MINUTES OF MEETING OF JULY 28, 1987 After discussion, _Mr. Ryder moved, seconded by Mr. Blanchette that the corrections contained in the memorandum of September 2, 1987 be added and appended to the minutes of July 28, 1987. Motion carried 5-0. Mr. Rousseau abstained from voting, as he was not present at the July 28th meeting. MINUTES OF SPECIAL MEETING OF AUGUST 25, 1987 After explaining, Mr. Ryder requested a correction on page 14, suggesting that paragraph 4, be deleted except for "motion carried 7-0." Mr. Blanchette called attention to line 2, paragraph 5, page 23, and said "legally" should be changed to "illegally". On page 10, paragraph 3, line 2, Mrs. Huckle said "ove~- occupied" should be changed to "owner occupied." Mrs. Huckle also felt that on the first page, under "COMMUNICATIONS", the note, "Distributed separately to members" should be added, and the word, "None", should deleted. be Mr. Ryder moved that the minutes be accepted as corrected. PUBLIC HEARINGS ABANDONMENT Project Name: Agent: Owner: Post Landing Jon C. Yergler, Esquire Post Landing (Boynton), Ltd. - 2 - MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA SEPTEMBER 8, 1987 Location: Legal Description: Description: North Congress Avenue at L.W.D.D. L-21 canal, southwest corner 12 foot wide drabnage easement, Sec- tion 18, Township 45 south, Range 43 east, City of Boynton Beach, Palm Beach County, Florida Request for the abandonment of a 12 foot wide drainage easement. Ms. Heyden stated that Post Landing is located at the south- west corner of Congress Avenue and Lake Worth Drainage District L-21 canal. Mahagony Bay lies west of Post Landing and the Melear PUD is to the north. Ms. Heyden informed the Members that a mutual conflict existed with a 12 foot wide drainage easement and a recreation area with a swimming pool. The drainage easement is no longer required and, therefore, the City Staff recommended approval of the request, subject to the City Engineer's comment attached as Addendum A to the original copy of these minutes in the Office of the City Clerk. Mrs. Huckle requested that they be shown the corrections referred to in the City Engineer's memo. Mr. Golden pointed out the proposed location of the recreation areas on an overlay and informed Mrs. Huckle that he did not know, but he thought the technicality of comparing it to the legal description had to be resolved. Chairman Trauger asked if anyone in the audience wished to speak in favor of the abandonment. Mr. Glen Nicotra, 2090 Palm Beach Lakes Boulevard, Suite 610, West Palm Beach, Florida 33409, Vice President of Post Florida, which is the developer of Post Landing, was in favor of the request. Mrs. Huckle drew attention to the memorandum dated August 14th from Tom Clark, City Engineer, and asked if Mr. Nicotra knew what the comment was. Mr. Nicotra believed, as Mr. Golden did, that there was an error in the legal description. There was no one else who wished to speak in favor or against the request, and THE PUBLIC HEARING WAS CLOSED. Mr. Ryder moved to approve the request, subject to the City Engineer's comment, seconded by Mrs. Huckle. Motion carried 6-0. MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA SEPTEMBER 8, 1987 PARKING LOT VARIANCE Project Name: Agent: Owner: Location: Legal Description: Description: Sybar Square Shopping Center (formerly Savannah Square) Carlos Diaz Matthews and Associates Sybar-Savannah Square Joint Venture North Congress Avenue at N.W. 22nd Avenue, northeast corner. A parcel of land lying in Section 17, Township 45 south, Range 43 east, Palm Beach County, Florida. Request for a variance to Section 5-141(g)(6) "Major Driveways" of the Parking Lot Regulations. Mr. Golden stated that it was originally intended that this request be concurrent with the request for site plan approval and preliminary plat approval. However, there were technical problems with both the site plan and plat construc- tion drawings, and they were pulled from the agenda. There- fore, the Technical Review Board (TRB) recommended that this item be postponed and the public hearing be continued until the October meeting, so all three items can go ~orward con- currently. In the event the Board desired to make a decision at this point, Mr. Golden advised that the TRB formulated a techni- cal recommendation. If the Board desired that it remain on the table, the TRB could reevaluate the request when a new site plan comes in. Mr. Ryder stated that he felt there was sufficient substan- tiation from the TRB to table the action, as he felt that it may depend on what the applicant does in the preliminary plat and the site plan. He noted that this item had been lying fallow for so long that another month would not make much