CALL TO ORDER Hilary Zalman, Community Standards Special Magistrate, called the Hearings to order at 9:05 a.m. and explained the Magistrate's role and the procedures. Pursuant to Florida Statute, all orders are appealable to the Circuit Court in Florida and the City Commission. Also, that a fine will be imposed if the violation(s) are not corrected by the deadline. II. INTRODUCTION AND SWEARING IN OF WITNESSES Officer Guim administered an oath to all those intending to testify. ROLL CALL IV. NEW BUSINESS Case Hearing Case No. 20-0091 Francisco J Francisco Property Address: 203 E Gateway Blvd Type of Property: Single-family, homesteaded Violation(s): CO CH 15 SEC 15-120.D.1.A. CO CH 15 SEC 15-120.D.1.E. CO CH 15 SEC 15-120.D.1.H. CO CH 20 SEC 20-6 Mow and maintain all overgrown property areas, trim overgrown vegetation. Removal all outside storage, trash, and debris from property. Relocate trailer to a solid surface, such as a driveway; must have valid tag and registration. Meeting Minutes Community Standards Special Magistrate Hearings Boynton Beach, Florida September 16, 2020 Officer Hill presented the case, which was routine inspection. Not a repeat violator. Initial inspection date January 8, 2020. Courtesy notice issued January 10, 2020. Fifteen days given to bring the property into compliance. Notice sent via Certified Mail June 24, 2020; green card dated July 3, 2020. Property last inspected September 15, 2020, violations still exist. This is not a health and safety hazard. Sod all bare areas of yard visible from the City street. Officer Hart presented the case, which was routine inspection. Not a repeat violator. Initial inspection date December 9, 2019. Initial notice issued December 11, 2019, via courtesy notice. Thirty days given to bring the property into compliance. Notice sent via Certified Mail July 31, 2020; green card dated August 10, 2020. Property last inspected September 15, 2020, violations still exist with exception of the fence. This is not a health and safety hazard. Beverly Beckford, owner, requested additional time due to family unemployment or in the military for registration or removal of vehicles; lawn has been seeded as cannot afford sod at this time, not being very successful with birds. Due to situation and someone serving the country, the administrative fee is reduced to $100.12. Page 2 Meeting Minutes Community Standards Special Magistrate Hearings Boynton Beach, Florida September 16, 2020 Case No. 20-3539 Lewat Corp Property Address: 2180 Hypoluxo Rd Type of Property: Commercial (nursing home) Violation(s): LDR CH 4 ART I SEC 5 LDR CH 4 ART III SEC 11 Reseal and restripe parking lot to include disabled parking, repair potholes, repair broken/missing/incomplete parking stalls, repair damaged portion of parking lot and driveway. Replace old, faded traffic signs throughout the parking lot. Remove dead trees. Officer Guim presented the case, which was a routine inspection. This is not a repeat violator. Initial inspection date November 22, 2020. Courtesy notice issued November 28, 2019. Thirty days given to bring the property into compliance. Notice sent via Certified Mail July 10, 2020; green card dated July 24, 2020. Property last inspected August 14, 2020, tree has been removed, old faded signs replaced, remaining violations still exist. This is not a health and safety hazard. City recommended compliance date of October 16, 2020, or $75 a day assessed, plus administrative fee of$384.12. Clay Frankel, representative, provided affidavit to testify. All that remains to be done is the resealing and correction of old portions of parking stalls, which has been estimated at $21,000. The throughway itself seems to be in good condition. Because the nursing home tenant has been severely affected by the pandemic, an additional six months was requested. Officer Guim discussed with Mr. Frankel on more permanent repairs of potholes and improved safety. Photographs were presented to Ms. Zalman as evidence of handicapped area and some of the striping of parking stalls. City agrees to six months extension. Decision Based on the testimony, Ms. Zalman ordered compliance date of March 16, 2021, or $75 a day assessed, plus administrative fee of$384.12. Case No. 20-0820 David C Leary Property Address: 29 Misty Meadow Dr Type of Property: Single-family, homesteaded Violation(s): CO CH 15 SEC 15-120.D.1. CO CH 15 SEC 15-120.D.1.H. CO CH 10 SEC 