operation of the
nunlcipal gouernment to ~bolish such duties of the City Clerk
· s they pertain to the Municipal Court;
NOW, T~E:REFORE, BE IT ORDAII~ED BY Tt{E CITY COUNCIL OF
CITY OF BO~TON BEACH, ELORIDA:
Sectional: That Section 41 of Article III of the municipal
Charter of t~e City of Boynton Beachg Florida, be and is hereby
amended to read as follOws:
"Sec~io~. 41. Clerk~_~duties.
~nere shall be a Clerk of the Municipal Court,
w~o shall attend all sessions of the same. ~e shall
keep a docket in which shall be entered the title
of all cases tried in such Court, the nature of the
offenses charged~ the names of all witnesses sworn~ and
by wh~m called, the finding and judgment of the Court,
and thel fine and cost incurred, and by ~nom, whether
the judgment is satisfied, and, if so, how satisfied,
and the date of appeal, if granted. Upon the convic-
tion or~ac~uittai of any defendant, the Clerk shall
procure~ and file in his office, the complaint v~rrant
or other process, and all papers in the case~ and a
copy thereof, and of the entries upon the docket above
mentioned~ when certified to by him as being a true
copy of the original in his keeping, under seal of the
City~ shall be prima faeie evidence thereof and of the
facts therein sta~d, and shall have the same force and
effect ~in all courts as would the original if produced
and proved as such. Such Clerk and assistant Clerk may
issue writs and war~ants~ except search w~rrants."
Section 2:
Charter of the City of Boynton
amended to read as
"Section 66.
That Section 66 of Article IV of the municipal
Beach, Florida, be and is hereby
follows:
Same - Duties of clerk.
It shall be the duty of the City Clerk to attend all
meetings of the City Cou~cil~ and to keep a correct minute
of all their proceedings, in a book kept for that purpose;
the City Clerk shall be the custodian of papers~ books,
and records of the city and of. the seal of the eity~ and
shall attest and affix the seal of the city ~to all instru-
ments and documents requiring the same."
Section 3: AUT~0RITY TO CODIFY: Specific authority is
hereby granted to codify and incorporate this Ordinance zn the
City's existing Code.
Section 4: SEPARABILITY: Each of the provisions of this
Ordinance are separable, including word, clause, phrase or sen-
tence, and if any portion thereof shall he declared invalid, the
remaining portion shall not be affected but shall remain in full
force and effect.
Section 5: REPEALING PROVISIONS: All ordinances os parts
of ordinances in conflict herewith are hereby repealed.
Section 6: AN EFFECTIVE DATE: This Ordinance shall become
effective in the manner and at the time provided by law.
