A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
APPROVING THE AWARD OF CONTRACT TO
YOUNGQUIST BROTHERS, INC.; AUTHORIZING
THE MAYOR AND CITY CLERK TO EXECUTE THE
CONTRACT FOR THE AQUIFER STORAGE AND
RECOVERY WELL, WHICH IS ATTACHED HERETO
AS EXHIBIT "A"; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City had advertised for bids for the
%quifer Storage and Recovery Well to construct a well used
for storing potable water during low demand periods and
withdrawing water during high demand periods, and same were
opened on September 10, 1991; and
WHEREAS, Youngquist Brothers, Inc., submitted a low bid
of $325,295.00; and
WHEREAS, it has been determined by the City Commission
to be in the best interest of the citizens and residents of
the City of Boynton Beach to select the bid of Youngquist
Brothers, Inc.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA THAT:

This Contract. made and entered into this dayof 1990, by and between the
City of Boynton Beach, Florida, hereinafter called e uwner , and
Youngquist Brothers, Inc.
of 15000 Pine Ridge Road, Fort Myers, FL 33~08
hereinafter called the "Contractor";
WITNESSETH:
The Contractor, in consideration of the sum to be paid him by the Owner and of the
covenants and agreements herein contained, hereby agrees at his own proper cost and
expense m do all the work and furnish all the materials, tools, labor, and all appliances,
machinery, and appurtenances for the construction of an Aquifer Storage and Recovery
Well to the extent of the Proposal made by the Contractor, dated the 10 day of Sept.
19_%1 all in full compliance with the Contract Documents referred to herein.
The BIDDING REQUIREMENTS, including the signed copy of the Proposal, the
CONTRACT FORMS, the CONDITIONS OF THE CONTRACT, the
SPECIFICATIONS, and the DRAWINGS, are hereby referred to and by reference made
a part of this Contract as fully and completely as if the same were fully set forth herein
and are mutually cooperative therewith.
That the Owner hereby agrees to pay to the Contractor for the faithful performance of
this Agreement. subject to additions and deductions as provided in the Specifications or
Proposal, in lawful money of the United States, the amount of:
Three Hundred Twenty Five Thousand, Two Hundred Ninety Five
Dollars and Zero Cents
Dollars ($ 325,295.00
based on the estimated quanuties and Unit or'Lump Sum Prices contained herein.
The Contractor agrees to complete the work within the time specified herein and to accept
as full payment hereunder the amounts computed as determined by the Contract
Documents and based on the said Proposal.
The Contractor agrees to remedy all defects appearing in the work or developing in the
materials furnished and the workmanship performed under this Contract during the
warranty period after the date of final acceptance of the work by the Owner, and further
agrees to indemnify and save the Owner harmless from any costs encOuntered in
remedying such defects.
It is agreed that the Contract, based upon the Proposal, shall be fully complete
within 120 consecutive calendar days from the date the Notice to Proceed is issued.

In the event that the Contractor shall fail to compIete the work within the time limit or
the extended ume limit agreed upon, as more particularly set forth in the Contract
Documents, liquidat~l damages shall be paid at the rate of $200.00 per day plus any
monies paid by the Owner to the Engineer for any additional engineering and inspection
services associated with such delays. Sundays and legal holidays shall be included in
determining days in default.
