Chairman Trauger called the meeting to order at 7:30 P.M.
He recognized in the audience the presence of Mayor Nick
Cassandra, Commissioner Ezell Hester, former Vice Mayor Carl
Zimmerman, and Bill Cooper with The Palm Beach Post. Chairman~
Trauger introduced the Board members, Mr. Golden, Ms. Heyden,
and the Recording Secretary.
MINUTES OF APRIL 14, 1987
Mr. Ryder moved to adopt the minutes of April 14, 1987 as
presented. Mr. Schultz seconded the motion, which carried
6-0. Mrs. Huckle abstained from voting, because she was not
present at that meeting.
ANNOUNCEMENTS
Mr. Golden asked if the Board wished to postpone election of
a Vice Chairman until a full Board of the regular members was
present. Mrs. Huckle moved to delay the election of a Vice
C~airman until the next regular Board meeting. The motion
was seconded by Mr. Schultz and carried 7-0.
COMMUNICATIONS
Chairman Trauger wished to comment on two memorandums. The
first memo was an inquiry from City Manager Cheney to City
Attorney Rea dated April 21, 1987. The second was a reply
memo from City Attorney Rea to City Manager Cheney dated
April 22, 1987. (See "Addendums A and B" attached to the
original copy of these minutes in the City Clerk's office.)
The memos addressed two questions: (1) what the roles of the
Planning and Zoning Board (PZB) and the Community Appearance

Board (CAB) are in connection with review of architectural
features and colors of buildings, and (2) whether colored
elevations and architectural features ~ould become a part of
the site plan review procedure of the PZB, and whether
construction totally consistent with such presentations
could be required by the City prior to certification of
occupancy for such buildings.
Chairman Tr~qer agreed wholeheartedly with the City
Attorney's interpretation of the issues. Mr. Ryder moved
that for clarification at further PZB meetings, the memo
from the City Attorney, answerin~ the two inquiries of the
City Manager concerning the ~uties of the Board and Board
procedure, sh0~ld be attached to the minutes of this meeting.

that he had colored renderings of both the site plan and the
architectural elevations of the building.
Mr. Ryder asked Mr. Cuozzo to describe the boundaries of the
project. Mr. Cuozzo replied that the boundaries include
Golf Road, Congress Avenue, S.W. 26th Street, and Woolbright
Road. Mr. Cuozzo said the units are all two-story with
individual garages; each unit is above its own garage. Mr.
Cuozzo explained that the buildings have terra cotta colored
flat cement glazed tile, metal doors, brown trim, and bronze
windows. All this was shown on the front elevation. The
rear elevation revealed screened enclosures; the side eleva-
tions showed a side entr~ on the first floor.
Mr. Ryder inquired about the south elevation, which would be
facing the existing development across the road. Mr. Cuozzo
stated that there would be a berm and a fenced landscaping
feature along Golf Road, making it very difficult to see the
property. In response to Mr. Schultz' in~uirv, Mr. Cuozzo
explained that there is no porch over the-gar~e. Mr. Cuozzo
told Mr. Jackier that the colo~s on the rendering are as true
as could be obtained on a drawing, and he added that the units
are beiqe stucco with brown trim. Mr. Cuozso noted that this
same type unit is currently being constructed for Boca Golf
and Te~is and in HOllywood, FLorida.
Chairman Trauger asked if there was anything with the ren-
derings describing the specific paint colors. Mr. Cuozzo
replied that he had that information, but had not provided
it for the PZB. He said he had provided colors to the CAB.
In answer to Mr. Ryder's inquiry, Mr. Cuozzo said the entrance
to the project does not line up with the entrance of the project
across the street. Mr. Cuozzo advised that there are eight
units in each building, which would be condominiums. He added
that there would be a master association for the entire project,
a homeowners association for the 21 single-family units, and a
condominium association for these units. A large recreational
facility is planned for the entire area. In response to Mrs.
Huckle's inquiry, Mr. Cuozzo stated there would be no dumpsters,
but rather curbside pickup. In response to Mayor Cassandra's
comments, Mr. Cuozzo said there would be proper lighting also.
Mr. Schultz moved to approve the site plan request of Quail
Lake West to construct 96 multi-family units, subject to staff
comments. (See "Addendum C" attached to the original copy of
these minutes.) Mr. Schultz pointed out that the landscaping
for Tract 2 and the southern portion of Tract 6, as per the
City Attorney's letter, would be approved by the CAB. Chairman

