R91-047RESOLUTION NO. R91-~7 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A CERTAIN CONTRACT BETWEEN THE CITY OF BOYNTON BEACH AND THE SCHOOL BOARD OF PALM BEACH COUNTY TO PROVIDE SCHOOL BUS USE FOR SUMMER DAY CAMPS; A COPY OF SAID CONTRACT IS ATTACHED HERETO AS EXHIBIT "A"; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, each year the City of Boynton Beach contracts with the Palm Beach County School Board for use of their buses to transport children in our summer Day Camps and Playgrounds; and WHEHEAS, the City Commission of the City of Boynton Beach has deemed it to be in the best interests of the citizens and residents of this City to approve said contract based upon their review and upon recommendation of staff. NOW, THEREFORE, BE IT RESOLVED BY THE CITY CO~tiISSION OF THE CITY OF BOYNTON BEACH, FLORIDA THAT: Section 1. The City of Boynton Beach hereby authorizes the Mayor and City Clerk to execute a contract between the City of Boynton Beach and Palm Beach County School Board, which contract is attached hereto as Exhibit Section 2. MILLS SUPERINTENDENT OF SCHOOLS January 31, 1991 Use of School Buses by Municipalities and Day Camps Th~ Transportation Department will be able to provide school buses to Municipalities and Day Camps under the following conditions: Buses and drivers are available for up to eight (8) hours each day that schools ~r--~w~ are in session. Travel is restricted to adjoining counties and not more that forty-five (45) miles one way. Rates are subject to increase since the Board is required to recover the transportation costs of leased buses. The rates for 1991 are fifteen dollars ($15.00) per hour and one dollar ($1.00) per mile. If an emergency arises requiring the driver to work longer than an eight (8) hour time period, time and half (1.5 x $15.00.= $22.50) will be charged. Insurance policies must be written to cover any bus owned by the District and any driver employed by the District. 5. Trip tickets must be submitted two (2) weeks in advance. 6. The assignment of drivers will be made by the Transportation Department Staff. Ail arrangements, including contractual arrangements and insurance coverage, must be completed prior to June 1, each summer. TRA/~SPORTAT1ON AGREEMENT (As required by 234.21112)(a) Florida Statutes This agreement, made and entered into this day of March , 1991, by and~b~tween the SCHOOL BOARD OF PALM BEACH COUNTY, FLORIDA,-a public s~hool corporatio~ herein referred to as "BOARD" and CITY OF BOYNTON BEACH a political subdivision of the state of Florida, hereinafter referred to as the CITY Whereas the "BOARD" owns and operates school buses and whereas the "BOARD" recognizes the need on occasion, for other parties ~o utilize those buses to provide opportunities of a recreational nature for the children of CITY 1. Provision of Buses The "BOARD" agrees to provide school buses and drivers for trips organized and supervised by the Ci5¥ of BoynCon Beach (government entity) during the time period of June 17 , 1991, and August 31 , 1991. 2. ~ompensation The City of Boynnon Beach agrees compensate-the BOARD for these bus trips. include the driver's salary at $15.00 hour and charge of S1.00 per mile. to fully These costs dollars per 3. Liability Insurance The CITY (government entity) agrees to provide the "BOARD" with a certificate of insurance naming the "BOARD" as an additional insured on the CITY'S (government entity!s-) automobile liability insurance policy with regard to the "BOARD'S" buses. If the CITY (government entity) elects to self-insure the liabilities under paragraph 4, the CITY (government entity) agrees to provide the "Board" with written acknowledgement that these liabilities will be covered by the self-insurance plan. -4. Indemnification (As required by 234.211(2)(a)) The CITY (government entity) shall indemnify and hold harmless the "BOARD" from any and all liability, claims, lawsuits, damages and expenses (including attorney fees) related~to loss of life, bodily injury, property damage (including loss of use thereof) directly or indirectly caused by, resulting from, arising out of or occurring in connection with the uss of such buses per this agreement. This paragraph is authorized by Chapter 234.2ll and is subject to Chapter 768.28 of Florida Statutes. Damaqes to School Buses in Use Pursuant to This Aqreement The CITY (government entity) agrees to be responsible for accidental damages to the "BOARD'S" school bus directly or indirectly caused by, resulting from, arising out of or ~ccurring in connection with the use of the buses. ResDonsib~lity The requesting government entity shall be solely responsible for planning for the safety and well being of those being transported. 7. Procedure for Requestinq Use of School Buses Ail requests for the use of school buses by government entities will be initiated in writing and directed to the principal (or his/her designee) for community education at a local community school. After the aforementioned conditions have been met, the assistant principal for community education will forward the request to the Transportation Department.
