Minutes 04-14-87MINUTES OF THE PLANNING AND ZONING BOARD HELD IN COMMISSION CHAMBERS, CITY HALL, BOYNTON SEACH, FLORIDA TUESDAY, APRIL 14, 1987 AT 7:30 P.M. He recognized the presence in the audience of Mayor Nick Cassandra, Vice Mayor Ralph Marchese, former Vice Mayor Carl Z i m merman, Commissioner Ezell Hester, Commissioner Dee Zibelli, City Manager Peter Cheney, and Chamber of Commerce represen- tatives Ann Barrett and Dorian Trauger. Chairman Trauger introduced the Board members, Mr. Annunziato, Mr. Cannon, Mr. Golden, and the Recording Secretary. MINUTES OF /~ARCH 10, 1987 Mr. Ryder moved to approve the minutes as presented. The motion was seconded by Mr. Wandelt and carried 7-0. ANNOUNCEMENTS Mr. Annunziato welcomed back Board members returning for the 1987-88 year and also welcomed new members to the Board. He introduced members of his staff, including Senior Planner Tim Cannon, Administrative Assistant Barbara Schwertfager, Assistant City Planner Jim Gold~n, and Tambri Heyden, a new employee who will be assisting Mr. Golden. ELECTION OF CHAIRMAN AND VICE CHAIRMAN Chairman Trauger stated that, since one appointment to the Board had not yet been completed, the Board must decide whether to elect both officers tonight, elect the Chairman tonight and elect the Vice Chairman at the next meeting, or elect both the Chairman and the Vice Chairman at the next meeting. Mr. Wandelt moved to elect both the Chairman and the Vice Chairman at tonight's meeting. The motion was seconded by - 1 - MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA APRIL 14, 1987 Mr. Ryder. Mr. Walshak felt that the person to be appointed to the Board next week should be a part of the selection of officers, since that person would serve the Board for the next three years. Mr. Schultz thought elections should be held when there was a full Board present, since he was an Alternate sitting in for a regular member at that meeting. A vote was taken on the motion, and the motion carried 4-3. Opposing the motion were Mr. Walshak, Mr. Schultz and Mr. Jackier. Mr. Ryder then moved to reappoint Chairman Trauger as Chairman of the Planning and Zoning Board. The motion was seconded by Mr. Wandelt. Mr. Schultz moved that nominations cease, and that motion was seconded by Mr. Wandelt and carried 7-0. Mr. Annunziato announced that, by acclamation, Chairman Trauger would continue to serve as Chairman. Mr. Wandelt moved to reappoint Vice Chairman Winter as Vice Chairman of the Board. The motion was seconded by Mr. Schultz. Mr. Ryder moved that nominations cease. The motion was seconded by Mr. Wandelt and carried 7-0. Chairman Trauger announced that Vice Chairman Winter would continue to serve as Vice Chairman. OLD BUSINESS Chairman Trauger asked Mr. Annunziato to explain to the new members the operation and timing proposed some time ago for re-examining the Comprehensive Plan. Mr. Annunziato explained that, in December of 1986, the City Council approved the Evaluation and Appraisal Report, which was processed as a Comprehensive Plan amendment. Because of that, it now is the current Comprehensive Plan for the City of Boynton Beach. Over the next twelve months, Mr. Annunziato's staff will be working to implement the requirements of the Evaluation and Appraisal Report. Mr. Annunziato further explained that the 1985 Growth Management legislation requires the preparation of a new Comprehensive Plan, which must be submitted to the Department of Community Affairs by Boynton Beach in February, 1989. Work has begun on the 1989 Comprehensive Plan by hiring Plantec, Inc. to prepare the housing element of the Plan. There should be a draft document prepared by September, 1987. The work for the housing element should occur primarily in the 1987-88 budget year, until there is a draft Comprehensive Plan. The primary work of the Comprehensive Plan will commence in October, 1987, and be completed by .August or September, 1988. NEW BUSINESS A. PUBLIC HEARING PARKING LOT VARIANCE Project Name: Agent: Owner: Location: Legal Description: Description: Cusimano Office Building Cape International, Inc. Margaret J. Avenue, southeast corner 23rd Lot 1, High Point, a subdivision in the City of Boynton Beach, according to the plat thereof on file in the office of the Clerk of the Circuit Court, in and for Palm Beach County, Florida, recorded in Plat Book 23, Page 225 Request for relief from section 5-141 (g)(3) "Driveways" of the Parking Lot Regulations Mr. Golden reminded the Board that this request was denied at the March meeting. At that time, the Board advised the applicant to resubmit the request and provide additional information on uses of the building, traffic movements, and a more detailed conceptual site plan. Mr. Golden advised that the request had been resubmitted with a traffic report and a new site plan. The applicant was still requesting a driveway onto each frontage, with a slight change in loca- tions and width. Mr. Golden