difference. Mr. Golden informed Chairman Trauger that the previous site plan expired approximately a year ago. Mr. Ryder moved that this request be continued. Mr. Golden announced that the public hearing will be continued until October 13, 1987 at 7:30 P. M. at Pineland Plaza. Mrs. Huckle seconded the motion. Mr. Walshak interjected that the Planning and Zoning Board will have the final say on this. A vote was taken on the motion, and the motion carried 6-0. - 4 - MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA SEPTEMBER 8, 1987 Chairman Trauger commented that this has been around So long that shopping centers have been springing up all around it, and he remarked that all the City needs is another shopping center. Mrs. Huckle recalled this was one of the most beautiful site plans she had seen in a long time, and she was sad to see it delayed. Mrs. Huckle hoped the quality would be equal to what was presented earlier. At Mr. Walshak's request, Mr. Trauger explained that this was part of what the City Commission has been talking about (projects lay fallow for a long time and finally try to get off the ground). The P&Z Board has the right to refuse or allow such projects to continue. On parking lot variances, Mr. Walshak added that the P&Z Board has the final say. For the last two months, the City Commission has been discussing how the P&Z Members approve or deny the variances (a simple majority or a super majority vote). Mr. Golden believed it has to be five votes instead of four. Mrs. Huckle thought the last time the Commission spoke, %hey were talking about a complete vote. Mr. Golden was sure it would be discussed. B. SITE PLANS Project Name: Agent: Owner: Location: Description: Quail Run Shalloway, Inc. Coscan Development Corporation West of South Congress Avenue, between Golf Road and Woolbright Road extended. Request for site plan approval for entrance/project slgnage and for private recreation facility. Mr. Golden stated that this request for site plan approval includes a private recreation facility and project slgnage for Quail Run and Quail Lake West PUD. The site plan and preliminary plat for Phase I of this project was recently approved by the City Commission. Mr. Golden said the proposed recreation facility is to be located on the west side of S.W. 26th Street, midway between Golf Road and Woolbright Road extended. The proposed faci- lity consists of a 5,418 square foot recreation building including two indoor racketball courts, exercise room, a multi-purpose room and related ancillary facilities. Mr. Golden continued that adjacent to the recreation building, - 5 - MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA SEPTEMBER 8, 1987 on the south side, is the swimming pool, and on the north side of the parking lot are two tennis courts. Mr. Golden advised that the proposed signs include entry wall signs on Golf Road and Woolbright Road, sales office signs, street signs, recreation center signs, and temporary directional slgnage. The TRB recommended approval, subject to staff comments attached as Addendum B to the original copy of these minutes in the Office of the City Clerk. Don Cuozzo, Director of Planning for Coscan, Suite 400, East Building, 1900 Corporate Boulevard N.W., Boca Raton, Florida 33431, came forward. Mr. Ryder asked if there was going to be an access lane going west, approaching the 26th Street entrance from Golf. Mr. Cuozzo answered affirmatively and added that there will be a deacceleration lane and a left turn going east. In response to a question from Chairman Trauger, Mr. Cuozzo stated that he had read all Of the staff comments and concurred 100% with them. Mrs. Huckle moved that the request be approved, subject staff comments. Mr. Ryder seconded the motion, and the motion carried 6-0. to Project Name: Agent: Owner: Location: Legal Description: Description: Coral Industries Donald T. Smith, A.I.A. Robert R. Kipp East of Congress Avenue, between Neptune Drive and the L.W.D.D. L-29 canal. See Description attached as Addendum C to the original copy of these minutes in the office of the City Clerk. Request for site plan approval to construct a 21,600 square foot ware- house building on 1.89 acres. Mr. Golden stated that the warehouse building will serve as an addition to the existing Coral Industries facility, located at the east entrance of Neptune Drive, on the north side. The new building is proposed for the vacant lot on the east side of the existing building. Mr. Golden informed the Members that Coral Industries manu- factures interior trim products. The building is a 21,600 square foot rectangular shaped structure with parking pro- vided on the east, north and west sides of the structure, - 6 - MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA SEPTEMBER 8, 1987 with two driveways on Neptune Drive, and two connecting the existing facility on the west side. The remaining Vacant parcel adjacent to the north property boundary may serve as a futur~ addition, and Mr. Golden said it will require a site plan approval at some future time. The proposed building will be of masonry construction and will be light bluish g~ay in color. The TRB recommended approval, subject to staff comments, attached as Addendum D to the original copy of these minutes in the Office of the City Clerk. Mr. Golden wished to clarify the comments pertaining to the conditional use approval. There was some question about the use of the current facility and the proposed use of the new building. Mr. Golden had several conversations with the agent and owner, and Deputy Building Official today. To clarify that issue, a letter was submitted from the owner to Med Kopczynski, Deputy Building Official, for interpretation. Mr. Golden read said letter, which is attached to the origi- nal copy of these minutes in the Office of the City Clerk, as Addendum E-2. He also read Mr. Kopczynski's reply, which is also attached to the original copy of these minutes as Addendum E-1. Donald T. Smith, Architect, 2260 N. E. First Avenue, Boca Raton, Florida 33431 came forward. Mr. Ryder asked what type of manufacturing would be done, if millwork will not be done. Mr. Smith clarified that this is really an assembly of products, and he added that they buy doors from another source. He agreed with Mr. Ryder that it is a warehouse distributing center, and assured him that they will not have millwork. Chairman Trauger asked if Mr. Smith agreed with all of the staff comments. Mr. Smith did, but said he had a couple of questions such as whether the striping should be black or white. Chairman Trauger asked whether Mr. Smith agreed with the staff comments 100%, as now presented. Mr. Smith agreed with the comments. In view of what the applicant stated, Mrs. Huckle asked if the request would not call for an environmental review. Mr. Golden replied that the environmental review procedure is attached to the permitting rather than the site plan approval. Mr. Ryder understood that they did not have to spell out conditional use. At the time of use approval, if an environmental review was required, Mr. Golden explained - 7 - MINUTES - PLANNING & ZONING BOARD BoYNToN BEACH, FLORIDA SEPTEMBER 8, 1987 that the applicant would apply to the Planning Department to go through that procedure. The procedure is basically for the purpose of determining if any adverse environmental use is occurring there, and, if so, what would be required to make sure the operation is clean and safe. Chairman Trauger did not understand Mr. Hallahan's comment that the foundation landscaping was minimal. Mr. Golden could not answer without consulting the Code. Mrs. Huckle called attention to %2 of Mr. Jaeger's comments and asked what an inlet structure is. Mr. Golden explained that there was a conflict between the landscape plans and the drainage plan. A tree is in the grade where storm water spills. They are located in the same vicinity, and some further details or changes may need to be submitted. Mr. Golden thought that could easily be clarified through minor changes. ~r. Ryder moved to approve the site plan, subject to staff comments. Mrs. Huckle seconded the motion, and the motion carried 6-0. C. SITE PLAN MODIFICATIONS Project Name: Agent: Owner: Location: Legal Description: Description: Publix Distribution Facility Kilday and Associates Deustch-Ireland Properties North side of South Park Boulevard, within the Quantum Park of Commerce PID. See Addendum F attached to the original copy of these minutes in the Office of the City Clerk. Request for the approval of an amended site plan to allow for the addition of an on-site water storage tank for the fire protection system as well as various other site changes. (See letter from agent attached to the original copy of these minutes as Addendum G.) Ms. Heyden stated that the request was to amend the site plan approved by the City Commission on February 17, 1987. The desired changes were outlined in the letter from the applicant to Mr. Golden. (See Addendum G.) The City Staff - 8 MINUTES - PLAiqNING & ZONING BOARD BOYNTON BEACH, FLORIDA SEPTEMBER 8, 1987 recommended approval, sub~ect to staff comments attached to the original copy-of these minutes as Addendum H. Kiernan Kilday, Kilday & Associates, Landscape Architects/ Planners, 1551 Forum Place, Suite 100A, West Palm Beach, Florida 33401, came forward. Mr. Ryder inquired if the City Fire Department required this on-site water storage tank. Mr. Kilday answered affirmatively. Mr. Ryder asked