BEACH, FLORIDA, REPEALING CHAPTER 15 OF THE
CODIFIED ORDINANCES OF SA]I) CITY IN ITS ENTIRETY,
AND ADOPTING A NEW CODE PERTAINING TO MUNICIPAL
OCCUPATIONAL LICENSING PURSUANT TO CHAPTER
72-306 OF THE FLORIDA STATUTES; PROVIDING FOR
AUTHORITY TO CODIFY, AN EFFECTIVE DATE, I~EPEAL-
lNG PRO VISIOt~S,

PREAMBLE
This Ordinance is deemed zo be an emergency measure enacted
for the immediate preservation of public health, safety and welfare of
inhabitants of lhe Ciiy of Boynton Beach, Florida, and for the efficient daily
operation of the Municipal government.
WHEREAS, the Legislature of the State of Florida, effective
April 25, 1972, enacted Chapter 72-306 repiacin~ the present Chapter 205,
Florida Statutes, and creating a new Chapter 205, Florida Statutes; and
WHEREAS, said new Chapter 205 places certain restrictions
and requirene nfs upon municipal licensing procedures which require that
the Municipal ~dcupational Licensing Code of the City of Boynton Beach,
Florida, be repealed and a new Code adopted.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF BOYNTON BEACH, FLORIDA:
That ChapTer 15 of the Codified Ordinances of the City of Boyn-
ton Beach, Florida, be, and the same is hereby repealed in its entirety
and the foilowirg Code is hereby adopted in its place:
ARTICLE I
Section 1: License required; basis of one year.
A tax is hereby imposed by the Ciiy upon each and every
business, profession and occupalion having a business
location or branch office with lhe City, in the respective
amounis set forth in Sec. 18 of this code° In addition,
each and every business, profession and occupalion
which directly engages in interstate commerce, or which
competes with any business, p~ofession or occupation
engaged in interstate commerce, shall be licensed
pursuant to this code in the respecfive amour~s set forlh
in Sec. 18 The amount of such tax specified shall
be on the basis of one year.
Section 2: Regislration required; basis of one year; penalty.
Any person who engages in any business, occupation, or
profession within lhe muuieipal boundaries of the City of
Boynion Beach, Florida, not required to be licensed
hereunder, shall be registered with ~he City Clerk by
executing an information form lo be provided by the City.
The purpose o£ such registralien is to provide the City
with informatiori concerning those who are doing business
within the City, and, where appropriate to assure the City
thai such persons are licensed by lhe County of l~alm
Beach, Florida. Anyone violating this provisions by
failing lo register the required informatien with lhe City
Clerk shall be deemed guilty of.a misdemeanor punishable
as provided hereinafter.
Section 3: Before the City shall be reqti~ed io issue a license for
engaging in or carrying on any of the businesses, profes-
sions or occupations specified and set forth herein, it
shall be the duty of the applicant to file an application with
the City Clerk, such applicalion to be in the form required
by the City, and such applicant shall be requi~ed to furnish
to the City Council such other irff ormafion not contained
in the application as the Council may require.
Section 4: Issuance of license; duration; half-year license; when
due and payable.
All licenses shall expire on lhe 30th day of September of
each year. No license shall be issued for'more than one
(1) year. For each license obtained between September
1st and April 1st, the full tax for one (1) year shall be paid
except as hereinafter provided. For each license obtained
between April Ist and September 1st, one-half (1/2) of the
full tax for one (1) year shall be paid except as otherwise
provided. A half-year license issued pursuant to the pro-
visions of this Chapter, however, shall be granted only as
an initial license. Subsequent licenses must be issued on a
full year basis regardless of the date of application, except
where a period of at least five (5) subsequent conseeulive
years without license has elapsed, in which case the chara-
cteristics of an initial license will apply provided all other
provisions of this Chapter are fully satisfied. Upon payme~
of such iax, the Cily Clerk shall issue to the person paying
the same, a receipt for license signed by such City Clerk,
~'hich receipt or license shall expire at lhe end of the
period for which such license is issued as hereinabove
specified.

