1. Call to Order by Local Hearing Officer James D. Stokes
James Stokes, Special Magistrate, opened the Red Light Camera Hearings at 9:17 a.m.
He introduced himself and explained he travels all over the State to attend these
hearings and he was assigned to hear these cases. He is a neutral third party that
knows nothing about the cases. He received all the information about the case at this
hearing. The City puts on their case, the Respondents present their testimony, they
view the video and photographs, and he makes a ruling.

Susan Jane Jones Notice No. 1852000144348
Officer Verrigini, Boynton Beach Police Department, announced on June 6, 2020, at
12:07 p.m., a vehicle registered to the violator was travelling northbound on Federal
Highway at SE 23rd Avenue in lane three. After a review of the electronic evidence, Officer
Verrigini determined a violation occurred and a Notice of Violation was sent on June 25,
2020. He had an evidence packet to submit. Mr. Stokes and Ms. Jones viewed the
evidence.

Ms. Jones appreciated the opportunity to present her testimony. She has been driving
since 16 and never had a moving violation. She has taken all the safe driving courses
especially when moving to Florida to be aware of new rules. She is active with the Fifty-
Five Alive insurance course and she would not knowingly run a light. She went through
not knowing the light was red. She did not notice the car in front of her was slowing down
and she went through the intersection not knowing the light was red. It was early pre-
Covid and all were anxious to get home and stay inside.
Mr. Stokes commented the video and still photographs speak for itself. There was a car
turning left waiting for the light to change.
Ms. Jones looked at the snippet 20 times, trying to understand if the light was yellow when
she got to the line or red. She would not have contested it if the light was red when she
got to it, but she could not tell.
Decision
Mr. Stokes explained based on what he saw, he will uphold the violation. As to her safe
driving record, he advised this violation does not go on one's driving record, no impact on
insurance. It is a civil violation against the vehicle. He upheld the violation and assessed
a fine, but it would not impact driving her record. He appreciated her safe driving record
and it is still intact. The fine is $243 payable in 30 days. If not paid, there will be a hold
put on the registration.
Mr. Stokes recessed the Hearings at 9:27 a.m. and reconvened at 10:14 a.m.