explained the exact locations of the proposed driveways onto S.E. 23rd Avenue and Seacrest Boulevard. Mr. Golden said the TRB recommended that the variance be approved in part and denied in part. The TRB recommended that the applicant have one driveway on S.E. 23rd Avenue, located as close to the east property boundary as possible (without interfering with the turnout radius of the driveway located on the adjacent property). The TRB recommended denial for the second requeStedl driveway onto Seacrest, and Mr. Golden explained the reasons. (See a copy of Mr. Annunziato's memo to the Boar!d, dated 4/8/871 and attached to the original copy of these minutes as "Addendum 1".) The TRB further requested that the ~pplicant remove existing MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA APRIL 14, 1987 curb cuts at the time of site plan approval and provide 15 feet of right-of-way within 45 days of the parking lot variance approval. Chairman Trauger asked if the building had parking underneath it, and Mr. Annunziato replied that it did. Chairman Trauger also wondered how many offices would be in the building; Mr. Annunziato recommended asking the applicant. In response to Chairman Trauger's inquiry, Mr. Annunziato answered that the driveway on S.E. 23rd Avenue is within 30 feet of the driveway on the adjacent property. Mr. Schultz commented that he observed many more cars at the S.E. 23rd Avenue entrance than the 10 cars per hour that had been estimated at the last meeting. Mr. Wandelt thought the fact that it is now "income tax time" should be considered concerning the heavy traffic there. Mr. Ryder said, in view of the site plan, the traffic report, and TRB's objections to an entrance on Seacrest Boulevard because of the left turn movements, he felt the current recommendation to have the entrance on S.E. 23rd Avenue would have to be followed. Mr. Ryder saw no problem with having the single entrance to the site. In answer to Mr. Walshak's inquiry, Mr. Annunziato said cars traveling southbound and wishing to turn left to this building would conflict with the left turn lane for northbound traffic. Mr. Walshak wondered why anyone would want to turn across three lanes of traffic when they could turn left at the light and go into the curb cut on S.E. 23rd. Mr. Schultz asked, if the Seacrest entrance was moved to the extreme property line, if it would only be 5 or 6 feet from meeting the 180 foot requirement. Mr. Annunziato replied that there still would not be enough room on the property to meet the Code without a variance. Mr. Schultz commented that it would be 5 or 6 feet as opposed to 20 or more feet. Mr. Walshak was troubled that traffic coming out of the parking lot onto S.E. 23rd Avenue would go a very short distance before making a right hand turn, if wishing to go north on Seacrest Boulevard. Mr. Annunziato said, at peak hours, cars would more than likely Rot be able to make a left turn out of the driveway. Mr. Walshak thought that situation was comparable to cars turning left across Seacrest. Mr. Golden said that problem was weighed against the possibility of a head-on collision on Seacrest. The TRB believed that to inconvenience the people egressing the prop- erty was better than allowing for a potential head-on collision. MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA APRIL 14, 1987 Tom Scott, 600 Egret Circle, Delray Beach, Florida, urged the Board to vote in favor of a two-drive system. He felt having two drives would lessen the impact on the intersection and give people better options for entering and exiting the property. Mr. Scott said there would be advantages to the City as well, such as better and quicker trash pick-up and safer conditions in case of a medical, police or fire emergency. He felt the traffic signal would be better utilized if there was a two- drive system. Mr. Wandelt asked why the entrance on Seacrest could not be moved further south, closer to the property line. He thought that would give further distance for cars to stack up at the cross-over part. Mr. Annunziato said that it was possible. Mr. Scott said allowing both exits would solve the problem of turning left onto Seacrest during the peak hours. In response to Chairman Trauger's inquiry, Mr. Scott expected that there would be at least four offices in the building. Chairman Trauger thought there was going to be an extremely intensive use of that property. Mr. Annunziato pointed out that the building was proposed to be a general office building, rather than a medical office building. He said the traffic report did not reflect this being a medical office building. Mr. Annunziato said the City would monitor the situation to make sure the building is not used for medical purposes, because the numbers in the report would be higher if the building were a medical building. Mr. Scott said the traffic engineer had reported that, even if the traffic figures were doubled, they would be