AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA, AMENDING SECTION 30B-32 (D)(3) OF
CHAPTER 30B OF THE CODIFIED ORDINANCES OF
SAID CITY, PROVIDING FOR THE APPROVAL OF THE
CITY MANAGER UNDER SAID SECTION TO BE IN
CONJUNCTION ~WITH AND WITH ~ COOPERATION
OF THE CITY-ENGINEER~ PROVIDING FOR AUTHORITY
TO CODIFY, SAVINGS CIAUSE, REPEALING PROVISIONS,
AN EFFECTIVE DATE AND FOR OT~ER PURPOSES.
WHEREAS~ the City Council of the City of Boynton Beach,
Florida~ deems it necessary and advisable that Chapter 30B be
amended as follows in order to provide for assistance to the
City Manager;
NOW, THEREFORE~ BE IT ORDAINED BY THE CITY COUblCIL OF TME
CITY OF BOYNTON~ BEACH, FLORIDA:
Section 1: That Section 30B-32 (D)(3) be and is hereby
amended to read as follows:
"Section 30B-32(D) (3) The city manager~ in
conjunction and with the cooperation of the
city engineer, shall~ within thirty (30) dayst
approve plans or deny any proposals~ if:
(a) The proposal fails to comply with a
requirement of any city code or authorized regu-
lations; or
(b) The proposal will result in an economic
operating loss to the city."
Section 2: Apthority to C0dSfy: Specific authority is
hereby granted to codify and incorporate this Ordinance in the
City's existing Code.
Section 3: Separability: Each of the provisions of this
Ordinance are separable~ including word~ clause, phrase or sen-
tence, and if any portion thereof shall be declared invalid, the
remaining portion shall not be affected but shall remain in full
force and effect.
Section 4: RspD. ~linq Provisions: All ordinances or parts
of ordin~gaces in conflict herewith are hereby repealed.
~ection 5: An Effective Date: This Ordinance shall become
effective in the manner and at the time provided in the Charter
and Ordinances of the City of Boynton Beach~ Florida.