Trauger advised that the motion should also state that approval
is also made in accordance with the renderings displayed, and
final construction must reflect these renderings. Mrs. Buckle
seconded the motion, and the motion carried 7-0.
Mr. Walshak wanted to know what would happen to the archi-
tectural renderings after the developers have completed the
entire review process. Mr. Golden advised that, in the past,
they took the drawings back; however, with the new require-
ments and the fact that the Board is holding them to the
color schemes, he felt it might be wise to hold on to the
renderings. Mr. Waishak agreed with Mr. Golden's opinion.
Mr. Schultz said the City Attorney had addressed that question

Mr. Ryder moved to remove the Diaz Shopping Center project
from the table. The motion was seconded by Mrs. Huckle and
carried 7-0.
Mr. Golden reminded the Board that the TRB had recommended
approval of the project, subject to staff comments. Kimberly
Dellastatious, Currie Schneider Associates AIA, 25 Seabreeze
Avenue, Delra~ Beach, Florida 33444, showed a street elevation,
two side elevations, and a rear elevation.
Ms. Dellastatious told Chairman Trauger that the building has
blue tile and piped columns, as well as stucco columns. Ms.
Dellastatious also showed the site plan. In response to Mr.
Ryder's inquiry, Ms. Deltastatious reported that the building
is set back about 72 feet frQm the road. She told Mr. Schultz
that there is a three foot parapet from the roof. The walls
are off-white with a slight pinkish tone, and the tile and
columns are blue.
There was discussion concerning the location of the project
in relationship to various streets. Ms. Dellastatious advised
the the site is about 2,000 feet from Congress Avenue. Mrs.
Buckle asked if the building would be all retail or partly
olffice also. Ms. Dellastatious stated that the space is not
leased yet, ~but anything that is permissible in C-3 zoning
might go there.
Mrs. Buckle asked about the parking requirements, and Mr.
Golden answered that the site plan has sufficient parking to
accommodate retail, medical or professional office use. In
response to Mr. Nyquist's inquiry, Ms. Dellastatious stated
the walls are 240 feet in length, and she said there would be
fire walls with a one hour rating or a two hour rating, but no
major fire walls.
Mrs. Huckle moved to approve the site plan request of the
Diaz Shopping Center to construct a 14,400 square foot com-
mercial building on 1.18 acres, subject to all staff comments
(See "Addendum D" attached to the original copy of these
~inutes.) and subject to conformance to the colored renderings.
The motion was seconded by Mr. Nyquist and carried 7-0.

Mr. Schultz moved to remove the Jacobs Office Building project
from the table. The motion was seconded by Mr. Walshak and
carried 7-0.
Mr. Golden stated that the project had been recommended for
approval by the TRB, subject to staff comments.
David Diesselhorst, Project Manager for Dr. Jacobs, 10811
Cedar Avenue, Fairfax, Virginia, displayed colored elevations
of the building. Mr. Diesselhorst said the colors would be
the same as those shown in the drawings, and he stated that
he already has made a color selection with manufacturer color
numbers that are available in this area.
In response to a comment by Chairman Trauger concerning Mr.
Diesselhorst's statement at the City Commission meeting that
the PZB should be reprimanded for tabling these projects, Mr.
Dissselhorst stated that his remarks were not meant to be a
personal statement against any individual. Mr. Ryder replied
that the comments were an insult to the Board; he said the
people on the Board give their time freely to serve the City
and do not deserve such comments. Mr. Diesselhorst responded
that he had just expressed his interpretation of a City's
ordinance. Mrs. Huckle believed that the Mayor and the City
Commissioners had adequately responded to his remarks in
support of the Board, and she thought that should be the end
of the issue. Mr. Walshak expressed his agreement with Mrs.
Huckle's statement.
Mr. Diesselhorst informed Mrs. Huckle that the building was
a light beige or sand color with darker brown accents. He
said the roof was a substantial weight (320 pounds), with
fiberglass shingles.
Mr. Walshak asked if this property abuts residential property.
Mr. Golden advised that it abuts an R-2 parcel to the west
that is owned by Florida Power and Light; further to the west
on that parcel is the FP&L substation. Mr. Diesselhorst noted
there would be a six-foot wall between the front portion of

