90-YYYYYYRESOLUTION NO. 90-
A RESOLUTION OF THE CiTY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
EXPRESSING CONCERN REGARDING THE
EXPANSION OF THE REVIEW RESPONSIBILITY
OF THE GOVERNOR AND CABINET, IN THEIR
CAPACITY AS THE FLORIDA LAND AND WATER
ADJUDICATORY COMMISSION.
WHEREAS, the Governor and Cabinet, in their official
apacity as the Florida Land and Water Adjudicatory
Commission (FLAWAC) have recently decided to review the City
of Jacksonville's permit for a new landfill; and
WHEREAS, this project has been reviewed by
and Federal agencies charge with protecting the
and managing our water quality; and

WHEREAS, this review process constitutes an
unnecessary, additional discussion of the case;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA, THAT:
Section 1. The Governor and Cabinet are hereby
urged to relinquish jurisdiction over surface water
management permits and not to conduct additional review
procedures which translate into costly delays for the
taxpayer and are duplicative in nature.
Section 2. That if the Governor and Cabinet wish to
establish a precedent and review management and storage of
surface water permits, that the review be conducted on the
requirements set forth by appropriate State Statutes,
Florida Administrative Code and Federal regulations.
Section 3. The City Clerk is hereby directed
furnish a copy of this Resolution to the Governor and
Cabinet.