All licenses issued here~ nder may be renewed without
penalty no later %hah September~ 30th by application of the
license holder. Licenses nol renewed by October 1st shall be
considered delinquent and subject to a delinquency penalty
of ien percen~ (10%) of the full year license fee for the
month o£ October, plus an additional five percent (5%)
for each month of dellnqu~lCy thereafter until paid, The
total delinquencyl~ nalty shall never exceed twenty-five
percent (25%) of the full year license fee for that
applicant.
Section 5: How tax construed as to specified professions.
The tax provided in Sec. 18 for architects, auctionneer~
auditors or accountants, dentists, draftsmen, civil
engineers, lawyers, osteopaths, chiropractors, chiro-
podists, phrenologists, physicians or surgeons, real
estate salesmen, or other similar professions, shall be
construed to me an that each individual shall pay the tax
herein provided, whether- practicing by himself or in
partnership or employed by another.
Section 6: Special permits to nonprofit enterprise.
The Cily Clerk shall issue special permits, withoul pay-
ment of any license fees or other charges therefor, to any
person or organization for the conduct or operation of a
non-profit enterprise, either regularly or temporarily,
when he finds that the a~lieant operates without private
profit, fora public, charitable, educational, literary,
fraternal or religious purpose.
(a) Application for special permit. An applicant for a
special permit shall submit an application therefor to the
Ciiy Clerk, upon forms prescribed by said officer and
approved by the City Council, and shall furnish such
additional information and make such affidavits as the
City Council may require.
(b) Special permittees-must conform. A person operating
under a special permit shall operate his nonprofit enter~
prise in compliance with this Section and ali other rules
and regulations.
Section 7. Declaration where fee depends on variable factors
within applicant' s knowledge.
Whenever the amount of the license applied for depends
upon the amount of stock in trade carried by the applicant,
or the number of sleeping roomsiin a hotel, motel,
apartment or rooming house, etc., or the amount of
capital invested in the business, or the number of seats or
spaces in a restaurant, em., or the number of employees,
or the number of vehicles, or any other facts not within
the persona] knowledge of the City Clerk, no license shall
be issued until the applicant therefor has made and filed
with the City Clerk a declaration setting forth the amount
of stock in trade, the number of sleeping rooms, ~he
amount of invested capital, the number of seats or spaces,
the number of employees, the number of vehicles, or
other facts upon which the amount of such license depends,
which to the best of the applicant's knowledge and belief
is true, correct and complete.
Section 8: Transfer of license; duplicate; fee, posting.
(a) Transfer to new owner. Business licenses grunted or
issued under the provisions of this ehapter may be trans-
ferred with the approval and written authorization of the
City Clerk endorsed thereon, with the business ~r;~vhich
they were taken out when there is a bona fide
for of the property used and employed in the business,
such transferred license shall not be held geed for any'
longer time or any other place thun that for which it was
originally issued; provided, that the original license shall
be surrendered to and filed with the City Clerk at the tir~
application for transfer is made, and such transferred
license after being approved shall be of the same force und
effect as the original license. At the time uny
is transferred, the person applying for such transfer shall
pay to the City Clerk a transfer fee (~ three dollars ($3.00)
and shall present evidence of the sale.
(b) Transfer to new location. Business licenses may also
be transferred from location to location with the approval
and written authorization of the City Clerk endorsed
thereon, provided no change of ownership has occurred
or is in the process and the license classification in which
~e~ens~ras originally issued remains unaffected, but
such transferred license shall notbe held good for any
longer time or any other place than thai for which it was
originally issued; provided that the original license shall
be surrendered To and filed with the City Clerk at the time
application for trunsfer is made, and such trunsferred
license after being approved shall be of the same force
effect as the original license. At the time any such license
is transferred, the person applying for such transfer shall
pay To the City Clerk a fee in the amount of three dollars
($ 3.00).
(c) Duplicate. The City Clerk shall make a charge of
one dollar(S1.00) for each duplicate license issued to
replace any license issued under the provisions of this
chapter which has been lost, stolen, defaaedcx)r destroyed,
without any wilful conduct on the part of the licensee,
upon the filing by the licensee of a statement attesting
to such fact.
(d) Posting of licenses. All licenses granted hereunder
shall be posted in a conspicuous place on the premises
where the licensed business is being ~onducted, either
stationary or mobile or in case of solicitors and can-
vassers, said license must be carried upon their person.
