Minutes 06-09-87MINUTES OF THE PLANNING AND ZONING BOARD MEETING HELD IN COMMISSION CHAMBERS, CITY HALL, BOYNTON BEACH, FLORIDA TUESDAY, JUNE 9, 1987 AT 7:30 P.M. He introduced the members of the Board, the Planning Staff, and the Recording Secretary. Chairman Trauger recognized the presence in the audience of Mayor Nick Cassandra, Vice Mayor Ralph Marchese, Commissioner Ezell Hester, Commissioner Dee Zibelli, Commissioner Leonard Mann, City Manager Peter Cheney, Chamber of Commerce Executive Director Owen Anderson, and Chamber members Lucy Gratton and Don Zyto. ANNOUNCEMENTS Mr. Annunziato reminded the Board of the Special Planning and Zoning Board meeting scheduled for Tuesday, June 23, 1987 at 7:30 P.M. This meeting will be to conduct Public Hearings on three matters related to Comprehensive Plan amendments. I Mr. Annunziato then introduced a new employee of the Planning Department, Michael Rumpf, a recent graduate of the University of Michigan. MINUTES OF MAY 12, 1987 Mr. Ryder moved to approve the minutes of May 12, 1987 as presented. The motion was seconded by Mr. Walshak, and the motion carried 6-0. (Mr. Lehnertz had not yet arrived at the meeting.) COMMUNICATIONS Mr. Annunziato handed out several memorandums to Board mem- bers pertaining to the agenda. - 1 MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA JUNE 9, 1987 Chairman Trauger asked about the recent Supreme Court decision concerning Planning and Zoning Boards compensating owners for their property, if the Boards decide the current zonings should not be allowed and the owners are denied that use of their property. Mr. Annunziato replied that he did not have a lot of details about the decision, but as more information became available the Board would be advised. Mr. Walshak told of a decision concerning easements; if someone's property is used via an easement, that person is entitled to compensation for that easement. Mr. Annunziato stated that the City compensates for easements. Mr. Annunziato added that what was tested, how it was tested, how it relates to the Comprehensive Planning program, how it relates to Florida law, and what the City Attorney advises will all have to be considered when evaluating how this decision affects the Board. OLD BUSINESS A. Mr. Ryder moved to take the request of Dr. Nelson Lopez from the table and DELETE it from the agenda. Mrs. Huckle seconded the motion, which carried 6-0. B. Mr. Blanchette moved to leave the request on the table, and the motion was seconded by Mr. Ryder. The motion carried 6-0. NEW BUSINESS A. South Federal Highway at Woolbright Road, southwest corner Request for relief from Section 5-141 (g)(3) "Driveways" of the Parking Lot Regulations Mr. Annunziato reported that, upon further review of the request, it was determined that Mr. Felton's request did not constitute intensification, which would make him fall under the Parking Lot Regulation. Therefore, he recommended that this request be removed from the agenda and that the applicant be reimbursed for the administrative fees he had paid. Mrs. Huckle moved that this request be deleted from the agenda. The motion was seconded by Mr. Ryder and carried unanimously. Individual homeowners owning property in Boynton Lakes, whose names are on file with the City Clerk East side of North Congress Avenue, south of Hypoluxo Road See "Addendum A" attached to the original copy of these minutes in the City Clerk's Office - 3 - MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA JUNE 9, 1987 Description: Request for the abandonment of a 12' wide utility easement (to be replaced by a new easement) Mr. Golden said that Plat No. 2 was located adjacent to Congress Avenue and north of the main entrance of Boynton Lakes. He noted that the plat consisted of single-family, detached, zero lot line homes. Mr. Golden explained that the purpose of the abandonment was to set the stage for a future request for a Master Plan Modification to allow extended screened enclosures and porches. Mr. Golden reported that Florida Power and Light and Southern Bell had agreed to the abandonment, subject to the dedication of new easements prior to the abandonment of the old easements and the cost of utility relocation being paid by Lennar Homes. Based on this response, the City Engineer recommended approval, subject to the same two factors. Attorney David Shaw, of Fleming, Haile & Shaw, P.A., 50 Cocoanut Road, Suite 212., Palm Beach, Florida 33480, was representing Lennar Homes. Attorney Shaw explained that, when the plat was recorded, there was a uniform utility easement along every lot shown on the plat. Along the line, certain improvements were made to the existing zero lot lines, pursuant to duly issued building permits. Later, it became apparent that some of the existing and proposed patios