10-56.A, C, D. Clean pool and maintain sanitary conditions. Install 4 inch house numbers on building to be visible from City Street. Repair exterior facade around garage door, repair and paint damaged facade. All exterior surfaces shall be maintained in good condition. Remove mildew from exterior walls and driveway. Replace damaged screen for pool enclosure and remove wood from exterior of home. Officer Guim presented the case, which was a citizen complaint. This is not a repeat violator. Initial inspection date February 28, 2020. Courtesy notice issued March 4, 2020. Thirty days given to bring the property into compliance. Notice sent via Certified Mail August 6, 2020. Property posted August 25, 2020. Property last inspected August 14, 2020, all violations still exist. This is a health and safety hazard due to green pool in back of property. City recommended compliance date of October 16, 2020, or $100 a day assessed, plus administrative fee of$384.12. David Leary, owner, appeared claiming financial hardship from hospital and credit card bills preventing cleaning and repair of pool. A $12,000 estimate has been received. An alternative is to empty the pool and cover it; however, owner may be able to use a transfer pump on his own. Owner is unemployed; medical and credit bills were submitted for Ms. Zalman's review. Ms. Zalman extended the compliance date to October 31, 2020. Decision Based on the testimony, Ms. Zalman ordered compliance date of October 31, 2020, or $100 a day assessed, plus administrative fee of$384.12. Property had a BTR inspection on November 13, 2019; additional violations found, property did not pass inspection. Multiple communications, extension given due to Covid-19. Andrew Lassise, owner, stated permit application had been submitted September 10, 2020; however, received notice that permits are three weeks behind. A reminder was given that two years' BTR charges will be due at sign-off. Mr. Lassise asked that the record show he had hired a contractor in March, and has been in frequent contact to come into compliance. Decision Based on the testimony, Ms. Zalman ordered compliance date of November 15, 2020, or $50 a day assessed, plus administrative fee of$384.12. CO CH 15 SEC 15-120.D.1.E. Overgrown grass. CO CH 10 SEC 10-56.D. No visible house numbers. LDR CH 2 ART IV SEC 2.A.2. Duplex converted into single family home without permits. Officer Torres-Lee presented the case, which was a routine inspection. This is not a repeat violator. Initial inspection date August 7, 2019. Courtesy notice issued August 12, 2019. Ten days given to bring the property into compliance. Notice sent via Certified Mail July 31, 2020; green card not signed. Property was posted September 3, 2020. During August 27, 2019, inspection it was noticed that a wall had been removed to make a single-family home; Building inspected again on September 10, 2019, when a Red Tag for pulling of several permits. Permit has been applied for but is still in plan check; as of September 4, 2020, items are needed for permit. Property last inspected September 15, 2020, violations are mostly in compliance, except for permits. This is not a health and safety hazard. Page 5 Meeting Minutes Community Standards Special Magistrate Hearings Boynton Beach, Florida September 16, 2020 Michael Feoli, property manager, presented affidavit to speak on behalf of owner, and gave a history of work being done to date. However, due to Covid-19 concerns, the tenant is reluctant to allow contractors in her home. Four months for completion is requested as the resolution for compliance is moving very slowly. John Kuntzman, Deputy Building Official, testified that if the project could be completed in four months, that would suffice; criteria for passing the inspection were given to the property manager. Decision Based on the testimony, Ms. Zalman ordered compliance date of January 16, 2021, or $50 a day assessed, plus administrative fee of$384.12. Case No. 20-0205 136 BBB Property LLC Property Address: 136 West Boynton Beach Blvd Type of Property: Commercial Violation(s): LDR CH 2 ART IV SEC 2.A.2. New counters installed without building permit. Officer Torres-Lee presented the case, which was a routine inspection. The previous tenant was no longer in business. Initial inspection date January 16, 2020, and a new tenant was in business. Initial notice issued January 17, 2020. Fifteen days given to bring the property