Section 9: Doing business not covered by license; license
obtained by false statements void ab In%rio.
No license: issued under the provisions of this Chapter
shall protect any person from prosecution for transacting
any business, trade or profession not covered by such
license, or shall protect any merchant doing business with
a greater stock in trade than ~overed by such license, or
any hotel keeper or rooming house keeper having a greater
number of rooms than is co?ered by such license. Any
license issued upon any~fatse siatement made under oath
shall be considered as void ab iaitio~and shall not protect
the holder %hereof from prosecution for transacting
business without a license.
Section 10: Payment of personalproperty taxes; preliminary
persona] property tax return; deposit.
(a) No license shall be issued to any person for any
business, profession or occupation under this Chapter
unless and until the applicant for such license shall have
paid or caused to have paid current year personal property
taxes which have been assessed by the City against the
property lo be used in such business, profession or
occupation.
(b) In the event of application for transfer of an existing
license ii shall be the responsibility of the transferee
to have paid or camsed to have paid all personal property
taxes which have been assessed by the City against the
property used in the business by the transferor prior to
the granting and issuance of a transfer of license as
provided for in Sec. 8
(c) In addition thereto, all persons desiring a license
under the provisions of this Chapter, who have heretofore
not been levied and assessed personal property taxes by
the City against personal property to be used in such
business, who shall, by reason of engaging in a business or
profession in the City, be subject to a levy for personal
property taxes by the City against personal property used
in such business shall, before receiving a license, file
with the City %~lerk a preliminary personal property tax
return setting forth the estimated valuations of:
(1) Goods, wares and merchandise (estimated yearly
average),
(2) Furniture, fixtures and office equipment (including
commercial or law library),
(3) Plant machinery, tools and equipment to be used in
the operation of the business or profession.
Said preliminary tax return to be use~t only in connection
with new applications for occupational licenses and does
not preclude the filing of the regular personal property
tax return due each year between January 1 and April 1o

(d) However, the City Clerk may, before issuing a
license based on information of which she has knowledge,
require lhat a deposit for persortal property taxes be
pc sted by the applicaht for such license in an amount
determined by the City Clerk based upon a reasonable
estimale of ~he valuation of persona~ prop. erty by her and
subjected to the millage assessed for the previot~s tax
period, with such deposit being applied against the sub-
sequent assessmenl for personal properly taxes.
Section 11: Compliance by principal deemed compliance by ageni
noncompliance of principal.
Where the principal, master or ~ployer has complied
with the provisions of this Chapter, it shall be unnecessar~
for his agent, servant, or employee to comply herewith,
unless otherwise expressly provided for herein; provided,
however, that in the event such principal, master or
employer shall not have complied with this Chapter, each
of his agents, servants or employees shall be subject To
prosecution, and upon conviction, to fine or imprisonment
to the same extent as his principal, master or employer.
Section 12: Suspension or revocation of license; refund of fee.
Any license hereafter issued by the City may be temporar-
ily suspended or absolutely revoked or canc sIled by a
majority vote of the City Council, when such Council shall
have ascertained and determined, in the exercise of its
sound discretion, that such action will promote the public
peace, health, safety, welfare, harmony or good order of
the neighborhood in which the licensee's place of business i~
located; provided, however, that in the case of the revoca- !
tion and cancellation of such license, ~he City shall refund
To such licensee the pro rata unearned or unused portion of
his license, provided, further, that no refund shall be mad.
where the license is temporarily suspended.
Section 13: Records required of persons dealing in used or
second-hand personal property.
All persons who shall in any way whatsoever buy, sell or
trade any used or secondhand personal property of any and
all kinds shall keep a complete and true record of all
transactions, showing the name and address of the person,
firm or corporation from whom each article of personal
property was acquired, the date of acquisition, and the
date and to whom each article of personal property was
sold or traded. All such persons dealing in used or
hand articles of personal property shall make a full and
complete report of such transaction each and every week to
the City Police Department. The records of such dealers
in regard to the items as' aforesaid shall at all times be
open and subject to the inspection of any police or peace
officers of the City°
Section 14: License tax exemptions.