and other improvements encroached upon the existing easements granted by the plat. Don Elliott, also representing Lennar ~omes, said that the easements to be abandoned were within the property lines, and he showed their locations. Mr. Elliott noted that Southern Bell's lines were within the old easements, about 1½' from the rear property line. ge said, with the new easements, there were only three places where the lines would still be encroaching. Mr. Elliot stated that they were willing to pay for the relocation of these utilities. Mr. Ryder asked if the purpose of relocating the easement was to have additional porches. Mr. Elliott answered that the screened enclosures had already been built, and they were unknowingly in the easements that were originally provided. He said they were now trying to abandon the old easements and adopt new easements, so the property owners would not have to tear down their screened e~closures. (At 7:50 P.M., Mr. Lehnertz arrived at the meeting.) - 4 - MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA JUNE 9, 1987 In response to Mr. Btanchette's inquiry, Mr. Elliott said the new easements, for the most part, would be 10' wide. Chairman Trauger asked if anyone wished to speak in favor of the request. One woman in the audience stated that she felt granting of the request would help many people in the area, and she did not think it would cause any problems. Chairman Trauger asked if anyone wished to speak against the request. There was no response. THE PUBLIC HEARING WAS CLOSED. Mr. Walshak moved that the request of Boynton Lakes Plat No. 2 for the abandonment of a 12' wide utility easement, to be replaced by a new easement, be approved. Mr. Ryder stated the recommendation of the Building Department should be included, which would make the approval s~bject to the dedication of a new easement prior to the abandonment of the old easement and subject to the expense for utility relocation being covered by the applicant. (See "Addendum B" attached to the original copy of these minutes.) Mr. Walshak agreed to make those conditions part of his motion. The motion was seconded by Dr. Jackier and carried 7-0. LAND USE ELEMENT AMENDMENT AND REZONING Project Name: Agent: Owner: Location: Legal Description: Description: Quatman Property None Jack Quatman South side of Shore Drive, North Federal Highway east of The East 30 feet of Section 2, COQUINA COVE SUBDIVISION, lying parallel with the West line of Lot 62, according to the Plat of COQUINA COVE, as recorded in Plat Book 24, at Page 14, in and for the Public Records of Palm Beach County Request for an amendment to the Future Land Use Element of the Comprehensive Plan from Local Retail Commercial to Low Density Residential and rezoning from C-3 (Community Commercial) to R-1AA (Single-Family Residential) for the purpose of constructing a two-car garage (to be attached to the existing s~ngle-family home on the adjacent lot to the east) Miss Heyden stated the proposed use of the property, if rezoned, would be to combine the land in question with the MINUTES - PLANNING AND BOYNTON BEACH, FLORIDA ZONING BOARD JUNE 9, 1987 existing R-1AA lot to the east (both owned by Mr. Quatman) to allow for the addition of a two-car garage to the existing single-family home. Miss Heyden noted that the applicant's single-family home is to the east of the property; further to the east are additional single-family homes in Coquina Cove zoned R-1AA; to the south is the Boynton C-16 canal; to the west is a 1.605 acre C-3 zoned parcel, which is currently vacant; to the north is a 50' wide right-of-way to Shore Drive. Miss Heyden explained that, under the present zoning, the subject parcel would be undevelopable, as it does not meet the minimum criteria for the C-3 zoning regulations. She reported that allowing the rezoning to R-1AA would allow the applicant to seek a Unity of Title on his property, in order to allow f~r the proposed addition to the home. Miss Heyden noted that the Comprehensive Plan policies rele- vant to this request were outlined in a Planning Department memo. She further pointed out certain issues pertinent to the rezonlng and Land Use Amendment request, which were noted in the same memorandum (dated 6/1/87) from Mr. Annunziato to the Board. In summary, Miss He,den stated the proposed rezoning and use of the property would b~ compatible with existing and proposed land uses in the vicinity and was consistent with the Comprehensive Plan policies. Therefore, the ~lanning Department recommended approval of the request without reservations. Hank Thompson, Hank Thompson Realty, 639 East Ocean Avenue, was representing Mr. Quatman. Mr. Thompson concurred with all the comments that had been made. Chairman Trauger asked if anyone wished to speak in favor of the request. There