negligible, as far as the impact on the intersection. Mr. Scott added that if there were medical offices, the increased traffic would be spread out over the entire day and would not greatly affect the peak loads. Chairman Trauger asked if anyone wished to speak in favor of the request. There was no response. Chairman Trauger asked if anyone wished to speak in opposition to the request. There was no response. THE PUBLIC HEARING WAS CLOSED. Mr. Ryder moved to follow the recommendation of the TRB and approve one driveway on S.E. 23rd Avenue, subject to all staff comments. Mr. Wandelt commented that he felt both entrances were necessary. As there was no second to the motion, the motion died. Mr. Walshak moved to approve the request for relief from Section 5-141 (g)(3) "Driveways" of the Parking Lot Regulations by approving the variance for two driveways. The motion was seconded by Mr. Wandelt. Mr. Annunziato MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA APRIL 14, 1987 stated that the motion should also include that the appli- cant must dedicate 15 feet of rights-of-way on S.E. 23rd Avenue. Mr. Scott said that was not discussed at the TRB meeting. He said he had no problem with the dedication, but he did not know what that would do to the building. It was decided to reserve this issue for site plan approval. A vote was then taken on the motion, and the motion carried 4-3. Voting in opposition to the motion were Chairman Trauger, Mr. Ryder and Vice Chairman Winter. Chairman Trauger stated that the variance was granted. B. North side of Golf Road, west of Congress Avenue Tracts 1, 2, 3, 4, 5, 6 and 9 according to the plat of Quail Lake West and Tracts 1 and 2 as recorded in Plat Book 50, at Pages 3, 4 and 5 in and for the Public Records of Palm Beach County, Florida Request for site plan approval to construct 96 multi-family units plus landscaping at Tract 2 and the southern portion of Tract 6 at the Quail Lake West Planned Unit Development Mr. Golden stated that the applicant was requesting site plan approval for 96 units, including 40 units in Tract 2 and 56 in the southern portion of Tract 6. Mr. Golden explained that there would be 8 units per building. Additional guest parking is above and beyond Code requirements, and the maximum building height is 31 feet. Mr. Golden said the TRB recommended approval, subject to staff comments. Mr. Golden noted that a large number of the comments were related to future platting and development of the entire 315 units. Don Cuozzo, Director of Planning and Development, Costain Florida, Inc., Suite 400 East Building, 1900 Corporate Blvd. N.W., Boca Raton, Florida 33431, advised that they took over the project in September and plan to having closings in 1987. Mr. Annunziato noted that Costain is probably the first real home builder to own this tract of land. Mr. Cuozzo replied that there were only the ren- derings of the architect s elevations that were shown. Mr. Wandelt said he would like to have an artist rendition of what the project will look like. Mr. Annunziato advised that the Board could request the applicant to provide this material to the Community Appearance Board and the City Commission, the~ could table the request until the applicant ~returned with artist renditions at the next.meeting, or they could approve the project as it is. Mr. Schultz asked if the project would have to be resubmitted in its entirety, if it were tabled. Mr. Annunziato advised that it coul~ come back in the same form, and, in the meantime, the applicant could begin to clean up the plans. Mr. Schultz moved to TABLE the request until the next meeting, at which time the applicant should return with a color artist rendition of four sides. West side of North Congress Avenue, north of Old Boynton Road See "Addendum A" attached to the original copy of these minutes in the City Clerk's Office Request for site plan approval to construct a 36,589 square foot children's toy store on a 4.46 acre portion of outparcel no. 2 at the Boynton Beach Mall Mr. Golden said the proposed location of the project is the north side of the south Mall driveway, immediately across from SunPoint Savings Bank. The main parking area would be located in front of the building, adjacent to Congress Avenue. There would be two driveways, one in front and one to the rear of the building. Mr. Golden showed an overlay of the building and elaborated on the architect and design. Mr. Golden added that with the proposed signage, they were proposing to have a kangaroo. He explained how water and the sanitary sewer would be provided. Mr. Golden said the TRB recommended approval, subject to staff comments. In reply to Mr. Walshak's inquiry, Mr. Golden noted that archi- tectural renderings would have to be submitted to the CAB. John Roland, Peterson and Associates, Suite 1980, Southern National Center, Charlotte, North Carolina 28202, said they were trying to follow the basic features of and