what the size of the tank is. Mr. Kilday replied that it is ten feet in height, but he did not know how many gallons it holds. He confirmed Mr. Ryder's statement that a sprinkler system is within the warehouse. Because of the flow character- istics, Mr. Kilday said they need additional water in storage to provide the p~mps enough water. Mr. Kilday informed Mr. Ryder that the building is a single story building. He pointed to an annotated site plan showing where each change was made, noting that they were very close to getting their building permit. He stated that the tank is round and is in the northwest corner of the site. The tank is connected to a pump house, which provides the pumps to the sprinkler system inside. It is surrounded by a wall, which will be of stucco and flagstone treatment similar to the other treatments of the buildings in ~he area. Mr. Kilday told the Members the original guardhouse was changed to provide security for the trucks entering the facility, as well as the employ.ee parking area. The truck receiving booth should eliminate trucks stacking on the main road. Mr. Kilday pointed out that the FP&L meter vault would be in a small building about 10 feet tall. It will be done in the same ~lagstone treatment as the wall and will be located behind a landscape buffer, which did not show up on the site plan. Mr. Kilday advised that the railroad dock, which was on the original plans the Board approved, has been eliminated. The freight cars now can be pulled into the back of the building, which is an improvement to the site. With regard to the changes on the elevation, other than wha~ he had already told th~ Board, Mr. Kilday said the office building was originally a band of glass and a band of stucco. It will now be banded all in glass in a color which is a cross between rose and brown. The only other change was on the main building itself because it is such a broad building (roughly ten acres under a - 9 - MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA SEPTEMBER 8, 1987 roof). Additional concrete casting and panels have been put in the building to make it a better looking building. Mr. Kilday explained. Mr. Kilday read all of the staff comments, and said they were acceptable. He confirmed Mr. Ryder's statement that South Park Boulevard is the southern peripheral road of the development. Mr. Ryder observed that there was quite a set- back on the north from 22nd Avenue. Mr. Kilday said they have done special treatments on the north side, and he explained. Mr. Walshak saw various phases and questioned whether it was expansion or if it was all approved. Mr. Kilday replied that it was approved to a point. At the time they received their original approval of the project, the phases were laid out. ~owever, it was approved with the understanding that they will come in on individual site plan approvals on each phase. Mr. Walshak thought the original approval was for almost 1,000,000 square feet. Mr. Kilday explained that they bad-no architectural plans for them, so at the time they went through, they agreed to come back on each subse- qUent phase. Mr. Walshak asked if the architecturals that he was seeing were strictly for Phase I. Mr. Kilday a~swered affirmatively. Mr. Walshak thought that what was approved by the Commission five or six months ago was for 1,000,000 square feet to be built all at one time. Mr. Kilday clarified that it was approved as an alternate build out of the building with a stipulation in their approval that they would come back on each of the subsequent phases for subsequent site plan approvals. Mr. Walshak asked if there was a specific reason why they were doing that. Mr. Kilday replied that the basic reason was that Publix had a tremendous expense putting in this facility and needed to know that they had enough land and area to allow for future expansions over the next twenty years. At the same time, they were not prepared to move ahead, so they provided all of the data for the ultimate build out, but they realized things change over the years, and these phases would come in. Mr. Golden clarified that the entire site was approved in concept with the understanding that future phases would come back for individual site plan approval. Essentially, the planning is being done for the facility at build-out, so - 10 - MINUTES - PLANNING & ZONING BOARD BO~NTON BEACH, FLORIDA SEPTEMBER 8, 1987 that they can go with that ultimate build-out which was approved in concept by the Commission at the time of the initial request. Chairman Trauger asked what the approximate construction completion date for this part of the project was. Mr. Kilday stated that the only problem they have now is waiting on the road and infrastructure. Completion