was no response. Chairman Trauger then asked if anyone wished to speak in opposition to the request. As there was no request, THE PUBLIC HEARING WAS CLOSED. Mr. Ryder moved Future Land Use Retail Commercial to Low Density Residential and rezoning from C-3 (Community Commercial) to R-1AA (Single-Family Residential) for the purpose of constructinq a two-car garage (to be attached to the existing single-family home the adjacent lot to the east be approved. Palmer Coscan Development Corporation West of South Congress Avenue, between Golf Road and Woolbright Road extended A rep!at of Tracts 1, 2 and a portion of Tract 6 of the Plat of Quail Lake West and Tracts 1 and 2 [Plat Book 50, Pgs. 3, 4 & 5), and lying in the Northeast quarter of Section 31, Township 45 South, Range 43 East, City of Boynton Beach, Palm Beach County, Florida Request for the approval of the construction plans and preliminary plat which provides for the construc- tion of infrastructure improvements to serve 96 multi-family units and 21 single-family units at Phase No. 1 of the Quail Lake.West Planned Unit Development Mr. Golden advised that Phase One of Quail Run consisted of 96 units in the southern portion of the property, which were a part of the site plan approved at the special Board meeting held in April. He stated that Phase One also included 24 single-family platted lots. Mr. Golden reported the applicant had submitted a letter to the City outlining the improvements to be constructed with this request (letter attached as part of the staff comments addendum). Don Cuozzo, Director of Planning and Development for Coscan Development Corporation, 1900 Corporate Boulevard, Boca Raton, Florida, agreed to all staff comments. In answer to Mr. Ryder's inquiry, Mr. Cuozzo said $.W. 26th Street would be a public street. Coscan will construct Woolbright Road from Congress Avenue to the western boundary of its property and S.W. 26th from the lift station north to Woolbright Road, along with making other improvements as noted in the letter. In response to Chairman Trauger's ~nquiry, Mr. Annunziato said the gross density for the entire develop- ment is 4.8 units per acre, but he noted there is a large lake causing a higher net density. Mr. Annunziato reported that Coscan has a fine reputation. Mr. Cuozzo stated that the company's name had to be changed from Costain to Coscan, because of a requirement of the - 7 MINUTES PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA JUNE 9, 1987 purchase of the company that the name five years of the purchase. He added never been through bankruptcy. must be changed within that the company had Mr. Annunziato explained that the improvements noted in the letter would be completed during the first phase of Quail Run. Mr. Annunziato noted that the construction of Woolbright Road would be completed within 21 months of City Commission approval, unless three certain conditions became imminent. If any one of these three conditions became imminent, construction would begin immediately. Mrs. Huckle moved to approve the construction plans and pre- liminary plat which provides for the construction of infra- structure improvements to serve 96 multi-family units and 21 single-family units at Phase No. 1 of the Quail Lake West Planned unit Development, subject to all staff comments. (See "Addendum C1-5" attached to the original copy of these minutes. ) The motion was seconded by Dr. Jackier and carried 7-0. MASTER PLAN MODIFICATIONS Project Name: Agent: Owner: Location: Legal Description: Description: Meadows 300 Tract D-Viscaya David L. Flinchum The Babcock Corporation West side of North Congress south of Hypoluxo Road Avenue, Tract D, Meadows 300 Request for approval of an amended master plan to reinstate seven interior single-family lots which were previously deleted to provide for a private recreation facility Mr. Golden informed the Board that Tract D was located in the southwest corner of the Meadows 300 PUD. Mr. Golden outlined the procedure for a Master Plan modification for the benefit of new Board members. He explained that a letter and plans are submitted to the Planning Department, who schedules the applicant to meet with the Technical Review Board (TRB). The TRB would review the request and plans and make a recommendation to the City Commission of either a substantial or an inconsequential change to the Master Plan. The City Commission would then review the request, including the TRB recommendation, and would decide whether or not the change to the original Master Plan would be substantial. If the change was found to be substantial, the applicant would - 8 - MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA JUNE 9, 1987 have to resubmit the entire PUD application. If the change was not found to be substantial, the request