WHEREAS, pursuant %o the provisions of Chapter 166 of the
Florida statutes, entitled "Mun~icipal Home Rule Powers Act", the
City Council of the City of Boynton Beach, Florida, deems it
necessary and advisable to a~o~ish the offices of the Superinten-
dent of Public Works and Public Utilities ~nd of the T~x Assessor;
NOW~ THEREFO~RE, BE IT ORDAINED BY TPiE CITY COUNCID OF THE
CITY OF BOY~TON BEACH, FLORIDA:
Section 1: That Section 49 of Article IV of the municipal
Charter of the City of Beynton Beach~ Florida~ be and is here~y
amended to read as follows:
"~ection 4__9. ~.election, appointment.
~ne government of the City shall be carried on by the
following officers, to-wit:
A Mayor
A City Council
A Municipal Judge
A City Attorney
A-Chief of Police
A City Clerk, Tax Collector, and City Treasurer,
of said offices may-be held by the same person; and such
other officers as may be created by ordinance of the City
not inconsistent herewith~ and they shall perform such
duties, and receive such compensation as may ~e prescribed
by the resolutions of the City~ and ~e provisions of this
Act; provided, that the members of the City Council shall
~e electsdiby the duly qualified voters of the City at an
election called and held pursuant to the provisions hereof
and of the City ordinances; and that all other officers of
the said City shall be appointed by the City Council~ except
those offices that come within the police power of the City,
which officers shall be appointed by the Mayor and confirmed
by the CouRcil.
The City Council may appoint a City ManaGer whose duties
and powers shall be designated by ordinance a~opted by ~he
City Council."