use similar materials to the Mall. He elaborated on building materials and said the canopy would be blue. In response to Mr. Walshak's inquiry, Mr. Roland said the kangaroo is located within the sign on the canopy on the front of the building. Mr. Schultz asked if the roof would go up to the top of the split brick. Mr. Roland answered that there would be a three foot high parapet around the entire building, including the entrance. Mr. Sch~ltz wondered if anything would be more than three feet high. Mr. Roland replied that the mechanical units would be 42 inches, but were set back far enough to not be seen. In answer to Chairman Trauger's inquiry, Mr. Roland agreed to all staff comments, including the new list of additional comments. Mr. Schultz moved to approve the request for site plan approval for construction of the toy store, subject to all staff comments. Request for site plan approval to construct a 14,400 square foot com- mercial building on 1.18 acres - 8 - MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA APRIL 14, 1987 Mr. Golden reported that the Diaz property was annexed into the City in December of 1986. Mr. Golden stated that the requested building would be one story and would have parking on the so~th and east sides. Two driveways would be provided onto West Boynton Beach Boulevard near the east and west property boundaries. The building would have a light, cream- colored stucco finish with blue ceramic tile trim and a glass door front. The maximum height will be 25 feet. Mr. Golden noted that the TRB recommended approval, subject to staff comments. In response to Mr. Ryder's inquiry, Mr. Golden stated that the property is east of Greentree Plaza II. Chairman Trauger asked if any more small strip shopping centers would be planned in this area. Mr. Annunziato had not heard of any plans for that, but he thought the Board could anticipate all properties east Of Knuth Road on West Boynton Beach Boulevard would develop similarly to this project. In response to Mr. Schultz' inquiry, Mr. Annunz~ato said the land north of the canal has an agricultural zoning by the County, but it has commercial potential in their future land use element. He explained that aL1 land 400 feet west of Winchester Park Boulevard eastward is to be developed Retail-Commercial by the City, from 4~0 feet west of Winchester Park Boulevard to Knuth R~ad is to be Office-Professional, and west of that is to be Residential. Mr. Annunziato said the intent is to keep the inteasi~e commercial development from Winchester Park east to Congress and to diminish the intensity going westward. Chairman Trauger ,noted that there were 33 original staff comments, plus a~ditional comments. Mr. Annunziato replied that the comments should not be construed as being detrimental to the site plan; many of the comments are informative or request more detailed input in the plans. Kimberly Dellasta~ious, Currie Schneider Associates AIA, 25 Seabreeze Avenue, Delray Beach, Florida 33444, represented the Diaz project. Mr. Schultz asked if there was only a mansard on the front of the shopping center, and Ms. Dellastatious replied there was a parapet on the front and a straight parapet (2 feet above the roof) going across on the rear of the building. Mr. Schultz said he would like to see something of a screening effect on the back of the building as high or higher than any anticipated equipment on the roof. Chairman Trauger stated that would be added as a requirement to the staff comments. Mr. Walshak asked if the Board could have elevations of all sides of the buildings to get a better idea of what they will - 9 - MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA APRIL 14, 1987 look like. Chairman Trauger said he was going to propose to the Planning Department that the applicant must submit a color artist rendering of at least three sides of the building. Mr. Walshak wanted to see all four sides and color schemes of the buildings. Mr. Walshak moved to TABLE this request until architectural renderings were available. Ms. Dellastatious stated that they have submitted color drawings to the CAB, which she thought was the Board to be concerned with this detail. She said she could also bring color elevations to that meeting. Mr. Walshak wished to see the drawings himself. Mr. Walshak's motion was seconded by Mr. Schultz. Mr. Annunziato advised Ms. Dellastatious that her meetings with the CAB and City Commission would be delayed until next month, if the motion passed. Mr. Schultz asked that the requested barrier on the roof be included in the drawing. A vote was then taken, and the motion carried 7-0. Jacobs West Boynton Beach Boulevard at Old Boynton Road, northeast corner West quarter of Lot 8 of the sub- division of Section 20 Township 45 South, Range 43 East, according to Plat Book 1, Page 4, less the East 3 acres as described in Deed Book 975, Page 125, Public Records of Palm Beach County Request for site plan