A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
AUTHORIZING AND DIRECTING THE MAYOR AND
CITY CLERK TO EXECUTE A CERTAIN
INTERLOCAL AGREEMENT BETWEEN THE CITY OF
BOYNTON .BEACH AND PALM BEACH COUNTY FOR
JOINT PARTICIPATION IN CONSTRUCTION GF
OLD BOYNTON ROAD FROM MILITARY TRIAL TO
KNUTH RGAD; A COPY OF SAID AGREEMENT
BEING ATTACHED HERETO AS EXHIBIT "A";
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Palm Beach County proposes a widening of Old
~oynton Beach Boulevard between Military Trail and Knuth
~oad; and
WHEREAS, construction is to begin in the spring of
[992; and
WHERA$, it has been advantageous in the past for the
~ity of Boynton Beach to enter into an agreement with Palm
~each County for the construction of that portion of water
hain within their prcject;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
)F THE CITY OF BOYNTON BEACH, FLORIDA THAT:
Section 1. The Mayor and City Clerk are hereby
uthorized and directed to execute a certain Interlocal
Agreement between the City of Boynton Beach, Florida and
Palm Beach County, for the joint participation in
construction of Old Boynton Road from Military Trial to
Knuth Road, said Agreement being attached hereto as Exhibit
Section 2. This Resolution shall take
immediately upon passage.

FOR JOINT PROJECT PARTICIPATION IN CONSTRUCTION
OF OLD BOYNTON ROAD FROM
MILITARY TRAIL TO KNUTH ROAD

THIS AGREEMENT. made and entered into this

WHEREAS, the CITY and the COUNTY are authorized to enter
into this agreement pursuant to Section 163.01, Florida
Statutes, as amended, which permits local governmental units to
make the most efficient use of their powers by enabling them to
cooperate with other localitles on a basis of mutual advantage~
and
WHEREAS, the COUNTY has caused to be prepared roadway
construction plans and specifications for improving Old Boynton
Road from Military Trall to Knuth Road; and
WaEREAS, the CITY has caused to be prepared utility
construction plans and specifica%ions for water distribution,
sewage collection and/or transmission systems for the
aforementioned portion of Old Boynton Road which will serve
portions of its service area; and
WHEREAS, both the CITY and the COUNTY declare that it
is in the public interest that the water distribution, sewage
collection and/or transmission systems be constructed with the
aforementioned Old Boynton Road improvements; and
WHEREAS, the CITY has budgeted funds for cooperation
in construction of the water distribution, sewage collection,
and/or transmission systems along the authorized service section
of Old Boynton Road; and
WHEREAS, the CITY is desirous of funding the costs for
construction of the water distribution, sewage collection and/or
transmission systems which benefit the CITY; and
WHEREAS, the CITY will perform all inspections, testing
and certifications required for the water di~tribution, sewage
collection and/or transmission systems to insure compliance with
their specifications and permlts~
NOWt THEREFORE, for and in consideration of the mutual
covenants contained herein, the Parties to this Agreement agree
as follows:

the project, the CITY agrees to be responsible fo

funding for the actual costs of construction of
the water distribution, sewage collection and/or
transmission systems. Contributions and funding
for.the cost of such construction shall be paid by
the~CITY as such costs accrue and within 30 days
after a bi~l for same has been sent by the COUNTY
to the CITY.
Both the COUNTY and the CITY agree to pay to the other

forth in Paragraph 2 (C) above, which will balance
