A RESOLUTION OF THE CITY COMMISSION OF
THE CITY OF BOYNTON BEACH, FLORIDA,
AUTHORIZING AND DIRECTING THE MAYOR
AND CITY CLERK TO EXECUTE AN AGREEMENT
BETWEEN THE CITY OF BOYNTON BEACH,
FLORIDA AND PALM BEACH COUNTY,
FLORIDA, FOR THE JOINT FUNDING
IMPROWEMENTS TO WOOLBRIGHT ROAD FROM
MILITARY TRAIL TO CONGRESS AVENUE,
MORE PARTICULARLY DESCRIBED AS PROJECT
NO. 87538B; A COPY OF SAID AGREEMENT
BEING ATTACHED HERETO AS EXHIBIT "A";
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Palm Beach County and the City of Boynton
~each desire to jointly participate in the construction of
~ertain utilities within right-of-way of Woolbright Road
from Military Trail to Congress Avenue; and
WHEREAS, the execution of agreement is in the best
interests of both governmental units by promoting efficient
utility construction along the Woolbright Road right-of-way
referred to previously;
NOW, THEREFORE, BE IT RESOLVED by the City Commission
of the City of Boynton Beach, Florida, that:
Section 1. The Mayor and City Clerk are hereby
authorized and directed to execute a certain Agreement
between the City of Boynton Beach and Palm Beach County, a
copy of which Agreement is attached hereto as Exhibit "A".
Section 2. This Resolution shall take effect
immediately upon passage.

THIS AGI~EEMENT, made and entered into this day of
199_, by and between PA~.! BEACH COUNTY, a political subdivision
in the State of Florida, herein referred to as "COUNTY,, and the
city of Boynton Beach, a legal entity in the State of Florida,
herein referred to as the "CITY",

WHEREAS, the COUNTY and the CITY desire to jointly
participate in the construction of certain utilities within
right-of-way of Woolbright Road from Military Trail to Congress
Avenue~ and
WHEREAS, Florida Statutes, Section 163.01, allows
governmental units to make the most efficient use oX their powers
by. enabling them to cooperate with other localities on a basis
of mutual advantage; and

The CITY agrees to pay directly to the COUNTY costs
directly attributable to said utility construction as
outlined in the Specifications for this project.
Said summation of costs is stated in the amount of
$ ~29,550 in accordance with the attached bid tabulation
for the specified work.
Said costs shall be adjusted upon completion of the
project using "as constructed quantities,,, said
quantities being measured by the Palm Beach County
Engineerinq and Public Works Department in conjunction
with CITY'S inspector,s approval.
The CITY agrees to fund those contributions set forth in
Paragraphs i through 3 above within forty five (45) days
of receiving written notice from the COUNTY that funding
is required.
The COUNTY is to be responsible for administering the
funds in accordance with the Agreement provided however
that CITY,S inspector will review and approve at1 pay
requests for water and sewer utility ~crk prior to
payment to the utility contractor.

subdivision of the State of Florida, hereinafter called and referre~
to as the ~COUNTY" and the City of Boynton Beach, a legal
municipality in the State of Florida, hereinafter calle~ and
referre~ to as the ~CITY~,

WHEREAS, the CITY and the COUNTY are authorized to enter into this
agreement pursuant to Section 163o01, Florida Statutes, as amended,
which permits local governmental units to make the most efficient
use of their powers by enabling them to cooperate with other
localities on a basis of mutual a~vantage~ and
WHEREAS, the COUNT~ has caused to be prepared roadway construction
plans and specifications for improving Woolbright Road, Hilitary
Trail to Congress Avenue~ and
WHEREAS, the CITY has cause~ to be ~repared utility construction
plans and specifications for water dlstr~butio~, sewage collection
and/or transmis~ion systems for the aforementioned ~ortion of
Woolbright Roa~ from Military Trail to Congress ~venue which will
serv~ portions of its service area~ and
WHEREAS,
interest that the water distribution, sewage
sewage transmission systems be constructed with
Woolbright Road improvements~ and
both CITY and the COUNTY declare that ~t is in the public
collection and/or
the aforementioned

WHEREAS, the AUTHORITY has budgeted funds for cooperation in
construction of the water distribution, sewage collection, and/or
sewage transmission systems along the authorized service section of
Woo~bright Road~ and
WHEREAS, the CITY is desirous of funding the costs for construction
of the water and sewage systems which benefit the CITY~ and
WHEREAS, the CITY will perform all inspections, testing and
certifications required for the water distribution, sewage
collection and/or sewage transmission systems to insure compliance
with their specifications and permits~
NOW, THEREFORE, for and in consideration of the mutual covenants
contained herein, the Parties to this Agreement agree as follows~
The recitals set forth above are hereby adopted and
incorporated in this agreement.
The COUNTY agrees to=
Advertise for bids, submit bids to CITY for review,
accept bids found acceptable by CITY, and award a
contract for the construction of Woolbrtght~ Road
improvements, water distr~butions, sewage collection
and/or sewage transmission systems which are to be owned
by CITY.
Administer the above contract and administer the funds
in accordance with this Agreement.

Supply the CITY with a contract audit in accordance with
standard accounting procedures which reflect total, final
costs of the water distribution, sewage collection and/or
sewage transmission systems, upo~ completion of this
project.
3. The CITY agrees tot
Use a professional engineer selected by the
CITY to prepare aud design plans for their portion of the
project.
Pay the costs of engineering services to accomplish
design plans for the project.
Provide or cause to be performed all inspection services
during construction of and final certification for the
aforementioned water and/or sewer systems.
To the extent that the CITY is charged with design of the-
project, CITY agrees to be responsible for any and all
liability with regard to its performsnce of the
requirements of this agreement.
To contribute and to forward to the COUNTY the funding
for the actual costs of construction of the water
distribution, sewage collection and/or sewage
transmission systems after bids have been accepted and
within 45 days of request by the COUNTY, based on the
contract costs as awarded by the COUNTY.
Both the COUNTY and the CITY agree to pay to the other such
funds as are indicated in the final audit set forth in
Paragraph 2 (C) above, which will balance accounts between the
parties.