of the project from the time they receive the building permit will probably take 12 months. Mr. Kilday hoped the building would be under construction within the next 3 to 6 months. Mr. Ryder stated that they should spell out some of the other conditions, as the agenda deals primarily with the water storage tank. He moved to approve the request for the Publix Disbribution Facility located on the north side of South Park Boulevard withi~ the Quantum Park of Commerce for an amended site plan to allow for the addition of an on site water storage tank for the fire protection system, subject to staff comments. Also included in the motion was the removal of the rail dock, relocation of the gatehouse, addition of the truck receiving building, the addition of the FPL meter vault, and chang~srto the elevations. Ms. Heyden stated that on the south side of Boynton Beach Boulevard, across from Cross Creek Centre, is Leisureville Lake Condos. The site plan for the Planned Commercial Development (PCD) was approved on March 17~ 1987 by the P&Z Board, contingent upon the total signage being submitted to the City at subsequent site plan modifications. She told what the signage would iinclude. The City Staff recommended approval of the signage as presented. Kevin McGinley, Agent, Land Research Management, Inc., ResearCh Management, Inc., 12:80 North CongreSs Avenue, Land - 11 - MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA SEPTEMBER 8, 1987 Suite 106, West Palm Beach, Florida 33409, was asked by Chairman Trauger how high the sign was above the ground. After discussion, Mr. Golden said there were really no regu- lations for signs in PCDs. The Board could approve or deny the request almost as they pleased. Chairman Trauger asked how wide the sign was at its widest point. There was di/scussion about the height and width of the sign. Mr. Golden explained that there was pylon with a sign on two sides. Mr. McGinley clarified that it is a triangular shaped sign. Mr. Blanchette did not think a Sign Code had been adopted. Mrs. Huckle thought there would be a workshop on it and recalled that the Board received a copy of a draft of the Sign Code in April. Wl~en she looked at it the other day, she did not see anything that went to this height. Mr. Blanchette thought the sign was small in relation to the whole project. Mr. Golden stated that Ms. Heyden is presently investigating, as there are no guidelines for signage in planned districts. She is working on this and also thinking about the possibi- lity of implementing some basic standards. Mrs. Huckle asked if the issue was wide open presently, and Mr. Golden stated that it was. In response to Mrs. Huckle, Mr. Golden recapped, stating that the height of the sign is 27 feet from the ground to the top of the sign. The dimension of the triangle is 20 feet per face. It was noted that words were to be on two sides and one side would be blank. Mr. Blanchette commented that the sign will not be overwhelming. Mr. Ryder asked what the height of the building is. Mr. McGinley thought it was about 30 feet. If it was illuminated at night, Mr. Ryder said he would be concerned about people living in the back. Mr. McGinley understood trees were behind the building. Mr. Blanchette referred to the line of sight, and said the people behind, to the north, would not be bothered by the sign. Mr. Ryder alluded to people living in the Leisureville condo- miniums across the road, as the signs will be lighted. Mrs. Huckle remarked that it would be the height of a two story building, which is tall. Mr. Golden referred to the sign at Oakwood Square, and Mr. Blanchette mentioned the sign at Sunshine Square. There was discussion. Mr. Walshak 12 - MINUTES PLAi~NING & ZONING BOARD BOYNTON BEACH, FLORIDA SEPTEMBER 8, 1987 also noted that this sign will be directly across the street from the Leisureville condominiums and will be illuninated. Be feared those people would be very unhappy with the Board and the City Commission. Because of the Sign Code, Chairman Trauger said the Board had no basis to deny this. Mrs. Buckle wondered what Don Jaeger, Building Department, had to say about the sign. Mr. Golden spoke tc Mr. Jaeger, who is working closely with Cross Creek's Architect to put this together. Mr. Golden confirmed Chairman Trauger's understanding that there were no staff comments. Mrs. Huckle commented that she was surprised there were no architectural renderings for the Board to look at. She restated that the Sign was to be on a triangular base. Mr. Golden explained that one sign will face east and one west. Mr. M~Ginley advised that there will be three poles (one in the middle, and two on the back). There was further discussion. Mr. Walshak reiterated that