would be for- warded to the PZB for final review and consideration. Mr. Golden reported that this request went before the City Commission on June 2, 1987, and the recommendation of the TRB to forward the request to the PZB was unanimously approved. The City Commission did not feel that the request constituted a substantial change to the Master Plan. In response to inquiries by Chairman Trauger and Mr. Ryder, Mr. Annunziato reported that all of the lots were still vacant, and there had been no sales yet. David Flinchum, 6306 Via Townsend, West Palm Beach, Florida, was representing The Babcock Corporation. Mr. Flinchum stated that he had appeared before the PZB and the City Commission in October of 1986 to remove the seven interior lots to pro- vide for a private recreational facility. After a disappointing marketing response, the developer wished to have the seven lots reinstated and tha units upgraded. Mr. Flinchum advised that reservations had been taken on five of the home sites, and those who made reservations had their money returned. Mr. Plinchum concurred with Mr. Annunziato's statement that no lots had been sold. Mrs. Suckle complimented the applicant's recognizing the need for a marketing change early in the project's development. She wished more developers would make such considerations. Mr. Ryder asked how the three different Meadows 300 projects they were considering tied in, in view of the fact that they had different agents and owners. Mr. Annunziato explained that the original developer of the Meadows, Mr. Franks, developed the overall plan for the property and recorded the first plat of four tracts, plus the construction of a loop road. Mr. Franks subsequently platted the property in tracts, and those properties are being sold to individual building companies. Those companies are buying one or more tracts and are developing the individual tracts. Mr. Annunziato stated that, in addition to having several developers, the Meadows also has several homeowners asso- ciations. Each tract has its own internal association to maintain the common properties within that tract. There is also a parent association for properties common to all of the tracts. M~r. Annunziato further explained that there are recreational facilities common to all of the tracts, as well as additional recreational amenities common to individual tracts. - 9 - MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA JUNE 9, 1987 Mrs. Huckle moved to approve the request of the Meadows 300 Tract D-Viscaya for an amended master plan to reinstate seven interior single-family lots which were previously deleted to provide for a private recreation facility. Project Name: Meadows 300 Tract E Agent: Ed Schwab Owner: The Wilshire Corporation Location: West side of North Congress Avenue, south of Hypoluxo Road Legal Description: Description: Tract E of the Meadows 300, Plat No. 3, according to the Plat thereof as recorded in Plat Book 48~ Pages 196 through 200, of the Public Records of Palm Beach County, Florida Request for approval of an amended master plan to delete 25 units (from 126 to 101) and to modify the approved unit type from Cluster (CL) to Single- Family (SF) Mr. Golden reported that Tract E is the last tract in the Meadows that is unaccounted for. He said that Tract E is adjacent to Viscaya, but is separated by a 50' local street. Mr. Golden advised that this project also went before the City Commission on June 2, 1987. The City Commission voted unanimously to accept the recommendation of the TRB that the requested change was not substantial in nature and that the request be forwarded to the PZB for final consideration. Chairman Trauger asked if a change in unit type would affect what was to be constructed there. Mr. Golden answered that cluster homes would have allowed apartments or some other form of multi-family housing. The current request would restrict the property to single-family homes. Chairman Trauger asked if there was any plan of what the homes would look like. Mr. Golden replied that there was only a conceptual plat document for the tract, showing the basic proposed layout. Ed Schwab, The Wilshire Corporation, 1000 Southern Boulevard, Suite 300, West Palm Beach, Florida 33405-2426, reported that The Wilshire Corporation had been a developer, along with Mr. Franks, providing recreational amenities for the entire Meadows PUD. Mr. Schwab explained that they were seeking a reduction in density for what was designed to be a straight subdivision with no recreational facilities provided within it; the tract would rather share the facilities designed and 10 MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA JUNE 9, 1987 built for the entire Meadows 300. Mr. Schwab added that the density would be reduced from five units per acre to four units