(a) Disabled veterans of the Spanish-American War,
World War I, World War II and the Korean War, all con-
firmed cripples, blind, deaf and dumb persons and invalids
physically incapable of manual labor, widows with minor
dependents' and persons sixty-five (65) years of age or
older, shall be allowed the same exemptions as such per-
sons are now or shall hereafter be entitled to by law in
connection with state and county licenses.
(b) Any person entitled to an exemption provided by this
Section shall, upon application and furnishing of the nece-
ssary proof, execute an affidavit supporting his right to
exerr,-,ption, and be issued a license which shall have plainly
stamped or written across the face thereon the reason for
exemption.
Section 15: Bngaging in business without license or under a
license issued upor~ false statements; penalties; prima facie
evidence.
It shall be unlawful for any person to engage in any business'
profession or occupation taxable by license hereunder with-
out a license or under a license issued upon false state-
ments made by such person, or~in his behalf. Any person
engaged in any such business, profession or occupation
without first obtaining a license, if re~luired herein, shall
pay a penalty of twenty-five percent (25%) of the £ull year
license fee for such trade, in addition to %he license fee set
forth herein.
In any original prosecution under this Section, the fact that
such person is open for business, shall be prima facie
evidence of engaging in such trade, business, profession
or occupation, and the burden shall be upon the defendant
to rebut the same.
Section 16: Method of collection of delinquent '~i~ense Taxes,
generally; liens.
Whenever any person who is subject to the payment of a
license or privilege tax provided by this or any other
ordinance of the City, or law of the State of Florida, shall
fail to pay the same when due, the City Clerk or other
official to whom the said tax is payable, may issue a
warrant directed to all and singular the Chief of Police of
the City of Boynton Beach, Sheriff, Deputy Sheriff of the
County of Palm Beach, Florida, commanding them and eact
them to levy and sell any real or personal property of the
person liable for said tax within his respective jurisdiction
for the amount thereof and ~he cost of execuling the warrant
and to return such warrant to the officer issuing same, and
to pay to him the money collected by virtue thereof. The
Chief of Police or Sheriff to whom the said warrant may be
delivered shall proceed in all respects and in the same

manner prescribed by law in regard to executions issued
against property judgments of a circuit court~ and shall
be entitled tothe same fee for his services in executing
the warrant, to be collected in the same manner. The
officer issuhag the warrant may file a copy of the warrant
with'the Clerk of the Circuit Court of the County and the
Clerk shall record the sa'me~ whereupon the amount of
the warrant and recording £ee shall become a lien upon the
title to- and interest, whether legal or 'equitable, in any
property, whether real, personal; or mixed, of the person
against whom the warrant is issued, in the same manner ax
to the same extent as a judgnent duly docl~eted in the office
of such clerk of the circuit court with execution duly
issued and in the hands of the Sheriff or_the Chief of Police
the City. Any person subject to and who fails to pay a
license or privilege tax required by ibis or any,~ other
ordinance of the City of law of the State of F~ogida, shall,
on petition cf the officer to whom the ~aid taxis payable,
be enjoined by the Circuit Court frozn engaging,in the
business for whi ch he has f~iled to-pBy Saidi!ic~nse, until
such time as I~e shall pay the same~ ~vith tail costs of such
action, as provided by Section 205. i0 ~lor~t~ Statutes
(1959).
Section 17: Existing licenses valid through October 31, 1972;
renewal at eleven-twelfths (11/12) rate; delinquency; penalty.
All muuieipal licenses which have been issued by the City
prior to the e~ective date of this Ordinance shall be valid
and shat] remain in effect until October 31, 1972. Inas-
much as the following licensing year commences October
1, 1972, as praided herein, licenses presently in effect
through October ~1, 1972, will be renewed for the
complete licensing year and dated effective from October
1, 1972, to September 31, 1973. Such renewal being
effective for an eleven month period, and not a full
licensing year, the license tax rate levied by the City
for such duration shall be eleven-twelfths (11/12) of the
full year license rate.