into compliance. Notice sent via Certified Mail August 7, 2020; green card not signed. Property was posted September 3, 2020. Information for new business given to Business Specialists for BTR. Property was issued a Red Tag about counters installed without permit and it was not wheelchair accessible. Last time spoken with owner on the phone was March 16, 2020; tenant was spoken with the same day with plans to come into compliance. Property last inspected September 15, 2020; owner requested an extension but was told the hearing would proceed. This could be a health and safety hazard due to wheelchair inaccessibility. City recommended compliance date of October 16, 2020, or $100 a day assessed, plus administrative fee of$384.12. Roberson Voltaire, tenant, and James Knight, owner, appeared. Ms. Zalman explained the hazards of not being ADA compliant under the law, which requires going through proper channels. Permits for the counter are still required as well. An extension to November 30 was granted. Mr. Kuntzman will speak with respondents outside after hearing with advice on coming into compliance. Property Address: 1614 N Seacrest Blvd Type of Property: Single-family Violation(s): As noted in the Notice of Violations Officer Pierre presented the case. Notice of violation date March 18, 2015. The Magistrate hearing was on December 17, 2014, no one appeared. Compliance date for Cease & Desist Order given was December 18, 2014, as $1000 per day plus administrative fee. The property has 80 occurrences of non-compliance with fines of $1000 per occurrence for $80,000, plus administrative fee $346.03, for a total of $80,346.03. Owner of property has complied for lien reduction. (see Case Nos. 08-2685 and 15-0277, all cases will be heard before decision.) Case No. 08-2685 Linda Shelton & Nancy Morrow Property Address: 1614 N Seacrest Blvd Type of Property: Single-family Violation(s): As noted in the Notice of Violations Officer Pierre presented the case. Ms. Zalman calculated the total lien of$1,998,326.18. (see Case Nos. 14-2433 and 15-0277, all cases will be heard before decision.) Case No. 15-0277 Nathaniel Shelton, et al. Property Address: 1614 N Seacrest Blvd Type of Property: Single-family Violation(s): As noted in the Notice of Violations Officer Pierre presented the case. Notice of violation date March 18, 2015. The Magistrate hearing was on December 17, 2014, no one appeared. Compliance date April 2, 2015, or $500 per day plus administrative fee. Date of compliance was September 28, 2016. There are 544 days of non-compliance with $500 per day for a total amount of $272,000, plus administrative fee. Owner of property has complied for lien reduction. (see Case Nos. 08-2685 and 14-2433, all cases will be heard before decision.) Maximo Arevalo, new owner, appeared, stating that the property's current value is approximately $230,000. $136,000 was spent to bring the property into compliance. Receipts and photographs were presented to Ms. Zalman. Officer Pierre also noted that numerous liens for water were also paid. City recommends a total of$2,000 for all three cases plus the administrative fees for each case due to the great improvement of the property and the image for the City of Boynton Beach. Property is expected to be a rental to recoup expenses. Notice of violation date July 30, 2009. The Magistrate hearing was on September 16, 2009, no one appeared. Compliance date given was November 16, 2009, or $100 per day plus administrative fee. Date of compliance was February 17, 2010. The property has 117 days of non-compliance with fines of$100 per day in fines and administrative fee of$634.12, for a total of$12,334.12. Owner of property has complied for lien reduction. Robert Briscuso, father of owner, did not have affidavit allowing him to speak on behalf of owner. Permission affidavits need to be from his son as well as the new owner as well., the hearing needs to be reset. Notice of violation date February 26, 2016. The Magistrate hearing was on April 20, 2016, no one appeared. Compliance date given was April 30, 2016, or $200 per day plus administrative fee. Date of compliance was November 30, 2016. The property has 213 days of non-compliance with fines of $200 per day in fines for $46,600 and administrative fee of $730.15, for a total of $47,330.15. Owner of property has complied for lien reduction. (see related Case No. 11-075) Louis Jeune Dieufort, owner, stated