this sign will be illuminated and will be staring right into the face of the residents across the street. Mr. McGinley responded that the sign does not go straight across. It is directed at the traffic, east and west. Mr. Walshak repeated his previous statement and said if he was a resident there, he would not want the sign. There were other comments. Mr. Ryder stated that he felt the discussion should move along. He pointed out that since the inception of this project, which required rezoning from Residential to Commercial, he was opposed to it. The City Commission did go along with it, but Mr. Ryder said he would still oppose it because of the past history he had with it. Mr. Walshak stated that until he hears from the Planning Department or someone who has control of the sign as to how it is to be illuminated and what hours it will be illumi- nated, he would definitely oppose it. He felt it would not be fair to the residents 50 to 100 feet from the two signs. Mr. Golden stated that it would be extemely difficult to limit the hours the sign would be illuminated, and it would not be feasible. Mr. Walshak asked if anyone had considered a normal sign rather than an illuminated one. He thought the sign was rather big and high. Mr. Golden replied that was something for the Board to consider. Chairman Trauger questioned why the sign had to be illuminated. Mr. McGinley - ¸13 MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA SEPTEMBER 8, 1987 answered that it was for advertising purposes. Mrs. Huckle wondered if the Villager had a lighted sign. Mr. Golden had samples of the proposed lettering for the facades. More discussion followed regarding the Villager. Mr. Walshak made a motion to approve the request for sign- age, subject to the fact that the sign is not illuminated. Mr. Rousseau seconded the motion. Chairman Trauger took a vote on the motion as follows: Mr. Blanchette No Mrs. Huckle No Chairman Trauger Yes Mr. Ryder No Mr. Walshak Yes Mr. Rousseau Yes (He felt voting for or against the lighting was a little unclear.) (She did not feel it was within the Board's purview to restrict the illumination.) (He was opposed, due to his previous disapproval of the project.) The vote was 3-3. Mr. Golden added that requests from individual homeowners are not normally processed, and he called atten- tion to a letter from Harold Kahn, President of Cambridge at Hunters Run Condominium Association, Inc., which is attached to the original copy of these minutes in the Office of the City Clerk as Addendum J. Apparently, a similar addition had been permitted at this location, but no site plans were approved. Mr. Golden said that was the basis for this request. It was built, and it is there. Mr. Golden informed Mrs. Huckle that the Building Department issued a permit in error. He explained to Chairman Trauger that the original site plan had a trellis patio in the back and allowed for an optional sauna. Edson L. Buza, General Contractor, 222 N. W. 15th Street, Delray Beach, Florida 33444, in response to a question by Mr. Ryder, stated that there are no encroachments. The back of the house sets on the golf course. It is approximately 25 feet from the edge of the golf course to the backyard area of the house. Mr. Ryder asked if this was the first instance of this kind in this particular tract. Mr. Buza replied that it was, other than the fact that the existing structure somehow was built. He had photographs which showed what the site looks like and also of the one with the existing structure. Mr. Ryder pointed out that they have patios now, and this was an attempt to enclose one and create another bedroom. In a sense, the Board would be creating a possible future pattern. If this was ~approved, Mr. Blanchette said anyone else who wishes would not have to come before the Board. They could just apply for a building permit. Mr. Buza referred to Addendum J, where the Association approved the addition for any other homeowner in Cambridge II. Be further stated that in a sense this is like an enlargement of the master bedroom. The gate house must be accessible to the handicapped. 2. Separate permits are required for all signage. Signs must be designed to withstand a 50 pound per square foot wind load. 3. T~e flag poles' must be engineered in c~nformance with Section 1205 of the Standard Building Code, 1985 Edztion to withstand a 120 m.p.h. wind load. 4. Details must be supplied for the water tank, pump house and enclosures. NOTE:- This approval is for the items requested on the letter from Kilday and Associates, dated August 24, 1987. These items are: 1. Addition of water tank and pump house. 2. Removal of rail dock. 3. Relocation of gate house. 4. Addition-of truck receiving building. 5.
