AN ORDINANCE OF THE CITY OF BOYN~DN BEAC~I, FLORIDA,
PROVIDING FOR THE CREATION AND ESTABLISHMENT OF AN
~ERA~TING CAPITAL IMPROVEMENTS FUND AND FOR THE
~RA~sFER OF CERTAIN SURP~3S~S T~ERETO AT THE CLOSE
OF-EACH FISCAL YEAR; PROVTDING FOR ~tORITY TO
CO~IFY~ SAUtSIGS CLAUSE, REPEALING PROVISIONS, AN
EFFECTIVE DAT~ AND FOR OTHER PURPOSES.
WHEREAS, the City C~uncil of the City of Boynton Beach,
Florida, deems it necessary and advisa~ble to create and establish
an Operating Capi,~ Improvements Fund to provide for present
and future munic~i~l capi~ai improvements; and
WHEREAS, the City CoUncil deems it necessary and advisable
to transfer certain surplus funds to the said Operating Capital
Improvements Fund at the close of each fiscal year;
NOW, TPiEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF BOYNTON BEACH, FLORIDA:
Se~ction 1: An Operating Capital Improvements Fund is
hereDy created and established for the City of Boynton Beach~
Florida.
S.ection 2: Ail funds remaining as surplus within the
individual ~perating department budgets at the close of each
fiscal year, including unappropriated funds and excepting there-
from ali funds approved by the City Council as being encumbered
and to be c~rried over into the budget for the ensuing fiscal year
and further excepting therefrom all surpluses within the water
and sewer systems budgets, shall be transferred and revert to
the Operating Capital Improvements Fund.
Section 3: All Federal Revenue Sharing Funds received
under the State and Iocal Fiscal Assistance Act of 1972 (Title
I, Public Law 92-512) except the ten per cent (10%) of such
Federal Revenue Sharing Funds heretofore allocated for ordinary
and necessary maintenance and operating expenses for social
services for the poor and aged under Ordinance No. 73-15, shall
be deposited into the said Operating