the C-2 lot and the R-2 area. Mr. Golden said it is a require-
ment of the zoning regulation that the wall be provided at that
site. In response to Mr. Ryder's inquiry, Mr. Golden said that
to the east of the existing dental office along Boynton Beach
Boulevard there is C-2 zoning; to the east of the proposed
building there is R-1-A zoning. There will also be a rezoning
request in May for one of the parcels immediately east of this
building. Mr. Diesselhorst concurred with Mr. Walshak's state-
ment that 3/_4 of the surrounding property is residential.
Mr. Diesselhorst added that the back part of the property
being built on is C-1 zoning, which requires a six-foot
hedge or wall. Mr. Golden said the only place the wall has
to be provided is at the C-2 zoned parcel on the west side;
the remainder of the commercial propert~ (C-l) which abuts
residential has the choice of a six-foot wall or hedge. The
reason for the choice is beoa~use an office use is not viewed
as being as offensive as a r~ail use. Mr. Diessethorst said
a hibiscus hedge will be maintained around the rest of the
property that does not require the wall.
In response to Mr. R~der's inquiry, Mr. Diesselhorst stated
there would be a a~ximum of four offices, including Dr. Jacobs'
office. Dr. Jacobs' dental labor~atory might take up a second
office. Mr. Ryder commented that there is now a 40% vacancy
rate for office spaces in Palm Beach County. Mrs. Buckle
thought that Dr. Jacobs' presence as an owner-occupant would
assure that the facility would be maintained in excellent
condition as long as he is there. In response to Mrs. Buckle's
inquiry, Dr. Jacobs said he did not yet know what he would do
with his current building, which is zoned C-2.
In response to Mr. Walshak's inquiry, Mr. Diesselhorst noted
that the curb cuts are existing and are located on Boynton
Beach Boulevard. Mr. Golden advised that a variance has
been granted for the driveway, which is a single two-way
driveway toward the eastern property. Mrs. Buckle referred
to a comment made by Mr. Annunziato about the correct loca-
tion of the driveway, and Mr. Diesselhorst said the location
shown on the landscape plan and the site plan are now the
same.
Mrs. Buckle moved to approve the site plan request of Dr.
Jacobs to construct a 6,885 square foot professional office
building on .89 acres, subject to all staff comments (See
"Addendum E" attached to the original copy of these minutes.)
and with the understanding that the construction will conform
to the color renderings submitted tonight. The motion was
seconded by Mr. Schultz and carried 7-0.

NEW BUSINESS
A. Comments by Members
Mr. Ryder wished to comment on the fact that Garry Winter
was no longer a member of the PZB. Mr. Ryder said former
Vice Chairman Winter has been on advisory boards for over 12
years. As Mr. Ryder had served on the PZB with Mr. Winter
for many years, he felt the Board would be remiss if they
did not commend his years of public service with the City.
Mr. Ryder felt it was deplorable that Mr. Winter had to leave
his service to the City, because he was not leaving of his
own volition and was willing to continue serving the. Board.
Mr. Ryder moved tha~ the Board indicate their appreciation
for hls public service ~o the ciky of Boynton B~ach for so
many years. The mo%ion was seconded by Mrs. Huckle and
carried 7-0.
Mr. Walshak wished to thank Mayor Cassandra and the City
Commission members for standing behind this Board at the
City Commission meeting last*Thursday concerning the tabling
of these projects and the request for artist renderings. He
also thanked the City Manager, the City Attorney, and City
Commissioner Mann who researched the duties of the Planning
and Zoning Board.
ADJOURNMENT
Chairman Trauger moved to adjOurn, and Mr. Schultz seconded
the motion. There being no further business to come before
the BOard, the meeting was adjourned at 8:25 P.M.

At the April 14, 1987 Planning and Zoning Board meeting, a number of site plans
were tabled because the Members of the Board wished to have the developers_pre-
sent to the Board colored renderings of the facade and more detailed elevations
of the buildings that will be considered on the site plans being reviewed by the
Boards. At the end of the meeting, the Board requested that considerations be
given specifically requ;iring each application coming to the Board include
~olored elevations of builldings to be bu!lt. This request raises concerns that
you are being asked to ~eview as follows.
What are the appropriate roles that are clearly outlined in the
Ordinances for Planning and Zoning and Conmunity Appearance