Licenses in effect and valid through October 31, 1972,
shall be renewed before November 1, 1972, or shalI on
that date be considered delinquent. Such delinquent
licenses shall be subject to a delinquency penalty of ten
percent (10%) for the month of November, 1972, plus an
additional five percent (5%) penalty for each month of
delinquency thereafter until paid; provided that the total
delinquency penalty shall not exceed twenty~five percent
(25%) of the fuil year occupational license fee for the
delinquent establishment.
Section 18: License Tax Schedule attached hereto and hereby
made a part hereof.
ARTICLE II. Coin-operated Devices
Section 19: Definition.
For the purpose of this Article, amusement coin-operated
devices are defined and clarified as follows:
Any game, machine, contrivance or device, or any amuse-
ment or recreational device, contrivance or facility, which
is set in motion or made orpermitted to function by the
insertion of a coin or slug and which does~not disburse any
prize or reward and which has no feature of gambling, and
which game, machine, contrivance or device or the use or
operation thereof does not cooL'iici with, nor is contrary
to, and is not prohibited by, the Laws of the State of
Florida.
The law and court decisions applicable to Section 19,
Chapter 20956, Laws of Florida, Acts Of 1941, shall
apply to this Ordinance.
The foregoing described and defined game, machine,
contrivance or device shall not be construed to include any
vending mahhine which vends merchandise such as cigars,
cigarettes, gum, candy, drinking cups, etc., and which
shall have no amusement feature of any kind as a part
thereof or attached thereto; nor shall the same include any
music vending machine without such amusement feature,
which vends music only, such as automatic phonographs,
piano, etc.; nor shall the same include any machine vendi~
United States stamps.
Section 20: License required; exception.
It shall be unlawful for any person to set up for operation~
operate, lease or distribute for the purpose of ope rating,
any coin-operated amusement device as defined in the
preceding section, without first having obtained a license
therefor. This article, however, does not apply to
machines or devices being displayed or demonstrated by
manufactures, distributors, salesmen and agents for
sales purposes.
Section 21: Operators to pay license tax; locatio~ operator
defined.
Any person who leases or rents out or places, under any
kind of arrangement whatsoever, with any other person,
the latter being defined as a "location operator", any
coin-operated machine or device, as defined above, shall
pay a license fee as set out in the license tax schedule Sec-
tion 18 and shall be known as an "operator".
Section 22: Annual licenses - When due and payable; fractional
license.
All licenses shall be due and payable on or before the first
day of November of each year, and no license shall be
issued for any fractional portion or a year.

Section 23: Same ~ Offieiat form; posting; transfer; name and
nu mb e r.
The City Clerk shall issue the licenses herein proyided
for on forms to be adopted by the City Clerk. Such
licenses shall be pasted on or otherwise securely fastened
to the machine so licensed and it shall be unlawful to frans,
fer any license from one machine to another. Each
license, except on operator's license, shall, bear the name
and r~m~er~Sf'of the machine.
Section 24: Same - Number limited; orde~ of issuance.
The City Clerk of the City shall not issue any license for
any machine under the provisions of this Article which
shall be in excess of one such machine to each two hundred
persons in the City, according to the last State, Federal
or Municipal Census. All such licenses as shall be
issued by the City Clerk under the provisions of this
Article shall be issued in the order in which applications
therefor are made, and in no other' manner.
Section 25: Same - Cancellation; surrender and reissuance
v/~en licensee changes machines.
Any and all amusement machine licenses issued by the Cit'
as comemplated by this Article, shall be cancelled by the
City in the event the operation of such machine shall be
decls_red unlawful; and no refund shall be granted thereon.
In case or in the event a licensee holding a license for the
operation of a game, device, contrivance or machine is
hereinbefore defined shall desire to change any machine so
licensed for another machine has herein defined, he may
surrender the license so issued him, and thereupon, the
treasurer shall issue to such licensee on payment of the
license fee provided in Section 8 , a license for the
machine sought to be exchanged for the one so previously
licensed. Such new license so granted shall in no wise
affect the number of licenses to be issued under the pro-
visions of this Article; and for all purposes hereunder
such new license shall be deemed to have been issued in
lieu of the license so surrendered.
Section 26: Enforcement of Article provisions; conffiscation of
machines.
