R90-192RESOLUTION NO.~90-/~,~ A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE A CERTAIN ADDENDUM TO THE CONTRACTS FOR THE DESIGN OF A 23 ACRE SITE AND MULTI-PURPOSE COMMUNITY CENTER, AND THE DESIGN OF ROLLING GREEN PARK BETWEEN THE CITY OF BOYNTON BEACH AND OSCAR VAGI & AssoCIATES ARCHITECTS, INC., WHICH ORIGINAL CONTRACTS WERE DATED JUNE 23~ 1988; A COPY OF SAID ADDENDUM BEING ATTACHED HERETO AS EXHIBIT "A"; AND PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION THE CITY OF BOYNTON BEACH, FLORIDA THAT: Section 1. The Mayor and City Clerk are hereby authorized and directed to execute a certain Addendum to the 2ontracts between the City of Boynton Beach, Florida and )scar Vagi & Associates Architects, Inc., for the design of ~ 23 acre site at NW 17th Avenue and NW 19th Avenue, to be leveioped as a district park and to include a Multipurpose ~ommunity Cester and the Rolling Green Park at Miner RJoad ~nd NE 26th Avenue, to be developed as a neighborhood park, :he original Contracts beind dated June 23, 1988; said ~dendum being attached hereto as Exhibit "A". Section 2. This Resolution Lmmediately upon passage. PASSED AND ADOPTED this ~-' day shall take effect December, 1990. BEACH, FLORIDA ~TTEST: ~Corpor~a~t~-Sea!~ Vice Mayor dommissioner ADDENDUM This Addendum made this / day of ~--~w~E~ , 1990, between the CITY OF BOYNTON BEACH ("Owner") and OSCAR VAGI & ASSOCIATES ARCHITECTS, INC. ("ARCHITECT") as follows: WHEREAS, Owner and Architect have heretofore entered into two (2) Standard Form of Agreement Between Owner and Architect, both dated June 23, 1988, and referring to the Rolling Park Project and the twen=y-three (23) acre site and multi-purpose Community Center; and WHEREAS, Architect has heretofore requested additional compensation based on architectural services beyond the ~wenty- four (24) month time period allocated for basic services; and WHEREAS, Owner had objection to additional compensatlon~ and WHEREAS, Owner and Architect have negotiated a settlement of Architect's demand for additional compensation. NOW, THEREFORE, in consideration of the mutual covenanEs contained herein, and the paymen= of compensation by Owner Architec~ as set forth herein, the parties agree as follows: 1. This documen~ shall constitute an addendum to the written agreements between Owner and Architect as described above. To the extent of any conflict between this Addendum and the Standard Form of Agreement between Owner and Architect, this Addendum shall control. 2. Owner shall pay to Architect a~.total additional compensation for architectural of $21,221.67 as services as Page 1 of 2 _1 contemplated by both the Rolling Green Park Project and the 23 Acre Site Community Center Standard Form of Agreements paragraph 11.5.1, additional provisions. 3. Architect agrees to provide basic services up no the completion through the administration of the construction phase of the Contract. Compensation for same shall be limited to the amoun~ of $21,221.67 in addition to the Contract amount. This Addendum entered into as of the day and year first written above.
