AN EMERGENC~ff ORDINANCE OF THE OF THE CITY OF
BOYNTON BEACH, FLORIDA, REPEALING PROVISIONS OF
ORDINANCE NO. 71-19 OF SAID CITY PROVIDING FOR TRIAL
BY JURY FOR OFFENSES TRIED IN THE MUNICIPAL COURT
OF SAID CITY; PROVIDING FURTHER FOR REPEALING
PROVISIONS, SEPARABILITY, AN EFFECTIVE DATE AND
FOR OTHER PURPOSES
PREAMBLE
WHEREAS, the voters of the State of Florida have heretofore,
by referendum, voted to abolish existing Municipal Court systems within
said State; and
WHEREAS, the City of Boynton Beach has heretofore indicated
its intent, pursuant to the above dictate of the Florida voters, to abolish
its Municipal Court system at the earliest possible date; and
WHEREAS, the City Council of the City of Boynton Beach, Florida,
by adoption of Ordinance No. 71-19 has heretofore provided for establiskment
of jury trials in its Municipal Court; however, required rules of procedure
implementing conduct of such jury trials have not yet been adopted; and
WHEREAS, the cosz of such implementation at this time, in the
light of the above decision to abolish its Municipal Court system, is deemed
to be a waste of taxpayers~ money; and
WHEREAS, it is deemed in the best interest of the health, safety
and welfare of the inhabitants of the City of Boynton Beach, Florida, and the
efficient daily operation of said City's Municipal Court system that this
Ordinance be enacted as an emergency measure.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF BOYNTON BEACH, FLORIDA:
Section 1: That Ordinance No. 71-19 of the City of Boyn%on Beach,
Florida, effective August 6, 1971, is hereby repealed in its entirety.
Section 2: Separability: Each of the provisions of this Ordinance
are separable, including word, clause, phrase or sentence, and if any
portion hereof shall be declared invalid, the remaining portion shall not be
affected but shall remain in full force and effect.
Section 3: Repealimg Provisions: All ordinances or parts of
ordinances in conflict herewith are hereby repealed.
Section 4: Effective Date: This Ordinance shall become
effective immediately in accordance with the provisions of the Charter of
the City of Boynton BeaCh, Florida.