per acre. In response to Mr. Walshak's inquiry, Mr. Schwab stated that the price range would be $110,000 $125,000 for both lots and homes. Chairman Trauger wondered when the Board would be able to see what the homes would look like. Mr. Annunzlato advised that no site plans for fee simple, detached single-family homes are required to be submitted in connection with PUD regula- tions; only common areas and multi-family units are subject to site plan review. Mrs. Huckle wondered if requiring site plans should be suggested. Mr. Annunziato replied that the requirement that single-family homes and detached duplexes in a PUD be subject to site plan review was specifically deleted years ago. In response to Chairman Trauger's inquiry, Mr. Annunziato said the logic behind this deletion was that these homes would be governed primarily by the Building Code and that there are ~a different set of standards for single-family homes than for multi-family homes. Mrs. Huckle thought that deletion should be reviewed. Mr. Blanchette felt that reinstating the requirement would eventually lead to reviewing of every home in the City. Mrs. Huckle responded that P~Ds get a lot of leniency and should be closely reviewed. Mr. Annunziato noted that single-family homes in condominium form are reviewed by the PZB. Mr. Schwab said they had a certain criteria that is submitted with their preliminary site plan as far as setbacks, side yard clearances, etc. He said the replat would show specific easements and road construction. Mr. Schwab also mentioned other strict controls and regulations of the City that would be enforced. Mr. Annunziato asked if Mr. Schwab would be willing to show the four planned units to the Planning and Zoning Board at the time of preliminary plat approval. Mr. Schwab said he would like to submit elevations that would show a typical product, but not one specifically for this use, because the units had not yet been designed. Mr. Schwab confirmed Mr. Annunziato's explanation that there was a master homeowners association for the Meadows 300 for all the tracts and that each tract had its own homeowners association, if there was a common element in the tract. He stated this tract would not have its own association, since it was a straight subdivision, but would be a part of the master association. - 11 MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA JUNE 9, 1987 Mr. Schwab reported the overall impact on the Meadows 300 from the day of conception to the present time is an overall reduction in the PUD of 25 units. He explained that there are over 1,300 units in the Meadows. Mr. Ryder moved to approve the amended master plan to delete 25 units (from 126 to 101) and to modify the approved unit type from Cluster (CL) to Single-Family (SF). (There were no staff comments.) The motion was seconded by Mr. Walshak and carried 7-0. C. SITE PLAN Project Name: Agent: Owner: Location: Legal Description: Description: Meadows 300 Tract M-Meadow Lake Tim Lynch Boynton West Corporation West side of North Congress Avenue, south of Hypoluxo Road Tract M, Meadows 300 Request for site plan approval for entrance wall signage and a private recreation facility Miss Heyden stated that Tract M was located on the southeast corner of the L.W.D.D. L-19 canal and Meadows Boulevard. She said the applicant was proposing to construct a private recreational facility on one of the zero lot line, single- family detached lots immediately west of the lake. The entrance signage would be located at the intersection of Meadows Boulevard and Swallow Drive. The facility would provide a.pool and deck area, bath house and adequate parking. Miss Heyden distributed pictures indicative of the architec- tural character of the homes to be built in Tract M. She pointed out the recreation area would not interface with units of other tracts. Miss Heyden noted that the renderings of the entry wall elevations and recreational facilities indicated the colors to be used. She advised that the TRB recommended approval, subject to staff comments. Mr. Golden commented on items i and 2 of the memo from Chief Building Inspector Don Jaeger to Mr. Annunziato. Item 1 said that 10 parking spaces were required for recreation area parking. Mr. Golden said that. requirement refers to community swimming pools that serve the public (such as a pool that would serve the entire Meadows project). Mr. Golden explained that, in the past in a number of PHDs, a lesser requirement for private recreation parking was used, since these areas were accessible by foot. He said the lesser requirement was one - 12 - MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA JUNE 9, 1987 parking space per 1,500 square feet of pool and deck area, and the site plan does fulfill that requirement. Mr. Golden said, based on zoning