the property was purchased without knowledge that there were existing liens; it was purchased online. The house was a two-bedroom and now is three. An estimated $25,000 was spent in repairs, but no receipts were available; the house is valued at approximately$200,000 and is a rental property. Photos and some documentation were presented to Ms. Zalman. City recommended 5% reduction; the fact that the work was done with qualified contractors with permits will be considered. Case No. 12-1097 Donnie & Doris Jones Property Address: 205 NE 9t" Ave Type of Property: Single-family, homesteaded Violation(s): As noted in the Notice of Violations Officer Pierre presented the case. Notice of violation date June 13, 2012. The Magistrate hearing was on August 15, 2012, no one appeared. Compliance date given was August 257 2012, or $100 per day plus administrative fee. Date of compliance was September 17 2020. The property has 2,928 days of non-compliance with fines of $100 per day in fines for $292,800 and administrative fee of $634.12, for a total of $293,434.12. Owner of property has complied for lien reduction. Doris Jones, owner, stated the property was purchased in 2000. Family has had several catastrophes, including a relative's house fire and the owner's breast cancer; as soon as owner was aware of the situation, the house was brought into compliance. $500 was spent to bring the property into compliance for the Business Tax Receipt. Date of compliance was June 10, 2019. The property has 1,206 days of non-compliance with fines of $100 per day in fines for $120,600 and administrative fee of $634.12, for a total of $121,234.12. Owner of property has complied for lien reduction. (see related Case No. 17-0974) Erick Jeanty, new owner, purchased the property July 2019 with the liens. The property is currently rented. Ms. Zalman had previously received and reviewed a spreadsheet of the repairs as well as photos of the repairs in construction; $51,155 (plus personal labor) was spent to bring the property into compliance. Decision Based on the testimony, Ms. Zalman reduced the liens to the following: Case 15-0314: Reduced to $1,388.90. Case 17-0974: Reduced to $730.15. Property Address: 137 E Woolbright Road Type of Property: Commercial Violation(s): As noted in the Notice of Violations Officer Pierre presented the case. Notice of violation date February 23, 2015. The Magistrate hearing was on May 20, 2015, no one appeared. Compliance date given was June 4, 2015, or$500 per day plus administrative fee. Date of compliance was December 12, 2019. The property has 1,650 days of non-compliance with fines of$500 per day in fines for $825,500 and administrative fee of $634.12, for a total of $826,134.12. Owner of property has complied for lien reduction. (see related case 10-2877) John Hammad, sole owner, previously occupied the property and ran own business there before renting it out; when the building became in bad shape, the five tenants were evicted in 2012 and the building remained closed. After obtaining permits, the building was demolished and a new building put up in its place. Regarding the violation, respondent claimed to have never received notification; the building was sealed and secured and was not occupied. To level the building cost $1.2 million; rent was not collected since 2012; property taxes, property insurance, and maintenance paid out of pocket. Purpose of property today is as a retirement investment. Case No. 10-2877 137 Woolbright Inc. Property Address: 142 SE 14th Type of Property: Vacant Lot Violation(s): As noted in the Notice of Violations Officer Pierre presented the case. [no particulars were given] (see related case 10-2877) John Hammad, sole owner, stated at the time of purchase the empty lot was being used for neighborhood parking. The property was maintained and eventually a house was put up, but it was overbuilt for the area. It was never rented out; kept closed from 2016; paid $20,000 a year for property taxes, insurance, and maintenance. When decision was made to sell the property, the liens were discovered; the contract was lost because of it. A low market price was put on the house for $385,000. Decision Based on the testimony, Ms. Zalman reduced the liens to the following: Case 15-0314: Reduced to $4,206.71. Case 10-2877: Reduced to $634.12. This is health and safety hazard, roof actively leaks with every rain; there are tenants with children.