Role of Planning and Zoning Board Relative to
Architecture and Design Review
Your Memorandum of April 21, 1987, raises two primary
concerns related to the April 14, 1987, Planning and Zoning
Board meeting. I will try to address these issues
independently and as clearly as possible.
1. Pursuant to City Ordinance, what are. the
appropriate roles for Planning and Zoning and the
Community Appearance Board in connection with review of
architectural features and colors of buildings?
The roles of Planning & Zoning and Community Appearance
Board appear to be somewhat overlapping pursuan~ to the
requirements of Section 19-26 and Section 19-43 of the Code
of Ordinances of this City. Under Section 19-26 the
Planning & Zoning Board is to make recommendations to the
City Commission. These recommendations may .impose
conditions designed to safe-guard the community ~elating to
the promotion of public health, safety, morals and general
welfare. Various criteria are established.
The broadest grant of authority related to criteria for
review is established in Section 19-26(b) which states:
"The proposed use, building or structure is generally
compatible and in harmony with the uses and structures on
adjacent and nearby properties and is appropriate in
relation to the established character of other structures in
the immediate area or neighboring areas."
It appears from this grant of authority and this
particular criteria that the Planning & Zoning Board has a
very broad perspective upon which site plans may be
reviewed.
The Community Appearance Board criteria generally
parallel those provided to the Planning & Zoning Board. In
Section 19!-43(a) it is required that "the proposed use,
building or structure is in harmony and generally compatible
with the standards of architecuure, beauty and other
aesthetic considerations as established in the community
design plan." Sub-paragraph (b) of Section 19-43 states as
an additional criteria that "the proposed~use, building or

structure is in harmony with the uses and structures on
adjacent and nearby properties as to landscaping,
preservation and maintenance of beauty, reforestation, open
space, greenery and other aesthetic features of the
immediate and neighboring areas.
Thus it appears that the specific grant to the
Community Appearance Board with regard to review criteria
relates directly to standards of architecture, beauty, and
other aestheti~ considerations. In additien the Community
Appearance Board is specifically charged with evaluation of
l~dscaping, preservation and maintenance of beauty,
reforestation, open space, greenery and other aesthetic
features of the immediate and neighboring areas.
By evaluating these two sections of the Code as they
relate to the Planning & Zoning Board and the Community
Appearance Board, it appears that the. Planning & Zoning
Board can require color renderings for the___e_~llka~ion of a

It is important to point out that in Section 19-17,
that the City Planner may request "such other data as will
assist the technical committee in reviewing and evaluating
the proposed use, building or structure." This provision
adds additional authority to the Planning staff in its
administrative capacity, to request color renderings for
evaluation not only by the technical committee but also
Planning & Zoning and Community Appearance. I must
additionally point out that specific

prior to certification of occupancy for such buildings?
The answer to these two questions are in the
affirmative. Since colored elevations and architectural

features would be considered an integral part of the site
plan review procedure, this City can mandate construction
totally consistent with such presentations. The only
procedural problem would be documentation in the site plan
file of the architectural features and the colored
elevations for future reference. Should the City decide to
enforce consistency with the elevations and architectural
features for final construction it would be advisable for
this city to prouide sufficient notice to an applicant that

Included in this site plan approval is tract no. 2 and the
southern portion of tract no. 6. Tract no. 1, which consists
of single-family platted lots, does not require site plan
approval and is not included as a part of this application.
A lighting plan with full details is required for all parking
lot areas, with the exception of the driveway parking in
front of the units. With reference to the driveway parking,
double-striping Will not be required for these spaces.
Ail local streets are to be aligned with S.W. 26th Street to
form proper intersections.
In connection with site development, the City's Comprehensive
Plan requires the use o~ fences, wetting operations, seeding
and mulching, phased clearing, and other Soil treatment
techniques to control blowing sand. Seeding and mulching is
required if construction does not commence within 30 days of
clearing work.
6. Concrete sidewalks are required on both sides of S.W. 26th
Street. If it is the desire of the developer to construc= a
bicycle path as an alternate to the required sidewalks, the
procedure which allows for relief from this requirement is
outlined in Section 22-25(b) of the Street and Sidewalk
Ordinance. A letter of request submitted to the Planning
Department will initiate this procedure.
If the Littoral Zone has not been completed prior to the
expiration of construction bonds, an additional bond must.be
posted to insure completion of this requirement.
If any residential tracts.are to be platted prior to the
tract containing the recreation facilities, the developer
must submit a bond to cover the cost of construction for the~
recreation facilities.
