A RESOLUTION OF THE CITY OF BOYNTON BEACH,
FLORIDA, APPROVING AND ACCEPTING A 10 FOOT
5 DEDICATION OF LAND FROM THE BOYNTON
6 BEACH COMMUNITY REDEVELOPMENT AGENCY
7 TO PROVIDE FOR A 50 FOOT RIGHT-OF-WAY ON
8 NORTHEAST 1ST STREET BETWEEN NORTHEAST 4TH
9 AVENUE AND NORTHEAST 5TH AVENUE; AND
0 PROVIDING AN EFFECTIVE DATE.
2 WHEREAS,as it currently exists,NE 1st Street is the City's standard 50'right-of-way
from E. Boynton Beach Boulevard to NE 9th Avenue. However, between NE 4th Avenue
south to NE 5th Avenue the right-of-way narrows to a 40'right-of-way; and
WHEREAS, to obtain the standard 50 ft R/W for the entire length of NE 1st Street,
staff requested that the CRA dedicate 10ft to the City between NE 4th Avenue south to NE 5th
Avenue; and
WHEREAS,the City Commission,upon recommendation of staff,deems it in the best
interest of the Citizens and residents of the City of Boynton Beach to approve and accept the
10 foot Dedication of Land from the Boynton Beach Community Redevelopment Agency to
provide a 50 foot right-of-way on Northeast 1st Street between Northeast 4th Avenue and
Northeast 5th Avenue.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH,FLORIDA, THAT:
Section 1. The foregoing"WHEREAS"clauses are true and correct and hereby
ratified and confirmed by the City Commission.
Section 2. The City Commission of the City of Boynton Beach hereby approves
and accepts the 10 foot Dedication of Land from the Boynton Beach Community
Redevelopment Agency to provide a 50 foot right-of-way on Northeast 1st Street between

Northeast 4th Avenue and Northeast 5th Avenue. A copy of the Dedication of Land is attached
2 hereto as Exhibit"A".
E Section 3. That this Resolution will become effective immediately upon passage.

DEDICATION OF LAND
(Addition to NE 1"S reet)
THIS INDENTURE made this 14 day of j 1.020 between Boynton Beach
Community Redevelopment Agency, a Florida public bod corporate and politic created
pursuant to Section 163.356 F.S. (hereinafter the "Grantor"), with a mailing address of 710 N.
Federal Hwy, Boynton Beach 33425, and the City of Boynton Beach, a Florida municipal
corporation, (hereinafter the "Grantee"), with a mailing address of P.O. Box 310, Boynton Beach,
Florida 33425.
WITNESSETH:
That Grantor, for and in consideration of the mutual promises herein contained and other
good and valuable consideration, does hereby dedicate, grant, remise, release, quit claim and
convey unto the Grantee, its successors and assigns, all right, title, interest, claim and demand
which the party of the first part has in and to the following-described land, situate, lying and being
in the County of Palm Beach, State of Florida, to-wit ("Property"):

See Attached Exhibit"A"
This Dedication is made for the purpose of giving, granting, and dedicating to the Grantee,
its successors and assigns, the Property for construction and widening of a public roadway, street,
and for public utility purposes and the construction and maintenance thereof along NE Pt Street.
That this Property shall be subject only to those easements, restrictions, and reservation of
record. The Grantor agrees to provide for the release of any and all mortgages or liens
encumbering the Property.
The Grantor does hereby fully warrant the title to the Property and will defend the same
against the lawful claims of all persons whomsoever claimed by, through or under it, that it has
good right and lawful authority to grant the Property and that the same is subject only to the
encumbrances of record. Where the context of this Dedication allows or permits, the same shall
include the successors or assigns of the parties.

TO HAVE AND TO HOLD THE SAME,together with all and singular the appurtenances
thereto belonging or in anywise incident or appertaining, and all the estate,right,title, interest, and
claim whatsoever of the said party of the first part, in law or in equity to the only proper use,
benefit, and behalf of the Grantee, its successors and assigns.
