LEVYING SPECIAL ASSESSmENt'S AGAINST PROPERTY BENE-
FITED BY A CERTAIN STREET IMPROVEMENT PROJECT WITHIN
THE SAID CITY, TO WIT: CONSTRUCTION OF APPRO~LTM~TELY
600 FEET OF ROADWAY ON S. E. 26th AVENUE, BETWEEN
S. E. 1st STREET AND SEACREST BOULEVARD, RECITING
BY W-~AT METHOD SAID SPECTAL ASSESSMENT IS MADE
FOR THE METHOD OF .COLLECTION THEREOF, A~D FOR O~ER
PURPOSES.
WHEREAS~ pursuant to the provisions of Section 160 of the
Charter of the CITY OF BOYNTON BEACH, FLORIDA, the City has here-
tofore caused a certain public street to be constructed over the
property more particularly described as: CONSTRUCTION OF APPROX-
IMATELY 600 FEET OF ROADWAY ON S. E. 26th AVENUE, BETWEEN S. E.
1st STREET AND SEACREST BOULEVARD, and
WHEREAS, the City Clerk has heretofore compiled an assessmen~
roll showing the lots and land assessed to pay the cost thereof ix
connection with subject improvement, and the amount of assessment
as to each such lot or land, ~nich said roll has heretofore been
approved by the City Council; and
WHEREAS, proper legal notice of the approval of said roll
has been given and a public hearing held relative thereto, at
same w~re

made, or if objections were made,
by the City Council;
IT ORDAINED BY THE CITY COUNCIL OF THE
BEACH, FLORIDA:
That the special assessment roll covering the
above-described project, a true copy of which is attached hereto
and hereby made a part hereof and marked Exhibit A, and as set
forth on the map attached hereto and hereby made a part hereof
and marked Exhibit B, is hereby ratified, approved and confirmed,
and the amounts indicated for each lot or parcel described therei~
are hereby levied against same as a special improvement and same
shall constitute liens against said land as of the effective date
of this Ordinance, each of said parcels along subject improvement
having been assessed on a front footage basis, charging each parcel
its proportionate share by dividing its respective front footage
into the total improvement cost.
Se___c. tion 2: Each property owner shall have the. privilege of
paying the entire assessment 'as to his property within ninety (90)
days from the attachment of said improvement lien without penalty.
If any owner fails to pay said lien within said ninety (90) day
period, it shall be paid in three consecutive equal installments,
payable as other ad valorem taxes ~re paid, commencing with the
year 1973, together with interest at the rate of 8% per annum from
the date of attachment of said lien on the unpaid balance thereof.
Section 3: Each of the provisions of this Ordinance are
separable, including word, clause, phrase, or ~entence, and if any
portion hereof shall be declared invalid, the remaining portion
shall not be affected, but shall remain in full force and effect.
Section 4: REPEALING PROViSiONS: All ordinances or parts of
ordinances in conflict herewith are hereby repealed.
Section.~: EFFECTIVE DA~E,: This Ordinance shall become
effective in the manner and at the time provided in the Charter
Ordinances of the City of Boynton Beach, Florida.
