R90-174RESOLUTION NO.~90-1~ A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, RATIFYING AND INCORPORATING CERTAIN CHANGES TO THE 1989/91 AGREEMENT BETWEEN THE CITY OF BOYNTON BEACH, FLORIDA AND THE PALM BEACH COUNTY POLICE BENEVOLENT ASSOCIATION; A COPY OF SAID CHANGES BEING ATTACHED HERETO AS EXHIBIT "A"; AND PROVIDING AN EFFECTIVE~DATE. WHEREAS, representatives of the Police Benevolent ~sociation and City of Boynten Beach administrative staff net and reviewed several changes which they would like ~atified and incorporated into the 1989/91 Agreement between the City of Boynton Beach, Florida and the Palm Beach County Police Benevolent Association; iNOW, THEREFORE, BE IT RESOLVED by th~ City Commission f the City of Boynton Beach, Florida, that. Section 1. Ail of the changes suggested in the ttached Exhibit "A" shall be ratified and incorporated into ~he 1989/91 Agreement between the City of Boynton Beach and the Pa~lm Beach County Police Benevolent Association. Section 2. This Resolution shall take effect immediately upon passage. PASSED AND ADOPTED this ~/~ day of November, 1990. New Step 4 - "If the vacancy remains, the permanently assigned members of the off-duty shift or tour (3rd shift) will be offered the position by seniority." The current steps numbered 4, 5, and 6 would then move to steps 5, 6, and 7. Article 13 - Section 13.2 (page 18) - The top paragraph would be changed to delete the term "specialty units" and substitute "traffic units". The new paragraph would be: For the purpose of this section, those officers assigned to traffic units shall be considered to be members of the platoon during which they work the most hours. If their scheduled hours are evenly divided between two platoons, then they shall be considered members of the platoon during which they be- gin work. Their traffic designation shall not preclude them from being offered non-specialty overtime per this section. Any officer assigned as a plain clothes investigator will be considered the same status as a detective in this section. Article 13 - Section 13.2, paragraph e. (page 18) - The phase "and any other newly created position that may be developed would be added so the new paragraph would read as follows: In the event of a vacany in any division or unit, seniority will prevail, after consideration of job related qualifications. All such vacanices will be posted as soon as possible after they are known so that interested officers can be considered, Job related qualifications will be listed for each of these vacanices when posted. The above section shall include Traffic, K-g, Vice, Community Police Officer, SNAP, Investigators, Public Relations, and any other newly created position that may be developed. 4. Article 18 - Section 18.2, paragraph e. (page 28) - The counseling session for restricted sick leave can now be held with a watch com- mander {Lieutenant rank only} as opposed to the Division Conmnander. 5. Article 27 - Section 27.1 {page 42) - The phrase "and Section 112.533 of the Florida Statutes as amended from time to time" would be added. EXHIBIT "A"