regulations and previous policy, the Planning Department was recommending that parking was suf- ficient. Mr. Golden advised there were four parking spaces. In reference to item 2 of 5~r. Jaeger's memo, Mr. Golden said Mr. Jaeger had noted that the recreation area driveway must be 30' from the intersection of two street right-of-way lines. Mr. Golden read the definition of a driveway, according to the parking lot regulations. Mr. Golden then explained that these streets were private rather than public and, therefore, d~d not have to me~t that requirement. He said the TRB would have imposed that requirement, if they had felt it necessary. Chairman Trauger asked if the signage was in compliance with the proposed, revised Sign Code. Mr. Annunziato remarked that the new Sign CQde had not yet been adopted. He noted that; in PUDs, wall ~signs have been subject to review by the PZB and the City Co~ission. Mr. Annunziato was not sure wh~ether it was consistent with the new Sign Code, but he knew it was consistent with other kinds of wall signs which this Board had approved. Chairman Trauger did not want to ~rppr~ve a sign t~at would be in violation in a few months; · .Annunziato di~ ~ot think the sign wo~ld be in violation, if it~was ~prov~d ~w. Mr. A~nunziato s~id he wo~ld double- c~eck the situa%ion 'before the project came before the City C~mmission. Mr. Walshak wondered if a recommendation could be made at some time to amend this ordinance regarding parking areas and right-of-way lises to accomodate situations of this nature, so the Board would have a specific guideline to govern their actions. Mr. Annunziato concurred that there should be clarification of the ordinance. ~e stated that the recommendations being made tonight were consistent with the handling of prior similar situations. Tim Lynch, Boynton West Corporation, 840 U.S. #1, North Palm B~ach, Florida 33408, stated that the colors to be used in the project were brown and peach. Mr. Corbett explained that the request is to extend the existing maintenance facility in order to house some of the equipment inside. He said the addition was not for the pur- pose of having more golf carts, but rather to be able to store indoors more of the maintenance equipment. - 14 - MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA JUNE 9, 1987 Chairman Trauger asked how close the maintenance shed was to the closest residence; Mr. Corbett did not know the exact distance, but said it was a long way. Mr. Blanchette said that, since the original complaints concerning noise were made, the vegetation has grown so high that it muffles the sound of the lawn mowers. Chairman Trauger said it had been requested that any future development of this property be thoroughly buffered. ~Mr. Corbett concurred with Mr. Blanchette that the vegetation there was acting as a noise buffer. Mr. Annunziato added that the country club has to comply with the City's noise ordinance. Mr. Walshak asked what the dimensions of the building would be. Mr. Corbett replied the dimensions were 30'x152'4". He added that the trees and hedges around the building were already existing. Mr. Corbett explained how the interior of the building would be rearranged. Mr. Corbett stated that High Ridge Country Club agreed with the one staff comment. The TRB recommended approval, subject to staff comments. Frederick Vecchione, 2434 Cardinal Lane, Palm Beach Gardens, Florida 33408, concurred with the staff comments. Chairman Trauger asked about the letter from the Palm Beach County Health Department and dock permits. Mr. Vecchione replied that the Corps of Engineers had reviewed the applications from the individual owners on the boat docks to be located behind the buildings, at the request of the Health Department. He ~dded that verbal approval h~d been given by the Corps of Engineers, .with letters' to follow. The owners wanted to make s~re it was permissible to be in the site plan, so if permission was received in writing from the Corps of Engineers and the ~ealth Department, they could proceed with t~e plans. Chairman Trauger again remarked t~hat it appeared the mangroves had been carefully trimmed at the site of the proposed boat docks. Mr. Vecchione answered that careful review had been taken of the existing condi.tions, and the boat docks had been designed around the mangroves; not one mangrove had been trimmed. If it were possible to trim the mangroves, there would be docks in every unit. Mr. Annunziato asked Mr. Vecchione to comment on the statement in the Health Department's letter that the dock plans showed an increase of deck widths from 6' to 12', which would reduce the buffer significantly and could cause serious biological impact. Mr. Vecchione responded that the deck would not affect the buffer because of the way it was designed; he