The enforcement of this Article shall be carried out by the
Chief of Policie~ of the City and officers of the Municipality
and it shall be the duty of the Clief of Police and other
officers of the Municipality to confiscate any and all
machines as herein defined upon which licenses have not
been paid or which are used and operated in violation of
any provisions of this Article, or of the Laws of the State
of Florida.
Section 27: Used car lot.
(1) For the purposes of %his Section, a "used car lot" shall
be considered to be any business location within the muni-
cipal limits of %he City engaged in the wholesale or relail s:
of secondhand or used automobiles, or other type of used
motor vehicles and other services normally attendant to
such business.
(2) Prior to the issuance of any occupational license au-
thorizing the operation of a used carlo% within the City,
such license must be approved by The City Council. In
add%lion, to the other requirements'set forth in this Section
and other existing sec%ions of the co~le pertaining To the
installation or license application for .the operation of any
such business, ii is the judgment of the City Council %hat
the issuance of such license shall result in increasing or
creating fire, traffic or other dangerous hazards, esdan-
gering children or the general public, the emission of
offensive noise or noxious odors, or .otherwise constitute
an objectionable nuisance, or oiherwise be detrimental To
the health, safely, and general welfare of the community,
and in the absence of counierbalancing public demand for
the issuance of such license in the viciniiy in question,
theCouncil may refuse to issue such license. The require-
ments set forth in this subsection of this Section shall be
applicable regardless of the zoning classification of the
property location connected with any such license applica-
tion contemplated herein.
(3) In addition, the City Council reserves the right, in
connection with the approval and issuance of any such
license, to impose reasonable restrictions or requirement
upon the operation of such business relative to installation
of sanitary and office facilities, paving and lighting install-
ation and reasonable hours and times of business operation.
Section 28: License Identification.
(1) Any and all trucks or other vehicles operated or used
in connection with any contracting, bu~l~ing, delivery,
maintenance, repair service, or manufacturing business
or occupation conducted withi]ial~e municipal limits of the
City of Boynton ]Beach, Florida, as more particularly
defined under the provisions of Section 1 of this Code,
(excludin~ however, any profession including under the
professional classification section of the City's occupation-
al license Tax schedule) shall have painted or otherwise pro
nenily displayed in a visible and legible manner upon such
truck or other vehicle, the name and address of the bus%nos
in which such truck or other vehicle is used. For the put
pose of this Section, such information shall be pa%hied on
both sides of the vehicle and the letters included in such
sign shall each be a minimum height of two (2}~ inches.
(2) Any and all trucks or other vehicles operated or used
in connection with any business or occupation, as more
particularly defined in subsection (1) hereinabove conducted
within the municipal limits of the City of Boynton Beach,
Florida, shall have affixed thereto in a visible location, a
decal identifying said vehicle, which decal shall be coded ix
such a manner as to make availabl~ to the City or other
interested persons, the name and address of the business
or occupation in which said truck or other vehicle is used.
Such decal shall be prepared by the City Clerk and issued b
said Clerk. In the event any of the vehicles mentioned in
this Section do not have a decal bni notwithstanding are
properly and duly licensed in the City as provided by this
Section, the police office shall warn the driver or the
owner of said vehicle to secure said de~al within two (2)
business days and shall not make an arrest for said omis-
sion unless at the expiration of the warning period, there
has been a failure to comply.
Section 29: Authority to Codify: Specific authority is hereby
granted to codify and incorporate this Ordinance in the City's existing ~ode.
Section 30: Separability: Each of the provisions of this Ordinan,
are separable, including word, clause, phrase or sentence, and if any pot-
tion thereo£ shall be declared invalid, the remaining portion shall not be
affected but shall remain in full force and effect.
Section 31: Penalty Provisions: Any person, firm or corporatio
violating the provisions of this Code shall upon conviction thereof be punishec
by a fine not exceeding $500.00, or imprisonment in the Municipal jail for
a period not exceeding ninety days , or by both such fine or imprisonment.
Each day upon which a violation exists or continues shall be deemed to be a
separate and distinct offense.
Section 32: Repealing Provisions: All ordinances or parts of
ordinances in conflict herewith are hereby repealed.
Section 33: Effective Date: This Ordinance shall become
effective imr~e diately.