approval to construct a 6,885 square foot pro- fessional office building on .89 acres Mr. Golden said this new building would be constructed behind Dr. Jacobs' existing medical office building. Parking would be to the east of the existing office and to the east and north of the proposed building. One driveway would be provided onto West Boynton Beach Boulevard. The building would have a stucco finish with wood trim and a fiberglass shingle roof. Mr. Golden explained provision for water and a sanitary sewer. He stated that the TRB recommended approval, subject to staff comments. Dr. M. N. Jacobs, 614 N.W. 8th Avenue, Delray Beach, Florida 33444, stated that, besides his office, there would be a dental lab and about three other offices in the building. Glen Martin, Engineer, Reikenis and Associates, 301 Clematis - 10 - MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA APRIL 14, 1987 Street, West Palm Beach, Florida, advised that the architect had indicated to him there would be a total of four offices, including Dr. Jacobs' office. Mr. Ryder asked if Dr. Jacobs would be maintaining the existing building; Dr. Jacobs replied that he was not sure what he would do with the old building, once he moved into the new building. There was discussion about the surrounding property. Mr. Martin said the zoning to the west is R-2, but the property is owned by Florida Power and Light, which is not in the habit of selling or getting rid of their transfer stations. Mr. Annunziato said the power station is in the northwesterly 1/8 of the site, and the rest of the site is predominantly vacant. Mr. Martin said plans for water and ~ewer extensions are based on the plans of the County and the City to abandon Old Boynton Road; t~erefore, that R-2 property would not have frontage on any roadway in the future. Mr. Annunziato said it would have frontage on Old Boynton Road. Mr. Walshak pointed out that these plans also had schemes or exterior aesthetics. Mr. Martin noted request~was made for such information. no color that no Mr. Wandelt moved to TABLE the request until the applicant submits an artis% rendition of what is being built for the Board to review. The motion was seconded by Mr. Walshak. Mr. Martin remarked that it is difficult to do his job for his client if he does not know ahead of time what the requirements are for submittals. Mr. Martin believed this Board's purpose was not for appearance, but for site plan approval. Mr. Martin said his client would now have a month's delay, because something was not submitted because it was not requested. He asked the Board to reconsider the motion, as the project will be reviewed for appearance in the future. A vote was then taken on the motion, and the motion carried 7-0. C. He said the addition is proposed to be on the south side of the existing restaurant. The TRB recommended approval, subject to staff comments. Mr~ Ryder inquired if the shared parking would be compatible with the former agreement, and Mr. Golden answered that it would be. Ronald Uphoff, Architect, 3359 Belvedere Road, Suite K, West Palm Beach, Florida 33409, distributed photographs of the existing building. He stated that the addition would conform to the existing ma~terials and colors that are already there. Also provided would be a handicapped access ramp and proper egress for emergencies. Mr. Uphoff said a service store would be put in the rear on the south side of the building. Mr. Schultz said the entrance on the side was being moved to the rear, and even though it was an existing structure, it was being modified. He asked if screening could therefore be required on the roof of the existing building. Mr. Uphoff stated that such screening already exists, but was lost in the reproduction of the drawing that Mr. Schultz was looking at. Mr. Uphoff said he was in agreement with all staff com- ments. Mr. Ryder moved to approve the request for an amended site plan to allow for a change in building layout and design for the new addition, subject to staff comments. Mr. Golden said the addition is on the west side of the building and the additional parking is to the west of the addition. Determination of June Public Hearing Date for April t, 1987 Land Use ~mendment Applications Chairman Trauger commented that when they went through the Comprehensive Plan before, very few people came to the Public Hearing, except those with a vested interest in the land subject to a change. Only when someone came in for an amend- ment to the Comprehensive Plan, would people show an interest and get involved. Mr. Annunziato felt one of the applications for a plan amendment Submitted on April 1 (the property west of the intersection of Old Boynton Road and Boynton Beach Boulevard, east of the E-4 canal) would draw a lot of people. That application requests that the property be changed from a residential categor~ to a shopping center. Mr. Annunziato also noted that all O~ the property owners ~ithin 400 feet of the property in question ~ould be notified, which should generate discussion~ ~here will also be notiification in the newspapers. - 18 MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA APRIL 14, 1987 Mr. Golden wished to discuss possible meeting dates for this Public Hearing. He said the Board should decide whether to hold the Public Hearings during a regularly scheduled Board meeting, or whether to hold a separate meeting in June. Mr. Golden said three applications have been received. Two are for annexations for Planned Unit Developments on Lawrence Road. One annexation is just over and one is just under 50 acres. They are combinations of single family detached homes, zero lot line, and duplex units. The third application was the Planned Commercial Development previously mentioned by Mr. Annunziato. Mr. Annunziato advised there would be discussion from the public, presentations, technical documentation, and reports on traffic, market and employment. The Board members decided to hold the Public Hearing in a separate meeting on the fourth Tuesday of June (June 23). 2. Format for Scheduling Zoning Changes Consistent with the Evaluation and Appraisal Report Mr. Cannon announced there were a total of 16 rezoning appli- cations that would have to be reviewed. He explained that these were rezonings that wo~ld have to occur pursuant to the Evaluation and Appraisal Report, which was adopted by the City Council in December. As Public Hearings would have to be held and property owners notified, Mr. Cannon anticipated a substantial turnout for the meetings. Mr. Cannon stated the Board must decide whether to hold all of these hearings in one evening or hold several meetings. Mr. Annunziato advised that there was a difference between the applications submitted April 1 and these rezoning applications. He explained that there would not be a packet of information submitted by staff for these applications, because, in effect, that work was done in the adoption of the Evaluation and Appraisal Report. These meetings would involve the ~inal step of implementing the plan. Mr. Cannon reported that the Board would also have to review an additional package of ordinances some time during the summer. Numerous recommendations were made in the Evaluation and Appraisal Report Concerning landscaping, development of nonconforming lots, land other environmental policies; these will be codified. The ordinances which will allow them to be codified will come,before the Planning and Zoning Board. Mr. Annunziato explained for~new members that the Board is the local Planning Agency within the context of the Growth - 19 - MINUTES PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA APRIL 14, 1987 Management legislation. The local Planning Agency has the statutory responsiblity to review and recommend to the City Commission, for consistency with the Comprehensive Plan, land development regulations. All of the ordinances being discussed follow from the adoption of the Comprehensive Plan and the Evaluation and Appraisal Report and are land develop- ment regulations. The Board will be looking at proposed ordinances, consistent with the policies adopted in the Evaluation and Appraisal Report, for consistency with this Report. The Board has to make findings of consistency before the Commission can act. In response to ~r. Schultz' inquiry, Mr. Annunziato reported the rezoning portion should be completed one year from December 16, 1986. Mr. Cannon said he did not think more than half of the rezoning applications should be discussed in one night. The time involved in these meetings would be answering questions for the public. The Board members decided to meet tee fourth Tuesdays of July and August (July 28, August 25) to discuss the rezoning applications. Concerning the ordinances, Mr. Annunziato said he would report back at the next meeting with a listing of the ordinances that have to be amended. The Board could then decide how and when to accomplish that task. Redefining Requirements for Final Approval of Site Plans Chairman Trauger said the Board was looking for an architectural rendering in color of the proposed appearance of the completed building of the total number of elevations. Mr. Walshak also wanted the colors to be as true as possible to what was planned. Mr. Annunziato said they would present these requirements to the applicants before it becomes a TRB issue. They would know from the start that this was required of them. Mayor Cassandra thought the Board should consider whether they would hold the developer to that rendering. Chairman Trauger thought if these plans were put into the staff comments, the developer would have to be held to them. City Manager Cheney asked that he be able to confer with the City Attorney concerning potential conflicts between the PZB and the CAB (Would the CAB lose their right to approve archi- tectural items and color?) before any decision is made.