said the original monolithic slab would have affected the buffer, but now the docks have been redesigned to not affect the slope behind the building le~ding to the mangrove. Mr. Vecchione added that the deck will be tied into the existing structure and will be supported by 4'x4' posts going into a deep footer, which will not affect the natural grade behind the building. In response to Mr. Ryder's inquiry, Mr. Vecchione informed him that Mariner's Way was located on the north side of the canal and was a different pro~ect from Mariner's Village, which was located on the south side of the canal. He stated that the first building had already been completed and the decks would extend 6' out. Mr. Vecchione noted that the reason this was proposed was so the people purchasing the units could have a larger deck with a screened enclosure around it. - 16 - MINUTES PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA JUNE 9, 1987 Mr. Watshak agreed with Chairman Trauger's statement that the mangroves appeared to have been carefully trimmed. He recommended that Mr. Annunziato have the City Forester look into that situation. Mr. Vecchione said the Health Department and the Corps of Engineers had been brought in originally to determine the feasibility of having individual docks, and they had advised where the docks should be located. Mr. Walshak thought that was a wise action, but warned that anyone disturbing the mangroves should be very careful. Mr. Annunziato promised to contact the City Forester and have him examine the site for signs of tampering. Mr. Ryder asked if the porches would cantilever out, and Mr. Vecchione answered that it was similar to a cantilever, as it would not be sitting on the ground and would not affect the grade, but it would be supported on the outer end. Mr. Vecchione informed Mrs. Huckle that the canal was 90' wide. He also advised t~at the homeowners association's declaration limits the size of bOa%s on the canal to under 30'. The-re was further discussion of the layout of the decks and the docks. Mr. Uecchione stated that Mariner's Way has received seven reservation deposits; four of those are for the first building. He added~that {he eight units in the first building are very close to completion. Mrs. Huckle expressed reservations about approving the project, due to the intensity and the complications from the environ- mental aspect. Mr. Walshak commented that the project would have to comply with strict regulations by the environmental agencies. Mr. Walshak then moved to approve the request for an amended site plan to allow for the addition of screened enclosures and individual unit docks, subject to all staff comments (See ~Addendum Gl-4" attached to the original copy of these minutes, which includes the letter from the Health Department) and to request that the City Forester investigate possible tampering of the mangroves. Mr. Annunziato promised to have the topic on the next agenda. Comments by Chairman Trau~er Chairman Trauger asked if the Board was supposed to take any action on the proposed, revised Sign Code. City Manager Cheney advised that the members ~ould make any suggestions individually or as a Board to the City Commission. He said the issue will be on the next City Commission agenda, and a workshop will be held regarding the Sign Code in the future. Chairman Trauger next asked about Ordinance 87-10, which is holding up construction on Boynton Beach Boulevard. He asked when the consultants would be selected for this matter. City Manager Cheney responded that a Special City Commission meeting would be held on Thursday, June 11, 1987 at 7:30 P.M. At that time, two consultants would make presentations to the Commission, and the Commission would either make a selection that evening or at the next City Commission meeting on the following Tuesday; a contract would then be signed, and the work would proceed. Chairman Trauger asked if no requests for approval of projects on Boynton Beach Boulevard would be made of the PZB until this was finalized. Mr. Annunziato stated that there was a variance procedure that could be reviewed. Motion re Reviewing PUD Ordinance Mrs. Huckle moved that the PZB recommend that the City Commission review the PUD Ordinance relevant to the possibi- lity of an amendment to include architectural review for single-family homes in a PUD. Mr. Walshak seconded the motion. Mayor Cassandra remarked that the City Commission would be forming a Board to review all City Ordinances. He believed, at that time, Mrs. Huckle's concerns should be addressed. Mrs. Huckle preferred to let her motion stand and have the recommendation go to the City Commission, so they are aware of the Board's concern. A vote was then taken, and the motion carried 6-1. Mr. Blanchette voted against the motion.
